PRESENT: MR. THOMPSON, MRS, KILKELLY, MR. FIRTION, MR. BARNES,

ABSENT: MR. SHROYER, EXCUSED

ANNOUNCEMENTS: MRS. KILKELLY SUGGESTED THAT THE OLD BUSINESS OF
DISCUSSION OF RIGHT OF WAY OBSTRUCTIONS AND SPECIAL USE PERMITS
BE MOVED TO NEW BUSINESS AFTER THE CONDITION USE PERMIT FOR THE
DIFFERENT DRUM THERE WERE NO OBJECTIONS.

CHURCH - SITE PLAN WAS REVIEWED AT THE LAST MEETING ALL ACTION
WAS DEFERRED TILL TONIGHT. PUBLIC HEARING OPENED AT 7:05 P.M.
THERE WERE 15 LETTERS SENT NO RESPONSE
PUBLIC HEARING CLOSED AT 7:10 P.M. NO PUBLIC COMMENT
A MOTION TO APPROVE THE CONDITIONAL USE PERMIT FOR CHRIST THE
KING LUTHERAN CHURCH WAS MADE BY MR. FISCHER SECOND MRS. KILKELLY
UNDER DISCUSSION MR. THOMPSON MADE AN AMENDMENT TO THE MOTION
SECONDED BY MR. FISCHER AS FOLLOWS:
I MOVE THAT WE THE SEBASTIAN PLANNING AND ZONING COMMISSION
APPROVE THE CONDITIONAL USE PERMIT AT 1301 COUNTY ROAD 512
CONSISTING OF 3.63 ACRES FOR USE AS A CHURCH AND RELATED USES.
THIS PROPERTY AT 1301 COUNTY ROAD 512 IS TO BE USED BY CHRIST THE
KING LUTHERAN CHURCH FOR CHURCH ACTIVITIES. ALL CRITERIA OUTLINED
IN LAND DEVELOPMENT CODE 20A6.lC4A TITLED "CHURCHES, SYNAGOGUES
AND OTHER PLACES OF WORSHIP" HAVE BEEN MET.
AMENDMENT PASSED UNANIMOUSLY. MAIN MOTION PASSED UNANIMOUSLY.
A MOTION TO APPROVE THE SITE PLAN FOR CHRIST THE KING LUTHERAN
CHURCH WAS MADE BY MR. FALKE SUBJECT TO SCREENING AND THE OTHER
ITEMS WHICH WERE DISCUSSED AT THE LAST MEETING SECOND MR.
GOLDSTEIN - MR. THOMPSON MADE AN AMENDMENT TO THE MOTION SECONDED
BY MR. GOLDSTEIN AS FOLLOWS:
I MOVE THAT WE THE SEBASTIAN PLANNING AND ZONING COMMISSION
APPROVE THE SITE PLAN FOR CHRIST THE KING LUTHERAN CHURCH AT 1301
COUNTY ROAD 512 SEBASTIAN FLORIDA CONTAINING APPROXIMATELY 3.63
ACRES THIS SITE PLAN WE ARE APPROVING iS SHOWNON MOSBY AND
ASSOCIATES DRAWING 93-212 SHEETS C-1 AND C-2 SIGNED SEALED AND
DATED AUGUST 5TH, 1993 ALSO PETER JONES AIA ARCHITECT PROJECT NO
167 SHEETS NOS 2,4,5 AND DATED AUGUST 1993.
THE FOLLOWING CHANGES, ADDITIONS AND CONDITIONS SHALL BE. MADEA
PART OF THIS APPROVAL AND SHALL BE CHANGED PRIOR TO THE ISSUANCE
OF A BUILDING PERMIT.
1. HRS, ST JOHN'S WATER MANAGEMENT, INDIAN RIVER COUNTY RIGHT OF
WAY AND INDIAN RIVER COUNTY SEWER PERMIT SHALL BE SUBMITTED FOR
REVIEW.
2. CITY ENGINEER SHALL APPROVE DRAINAGE CALCULATIONS.
3. TRAFFIC FLOW ARROWS SHALL BE PAINTED ON THE NON-POROUS SURFACE
AS SHOWN ON THE PLAN.
4. AN ARCHITECTS DRAWING SHEET 4 THE PLUS OR MINUS SHOWNFOR
RIDGE HEIGHT SHALL NOT PERMIT A RIDGE HEIGHT OF 35 FEET TO BE
EXCEEDED.
5. A LETTER OF AUTHORIZATION FROM THE FISH AND WILD LIFE
DEPARTMENT REGARDING THE CLEARING OF THESE LANDS FOR ANY
ENDANGERED SPECIES.
6. UNITY OF TITLE OF ALL PARCELS IS REQUIRED.
THE COMMISSION APPROVES POROUS PARKING STALLS.
ALSO WE RECOMMEND TO THE CITY COUNCIL THAT ALL FEES BE WAIVED FOR
SITE PLAN APPROVAL AND FOR THE BUILDING CONSTRUCTION INSPECTION.
AMENDMENT PASSED UNANIMOUSLY AND MAIN MOTION PASSED UNANIMOUSLY
ALTHOUGH THE MAIN MOTION WAS MOOT AFTER THE AMENDMENT.
SITE PLAN GERALD IZZO WAREHOUSE - RANDY MOSBY IS PRESENT TO
ANSWER QUESTIONS - BRUCE SHOWS THE VIDEO OF THE PROPERTY.
BRUCE STATES SiTE PLAN NOW MEETS NUMBER 11 OF THE TRC THEY
ELIMINATED THE EXTRA PALMS AND MAX OF THREE STAFF RECOMMENDS
APPROVAL AT THIS TIME. MR. FALKE QUESTIONS WIDTH OF PAVEMENT
FEELS SHOULD BE MORE FOR SAFETY OF THE VEHICLES TRYING TO BACK
OUT. HE ALSO QUESTIONS THE IRRIGATION SYSTEM RANDY STARTS TO SAY
THE ENGINEER ADDRESSED THIS MATTER IN HIS MEMO BUT BRUCE BROKE IN
AND STATED THAT JERRY'S SUB AND PUB iS DEFICIENT IN THIS AREA AND
HAS DEAD LANDSCAPING AND SHOULD BE CONDITIONAL REQUIREMENTTO
BRING UP TO CODE ALONG WITH THIS PROPERTY. RANDY OBJECTS STRONGLY
AND STATES TWO SEPARATE SITE PLANS AND BRUCE SHOULD HANDLE THE
OTHER MATTER SEPARATELY. BRUCE STATES HE WILL CALL THE OWNER
REGARDING THE DEAD LANDSCAPING.
A MOTION BY MR. THOMPSON SECOND BY MR. FISCHER AS FOLLOWS:
I MOVE THAT WE THE PLANNING AND ZONING COMMISSION APPROVE THE
SITE PLAN FOR JERRY'S STORAGE FACILITY AT SECOND STREET. ALSO
IDENTIFIED AS LOTS 13 AND 14 BLOCK 10 HARDEES ADDITION OF
SEBASTIAN CONTAINING APPROX 0.29 ACRES.
THiS SITE PLAN WE ARE APPROVING. IS SHOWN ON MOSBY AND ASSOCIATES
INC DRAWING NO 93-232 SHEETS C-1 AND S-1 SEALED, SIGNED AND DATED
AUGUST 5TH, 1993.
THE FOLLOWING CHANGES, ADDITIONS AND CONDITIONS SHALL BE MADE A
PART OF THE APPROVAL AND COMPLETED PRIOR TO ISSUANCE OF BUILDING
PERMIT.

