FOR THE LAND USE CHANGE ~R. METCALF SPEAKS REGARDING THE LAST PARAGRAPH OF ME. COOPER'S LETTER TO THE COHMISSION ON THIS PROJECT. MR. COOPER'S LETTER STATED DCA APPROVAL WAS NECESSARY. MR. METCALF STATED HE FELT A DRI WAS REQUIRED ON THiS PROJECT. MR. GILCHER ASKS FOR A CLARIFICATION ON THE LEGAL DESCRIPTION TO BE SURE WHAT IS ACTUALLY BEING CONSIDERED. BRUCE DESCRIBES WHY THE REZONING WILL BE ALL INDUSTRIAL RATHER THEN THREE DIFFERENT ZONINGS AS THE APPLICATION STATED. MRS. TAYLOR HAD NO QUESTIONS MAHONEY HAD NO QUESTIONS MR. WADSWORTH HAD NO QUESTIONS HR. FULLERTON ASKS MR. METCALF WHY HE FEELS DRI APPROVAL IS NEEDED BRUCE CLARIFIES THE LAST PARAGRAPH OF HIS LETTER AND MR. NETCALF STATES HE MISREAD THE LETTER AND THOUGHT DRI WAS REQUIRED AND NOT DCA. MRS. KILKELLY STATES THE LEGAL DESCRIPTION' SHOULD BE CLARIFIED. ATTORNEY KRUZCAMP STATES THAT THE KEETS AND BOUNDS ADVERTISEMENT WAS PERMISSIBLE IN THiS CASE HOWEVER, THE LEGAL WOULD HAVE TO BE CORRECT ON THE ACTUAL REZONING ORDINANCE. THE PUBLIC HEARING WAS CLOSED AT 4:23 P.M. N~. WADSWORTH MADE A MOTION TO RECOMI~IEND TO CITY COUNCIL THAT THE LAND USE CHANGE TO INDUSTRIAL BE APPROVED FOR THE VICKERS INDUSTRIAL SUBDIVISION. MRS. MOTION TO RECOMMEND TO CITY COUNCIL THAT THE ZONING CHANGE FOR THE VICKERS INDUSTRIAL SUBDIVISION TO iNDUSTRIAL BE APPROVED BY MR. WADSWORTH SECOND BY MRS. TAYLOR PASSED UNANIMOUSLY. REQUEST FOR ZONING AND LAND USE CHANGE CHUCK HUMPHRIES MR. LULICH REPRESENTS MR, HUMPHRIES PUBLIC HEARING ON LAND USE CHANGE OPENED AT 4:85 P.M, MR. LULiCH ADDRESSES LES SOLINS COMMENTS REGARDING THIS REQUEST WITH RESPECT TO PARKING, MR, COOPER ALSO SPEAKS ON MR. SOLINS COMMENTS AND STATES HE FEELS IT WOULD BE BEST TO REZONE THE ENTIRE TRIANGLE RATHER THAN JUST.THE PARCELS REQUESTED BY MR. HUNPHRIES. ALL THE COMMISSIONERS EXCEPT MRS. KILKELLY WERE IN FAVOR OF THE ENTIRE TRIANGLE BEING REZONED. NO COMMENTS FROM THE PUBLIC PUBLIC HEARING CLOSED AT 4:40 P,M. A PUBLIC HEARING ON THE ANNEXATION REQUESTS FOR MORCHESKY, PLATT AND DECRISTOFARO WAS OPENED AT 4:47 P,M. IT WAS DETERMINED THESE SHOULD BE DISCUSSED TOGETHER SINCE THEY ABUT ONE ANOTHER PLANNING AND ZONING CON)fISSION SPECIAL MEETING MINUTES SEPTEMBER 29, 1988 PAGE THREE RENE VANDEVOORDE REPRESENTS IIRS. MORCHESKY AND SPEAKS FIRST ON MR. SOLINS COMMENTS, MR. PALKER STATES THAT WHEN THE ANNEXATION OF THIS PROPERTY CAME BEFORE THE BOARD SOME TIME AGO THE THEN CITY ATTORNEY DETERMINED IT DID NOT CREATE AN ENCLAVE. ME. VANDEVOORDE STATED THAT .MOST OF MR. SOLiNS COi~NTS ARB BEST DISCUSSED OR SHOULD BE CONSIDERED AT THE DEVELOPMENT STAGE AND NOT AT THIS TIME. ME. COOPER SPEAKS REGARDING LES SOLiNS COMMENTS AND STATES THAT HE CONCURS WITH MR. SOLIN THAT THE INDUSTRIAL ZONING SHOULD NOT BE APPROVED AT THIS TIME. MR. WADSWORTH ASKS THE NEW CITY ATTORNEY FOR A RULING ON THE ENCLAVE - MR. KRUZCAKP STATES HE CAN ONLY GIVE AN OPINION NOT A RULING. MR. GILCHER STATES HE FEELS THE OUT PARCEL SHOULD