NOVEMBER 2, 1989
CHAIRMAN CALLED THE MEETING TO ORDER AT 7:00 P.M.
PRESENT; MRS. TAYLOR, MR. THOMPSON, ALTERNATE, MR. MAHONEY,
MR. WADSWORTH, MR. KRULIKOWSKI, MRS. KILKELLY, MR. GILCHER
ABSENT; MR. FULLERTON, EXCUSED
ALSO PRESENT; PETER JONES, DAVID FISHER, LINDA KINCHEN
ANNOUNCEMENTS; THE ANNEXATION COMMITTEE MET LAST TUESDAY AND
WILL BE MAKING A RECOMMENDATION TO THE CITY COUNCIL
MINUTES 10-19-89: ON PAGE ONE SECOND TO THE LAST PARAGRAPH;
THERE IS NO ADDITION FROM THE TAPE FOR THE MINUTES OF 10-5-89
SO THE MINUTES REMAIN THE SAME.
A MOTION TO APPROVE THE MINUTES WAS MADE BY MR. THOMPSON
SECOND MRS. TAYLOR PASSED UNANI~IOUSLY.
MR. THOMPSON IS VOTING IN MR. FULLERTON'S ABSENCE THIS
EVENING.
HOME OCCUPATIONAL LICENSE - WILLIAM BEPLER JR. 617 FISCHER
HAMMOCK ROAD SEBASTIAN - PRESSURE CLEANING
MR. BEPLER STATES HE HAS NO EMPLOYEES AND NO STORAGE WILL BE
AT THE HOUSE. HE STATES HE IS LOOKING ONLY FOR A TELEPHONE
SERVICE WILL BE MOVING THE BUSINESS TO COMMERCIAL OFFICE
SPACE WHEN AVAILABLE THROUGH THE FISCHER'S - SINCE HE WAS
NOTIFIED BY THEM THAT DEED RESTRICTIONS PREVENT HIM FROM
HAVING A BUSINESS FROM HiS HOME.
MR. WADSWORTH STATES THAT PREVIOUSLY THE ATTORNEY HAS ADVISED
THEM THAT LEGALLY THE LICENSE CANNOT BE DENIED EVEN THOUGH
THERE ARE DEED RESTRICTIONS OR COMPLAINTS IF THE APPLICANT
COMPLIES WITH THE CODE REQUIREMENTS.

IT WAS STATED THAT TWO LICENSES ARE REQUIRED ONE FOR THE
CLOTHING BUSINESS AND ONE FOR THE TILE BUSINESS.
SHE STATES THAT CLOTHING IS DELIVERED ONCE A YEAR BY FREIGHT
AND KEPT AT THE HOUSE - SHE TAKES DELIVERIES TO 3 D OFFICE
FOR UPS PICKUPS. THIS BUSINESS ONLY OPERATES FROM JULY
THROUGH FEBRUARY. SHE HAS NO EMPLOYEES AND NO TILE STORAGE AT
THE HOUSE FOR HER OTHER BUSINESS.

MADE BY MR. WADSWORTH SECOND BY MR. THOMPSON FOR DISCUSSION
UNDER DISCUSSION iIR. THOMPSON REQUESTS THAT THE MOTION
INCLUDE THAT THEY ARB APPROVING A RETAIL TILE BUSINESS AND A
NAIL ORDER CLOTHING BUSINESS MR. WADSWORTH AGREES - PASSES

FA~. SMITH STATES HE HAS A TRAILER THAT HE USES TO TRANSPORT
HIS LAWN MOWER IN IT IS 4 X 5 IN SIZE NO EMPLOYEES ONLY DOES
IT TO KEEP BUSY
MR. THOMPSON STATES HE VISITED THE SITE AND THE TRAILER IS
SMALL AND KEPT BEHIND THE HOUSE.

A MOTION TO APPROVE THE LICENSE WAS MADE BY MR. WADSWORTH
SECOND BY MR. THOMPSON PASSED 4-3 WITH MR. GILCHER, MRS.
TAYLOR AND MR. THOMPSON VOTING NO.
MODEL HOME PERMIT SOUTHERN HERITAGE 1437 BARBER STREET
AL FRIEND IS PRESENT STATES THE HOUSE IS BUILT AND
WAITING TO BE USED FOR A MODEL HOME.

SITE PLAN CALVARY BAPTIST CHURCH - REV JAMES BAKER
REV BAKER CONFIRMS THAT THE REAR STREET AS SHOWN ON THE MAP
IS A PAPER STREET AND DOES NOT EXIST AT THIS TIME.

