MR. LOWE QUESTIONS WHEN IT WAS CHANGED AND WHERE DOES IT STATE THE CHANGES? MR. COOPER INFORMS MR. LOWE IT IS AT THE CITY CLERK'S OFFICE. THE CITY ATTORNEY HAS OPINED THAT SINCE A TRAILER IS A VEHICLE, IT IS PERMISSIBLE TO PARK THAT WITHIN THE GARAGE AND IT MEETS THE REQUIREMENTS OF SCREENING. THERE IS NOWHERE IN THE CODE THAT STATES THAT, BUT IT IS THE CITY ATTORNEY'S OPINION. THE AMENDED CODE HAS NOT BEEN GIVEN TO THE CITY IN A DISTRIBUTABLE FORM YET. MRS. LOWE (HANDICAPPED) REFERS TO THE PICTURES AGAIN, POINTING OUT HOW THE CONGESTION OF EQUIPMENT/TRAILERS/TRAFFIC AT MR. LAVENDER'S HOUSE MAKES IT VERY HARD FOR ANYONE TO ACCESS THE WALK WAY. MR. LAVENDER CONSTANTLY HAS FRIENDS WITH THEIR EQUIPMENT STOPPING OVER, TOO, PARKING IN THE VACANT LOT AND BIKE PATH/SIDEWALK. MR. GOLDSTEIN ASKS WHAT DAY THE PICTURES WERE TAKEN? MRS. LOWE DID NOT HAVE AN EXACT DATE BUT GUESSES SOMEDAY DURING THE PREVIOUS WEEK. eo*l MR. COOPER STATES FRIENDS STOPPING BY WITH THEIR TRAILERS DOES NOT CONCERN THE HOME OCCUPATIONAL LICENSE, BUT THEIR PARKING ON THE SWALE AREA WITH THE TRAILERS IS AGAINST CITY CODE, AND ASKS MR. LAVENDER TO HAVE THEM NOT BRING THEIR TRAILERS BY WHEN VISITING. CHMN. THOMPSON GIVES HIS CONCERNS, AFTER LOOKING AT THE PICTURES, OF THE PARKING ON THE SIDEWALK. SHROYER NOTES MR. LOWE 'S LETTER MENTIONS MR. LAVENDER STARTING HIS MOWERS IN THE GARAGE AND MAINTAINING THEM. MR. COOPER STATES THIS IS AGAINST THE HOME OCC. CODE, AND THE MOWERS MUST ONLY BE MOVED IN AND OUT OF THE GARAGE ON THE TRAILER. MR. GOLDSTEIN ASKS MR. LAVENDER HOW MANY MOWERS HE OWNS? MR. LAVENDER STATES TWO — ONE IS A MULCHING MOWER AND ONE IS FOR BAGGING THE GRASS CLIPPINGS. MR. GOLDSTEIN ASKS MR. MR. COOPER STATES SINCE THEY PERMITTED COMMERCIAL TRAILERS UP TO 14 FEET, IT WOULD BE ASSUMED A NUMBER OF VEHICLES WOULD BE ALLOWED NOT NORMAL TO YOUR AVERAGE GARAGE. MR. FALKE VOICES CONCERN ABOUT BLOCKING BARBER STREET WHILE TRYING TO BACK INTO THE GARAGE. MR. LAVENDER STATES HE HAS NO PROBLEM WITH THAT. MR. THE MEMBERS WERE GIVEN A FLOOR PLAN OF UCTURE. DSTEIN INQUIRES WHAT THE STRUCTURE IS USED FOR? PER STATES STRICTLY FOR STORAGE OF VARIOUS ITEMS THAT THE 'LANS TO DO - CARS, RECREATIONAL VEHICLES, ETC. HE HAS ED IT IS NOT FOR A HOME BUSINESS. PER ALSO NOTES THAT THERE IS NOT ANYTHING 'IN THE CODE THAT S A SIMILAR STRUCTURE BECOMING LARGER AND MAKING IT A FAMILY RESIDENCE. THERE IS NOTHING IN THE CODE THAT SAYS NOT HAVE A METAL BUILbING FOR A RESIDENCE PROVIDED IT MEETS NDARD BUILDING CODE, SET BACKS, AND