RECOMMENDATION TO CITY COUNCIL FOR APPROVAL OF AMENDMENT TO
THE COMPREHENSIVE PLAN
Mr. Massarelli gave an introduction and noted that, under Florida law, the Comprehemive Plan
must be updated once every five (5) y~ars. He pointed out a copy ofthe Evaluatitm and Appraizal
Report that was done last yiar (1996) which includes a series of recommended changes to the
Compreh~ive Plan. He eomme~ed that staff has been Comparing the Compretm~ive Plan from
the day-to-day practical ~ including issues, pr~olem~ and eoncem~ that have developed with
the use of this Plan. He-noted that both of these ~ of ~tio~ have ~ summarized in
the Compr~emive Plan AmmdmmU, the sevamd ~: ami they are available to the public at the
Library and at the Community Development Dep~,. For the benefit of the public, he further
explained the activities that this Local Planning Agency haz been involved with ~ year including
information provide by Mr. Les Solin on the Housin~ Elemeaxt, with ealeulationson the number of
units needed for affordable housing
There were two maps displayed on the wall, one. an .existing future land use map (unofficial copy),
and one a proposed future land use map, proposed at one oftbe last meetings of this Agency, and
also suggestions made by the Riverfront Committee. Mr. Massarelli pointed out the proposed

changes between thc two as well as some other issues. He also pointed out some environmental
areas; aa area that his Deparunent has very ~y received aa application for a PUD; a
questionable area that is either medium density or mobile home, on which he asked for guidance;
and a letter from Mr. Nelson Hyatt dealing with a piece of property located in the center of the
mobile home area, m which he is requesting a change.
Mr. Massarelli then recommended opcping thc publiC:hearing and get public inlmt, at which time
issues can be discussed in detail. He noted that staff has reconunendations concen~ing some of
changes that this Agency has proposed.

Mr. Richard Smith, 13895 Indian River Drive, Roseland spoke on recommended, cluu~es tothe
168 acre piece of property to the southwest of thc City Golf Course. He noted that .it is presently
designated as PUD, but was proposed to become-~. He explained thathe represems the
owners of the property, handed out copies and read parts of a letter from the owners. He further
explained that this property is owned by eight (8) individuals who are located .allover the world
and they are asking that the property remain aszoned at present so that they' may accomplish the
plan thatCh as been in the making for almost forty (40) years, He then wont on~.to explain the
~ plaa for this property ami showed drawings.
There was discussion between Mr. Massarelli, Mr. Mather, and Mr. Tempia, about, this property,
includiag tbe issue, of land use versus zoning. It was noted that aa inconsistenCy could ,arise if this
property is changed to industrial on the Land use map, and a PUD needs to be ia a .category of
Mr. Thomas brought up tho subject of the airport being so close to this PUD development, and Mr.
Smith responded that that issue will be handled by disclosures to the prospectivebuyers~.
Mr. Chuck Meehling, 5215 Tradewinds Drive, V~ro Beach, FL was present and:~plaialgl that he
represents the eommet purchaser for the PUD property previously discussed. He conuuemed on
the issue of being near the airport. He also gave information on his procedure of completely soiling
the project to builders prior to starting work. He noted 'that the developrmmt loan will be in place
and noted that Mr. Adam Bollinger of First National Bank is present toulght to speak on this as his
Bank will be handling the development loan. He th~ spoke on the recreatiomfi fac/l/t/es ~hat will
be part of this developmeat, and the many contacts that his group has had ~ mauy resid~ts near
this development. He riga introduced Mr. Bill Curr.
Mr. Bill Curt, 325 Marlin Pla~, Melboung Beach, ofBKl Cons~ Ecologists, spoke on some
environmental issues on the property. He mentioned'~ six (6) acres of w~amts,, a twelve (12)
acre scrub jay preserve, and the ~ire site is inhabited by goplgr tortoises. He not~! that:approval
lias been obtained on a mitigation plan for on-site mitigation of all wetlands ~ that. site from
Saint Johns River Water Management District, the U.S. Army Corps of Engiae0tS, and aPl~.wval
from the Field Inspector with the U.S. Fish and Wildlife Service for the scrub jay preserve which
will also preserve the gopher toRoises that live m that area. He noted that ~eg areno permi~g