LEVEL LANDSCAPING. HE STATES WOULD LIKE TO DO A CODE CHANGE NOT
TO ALLOW THE MAILBOXES BUT TO ALLOW THE LOW LEVEL LANDSCAPE. WILL
BRING BACK AT A LATER DATE.
DISCUSSION REGARDING CODE CHANGES FOR SPECIAL USE PERMITS MRS.
KILKELLY SUGGESTS THE LDC BE CHANGED TO ADDRESS THE REQUIREMENTS
TO APPROVE SPECIAL. USE PERMITS. MR FALKE FEELS THERE WILL BE
COMPLETE REDUNDANCY BY CHANGING THE CODE ANDADDING A SECOND
PUBLIC HEARING.

PHILOSOPHY FOR THE CODE CHANGE REGARDING SPECIAL USE PERMITS AS
OUTLINED IN CITY ATTORNEYS LETTER OF AUGUST 5, 1993 TO MR.
COOPER.MADE BY MR. THOMPSON SEcoND MR. FIRTION PASSED
UNANIMOUSLY.
DISCUSSION TO ADD BAIT AND TACKLE USE TO THE MCR ZONING BRUCE
ASKS FOR DEFERRAL AT THIS TIME TILL SPECIAL MEETING FOR
RIVERFRONT ZONING.
DISC CODE ENFORCEMENT COMPLAINTS ' BRUCE SPEAKS ON THE MATTER AND
EXPLAINS MR. NICHOLSONS COMMENTS AND FEELINGS MR FALKE FEELS
AUTOS AT THE RESIDENCE SHOULD BE LIMITED TO A NUMBER OVER AND
ABOVE THE NUMBER OF REGISTERED DRIVERS. MR. BARNES AGREES WITH
LIMITING THE NUMBER.