HEIGHT REQUIREMENTS. ~ENUE OF ACCESSORY STRUCTURES SHOULD BE LOOKED AT. NUMBER M SHOULD BE METAL STRUCTURES. WHAT SHOULD BE DONE IS A N SQUARE FOOTAGE AND HEIGHT RESTRICTIONS. TWO ITEM SHOULD ADDRESS ATTACHED STRUCTURES VS. DETACHED RES; GARAGE AND ACCESSORY STRUCTURES. HEIGHT RESTRICTIONS E TYPES OF BUILDINGS WILL ALSO BE ADDRESSING THE ISSUE OF ~ MOTOR HOMES/RECREATIONAL VEHICLES TO BE STORE.D ON OWNERS IES. THE ORDINANCE NOWFOR ACCESSORY STRUCTURES STATES IT BEHIND THE FRONT BUILDING LINE, CANNOT EXCEED 75% OF THE VING AREA, AND CANNOT BE HIGHER THAN THE MAIN STRUCTURE. :IEST WAS TO LIMIT ACCESSORY STRUCTURE CONFORMITY iS TO ~ THE MAXIMUM CEILING HEIGHT WHETHER ATTACHED OR DETACHED. IT IS ~P TO THE BOARD AND CITY COUNCIL IF THEY WANT TO BE THAT RESTRIC'-~IVE. iF THE ~OARD DOESN'T WANT TO BE THAT RESTRICTIVE, OTHER ASPECTS CAN BE LIMITED. A TYPICAL HOUSE PLAN MAY HAVE THE GARAGE PROTRUDING IN FRONT ~F THE MAIN HOUSE IN A L-SHAPED PLAN. IF AN ATTACHED STRUCTURE EXCEEDS A CERTAIN SQ. FOOTAGE/CEILING HEIGHT THEN IT SHOULD tBE ARCHITECTURALLY DESIGNED SO IT DOESN'T APPEAR .TO BE A SORE THUMB. THE BOARD COULD ALSO COME UP WITH STRAiGHT"STANDARDS. /oolh PLANNING AND ZONING COMMISSION PAGE NINE /om*) REGULAR MEETING OF NOVEMBER 3, 1994 METAL BUILDINGS CAN BE CONTROLLED BASED ON SIZE TO STILL ALLOW STORAGE SHEDS. A SURVEY BASED ON TYPICAL SIZES OF COMMERCIAL SHEDS COULD BE USED. MR. SHROYER FEELS IT IS INFRINGING ON A HOME OWNER'S RIGHTS TO SAY HE CAN'T BUILD A STRUCTURE TO STORE A MOTOR HOME IN IT. HE ASKS TO SEE THE VIDEO AGAIN. HE IS CONCERNED WITH THE PITCH OF THE ROOF AND SUGGESTS THAT IS ONE ITEM THAT CAN BE REGULATED IN COMPARISON WITH THE ROOF PITCH OF THE MAIN BUILDING. MR. COOPER STATES HE WOULD STILL BE CONCERNED THAT THERE ARE GOING TO BE PEOPLE THAT WILL MEET THAT REQUIREMENT BUT STILL LET THEIR BUILDING LOOK LIKE THE ONE AT 1421 THORNHILL. MR. SHROYER ALSO FEELS THE ACCESSORY STRUCTURE SHOULD HAVE THE SAME GENERAL APPEARANCE AS THE MAIN STRUCTURE. HE ASKS IF THE STRUCTURE AT 1421 THORNHILL WAS ATTACHED? MR. COOPER STATES YES, BY A BREEZEWAY. HE WANTS THE BOARD TO REVIEW THE MEANING OF ATTACHED VS. DETACHED, AND SHOULD THERE BE DIFFERENT CRITERIA FOR THE TWO? 14011\ MR. FALKE STATES THAT HE IS A REC. VEHICLE OWNER AND FEELS LUCKY SEBASTIAN ALLOWS RV'S ON OWNERS PROPERTY, AS SOME CITIES DON'T. HE FEELS RV'S ARE MADE TO BE OUTSIDE AND DOESN'T FEEL A STRUCTURE IS NEEDED TO STORE AN RV. MR. SHROYER SUGGESTS EVERY BOARD MEMBER SHOULD WRITE OUT WHAT THEY WANT TO