THOMPSON, MR. SHROYER,ALTERNATE, MR. KRULIKOWSKI, MR, FULLERTON, MRS. O'CONNOR. ABSENT; MR. WADSWORTH, EXCUSED, MR. LINDSEY, EXCUSED ALSO PRESENT; LINDA KINCHEN, SECRETARY, BRUCE COOPER, DIRECTOR OF COMMUNITY DEVELOPMENT ANNOUNCEMENTS; NONE APPROVAL OF MINUTES: AUGUST 2, 1990 MR, THOMPSON WOULD LIKE TO CHANGE PAGE ONE PARAGRAPH TWO TO MR, THOMPSON NOT MRS, THOMPSON, ALSO UNDER OLD BUSINESS ARNOLDS AIR CONDITIONING IT SHOULD STATE THAT RANDY GOES OVER THE VIEWS PROVIDED BY STAFF, A MOTION TO APPROVE THE MINUTES OF AUGUST 2, 1990 AS AMENDED WAS MADE BY MRS, KILKELLY SECOND MR. THOMPSON - PASSED UNANIMOUSLY. MR. SHROYER IS VOTING IN MR. WADSWORTH'S ABSENCE THIS EVENING. OLD BUSINESS; SUBDIVISION ACCESS CHANGE - SECRETARY ADVISES THAT MR. SHROYER ASKED FOR THIS TO BE ON THE AGENDA. EARL READS HIS NEW PROPOSAL WHICH HE EXPLAINS WAS CHANGED BECAUSE THE COUNCIL WANTED ADDITIONAL iNFORMATION. BRUCE STATES CITY COUNCIL WANTED FURTHER JUSTIFICATION FOR TWO ACCESSES. MRS. KILKELLY FEELS JUST THE LAST SENTENCE OF EARL'S PROPOSAL REGARDING EMERGENCY ACCESS SHOULD BE CONSIDERED. CHAIRMAN RECOMMENDS THE WORDS "IF POSSIBLE" BE ADDED IN THE FIRST SENTENCE. MR. THOMPSON MAKES A MOTION TO RECOMMEND TO CITY COUNCIL THAT A NEW PARAGRAPH (E) BE ADDED TO 20A17.2A1 AS FOLLOWS: ALL SUBDIVISIONS SHALL HAVE AT LEAST TWO PUBLIC MEANS OF PUBLIC INGRESS AND EGRESS UNLESS ADJUSTMENTS ARE APPROVED AS SET OUT IN 20A-16.1D. THEY SHALL, iF POSSIBLE OPEN UPON DIFFERENT ARTERIAL OR MAJOR COLLECTOR STREETS, IF IT IS NOT POSSIBLE FOR THE MEANS OF INGRESS/EGRESS TO OPEN UPON DIFFERENT ARTERIAL OR MAJOR COLLECTOR STREETS, THEN THE MEANS OF INGRESS/EGRESS SHOULD BE SEPARATED BY AT LEAST ONE THOUSAND (1000) FEET IF POSSIBLE, UPON THE ARTERIAL OR MAJOR COLLECTOR PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES SEPTEMBER 7, 1990 PAGE TWO STREET ON WHICH THEY OPEN. IF SECOND MEANS IS NOT PROVIDED THEN AT LEAST ONE EMERGENCY INGRESS/EGRESS WILL BE REQUIRED. ALL EMERGENCY INGRESS/EGRESS SHALL BE APPROVED BY THE CITY ENGINEER. SECOND BY MRS. KILKELLY - PASSED UNANIMOUSLY. MR, THOMPSON SUGGESTS A LETTER OF JUSTIFICATION ACCOMPANY THE PROPOSED CHANGE TO CITY COUNCIL. NEW BUSINESS: HOME OCCUPATIONAL LICENSE - D. C. WATER SYSTEMS DAVID CASTLE 980 FRANCISCAN AVENUE MR. CASTLE STATES HE INSTALLS WATER SOFTENERS, PUMPS TANKS, FOR PUBLIC AND PRIVATE USE. ALL DELIVERIES ARE MADE TO THE SITE NOTHING TO THE HOUSE, NO EMPLOYEES. PUBLIC HEARING OPENED AT 7:45 P.M. MR. DAVID MARSHALL ASKS SOME ADDITIONAL QUESTIONS SUCH AS IF ANY BUSINESS WILL BE TRANSACTED AT THE HOUSE AND IF THERE WILL BE ANY STORAGE OR DISPLAY THE APPLICANT ANSWERS NO TO BOTH