1. Call To Order -- Chairwoman Carbano called the meeting to order at 6:00 p.m.
2. Pledge of Allegiance -- was recited by all.

Ms. Carbano called for additions, deletions or corrections to the Minutes.
A motion to approve the January 23, 2018 Minutes as presented was made by Mr.
Crockett, seconded by Ms. Carbano.

7. New Business
A. Request to Reinstate a Certificate of Competency:
i. In the Matter of Mr. Donald R. Heaton
Drywall Contractor: Local License No. 348
Mr. Eseltine stated the case before the Board is a request to reinstate a certificate of
competency for Mr. Donald R. Heaton, a drywall contractor, that expired on 9-30-2011.
The applicable Code Section from the City Code of Ordinances is Section 26-168 (C),
which states: "A certificate which is inoperative because of failure to renew shall be
restored on payment of the proper renewal fee. If the application for restoration is not
made before the beginning of the next fiscal year of the City, the fee for restoration shall
be double the original renewal fee, and in addition the Board may require reexamination
of the applicant. A certificate which is not renewed within three full years after
expiration may not be renewed, restored or reinstated thereafter except by reapplication
and reexamination." He stated there have been cases in the past where it has been
more than three years and the cases were brought to the Board to decide on whether
the applicants would be required to retake the examination.
Ms. Carbano asked if anyone on the Board had any questions of Mr. Eseltine.
Mr. Fortier asked if there is any continuing education required. Mr. Eseltine stated no.
Mr. Fortier asked if there were any fees or costs incurred by the Building Department
during the period of lapse of the license. Mr. Eseltine stated the Building Department
sends out renewal notices for three years, but other than that there was nothing done by
the Department.
Ms. Carbano asked for clarification of the cost for being on inactive status. Mr. Eseltine
stated $10.00 a year.
Ms. Carbano asked if anyone else on the Board had any questions of Mr. Eseltine.
There being none, Ms. Carbano called for Mr. Heaton to come forward.
Mr. Heaton gave his name and address as Donald R. Heaton, 917 Carnation Drive,
Sebastian.

Ms. Carbano asked Mr. Heaton what he has been doing since 2011. Mr. Heaton stated
he had some personal problems, and that because of the economy he had some
financial problems. As the economy picked up, he was contacted by some of his former
employees asking when he would be getting back in the business. He now wants to be
productive again, and so he is applying to renew his license.
Ms. Carbano asked for questions by the Board.
Mr. Crockett asked the applicant if he wishes to take the exam again, and Mr. Heaton
stated he would rather not. Mr. Crockett asked if Mr. Heaton is financially prepared to
pay the costs of reinstating his license, and Mr. Heaton stated yes.
Mr. Eseltine summarized the case.
Mr. Fortier asked if the procedure for charging Mr. Heaton to reinstate his license could
be adjusted to charge the full amount for the three years the Building Department had
sent out letters for renewal, and then charge $10.00 for each of the following three
years, plus $60.00 for the current year. Mr. Eseltine stated the Code of Ordinances
would not have to be changed in order to do that, and he clarified there would be three
years at $75.00, plus three years at $10.00, and the current year of $60.00 for a total of
$315.00. Mr. Heaton was agreeable.
Ms. Carbano asked if there were any further questions from the Board. There being
none, Ms. Carbano called for a motion.
MOTION: Motion as amended was made by Mr. Crockett, seconded by Mr. Fortier
that, provided Mr. Heaton pays the sum of $75.00 for three years, $10.00 for three
years, and $60.00 for the current year, for a total of $315.00, his license be reinstated.

Total vote was 3-1 in favor. Motion carries.
8. Buildino Official Matters: Status update of Ordinance 0-18-02 amending Chapter
42 of the City Code of Ordinances: Fire Prevention and Protection.

Mr. Eseltine reviewed the status of the presentation he brought to the Board in January
regarding changes to Chapter 42 of the City Code of Ordinances for Fire Prevention
and Protection. The Ordinance went before City Council on 3-14-2018 and was
approved. In essence, this amends Chapter 42 with some revisions and establishes the
City of Sebastian's Fire Marshall's Office. The Fire Marshall's Office will conduct plan
review and inspections, including annual inspections as needed. He added that after
meetings among all interested parties, it was decided that Special Events are best left
up to the Indian River County Fire Bureau to handle. Also, the City's contract with
SAFEbuilt has been approved. Mr. Crockett inquired as to when the changes would
take effect, and Mr. Eseltine stated they are already in effect.