SEE SINCE THERE IS SO MUCH TO COVER. MR. COOPER AGREES THAT THE COMMISSION SHOULD SUBMIT TO STAFF THEIR COMMENTS ON WHAT IS PERTINENT AND THEN STAFF WILL TRY TO CORRELATE THAT INFORMATION AND COME UP WITH A CONSENSUS ON CRITERIA. WE NEED TO FORMULATE A CATCH—ALL FOR FUTURE BUILDING SITUATIONS. MR GOLDSTEIN WOULD LIKE STAFF TO ASK THE CITY ATTORNEY HOW ENFORCEABLE THE COMMISSION ACTING AS THE AESTHETIC REVIEW BOARD WOULD BE. WOULD THAT BE CHALLENGEABLE? MR. SCHULKE REVIEWS THAT THE BUILDING AT 1421 THORNHILL WAS ALLOWED BECAUSE IT WAS CONSIDERED ATTACHED BECAUSE OF THE BREEZEWAY. HE SUGGESTS A WAY TO IDENTIFY ATTACHED IS TO SHARE A COMMON WALL WITH THE MAIN STRUCTURE. MR. COOPER WILL BE REQUESTING THROUGH THE LEAGUE OF CITIES MORE IDEAS FOR ORDINANCES REGARDING ACCESSORY STRUCTURES. CHMN. THOMPSON FEELS SECTION 20A-5.7 SHOULD STAY AS IS RELATED TO eo*1 ATTACHED STRUCTURES. IT STATES THE ACCESSORY STRUCTURE SHALL NOT EXCEED THE HEIGHT OF THE PRINCIPAL STRUCTURE. ALSO SQ. FOOTAGE W PLANNING AND ZONING COMMISSION PAGE TEN REGULAR MEETING OF NOVEMBER 3, 1994 SHOULD NOT BE MORE THAN 75% OF THE MAIN BUILDING. DISCUSSION WILL BE CONTINUED AT A FUTURE MEETING. PLANTING IN THE RIGHT—OF—WAY MR. COOPER REVIEWS THAT WHEN THE BOARD FIRST STARTED DISCUSSING PLANTINGS IN THE ROW, IT WAS FLOWERS AROUND THE MAILBOXES AND VARIOUS SMALL, LOW LYING PLANTS. THE PREVIOUS CITY ENGINEER SUGGESTED THE UNIMPROVED ROW, USUALLY A 15 FOOT AREA ON MOST LOCAL STREETS, CONTAINING A DRAINAGE SWALE SHOULD JUST HAVE SOD. MAINTENANCE IS UP TO THE PROPERTY OWNER AND PLANTINGS BECOME A PROBLEM IF THEY DON'T MAINTAIN THEM PROPERLY. THERE WILL BE CONCERNS OF ALLOWING MULCH THEN. THE ENGINEER SUGGESTED ONLY ALLOWING SOD, SPRINKLER SYSTEMS, MAIL BOXES, AND NEWSPAPER RECEPTACLES. LANDSCAPING IS PLEASING TO SEE, BUT ON THE OTHER HAND, DRAINAGE MAINTENANCE IS IMPORTANT. MR. COOPER WANTS TO SEE WHAT KIND OF CONSENSUS THE BOARD HAS. CHMN. THOMPSON ASKS THE BOARD MEMBERS. MR. FISCHER GIVES HIS APPROVAL FOR PLANTING IN THE ROW. MR. FALKE FEELS THE CITY DOES A POOR JOB MAINTAINING THE SWALE IN THE ROW ON VACANT LOTS AND IMPROVED LOTS. HE APPROVES PLANTINGS AS 14 LONG AS THE OWNER KNOWS IF THEY BECOME A NUISANCE FOR DRAINAGE MAINTENANCE THE PLANTINGS CAN BE REMOVED BY THE CITY. MR. BARNES IS ALSO IN FAVOR. MR. GOLDSTEIN STATES NO. — ONLY AROUND THE MAILBOX. MR. SHROYER ALSO STATES NO. — AND ALSO ONLY AROUND THE MAILBOX. MR. MUNSART INQUIRES IF THIS INCORPORATES THE SIZE OF THE MAILBOX, AS PREVIOUSLY DISCUSSED. MR. COOPER