BAKER STATES BRUCE COOPER TOLD HIM IT REQUIRED A MINOR SITE
PLAN AND AN ENGINEER. MRS. KiLKELLY QUESTIONS THE ZONING ON
THIS PARCEL AND PETER 3ONES ADVISES HER TO CONSIDER IT PS.
A MOTION TO APPROVE THE SITE PLAN FOR THE CALVARY BAPTIST
CHURCH WAS MADE BY MR, WADSWORTH SECOND BY MRS TAYLOR UNDER
DISCUSSION iT WAS SUGGESTED THAT A RECOMMENDATION TO CITY
COUNCIL BE MADE TO WAIVE THE FEE FOR THIS SITE PLAN.
MOTION PASSES UNANIMOUSLY.
SITE PLAN - BOONE PROPERTY PARKING AREA. CITY OF SEBASTIAN
A MOTION TO APPROVE THE SITE PLAN AS SUBMITTED FOR THE
STREET AND INDIAN RIVER DRIVE PARKING LOT KNOWN AS THE BOONE
PROPERTY WITH THE CONDITIONS OUTLINED IN THE 10-26-89 TRC
LETTER AND THAT WE DO APPROVE THE USE OF POROUS PARKING WAS
MADE BY MR. THOMPSON, SECOND MR. WADSWORTH
MR. WADSWORTH ASKS IF THE MOTION CAN INCLUDE THE REQUIREMENT
OF A SPRINKLER SYSTEM FOR THE PROJECT AND MR. THOlfPSON STATES
HE PREFERS IT BE AN AMENDMENT TO HIS MOTION
MR. WADSWORTH MADE AN AMENDMENT TO THE MAIN MOTION THAT A
SPRINKLER SYSTEM OF SOME TYPE BE REQUIRED SECOND BY MR,
MAHONEY - PASSED UNANIMOUSLY
ROLL CALL ON THE MAIN MOTION WAS UNANIMOUS
MIR. THOMPSON MOTIONS THAT NON POROUS SHOULD BE USED ON THE
ENTRANCE AND EXIT DRIVES OUTSIDE OF THE PROPERTY LINES
SECOND BY MR. WADSWORTH PASSED UNANIMOUSLY.

HOME OCCUPATIONAL LICENSE DISCUSSION
MRS. TAYLOR STATES SHE IS STILL IN FAVOR OF DELETING THEM
ALL.
MR. WADSWORTH ASKS IF THIS ITEM COULD BE TABLED TO THE
WORKSHOP OF 11-7-89.
~R. GiLCHER OBJECTS STATES THERE IS TIME TONIGHT TO START THE
DISCUSSION.
MR, THOMPSON COMPLEMENTS ED ON HIS PROPOSAL - MR. THOMPSON IS
NOT IN FAVOR OF ELIMINATING THEM ALL. AND STATES WE SHOULD
LEAVE THE ORDINANCE AS IS.

MRS. TAYLOR STATES A LOT OF PEOPLE HAVE COMPLAINED TO I~R,
COOPER AND HE DID NOT DO ANYTHING ABOUT IT.
MR. MAHONEY STATES LIMITING THE TYPES OF BUSINESSES MIGHT BE
THE ONLY WAY TO GO,
MR, WADSWORTH STATES A LOT OF PEOPLE WILL NOT COMPLAIN
ABOUT THEIR NEIGHBORS AND FEELS iF THE BUSINESS CANNOT BE
SEEN FROM THE OUTSIDE THATS FINE.
MRS. KILKELLY STATES A LOT OF PEOPLE NEED HOME OCCUPATIONAL
LICENSES AND SHOULD NOT BE DENIED BECAUSE OF A FEW VIOLATORS,
MR. GILCHER THANKS THE KEMBERS FOR THE COI~fMENTS REGARDING HIS
PROPOSAL AND GIVES MORE INFORMATION REGARDING POSSIBLE
CHANGES.
A REQUEST TO GET THE HOME OCCUPATIONAL LICENSE FROM PALM BAY
WAS MADE BECAUSE THE ATTORNEY MENTIONED AT THE COUNCIL
WORKSHOP IT MIGHT BE HELPFUL. N/~. KRULIKOWSKI STATES HE FEELS
MORE STRONGLY NOW ABOUT ELIMINATION AFTER TONIGHTS COMMENTS
BECAUSE IF NOT HE IS SURE THAT FIVE YEARS FROM NOW WE WILL
AGAIN BE ADDRESSING THIS SITUATION.
IT WAS DECIDED THIS WOULD BE THE SECOND ITEM FOR THE NOVEMBER
7, 1989 MEETING, FOR FURTHER DISCUSSION.
SEBASTIAN WATERFRONT DISTRICT
PETER JONES SPEAKS ON THE PAPER HE PREPARED
STEVE LULICH REQUESTS PERMISSION TO ADDRESS THE COMMISSION ON
THIS MATTER.
HE STATES HE WOULD LIKE TO SEE THE NEW DISTRICT INCLUDE SOME
TYPE OF BONUS SYSTEM FOR DEVELOPERS FOR DOING SOMETHING NICE
AND ALSO THAT ALTERNATE ARCHITECTURAL NDTIFS BE ESTABLISHED
FOR THE DISTRICT.
IT WAS DECIDED THAT PETER HAD DONE AN EXCELLENT JOB ON THE
PAPER HE PRESENTED THE FOLLOWING MOTION WAS MADE.
A MOTION THAT CITY STAFF RESPOND TO N_R. JONES MEMO OF 10-25-
89 TO MOVE FORWARD AND TAKE WHATEVER STEPS ARE NECESSARY TO
START IMPLEMENTATION MADE BY MR, GILCHER SECOND N_RS.

A MOTION THAT WE ENDORSE THE DRAFT WORK PROGRAM FOR THE
SEBASTIAN WATER DISTRICT AS PREPARED BY MR. JONES AND SEND IT
TO CiTY COUNCIL WITH THE RECOMlfENDATION THAT THEY REQUEST
STAFF TO CONTINUE WITH THE PROGRAM AND CARRY ON TO GET THE
PROJECT IMPLEMENTED EXPEDITIOUSLY WAS MADE BY MR. THOMPSON
SECOND BY MR, WADSWORTH PASSED UNANIMOUSLY.
