MR, THOMPSON ASKS BRUCE TO GET CLARIFICATION OF THE ITEMS IN
HIS MEMO TO THE COMMISSION. MR. COFFEY STATES ONE OF THE
VEHICLES IS HIS PERSONAL VEHICLE AND ONLY THE CHEVY IS USED
FOR THE BUSINESS, STATES NO EMPLOYEES WILL COME TO THE HOUSE
THEY ALL MEET ON THE JOB SITE AND ARE PAID ON THE JOB SITE.

MRS. O'CONNOR STATES THAT TWO LETTERS OF OBJECTION HAVE BEEN
RECEIVED. MR. MAHONEY CLARIFIES THAT ONE HAS NO OBJECTION IF
THIS IS A PHONE ONLY.
MR, THOMPSON ASKS TO CLARIFY THE WEIGHT OF THE VAN SINCE THE
APPLICATION STATE A TON AND ONE HALF THE APPLICANT STATES IT
IS A 1/2 TON NOT A TON AND ONE HALF. MR. THOMPSON ALSO
REQUESTS IF THE LADDER AT THE PROPERTY IS USED FOR THE
BUSINESS THAT IT NOT BE STORED OUTSIDE THE HOUSE.

DAVID PELAREZ 1640 ADDIE STREET ASKS WHAT HAPPENS TO
SUPPLIES AND EMPLOYEES STATES HAD A PROBLEM WHEN HOUSE WAS
BUILT WHICH CAUSED A MAJOR ARGUMENT WITH THESE PEOPLE. HE IS
ADVISED THAT MR. ROGERS CANNOT HAVE EITHER AT HIS HOME UNDER
THiS LICENSE AND IF HE DOES ALL THAT IS NECESSARY IS TO
CONTACT BRUCE COOPER'S OFFICE.
MIMI LAUGER 1656 ADDIE STREET - WORRIES ABOUT THE NUMBER OF
VEHICLES WHICH ARE THERE NOW AND WHAT IT WILL LOOK LIKE IN A
YEAR, BRUCE STATES THAT IF THEY ARE HIS PERSONAL VEHICLES
THERE IS NO LIMITED TO HOW MANY THEY CAN HAVE - AND HE CAN
HAVE TWO BOATS AT HIS RESIDENCE UNDER CURRENT ORDINANCES.
ROBERT LAUGER 1656 ADDIE STREET - STATES HE WAS THE ONLY ONE
ON THE STREET THAT GOT A LETTER IN THIS MATTER AND BRUCE
INDICATED THAT CURRENT TAX ROLLS ARE USED FOR ADDRESSES AND
IF THEY ARE NEW TO THE AREA, THEY PROBABLY ARE NOT LISTED ON
THE TAX ROLL YET.

BRUCE SPEAKS REFERENCE THE TRAILER HAVING TO BE STORED
ELSEWHERE THE APPLICANT FEELS HE SHOULD NOT HAVE TO MOVE HIS
TRAILER SINCE OTHER LAWN SERVICES KEEP THEIRS AT THE HOUSE
BRUCE INDICATES THEY COULD HAVE BEEN BEFORE THE ATTORNEY'S
OPINION THAT A TRAILER IS TO BE CONSIDERED A VEHICLE.

MRS. NORMA SHIRER 461 TOLEDO STREET SPEAKS IN FAVOR OF THE
APPLICANT.
MR. THOMPSON ACKNOWLEDGES THAT THERE WERE FOUR WRITTEN
RESPONSES 2 IN FAVOR AND 2 AGAINST.

A MOTION TO APPROVE THE HOME OCCUPATIONAL LICENSE FOR
OCEANBREEZE LAWN SERVICE AT 450 TOLEDO STREET FOR FRANK
BORDEN WITH THE CONDITION THAT THE TRAILER BE MOVED WITHIN
TWO WEEKS WAS MADE BY MR, THOMPSON SECOND MR. MAHONEY PASSED
5-1 WITH MRS. O'CONNOR VOTING NO.

PARADISE MARINA SITE PLAN - CONDITION USE FOR TWO BUSINESS
APPLICATIONS.
BRUCE COOPER SPEAKS FIRST AND GIVES A BRIEF STATEMENT OF WHY
THESE NEEDED TO COME BEFORE THE BOARD.
STATES THE GIFT SHOP OFFICE WILL NOT INTENSIFY THE PARKING
USES AND THEREFORE CAN BE APPROVED. THE APPLICANTS LEE AND
MARVIN JAMESON OF 1109 INDIAN RIVER DR. COME FORWARD WITH TEE
SHIRT SAMPLES TO SHOW THE COMMISSION.
THERE IS MUCH DISCUSSION WITH REGARDS TO PAST PROBLEMS AND
WITH THE FACT THAT THERE IS LIMITED PARKING AVAILABLE. MR.
WADSWORTH FEELS THAT NOW WOULD BE THE TIME TO ASK THE
APPLICANT TO BRING THE SITE INTO COMPLIANCE BUT BRUCE
INDICATES THE CODE ONLY REQUIRES IT FOR AN INTENSIFICATION OF
THE NON-CONFORMITY,
MR. ED POTTER THE OWNER OF THE PROPERTY SPEAKS TO THE BOARD
AND EXPLAINS THAT HE WILL HAVE PROBABLY WITHIN THE NEXT TWO
WEEKS A SITE PLAN FOR ADDITIONAL PARKING SOME 42 SPACES WHICH
IS CURRENTLY ON THE DRAWING TABLE BY PETERSON AND VOTAPKA.
PUBLIC HEARING ON THE CONDITIONAL USE WAS OPENED AT 9:30 P.M.
ANN FOSTER SPOKE AND STATES THERE ARE SEVERAL REASONS SHE
WOULD LIKE CONSIDERED AND FEELS IT SHOULD NOT BE APPROVED.
STATES SHE IS COMPLAINING ABOUT THE BOAT RENTALS NOT THE
RETAIL STORE AND THAT THE NOISE FROM JET SKI'S WILL DISTURB
THE RESIDENTS ACROSS THE STREET. MR, COOPER ADVISES HER THAT
THE BOAT RENTAL LICENSE IS NOT BEING CONSIDERED NOW JUST THE
RETAIL SHOP. SHE STATES THERE HAS BEEN MANY PROBLEMS IN THE
PAST WITH NOISE AND SHE DOESN'T FEEL BOAT RENTALS IS A GOOD
BUSINESS FOR THE WATERFRONT DISTRICT,

