THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, WILL HOLD A REGULAR MEETING ON THURSDAY, NOVEMBER 4th, 1993 AT ?:00 P.M. IN THE CITY COUNCIL CHAMBERS, 1225 MAIN STREET, SEBASTIAN, FLORIDA. PLANNING AND ZONING REGULAR MEETING MINUTES NOVEMBER 4TH, 1993 CHAIRMAN OPENED THE MEETING AT 7:00 P.M. PRESENT: MR. BARNES, MR. SHROYER, MR. THOMPSON, MR. FALKE, MR. MUNSART, MR. SCHULKE, MR. FISCHER, MR. FIRTION, MR. GOLDSTEIN ABSENT': NONE ALSO PRESENT: LINDA KINCHEN, BRUCE COOPER ANNOUNCEMENTS: CHAIRMAN ANNOUNCES HE APPROVED A MINOR MODIFICATION FOR A SHED FOR THE ELKS CLUB. MR. SHROYER RECOMMENDS MOVING OLD BUSINESS DOWN AFTER NEW BUSINESS, SECRETARY ANNOUNCES CUSTOM HOMES HAS REQUESTED A POSTPONEMENT TO THE NEXT MEETING AND CHAIRMAN ANNOUNCES AT THE MEETING ON THE 18TH OF NOVEMBER A VICE CHAIRMAN WILL BE ELECTED. APPROVE MINUTES: OCTOBER 7TH, 1993 - A MOTION TO APPROVE AS SUBMITTED BY MR. BARNES SECOND MR. FALKE UNDER DISCUSSION MR. GOLDSTEIN CORRECTS A SPELLING ERROR. PASSED UNANIMOUSLY. I5 LETTERS NO RESPONSE STAFF HAS NO OBJECTIONS PUBLIC HEARING CLOSED 7:25 P.M. A MOTION TO APPROVE THE MODEL HOME RENEWAL FOR MGB WAS MADE BY MR. FISCHER SECOND MR. FIRTION PASSED UNANIMOUSLY. MODEL HOME PERMIT SUNSHINE QUALITY CONSTRUCTION 1082 BARBER STREET NO APPLICANT BRUCE STATES HAVE TOLD THE CONTRACTOR TO REDO THE PARKING LOT MR. SHROYER FEELS SHOULD BE ON HOLD TILL RENOVATIONS ARE DONE AND BROUGHT UP TO CODE MR. SHROYER SO MOVES SECOND MR. BARNES PASSED UNANIMOUSLY. A MOTION TO LAY ON THE TABLE THE PREVIOUS MOTION MADE BY MR. GOLDSTEIN SECOND MR. FISCHER PASSED UNANIMOUSLY. STAFF EXPLAINS THAT HE THOUGHT THEY WERE DISCUSSING CUSTOM HOMES THEY ARE THE ONE WITH THE PARKING PROBLEM AND THERE IS NOTHING WRONG WITH THE SUNSHINE MODEL. A MOTION TOAPPROVE THE MODEL HOME PERMIT RENEWAL FOR SUNSHINE ON LOT 3 BLOCK 207 UNIT 8 WAS MADE BY MR. FISCHER SECOND MR. SHROYER PASSED UNANIMOUSLY. RECESS CALLED AT 7:35 P.M. BACK AT 7:50 P.M, ALL PRESENT OLD BUSINESS: RIGHT OW WAY DISCUSSION - LOW FLOWERS ANDSHRUBS IN THE R.O.W. NEED TO BE DISCUSSED. BRUCE STATES CITY ENGINEER PREFERS NOT TO SEE ANY BECAUSE OF DRAINAGE iF SO THE HOME OWNER PLANTS AT OWN RiSK AND CANBE REMOVED AT ANY TIME UPON REQUEST. PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES NOVEMEBER 4TH, 1993 PAGE THREE FISCHER AND FALKE ARE IN FAVOR OF PLANTINGS