Mr. Kelly Mather, Acting Chairman, called the meeting to order at 7:00 pm. The Pledge of Allegiance was said. PRESENT: EXCUSED ABSENCE: Mr. Scott Mathis Mr. Mahoney(a) Mr. Mather Ms. Vesia Mr. Evely(a) Mr. Gerhold Mr. Barrett Chmn. Schulke and VCh. Pliska ALSO PRESENT: Tracy Hass, Planning and Growth Management Director jan King, Planning and Growth Management Manager Dord Bosworth, Secretary Tim Zelinski, Code Enforcement Officer ANOU~EMENTS: Acting Chmn. Mather announced that Chmn. Schulke and V. Ch. Pliska are excused tonight, and Mr. Mahoney(a) and Mr. Evely(a) will be voting in their places. Mr. Hass asked for an addition to tonight's agenda in the form of a headng for the possible revocation of an occupational license for a resident who refused to remove his tractor-truck from his property, which is in violation of the Home Occupational Code. Acting Chmn. Mather commented that this would be Item E. Revocation of a Home Occupational License for Vincent Giordano at 1073 Barber Street. MOTION by Barrett/Mathis I'll make a motion that we add this item to the agenda per Mr. Hass' request, Roll Call: Mr. Evely(a) - yes Mr. Mahoney(a) - yes Mr. Mather - yes Ms. Vesia - yes The vote was 7 - 0. A voice vote was taken. The vote was 7 - 0, motion.carried. OLD BUSINESS: A. Public Hearing - Model Home Permit - 717 S. Easy Street - Col#er Creek Estates Subdivision - Burgoon Berger Construction Corp. Mr. Willie Wiles, representing Burgoon Berger, was present and was sworn in along with Jan King, by the Acting Chairman. Ms. King gave staff presentation and recommended approval. Acting Chron. Mather opened and closed the public heedng at 7:05, as there was .no public input. There was discussion from Commission members. There were eleven (11) notices of headng sent, and no objection or non-objection letters were received. MOTION by Barrett/Gerhold I'll make a motion that we approve the Model Home Permit for Burgoon Berger at 717 S. Easy Street, Collier Creek Estates. Roll call: Mr. Mather - yes Mr. Barrett - yes Ms. Vesia - yes Mr. Mathis - yes Mr. Evely(a) - yes Mr. Mahoney(a) - yes Mr. Gerhold - yes The vote was 7 - 0. Motion carried. NEW BUSINESS: B. Public Hearing - Home Occupational License - 573 Saundem Street - Chris Zarcone - Handyman Mr. Chds Zarcone, applicant, was present and was sworn in by Acting Chron. Mather, along with Tracy Hass. Mr. Zarcone gave a bdef presentation. Jan King gave staff presentation and recommended approval. PLANNING AND ZONING COMMISSION MINUTES OF REGULAR MEETING OF SEPTEMBER 16, 1999 There was discussion between the Commission members and the applicant. There were twenty-six (26) notices of headng sent, and no objection or non-objection letters were received. MOTION by Vesia/Evely I make a motion that we approve the Home Occupational License for Chris Zarcone of 573 Saunders Street, Sebastian. Roll call: Ms. Vesia - yes Mr. Mahoney(a) - yes Mr. Gerhold - yes Mr. Mather - yes Mr. Evely(a) - yes Mr. Mathis - yes Mr. Barrett - yes The vote was 7 - 0. Motion carried. C. Public Hearing - Home Occupational License - 342 I-lemdon Street - Roy Lees - Photography Mr. Roy Lee, 342 Hemdon St., Sebastian, was present and was swom in by Acting Chmn. Mather. Mr. Lee gave a brief presentation, commenting that he works with a miniaturehorse, and all photography is done on location. He commented that he does nothing at home except for phone calls and an office. Jan King gave staff presentation, mentioned the use of the horse and recommended approval if the horse is not brought to 342 Hemdon Street. There were thirty-nine (39) notices of hearing sent, and there were no objection or non- objection letters received. There was discussion between the applicant and Commission members. Acting Chmn. Mather opened and closed the public hearing at 7:15 PM, as there was no public input. It was noted that this Home Occupational License is a transfer from another address on Schumann Drive. MOTION by Barrett/Mathis