STATES YES, HE WOULD LIKE TO SEE THIS DONE AT THIS TIME IF IT IS GOING TO AMENDED ALSO. MR. MUNSART STATES HE WOULD ALLOW PLANTING AROUND THE MAILBOX BUT OTHERWISE NOWHERE ELSE. MR. SCHULKE STATES NO, EXCEPT AROUND THE MAILBOX. MRS. BRANTMEYER STATES NO. SHE FEELS THE ORDINANCE SHOULD HAVE NO CHANGES MADE TO IT, NO PLANTINGS ALLOWED. CHMN. THOMPSON THINKS 12 INCHES AROUND THE MAILBOX IS OK. HE COMPLIMENTS CAPTAIN HIRAM'S LANDSCAPING, EVEN THOUGH THE CITY DOESN'T HAVE TO MAINTAIN THOSE ROW'S. HE FEELS THE REPORT FROM THE PREVIOUS ENGINEER IS NOT VALID, BEING THE CITY DOESN'T DO A GOOD JOB WITH UPKEEPING THE ROW'S ANYWAYS. MR. COOPER STATES THERE IS A CONSENSUS OF ALLOWING PLANTING AROUND THE MAILBOXES WITH A 2 FOOT PERIMETER. 3 MEMBERS WANTED TO ALLOW lo'1 PLANTING IN ALL OF THE ROW. PLANNING AND ZONING .COMMISSION REGULAR MEEtiNG OF NOVEMBER 3,. 19~{ MR, SHROYER NOTES THAT A 2 FOOT PERIMETER IS LARGE ENOUGH TO BE RUN OVER BY A MAIL DELIVERY VEHICLE OR NEWSPAPER TRUCK AND SUGGESTS MAKING IT 12 INCHES. MR. FALKE SUGGESTS ALLOWING PLANTING iN THE HOUSE SIDE OF THE SWALE. MR. SCHULKE NOTES THAT SOME RESIDENTS ON SOME STREETS HAVE THE MAILBOXES ALL ON ONE SIDE OF THE STREET. MR. MUNSART QUESTIONS WHAT ARE THE ORDINANCES/REGULATIONS REGARDING PARKING ON THE SWALE? MR. COOPER STATES THERE ARE NONE AT THIS TIME. FINAL CONSENSUS OF THE BOARD IS 7 MEMBERS ARE FOR PLANTIN~ AROUND THE MAILBOXES ONLY, ~ 2 MEMBERS FOR PLANTINGANYWHERE IN THE ROW. ,,CHAXRMAHMATTERS3 CHMN. THOMPSON INQUIRES ABOUT RESOLUTION R-94-58, QUASI-JUDICIAL HEARINGS. MR. COOPER STATES PLANNiNGAND ZONING SHOULD ADAPT THE FORMAT OF R- 94-58 FOR THEIR USE UNTIL THE CITY ATTORNEY IS FINISHED'WITH THE RESOLUTION FOR P & Z. SITE PLANS AND CONDITIONAL USE PERMITS ARE THE AUTHORATIVE iSSUES THAT CONCERN PLANNING AND ZONING. MR. GOLDSTEIN SUGGESTS P & Z ADOPT R-94-58 FOR THEIR OWN USE INSTEAD OF WAITING FOR A NEW RESOLUTION. MR. COOPER AGREES. THE RESOLUTION WILL BE RE-DEFINED FOR P & Z AND PUT ON THE AGENDA OF THE NEXT MEETING FOR THE BOARD'S APPROVAL. MEMBERS MATTERS~ MR. GOLDSTEIN ASKS IF HE MAY ROUTE SOME QUESTIONS REGARDING THE RIVERFRONT DEVELOPMENT TO THE CITY .ATTORNEY THROUGH THE COMMUNITY DEVELOPMENT DEPARTMENT? MR. COOPER STATES YES. MR. GOLDSTEIN THEN ASKS TO PUT A RIVERFRONT DISCUSSION ON THE NEXT AGENDA. MR. SHROYER ASKS FOR COPIES OF THE "VISIONS OF RIVERFRONT" DOCUMENT AND OTHER PREVIOUS PERTINENT DOCUMENTS TO BE AVAILABLE FOR THE MEMBERS FOR THAT DISCUSSION. REGULA~ MR. MUM HAD WI'. INQUIR~ MR.