QUESTIONS. THOMAS WOJECHOWSKI OF PETERSON STREET SPEAKS AGAINST ALL HOME OCCUPATIONS STATING THEY SHOULD NOT BE ALLOWED FEELS ALL BUSINESSES SHOULD BE IN COMMERCIAL AREAS. PUBLIC HEARING CLOSED AT 7;55 P,M. A MOTION TO APPROVE THE HOME OCCUPATIONAL LICENSE FOR DAVID CASTLE AT 980 FRANCISCAN AVENUE FOR D, C, WATER SYSTEMS WAS MADE BY MRS. KILKELLY SECOND MR, THOMPSON - PASSED UNANIMOUSLY. HOME OCCUPATIONAL LICENSE - HOWARD W. JACOBS - WOOD FLOOR FINISHING - 1349 HAVERFORD LANE - MR. JACOBS STATES HE IS LOOKING FOR A TELEPHONE ONLY WILL BE DOING NO WORK AT THE HOUSE AND HE USES A CLOSED VAN TO CARRY HIS EQUIPMENT, THERE WILL BE NO EMPLOYEES. PUBLIC HEARING OPENED AT 8:00 P,M. NO PUBLIC COMMENTS BUT THE CHAIRMAN ANNOUNCED THERE WAS ONE LETTER OF OBJECTION RECEIVED. PUBLIC HEARING CLOSED AT 8:00 P,M, A MOTION TO APPROVE THE HOME OCCUPATIONAL LICENSE FOR HOWARD JACOBS AT 1349 HAVERFORD LANE WAS MADE BY MR. THOMPSON SECOND MRS. KILKELLY PASSED UNANIMOUSLY. PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES SEPTEMBER 6, 1990 PAGE THREE HOME OCCUPATIONAL LICENSE - CAROL BARBATI - CJ'S CLEANING SERVICE - CHARLES ROYER HUSBAND IS PRESENT TO ANSWER QUESTIONS, HE EXPLAINS THIS IS CONTRACT COMMERCIAL CLEANING WORK AND IS DONE AT THE OTHER LOCATIONS STATES HE IS ONLY APPLYING BECAUSE THE CITY REQUIRED HIM AFTER HE RENEWED HIS COUNTY LICENSE. PUBLIC HEARING OPENED AT 8:05 P,M. MR. WOJECHOWSKI OF 425 PETERSON STREET SPEAKS AGAIN STATING THIS IS THE HOUSE WHERE THEY HAVE FIVE VEHICLES ALREADY PARKED THERE AND THAT THEY PARK THE WRONG WAY ON THE STREET. APPLICANT STATES THEY HAVE FOUR LICENSED DRIVERS IN THE HOUSE AND THAT'S WHY THEY HAVE SO MANY VEHICLES HE STATES NONE OF THEM PERTAIN TO THE BUSINESS, AND THAT HE DOES HAVE A TAX REGISTRATION NUMBER AND PAYS TAXES LIKE EVERYONE ELSE. CHAIRMAN STATES THIS PUBLIC HEARING IS FOR OBJECTIONS TO THE LICENSE ONLY NOT TO SPEAK AGAINST HOW MANY VEHICLES SOMEONE OWNS AT THEIR HOME. CHAIRMAN CLOSES THE PUBLIC HEARING AT 8:10 P.M. A MOTION TO APPROVE THE HOME OCCUPATIONAL LICENSE FOR CJ'S CLEANING SERVICE AT 449 PETERSON STREET WAS MADE BY MRS. KILKELLY SECOND MRS. O'CONNOR - PASSED UNANIMOUSLY. FiVE MINUTE RECESS CALLED AT 8:12 P.M. BACK TO ORDER AT 8:20 P.M. ALL MEMBERS PRESENT 20A17,2 DISCUSSION AND POSSIBLE ACTION - CHAIRMAN STATES MR, GILCHER WOULD LIKE TO ADDRESS THE COMMISSION ON THIS MATTER. THERE IS NO OBJECTION, MR, GILCHER SPEAKS REGARDING MR, SHROYERS PROPOSAL AND HANDS OUT A MUCH STRONGER VERSION OF THE CODE REVISION. MR. GILCHER FEELS THAT THE COUNTY SHOULD BE CONTACTED IN CONNECTION WITH THIS SECTION. BRUCE COOPER STATES THE ONLY PROBLEM HE HAD WITH