Ill make a motion that we approve Roy Lees for Pony Photos at 342 Hemdon Street for a Home Oc. Motion carried. D. Public Hearing - Home Occupational License - 1534 RJdgely Lane - Linda Jo Kelly - Construction Cleaning Linde Jo Kelly was present and was sworn in by Acting Chmn. Mather. Ms. Kelly gave a brief presentetion on her new home cleaning business. Jan King gave staff presentation and recommended approval. There were thirty-six (36) notices of headng sent, and two objection letters and no non- objection letters were received. The two objection letters were discussed. Acting Chmn. Mather opened and closed the public hearing at 7:18 PM as there was no public input. MOTION by Vesia/Barrett I make a motion we approve the Home Occupational License for Linde Jo Kelly; Kelly's Custom Cleaning at 1534 Ridgely Lane, Sebastian, Roll call: Mr. Evely(a) - yes Mr. Mahoney(a) - yes Mr. Gerhold - yes Mr. Mather - yes Mr. Barrett - yes Ms. Vesia - yes Mr. Mathis - yes The vote was 7 - 0. Motion carded. E. REVOCATION OF Home Occupational Ucense - Vincent Gierdane - 1073 Barber Street. Tracy Hass gave staff presentation and noted the violation of Section 20A-5.16,1-b that it shall be unlawful to park a semi-tractor in a residential area. He noted that Mr. Giordano was given notice to move the tractor-trailer and refused to do so, and has been approached by Code Enforcement on several occasions to do so. Mr. Timothy Zelinski, Code Enforcement ofr~,er, gave information that on September 10, 1999 a. complaint was mede about this vehicle being parked in front of the garage. He noted that he had already gone to this address in August and left a notice of violation with Mr. Giordano's son, requesting that this semi-tractor be moved within two (2) hours, and it was moved. He noted that in September, Mr. Giordano refused to move the vehicle. Mr. Zelinski noted that he gave him a notice of violation requiring him to move PLANNING AND ZONING COMMISSION MINUTES OF REGULAR MEETING OF SEPTEMBER 16, 1999 the truck in one hour, and Mr. Giordano refused to move it. After several attempts, Mr. Zelinski reminded him of his occupational license, and Mr. Giordano responded that he didn,t care about the license. Mr. Zelinski also noted that Mr. Giordano has been before the Code Enforcement Board about this same type of violation. There was much discussion on this issue. :MOTION by Barrett/Gerbold Mr. Chairman, in'light of the contempt of this person to respect our Code, I would recommend that wa revoke Mr. Giordano's Home Occupational License. Discussion: There was discussion on whether or not a public hearing is required, and lacking any information in the Code, this Commission proceeded as a Board action. Refererme was made to Code Enforcement calls to this address in the past. Mr..Barrett noted Mr. Giordano's obvious disrepect of the City Codes and Code Enforcement. Mather noted that Mr. Giordano's Home Occupational License has been revoked. Mr. Mahoney applauded the Code Enforcement Department for staying on top of this issue. CHAIRMAN MATTERS:. None MEI~IBERS MATTERS: None DIRECTOR...~ATTER$: Tracy .Hass referred to the agenda packet for the City Council meeting of-the following week concerning the tentative dates and times for Local Planning Agency meetings conceming the Land Development Code. There was discussion on this schedule and the matedal to be covered. The Commission members generally approved this schedule, being aware that all members may notbe able to make all meetings. PLANNING AND ZONING COMMISSION MINUTES OF REGULAR MEETING OF SEPTEMBER 16, 1999 Mr. Hass then gave an update on the Winn Dixie landscaping. He expects:the .project to be completed in the near future. There was a brief discussion of a CR 512 Corridor Plan similar to the SR 60 plan. Tracy noted that the consultants are already working on this plan, as well as the Historical corridor east of US #1 or the railroad in the Riverfront area. Acting Chmn.