AS LONG ASTHEY ARE KEPT OUT OF THE SWALE AND VIEW ATCORNERS. MR. GOLDSTEIN AGREES WITH BOTH OF THEM BUT ASKS IF THE CITY WOULD BE REQUIRED TO BEAR THE COST OF REMOVAL IF NECESSARY BRUCE STATES NO WOULD BE AT THE OWNERS EXPENSE. MRS. DAMP ASKS TO SPEAK FROM THE AUDIENCE STATES SHE HAS SEEN HOUSES WHERE THE PEOPLE DON'T MOW THE GRASS IN THE SWALE BECAUSE IT BELONGS TO THE CITY AND THIS MAKES THE AREAS LOOK BAD. BRUCE STATES MOST PEOPLE WILL TAKE CARE OF THAT AREA IF THEY HAVE A HOUSE ON THE PROPERTY BECAUSE THEY DO NOT WANT A TRACTOR IN THEIR FRONT YARD. MAJORITY RULES IN FAVOR OF SOME PLANTINGS BEING ALLOWED - BRUCE TO BRING BACK THE ORDINANCE CHANGE. CHAIRMANS MATTERS: NONE MEMBERS MATTERS: MR. SHROYER ASKS ABOUT THE NUISANCE ORDINANCE BRUCE STATES WILL DISCUSS UNDER HiS MATTERS. MR. FIRTION ASKS WHEN WE ARE GOING TO START ON THE PRIORITY LIST - BRUCE RECOMMENDS THE FIRST MEETING IN DECEMBER ARTHUR STATES HE IS INTERESTED IN THE ANNEXATION STUDY AND FEELS IT SHOULD BE TOP PRiORiTY. BRUCE FEELS THE SAME. MR. GOLDSTEIN ASKS CAN WE OR SHOULD WE OFFER INCENTIVES. MR. FALKE FOR THE RECORD CLARIFIES THE PRESS JOURNAL ARTiCLE ON THE RIVERFRONT ACTION TAKEN AND STATES THE COMMISSION DID NOT RECOMMEND HIRING A CITY PLANNER. BUILDING OFFICIAL MATTERS: BRUCE TALKS REGARDING JOY STREET VEHICLES AND ASKS THE COMMISSION IF THEY WANT TO LIMIT THE NUMBER OF VEHICLES AND STATES REGISTRATION AT A MINIMUM WILL BE REQUIRED AND PERHAPS A REGULATIONABOUT LOOKING DESIRABLE TO THE NEIGHBORHOOD. MR. FIRTION SUGGESTS WE COULD ALLOW ONE PER LICENSED DRIVER AND ONE OR TWO ADDITIONAL VEHICLES ONLY. A MOTION BY MR. THOMPSON SECOND MR. BARNES TO REQUIRE REGISTRATION OF THE VEHICLES AND ONE PER LICENSED DRIVER PLUS TWO ADDITIONAL VEHICLES ONLY. MOTION PASSED SIX TO ONE WITH MR. GOLDSTEIN VOTING NO ONLY BECAUSE OF THE NUMBER LIMITATION. BRUCE STATES THERE WILL BE A SPECIAL MEETING ON WALMART ONLY ON TUESDAY NOVEMBER 30TH, 1993 AT 7:00 P.M. PLANNING AND ZONING COMMISSION REGULAR MEETINGMINUTES NOVEMBER 4TH, 1993 PAGE FOUR TOMMIE ASKS BRUCE ABOUT THE SPECIAL USE PERMIT CHANGE AND BRUCE STATES HAS GONE TO COUNCIL AND ATTORNEY IS WORKING ON MR. MUNSART ASKS ABOUT THE SIDEWALK AT CAPT HIRAM'S AND BRUCE STATES DOT IS WORKING ON IT - MR. GOLDSTEIN ASKS ABOUT THE HRS LICENSING AND BRUCE STATES STILL NO RESPONSE HE WILL SEND ANOTHER LETTER.
