Chairman Fischer called the meeting to order at 7:03 p.m.

Chmn. Fischer excused the absent members. Ms. Kilkelly and Mr.
Driver would be voting in their places.
Chmn. Fischer stated he approved a minor modification to the site
plan for Sebastian Christian Church on Schumann Drive.
Mr. Pliska asked to be excused for the September 19, 1996 meeting.
APPROVAL OF MINUTES:
Mr. Driver made a motion to approve the minutes of August 15, 1996,
as written. Mr. Munsart seconded the motion.
A voice vote was taken. Motion carried 6-0.

State? Mr. Westover stated yes, and a small sign with 2 inch
letters would be hung adjacent to the door, as required by State
statute. No clients would be coming to the residence.
Mr. Munsart made a motion to grant a home occupational license to -
Phillip Westover trading as American Real Estate Foundation at 202
Delaware Avenue. Mr. Driver seconded the motion.
Roll call was taken. 6-0 motion carried.
PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - 626 DEMPSEY AVENUE -
LILLXAN STAAB - CNA FOR THE ELDERLY
Mr. John Staab is representing his wife, the applicant, and was
sworn in according to quasi-judicial procedures.
There were 20 notices of the public hearing sent out.

shopping, cleaning, basic nursing, etc. Staff recommended

PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - 581 BELFAST TERRACE -
JOANNA SZAFARZ - CLEANING SERVICE
The applicant, Joanna Szafarz, was present and sworn in according
to quasi-judicial procedures.

objection letters were received back.
Staff reviewed its report and stated the applicant's equipment
would be stored in her vehicle. The license was a transfer from
145 Capri Avenue where there were no current code enforcement
cases.

The applicant, Pawel Szafarz, was present and sworn in according to
quasi-judicial procedures.
There were 20 notices of the public hearing sent out.

DISCUSSION - ENVIRONMENTAL HEALTHDEPARTMENT, INDIAN RXVER COUNTY -
ON-SITE SEWAGE DISPOSAL SYSTEMS
Mr. Glenn Schuessler, Assistant Director for the Environmental
Health Dept, and Lori Hopkins, field agent, was present and spoke
to the Commission regarding development and on-site septic tanks
anddrainage fields.

He stated the high ground water level in Sebastian affected the
amounts of fill need for new residences. 600 to 700 new tanks were
permitted each year and there were approximately 25,000 existing
tanks in Indian River County currently.
Ms. Hopkins explained perc test procedures and Mr. Schuessler went
over how the size of drainfields were determined. Planting in the
drainfields and the safest commercial products for the septic tanks
was also discussed.
Other various questions regarding the subject were asked by the
Commission. Ms. Sally Gore, member of the Tree Advisory Board,
also had questions for Mr. Schuessler.
A break was taken at 8:35 p.m.
The meeting resumed at 8:53 p.m.

RECOMMENDATION TO CITY COUNCIL - REVIEW OF PROPOSED ORDINANCE
AMENDING THE LAND DEVELOPMENT CODE - DIVISION OF A SINGLE LOT
Mr. Massarelli reviewed the procedures in the past and went over
the definitions of minor and major subdivisions. The new ordinance
created a new type of subdivision. A lot could only be divided
into two and only allowed once.
If the following was supplied by the property owner or buyers, the
division could be done administratively instead of having to record
a new plat:

Mr. Massarelli stated the city attorney has been familiarized with
the proposed ordinance.
Ms. Kilkelly stated the "new subdivision" may need exclusion
statements in Articles 16, 17, & 18 from some of the requirements
of subdivisions. She would also like to see the more complex
applications be reviewed by the Planning and Zoning Commission.
Mr. Munsart stated concerns with minor subdivisions not required to
have proper drainage.

After further discussion, Ms. Kilkelly made a motion that Ordinance
0-96-30 be recommended to the City Council for approval with the
amendments mentioned previously. (All Articles involved with
subdivisions are reviewed to see if an exclusion statement is
needed and requirements of any recording with the City Clerk are
researched.) Mr. Schulke seconded the motion.
Roll call was taken. 6-0 recommendation approved.

be ready.

Mr. Massarelli explained staff had not yet received the re lslon
from Solin & Associates and would pass it immediately to the
Commission for their review for the next meeting.
Mr. Massarelli addressed comments made at a previous city council
meeting regarding attendance of the city attorney at the Planning
and Zoning meetings. Mr. Driver stated he felt the attorney should
be required to attend the meetings considering the salary she was
being paid.