BE INCLUDED IN THE ANNEXATION AND ALSO RECOMF, ENDS THAT THE CITY CONSIDER ANNEXATION OF ALL THE PROPERTY TO THE NORTH OF THIS PARCEL TO THE CITY LIMITS IF iT CAN BE ACCOKPLISHED HE WOULD HAVE NO PROBLEM WITH THE ANNEXATION BUT IF NOT HE HAS SERIOUS RESERVATIONS ABOUT THE ANNEXATION. MR. KAHONEY ASKS ATTORNEY VANDEVOORDE REFERENCE THE DATES ON THE DEEDS QUIT CLAIM VS PERSONAL REPRESENTATIVE DISTRIBUTION DEED. RENE EXPLAINS HOW THE PERSONAL REPRESENTATIVES DATE COULD BE BEFORE THE QUIT CLAIM DEEDS. MR. NAHONEY STATES HE FEELS THIS PROPERTY WILL INCREASE THE CITY'S TAX BASE MR. WADSWORTH AGREES THAT THE TAX BASE NEEDS IKPROVEMENT MR. FULLERTON STATES HE FEELS IT REPRESENTS A PROBLEM WITH MORE TRAFFIC ON 512, MR. METCALF SPEAKS ON THE MORCHESKY PROPERTY AND STATES HE FEELS MORE INFORMATION ON THE INDUSTRIAL USE SHOULD BE OBTAINED BEFORE A DECISION IS MADE. HE INDICATED SAND HAULING WAS GOING ON AND THEY WERE USING GEORGIA BLVD AS AN OUTLET. MRS. KILKELLY READS A PARAGRAPH FROM CHAPTER 171.062 REGARDING ANNEXATIONS. JO DORIS FLATT - MOTHER IN LAW TO TONY DE CRISTOFARO TONY DE CRISTOFARO ARE PRESENT TO REPRESENT THEIR PROJECTS. DAMIEN GILLIANS SPEAKS IN FAVOR OF THE ANNEXATIONS AND REZONING OF THIS PROPERTY. KILKELLY QUESTIONS MRS, FLATT REGARDING HER APPLICATION AND REQUESTS A CLARIFICATION IF SHE IS REQUESTING A LAND USE CHANGE TO INDUSTRIAL OR INSTITUTIONAL SINCE HER APPLICATION STATES INSTITUTIONAL. MRS. FLATT STATES SHE IS REQUESTING INDUSTRIAL NOT INSTITUTIONAL. DISCUSSION TURNS TO THE STATEMENT BY THE COUNTY REGARDING THESE PROPERTIES THAT THE OLD DIXIE CROSSING WILL PROBABLY BE CLOSED OFF FOR THE SWAP WHEN THE TWIN PAIRS GOES INTO EFFECT. MR. WADSWORTH FEELS THIS CROSSING ON OLD DIXIE IS A NECESSITY AND SHOULD NOT BE CLOSED UP THAT THE COUNTY SHOULD CONSIDER SWAPiNG BAY STREET'S CROSSING. CHAIRMAN ASKS FOR A MOTION ON THE ANNEXATION PORTION OF ~ORCHESKY A MOTION TO RECONSIDER THE ANNEXATION OF APPROX 10 ACRES WAS MADE BY MR. FULLERTON ATTORNEY KRUZCAMP ADVISES THAT IF THE BOARD WISHES THE ANNEXATION RECOMMENDATION CONSIDERED IN THE PAST TO STAND THAT NO MOTION IS NECESSARY AT THIS TIME. MR. FULLERTON WITHDRAWS HIS MOTION A MOTION TO RECONNEND TO CITY COUNCIL THAT THE LAND USE CHANGE FOR MORCHESKY BE APPROVED AS REQUESTED WAS MADE BY WADSWORTH SECOND BY MR, MAHONEY ROLL CALL VOTE i~R, GILCHER AND MR. ALL MEMBERS STILL PRESENT SEBASTIAN LAKES PUD- LAND USE CHANGE PUBLIC HEARING - DARRELL MCQUEEN REPRESENTS PROJECT - MR. MCQUEEN STATES THEY ARE REQUESTING AN AMENDMENT TO THE PRELIMINARY PUD PART OF WHICH HAS BEEN FINALED BY THE CITY OF SEBASTIAN. A MOTION TO EXTEND THE MEETING FOR ONE HOUR WAS MADE BY MR. GILCHER SECOND BY MRS KILKELLY PASSED UNANIMOUSLY. PUBLIC HEARING ON THIS MATTER WAS OPENED AT 6:57 P.M. ED MELANEY PRESIDENT OF THE SEBASTIAN LAKES PROPERTY OWNERS ASSOC SPOKE IN FAVOR OF THE LIBRARY SITE BUT STATED THE PROPERTY OWNERS WERE CONCERNED WITH COR ZONING ONLY THEY STATED