He then noted that final approval from these agencies will be given after submission ~r this
approval.
Mr. Adam Bollinger, 2006 Surfside Terrace, Vero Beach, and with First National Bank, was
present and spoke on their commitment to this development and the thoroughness of the developers.
In response to a question from Mr. Thomas, Mr. Smith responded that there will be model homes
and also some spec homes available. He no~ that lots will not be sold separately, but it will be a
package including the lot and the home. He also commented that the roads in this community will
be maintained by a homeowners association.
Ms. Kilkelly commented on the airport master plan and asked how the airport would impact Mr.
Smith's development if the master plan was not adopted. Mr. Smith responded that he didn't see
any problem although his group would like to see it implemented. He noted that'his group also has
an option on another one hundred fitty-three (153 ) acres in the vicimty of the airport.
Mr. Massarelli cautioned the LPA members that the proposed PUD is not an issue.tonight at this
~. He noted that the consideration Umight is good land use in that area and.if Iow density
residential is the proper land use in the area, or because of its close proximity to the airport it may
not be. He reminded all present that there are regulations in the Land Development Code that
require that anyone within one-half the leith of the loagest runway would have to gat a navigation
easement. He then noted that if low-~nsity resi~ is not a desirable land use in:that area, then
you must determine what is desirable, and if industrial is desirable, he urged the membe~ to
ex~aluate it and state why that property is desirable for industry. He commented that the changes
made to the land-use map have to be consistent with ~e rest of the Ccmp~~ Plan. He
proceeded to cite criteria for industrial property. He summarized by noting that staff would
r~end that thi~ property remain low-density residm~al.
Afar some discussion, Mr. Schulke commented that he thought it ludicrous'to haveC0nsidered
~ the land-use designation. He spoke about the condition of the roads in that'nren not being
conducive to industrial traffic, the differences b~se~ indusuial and residential tra~c, the golf
course buffer between this proposed community and the airport, and noted that the surroumting
residential land use lends itself toward residential USe on that property. He suggested leaving that
residential land-use alone. He also commented on the industrial zoni~ already in the City. and the
fact that it is not being used.
Mr. Curt commented that there is a two hundred (200) foot buffer (100' on each side) within this
plan to buffer Collier Creek which might not be available if changed to industriall use. He also
noted that the twelve (12) acre scrub jay habitat is next to the Goff Course and some homes will
face this habitat.
Mr. lamieSturgeon, 394 Main Street spoke on the residential use of Main Street, was opposed to
indusUial zoning in this area, ami was'in favor of keeping the residential designation.
Mr. Eric Crrotke, 358 Main Street, who is in the field of consultin~ engineering and the
environmental field, commented that changing the land-use designation on this property at.this

point would be very detrimental, not only to the area but also to the hard work that the developer
has put into this.
Mr. Marshall Bruce, 346 Main Street, spoke in favor of keeping this property residential.
Mr. John Mellinger, 9825 Riverview Drive, Little Hollywood, representing some of the property
owners regarding some properties near the proposed PUD, spoke in favor of keeping.this property
as residential.
Mr. John King, 103 Harbor Point Drive, referred to letters from Wmmm Dill on proposed .~cli~nges
to Schumann Commercial and Sandridge Esmes, which were included in the members: packets
tonight. He urged thc LPA members to take these letters into consideration before recommending
any changes to thc future land-use map to City Council.
V. Chmn. Munsart closed the public hearing at 5:58 P.M.
There was discussion on the land-use amendments. Staff questioned several areas which had been
considered for clmnge to industrial or commercial use. These areas included locations on High
Street and CR 512, and a site designated for mobile homes.
There was also discussion of a text change in the industrial land-use designation to open the
opportunity for some general commercial activitizs.
Mr. Les Solin commented that the intent, when the Plan was originally adopted, was to allow
commercial thai is compatible with ~ industrial, and that is what the Land Developmimt Code
says. He suggested that it might be very prudent of the Commission to direct staff and the
consultant to prepare an amemdrnem which stat~s thai intent for the futUre land use. There was
discussion about compatible commercial - industrial uses. Mr. Solin also spoke of criteria for
Mr. Schulke commented that this City will probably not amact heavy industrial and we need to
keep the land-use open to other commercial activities.
Mr. Mather commented that the industrial level would be the highest level for having sexvices, etc.,
and then other things of less service requirement, by changing the word, should be able to come in
there, and whichever wins out economically, wins out.
Staff prescmed this question- should industrial include a provision for commercial, jus~ as the
Land Development Code provides for it now?

Mr. Thomas had a problem with the definition of industrial versus commercial. He asked if, on
industrial property, a pizza parlor could be optmed ~ to an assembly plant.

Mr. Massarelli noted that strict interpr~ation of our Comprehensive Plan would not allow a pizza
shop in an industrial area next to an assembly plant.
Mr. Tom Tcmpia of Solin and Associates, also noted that the way the Comprebensive Plan is
written right now, you could not have that. But the Land Development Code is writt~ to allow it.
Mr. Les Solin agreed with Mr. Massarelli and Mr. Tompia,. and elaborated that an assembly plant
is an example of an industrial use, and a pizza parlor is an example of a commerc'ml use. ff you
want industrially classified lands on the furore land use map to accommodate both industrial aud
commercial, you must amend - it would be very prudent to amend the industrial land developm~t
classification in the furore land use map to clearly include the word "commercial uses" among thc
uses that are invited into that district, because right now it doesn't do that. However, over time,
ever since 1981, you have been allowing a mix of commercial and industrial, so any doparmrc
from that philosophy is going to be a major change in the philosophy of this City.
Mr. Thomas then suggested a consensus of that definition.