MR. SHROYERS PROPOSAL WAS THE FACT THAT THE WORDS HURRICANE PROOF IS NOT SOMETHING HE COULD ACCEPT. HE ALSO STATES HE DID NOT BLOCK MR. GILCHER FROM GETTING ANY INFORMATION AS MR. GILCHER HAS IMPLIED. A MOTION TO PUT THIS ON THE SECOND MEETING IN OCTOBER AGENDA FOR FURTHER ACTION WAS MADE BY MR. THOMPSON SECOND MR. SHROYER - PASSED UNANIMOUSLY. CHAIRMAN'S MATTERS: STAN ADVISES THE BOARD IN REFERENCE TO THE LETTER HE RECEIVED FROM TERRY PINTO. MR. MAHONEY REQUESTS A LETTER BE SENT TO HIM REGARDING THE SEWER LINE AND WHEN IT WILL BE OPERABLE. STAN SAYS HE IS GLAD THE BOARD TAKES INTEREST IN VARIOUS ITEMS BUT WOULD LIKE TO BE CONSULTED BEFORE THE AGENDA IS FINALIZED. FULLERTON ASKS IF THE CITY COUNCIL APPROVES THE PLANNING AND ZONING MINUTES - BRUCE ADVISES NO BUT THREE MEMBERS DO RECEIVE COPIES OF THEM, MR. MAHONEY ASKS IF THE BOARD WILL BE CHARGED FOR THE VERBATIM MINUTES AND WHEN THEY WILL BE RECEIVING THEM. SECRETARY ADVISES THEY ARE IN THE NEXT MEETING PACKAGE, AND THEY WILL NOT BE CHARGED. MR. MAHONEY ALSO ASKS ABOUT THE FRONT YARD FENCE REQUIREMENTS BRUCE STATES THE COUNCIL INITIATED THE ACTION AND HE TOLD THEM AT THE MEETING THAT THE PLANNING AND ZONING COMMISSION WAS NOT IN FAVOR OF FRONT YARD FENCES. MRS, KILKELLY ASKS IF THE MARTIAL ARTS SCHOOL WILL STILL BE GOING INTO SHADE TREE PLAZA NOW THAT THE VIDEO STORE IS THERE. BRUCE STATES THEY CANNOT BECAUSE THERE ARE NO EMPTY STORES LEFT, MR. THOMPSON ASKS WHAT THE RELATIONSHIP IS BETWEEN MARTIN CARTER AND TOM COLLINS AND BRUCE STATES THEY ARE PARTNERS, BLDG OFFICIAL MATTERS: BRUCE ASKS THE BOARD TO RECONSIDER PROFESSIONAL TITLES REQUEST BASED ON THE MEMO HE WROTE REGARDING THE HEALTH DEPARTMENT AND NO LIMIT ON PERSONAL ANIMALS. THERE IS MUCH DISCUSSION REGARDING THIS MATTER AND THE FOLLOWING MOTION IS MADE A MOTION TO APPROVE THE MINOR MODIFICATION FOR PROFESSIONAL TITLE FOR THE DECK AND KENNELS WAS MADE BY MRS. KILKELLY, SECOND MRS. O'CONNOR PASSED 6-1. CAPTAIN HIRAM'S INLET MARINA MINOR MODIFICATION - THE BOARD REVIEWS THE REQUEST AND IT IS DETERMINED THAT IT COULD BE APPROVED IF A GUARD RAIL CAN BE PUT UP. A MOTION TO EXTEND THE MEETING TILL lO:lO P.M, WAS MADE BY MR, MAHONEY, SECOND MR. THOMPSON PASSED UNANIMOUSLY. A MOTION TO APPROVE THE MINOR MODIFICATION FOR THE INLET MARINA LOUNGE AND WAITING AREA OF APPROXIMATELY 455 SQ FEET BE APPROVED IN ACCORDANCE WITH PLANS DATED 11-28-90 LAST REVISED 5-30-90 AND WITH THE CONDITION THAT THE MAXIMUM SEATING DOES NOT EXCEED THE ALLOWABLE PARKING, THAT A GUARD RAIL 50 LB CAPACITY BE INSTALLED FROM THE GATE AND DOCK AREA TO THE FRONT OF THE BUILDING AND SUBJECT TO HEALTH DEPARTMENT APPROVAL, MADE BY MR.