THIS REQUEST WAS NOT PARTICULARLY A PROBLEM TO THEM BUT QUESTIONED WHETHER OR NOT ADDITIONAL REQUESTS WOULD BE MADE FOR MORE COMMERCIAL LAND LATER ON. /00�,N DARRELL MCQUEEN STATES THAT BY APPROVING THE CHANGE THE DENSITY WILL DECREASE TO 304 UNITS FROM 405 UNITS. BROOKS BRIERLY-VICE PRESIDENT SPEAKS HE STATES HE MET WITH THE HOME OWNERS ASSOCIATION LAST NIGHT AND TOLD THEM WHAT THEY WERE REQUESTING FROM THE COMMISSION. TOMMIE THOMPSON RESIDENT OF 125 MAIN STREET SPEAKS ON THE PROJECT MR. THOMPSON ASKS HOW THEY MEET 20A4.5 B ATTORNEY KRUZCAMP STATES THEY QUALIFY UNDER THE UNDERLYING ZONING PART AND NOT THE SQUARE FOOT RATIO. MR. THOMPSON ASKS WHAT THE UNDERLYING ZONING WAS. 15.87 ACRES OF COMMERCIAL C-1 WAS THE ANSWER THEY NOW HAVE 10 ACRES OF COMMERCIAL AND EIGHT ACRES OF COR REQUESTING THE COR TO BE CHANGED TO CG MR. THOMPSON ASKS WHAT HAS HAPPENED TO THE 512 AND 505 INTERSECTION REFERENCE TO BUYING A PIECE OF LAND ON THE NORTH SIDE AND MAKING THE INTERSECTION SQUARE ACROSS ALSO QUESTIONS WHETHER THE COUNTY APPROVES OF THE NEW 505 DESIGN. MR. THOMPSON IS ADVISED THAT THE COUNTY HAS APPROVED THE DESIGN AND THAT THE OTHER OPTION WAS DROPPED. MR. GILCHER SECOND BY MRS. KILKELLY PASSED UNANIMOUSLY. FIFTEEN MINUTE RECESS CALLED AT 8:00 P.M. MRBTING RESUMED AT 8:15 ALL PRESENT MR. WADSWORTH QUESTIONS THE ENTRANCES AND EXITS ON 512 ALSO,HE STATES THAT THE SEWER PLANT IS NOT LOCATED WHERE THE ORIGINAL DRAWING INDICATED IT WOULD BE. MR. MCQUEEN STATED THAT THE SEWER PLAT LOCATION WAS PART OF THE APPROVED FINAL PLAT FOR THE PORTION THAT WAS COMPLETED AND HAD BEEN APPROVED BY THE CITY COUNCIL. MR. NAHONEY QUESTIONS THE LEGALITIES OF CHANGING A PRELiNINARY PUD AND THAT H~ FEEI~ THE COIO~/RCIAL AR~A SHOULD ONLY BE LIMITED COMMERCIAL AND NOT CG AT ALL. HE ALSO INDICATED THAT HE HAD PROBLEMS WITH PHASING AND THAT THIS PROJECT SHOULD HAVE BEEN ALMOST FULLY COMPLETED BY NOW. THE PUBLIC HEARING WAS CLOSED AT 9:14 P.M. THE ATTORNEY ADVISES THE BOARD HOW NANY ACTIONS WILL BE REQUIRED TO SATISFY ALL THE REQUESTS OF THE APPLICANT. MR. WADSWORTH FEELS THERE ARE TOO MANY PROBLEMS LEFT UNANSWERED AND NO DECISION SHOULD BE MADE TONIGHT BRUCE EXPLAINS THE WINDOW PERIOD TO THE BOARD AND STATES HE NEEDS ALL THE APPLICATIONS TO GO TO COUNCIL AT THE SAME TIN]E A MOTION THAT A SPECIAL MEETING ON 10-6 TO COMPLETE THIS MRETING AGENDA WAS NADE BY MR. FULLERTON MOTION WITHDRAWN AFTER BRUCE INDICATED HE NEEDED TO GET THIS TO COUNCIL BY FRIDAY MORNING OF NEXT WEEK. A MOTION FOR A 15 SIN TIMR EXTENSION FOR COMP DISCUSSION WAS MADE BY MRS. KILKELLY SECOND BY MR. GILCHER PASSED UNANIMOUSLY. BRUCE COOPER INDICATED THAT IF THE COKI(ISSION WANTED MORE TIFFS HE COULD ALLOW CONTINUANCE AT A SPECIAL MRETING ON OCTOBER 6TH, 1988 SINCE THERE WAS NO ANNEXATION REQUEST INVOLVED AND THAT WAS WHERE THE 30 DAY TIMR LIMIT CAN INTO PLAY A MOTION TO TABLE ACTION TILL OCTOBER 6TH AT A SPECIAL MEETING BEFORE THE REGULAR MEETING WAS MADE BY MR.