A MOTION TO APPROVE THE SITE PLAN APPLICATION FOR E. J.
POTTER WITH THE CONDITION THAT THE PARKING SPACES BE
RESTRIPED IN ACCORDANCE WITH THE CODE, THAT THE FENCE BE
REPAIRED AROUND THE POOL AREA, THAT WHEEL STOPS AND THE
HANDICAPPED SPACE BE INSTALLED ACCORDING TO THE CODE AND THAT
WE RECOGNIZE THAT THE SITE REQUIRES FOURTEEN SPACES WHICH IS
DEFICIENT AND ONLY HAS TWELVE AND THAT THHIS IS BASED ON THE
FACT THAT THEY ONLY HAVE 19 BOAT SLIPS ALSO WE ASK THAT THE
TWO SPACES IN THE R.O.W. BE REMOVED AND IN ADDITION WE ARE
APPROVING THE CONDITION USE PERMIT FOR TEES AND TREASURES AT
1109 INDIAN RIVER DRIVE. MADE BY MR. THOMPSON SECOND MRS.
KILKELLY PASSED 4-2 WITH MR. MAHONEY AND MR. WADSWORTH VOTING

FOR 1109 INDIAN RIVER DR.
THERE IS SOME DISCUSSION THAT MR. SZEZESNY NEEDS A DESK TO
OPERATE AND CANNOT JUST SIT ON THE DOCK. MR. AND MRS. JAMESON
STATE HE CAN USE A PORTION OF THERE SPACE FOR HIS LICENSE AND
PAPERWORK.
APPLICANT STATES HE ONLY HAS THREE BOATS AND THAT IS WHAT HE
WILL START WITH BRUCE INDICATES THAT THE PARKING FOR THIS
TYPE OF OPERATION IS NOT SPELLED OUT IN THE CODE AND THE
COMMISSION NEEDS TO DETERMINE THE REQUIREMENTS.
A MOTION TO EXTEND THE MEETING FOR 15 MINUTES WAS MADE BY MR.
THOMPSON SECOND MR. MAHONEY PASSED UNANIMOUSLY.
MR. SHROYER FEELS THAT THIS WOULD REQUIRE 4 SPACES ONE FOR
THE OWNER AND ONE FOR EACH BOAT. THE COMMISSION TENDS TO
AGREE.
A MOTION TO APPROVE THE CONDITIONAL USE PERMIT FOR
SWAZBUCKLERS WATER SPORTS AT 1109 INDIAN RIVER DRIVE
UNDER THE CONDITION THAT THE MARINA DOES NOT RENT 9 OF THE
BOAT SLIPS FOR THE NEXT NINETY DAYS OR UNTIL THE PARKING
FACILITIES ACROSS THE STREET ARE COMPLETED MADE BY MR,
SHROYER SECOND MRS. KILKELLY

BECAUSE OF HIS FEELINGS THAT NOW WOULD BE THE TIME TO REQUIRE

FEELS THAT THERE IS A REAL PROBLEM SINCE THIS PLACE WAS
VACANT FOR A YEAR AND ONE HALF.
MEMBERS MATTERS: MR. MAHONEY STATES THERE IS CONCRETE RIP RAP
ACROSS FROM VI'S - BRUCE INDICATES THEY ARE MEETING WITH DNR
TOMARROW AND IT IS ALREADY UNDER ENFORCEMENT.
MR. SHROYER STATES THAT HE HAS ASKED BRUCE TO CHECK THE OPEN
STORAGE OF A TRAILER AT THE FISCHER TRADE CENTER. FOR THE
LANDSCAPE COMPANY APPROVED TONIGHT.
MR. SHROYER GIVES A REQUEST TO THE BOARD WHICH HE STATES HE
WOULD LIKE FORWARDED TO THE CITY MANAGER FOR A WRITTEN LEGAL
OPINION. A MOTION TO FORWARD SAME TO THE CITY MANAGER FOR A
WRITTEN OPINION WAS MADE BY MR, MAHONEY SECOND MR, SHROYER
PASSED 4-2 WITH MRS, KILKELLY AND MR. THOMPSON VOTING NO,
MEETING ADJOURNED AT 10:30 P,M.