Mr, Massarelli suggested making a text ammdment to clearly define that commercial uses can be
included in the industrial future land-use designation, which is then compatible with what our Land
Development Code says.
At this point, V.Chmn. Munsart re-opened the public hearing at 6:25 P.M, for more public input.
john Mellinger spoke again and referred to a large lakefront property east of Wimbrow Drive,
between the proposed CR 512 twin pair roads, and noted'that he understood it was designated as
general commercial. He noted that as CR 512 is a main corridor east and west, and fe~ that an
industrial designation in that location would not be advisable, and gave his reasons. He felt that
industrial to the south of CR 512 would be more appropriate. He.comment~ that the property on
the lake has been subdivided into several parcels and is commercial limited at present, which would
allow something nice to go m there. And he comffumted that this will be the entrance and exit from
Sebastian in the future .and this Agency should consider this,
Mr. Schulke felt this was a valid point.
Mr. John King commented that m commercial general, a service station would not be allowed, yet
some uses under industrial could be advantageous.
Mr. Thomas pointed out that there arc two accesses to 1-95, Roseland Road (to be 4-1aned in the
near future) and CR 512. He didn't feel that "pretty" counted at this point, but the issue of
whether that piece of industrial property should accept commercial use, as well.
The next issue of discussion was Collier Club and whe~r it should be designated industrial or
remain low-density residential.

The consensus on this issue was tokeep Collier. Club Iow*denslty residential.
The next discussion was about Schumann Drive, in reference to the letters from Mr. Warren Dill
concerning "Sandridge Estates" and "Schumann Commercial Properties Subdivision", which is
presemly designated as a limited commercial area with a COR below it. Mr. Massarelli
· commented.that in past conversations, it was discussed to do away with the COR designation,
which creates aa issue, 5ecau~ the surrounding area is medium*density, and we havediscusscd
transition between Iow-density and commercial, or low-density - medium-density, and maybe the
medium-density designation is appropriate there. He noted that thore is an approvedsite plan on
the site, and if it is changed to medium-density, the site iplan would not be invalidat~ according to
the City Attorney's opinion. He comtrmmat that the problem is the limited commercial area. He
referred to a previous discussion that indicated that limited commercial should not.~ .inside of a
residemial area because of incompatibility, among other things. He indical~ '.t!mt staff
recomum~ that no chan~ be made, based on the Comprelm~ive Plan. He noted polities dealing
with commerci~ development, particularly limited commercial and the proximitY to
thorouglffares, near residential neighborhoods. He noted that Schumann is a major ~e,
and the plan is to make it four lanes. He then proc__eeded to read from the policy.
There was discussion of"strip commercial", and Mr. Mather asked iftbe plan of the City is to hold
thc commercial to CR 512 and U.S. 1, how does this fit into that policy.
Mr. Massarelli responded that that is not a plan in the CitY, and referred to '~mdes of commercial
activity" mentioned in the Comprehensive Plan.
Mr. Les Solin commamed that on the subject of gemini commerci-I, he had done the City's
original.plaa in 1981, and at that time, GDC had a Land Development Code and the GDC master
plan for the City of Sebastian. He noted that it had two (2) major potemial future sites laid Out for
right from the start to be a major area for low-intensive, neighborhood commemial shopping so
that people didn't have to go to U.S. I to shop. He also,noted that there is not a lc~O/~development
:in the south part of the City, yet, and as it develops, the population in that area will. be,subtly
greater than it is now. He suggested that the original planners for the City didfi~t'i~nvision only
commercial development, along CR 512 and U.S. 1, but, fortunately, they rescrvod-a,.few well-
located sites to give large sections of the residential community a choice in shoppi~. -lie poimed
out that the City has strip-commercial at present, but.the original plan for the City was to have
n~ighborhood shopping, and the market just hasn't reached it,yet,
There was further discussion on the issue of "mom-and-pop" neighborhood stores and commercial
uses in a residential neighborhood.

Mr. Massarelli continued to locate areas on the future tand~se map that had. been'diseased, at a
previous meeting. He specified an area at Park Place on the existing future landTus$, map.that is
designated as mobile homes, but on the proposed map, it is shown as low-dmsity::~al. He
noted that there is a conceptual PUD on that site for mobile homes, so staff recommends that part
be maintained as mobile homes. He also referred to the letter from Mr. Hyatt that requests medium
d~nsity residontial on Barber Street, south of Palm Lake Club, and staff has no objection to that as
it gives a good mixture to the area.
He asked for a consensus for medium-density in that area, and all members agreed.
Mr. Massarelli then suggested a motion to recommend to City Council the approval of the future
land use map as we have shown here, the changes that 1) thc Collier Club ar~ be low-density
residential, 2) Power=line Road as we show here is institufi~, 3) that the gtmeml ~cial
area on the twin pairs be industrial, (with the text muendffxmt later, that's understood), 4) that we
show the mobile home throughout (on thc H part) of Mr. Hyatts' property, and thc medium-density
resi&mtial as requested by Mr..Hyatt, 5) the area known as Sandfidge Estates to remain ngdium-
density, 6) Stonocrop area to be low-density residential, 7) Barber Street, Mr. Hyatts' request for

V. Chnm. Munsart referred to a list of site plan termination extensions, and suggested a change at
the bottom of the last sheet to road that the notices shall go out "60 days~' prior.
Mr. Tom 'Tempia, Harming Operatious Mmmger at $olin and Associates, the City's planning
consultant, presented the second dra~ of the compretie~ive plan arnen~ and not~ that
corrective changes have been made.
Ms. Kilkelly referred to page 6 of 38, policy 1-2.3.1, noted.the change in the maximum int~asity of
industrial development from vehicle trips to floor area, ratio, and asi~d for some e~planatiou and
discussion.
Mr. Solin explained that the data ontrips per day that was used was very soR, and it wes put in the
plan to fulfill tho requirem~ of tim State. The State requires that.,municipaliti~ amt':,~ give
a measurem~ of the.intensity of the land ~-USe..:, He noted that, at that tin~, they had 'no. feel for
floor ama ratio in Sebastian, and the easiest thing to do at.that time was ~o base the .' httemsity on
either use of water, ~ flow or trauspomUi0o. He noted that the St~ ~ecomme~l~
basin~ it on transpormtiou since there was no comurrency manag~ system. He.,~~ the
members that the State has since mandated ~ all local governmeots adopt a-co~mtrr~cy
management system and this will require trips,per-day g~merated by every use. He also explained
floor area ratio. Mr. $olin noted that as he goes tl~ough the Land Development Code, he is
developing a floor area' ratio for every one ofthe districts and he ~xplah~ how he goes about this,
Mr. Thomas asked about using the floor area ratio for residential, Mr, Solin responded that
deas~ is used now and if high-rise buildings were involved, floor area ratio might be used But he
noted that he could develop floor area ratio for residential, if requ~. He noted that,he has been
informed that 'to0 much ~ spa~ is being lost in Sebastian, which affects the p~m~.l~le'.stu-fa~
mt/o, and the open space ratio can be increased. There was discussion on this issue.
Mr. Solin also touched on the definitiou of"opeo space" and how water is calculated into this.

Mr. $olin requested that the Agency ~ keep an open,~ on cluster housing, becm~ som~
of it works.
Mr. Massarelli suggested inserting the language about the commercial and industrial in policy
1-2.3.1, and in paragraph flu~e (3) on page six (6) of 38, "and distribution activities; warehouse
and storage activities;" and insert "general commerc~l activities".
Ms. Kilkelly referred to page eight (8)of thirty-eight (38), the last sub-paragraph at the bottom of
page, and it was determined to ~ wordiiig to replace that which was omitted.

Ms. Kilkelly then referred to page ~hirty-three (33), last paragraph, and there was a dillon
about encouraging or requiring removal of exotic vegetation. Her next question was on page
thirty.six (36), where it mentions river access to the Indian River Lagoon. It was ~ to

Mr: Massarelli spoke about Grate's Landing and the letter of support that th~ ~ and in

He asked the Agency members if they would lik~ to see a policy, under the housing olem~$, which
would state that the City would develop or in~ provisions in its codo to provide for such

Mr. Pliska commented'that on the issue of upa~ti%o a twenty (20) year old property, tlgre must be
compromise, and he fcic that this represented a.good compromise,
Mr. Thomas asked thc applicant how he planned to keep the four (4) spaces for car'sales separat~
from the other parking spaces, and Mr. Philipson responded that if there are no comignmcnt cars in
those spaces, he was comfortable with anyone using them. Mr. Philipson also noted that the gym
may move fi*om his building and a differc~ business use may locate there, and additional spaces
may be needed
Mr. Massarelli suggested that when and if Mr. Philipsen applies for an occupatiotml license to sell
used cars, a conditio~ could be applied to the approval stating that four spaces Se'designated for
use car sales, and that will enable Coct~ Enforcemem to know that only four (4) autos can be
labeled '~or sale", and indicators can be placed on the wheel stops.

applications request the information that is r~luimd by the code, and should l~p mlumco the
permitting process and help the applicants.
He also noted that the evaluation of fees has been c, ompl~ and a comprehemive f~= ,.sclgdale
should be going to the City Manager ve~'y soon for all the Land Dewlopmmt Code ~ · He
