Fischer Mr. Schu~ke Robert Massarclli, Director of Community Development Dod Bosworth, Secretary Ann Brack, Secretary Chron. Fischer announc.~ that on Novembcr 5, 1996 he signed off on a minor modific~on for a building at 645 Fellsmerc Road to construct a fence around the dumpster area. He also noted that Bob is checking some other sites along the alleyway and them may be a few more to be done. APPROVAL OF ,MINUTES: Nolle ,OLD BUSINESS: Discussion was held on intcrprctation of Section 20A-6. I .c. 14.b,(1) regarding Home Occupational Licenses and Customers coming to the Home. Mr. Massarelli noted that he could, v/et fU~d a clear statemem in the Code in refru~nce to customers coming to a home. After much discussion, the consensus of opinion is that there should be no home where there is a Home Occupational License. Mr. Massarelli sus~ested they might set up a workshop to License issue. NEW BUSINESS: PUBLIC HEARING - MODEL HOME PERMIT RENEWAL - 932 BARBER STREET - CUSTOM HOMES David Avchon ,686 North Street, Palm Bay, was present for Custom Homos. There were 13 notices of hearing sent and we receivod no objection or non-objection letters. Staff r~port was presented by Mr. Massarelli with recomme~lation for approval for renewal of the Home Oc, cupational'permit Custom Homes for a one year period conditional upon the addition of three park~n_~ p~aees. The public hearing was opeaed at 7:15 PM. Thoro was no public.input and the hearing was closed at 7:15 PM. MOTION by Johns/Munsart I make a motion we approve rig Modol Home Permit for CUstom Homos at 932 Barber Street, subject to and providing three (3) additional parking spaces. Roll call was talom. 7 - 0 motion carried. PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - 267 COLUMBUS STREET - ANNETTE & STEVEN MACKEY - ADVERTISING Anm~ and Steven Mackey were prcsont and identified themselves. There were 12 notices of'hearing sent out. Thore were no objection or non-objection l~rs Mr. Massarelli gave a staff presentation and rec, on~n~ approval. The public hearing was opened at 7:17 PM. There was no public input and the hearing was closed at 7:17 PM. MOTION by Mathor/~Iohns I make a motion that we approve tlg Home Occupational License for Jadapts Video Billboard, 267 Columbus Street. Roll call was taken. 7 - 0 motien carried. PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - 150 PELICAN I~LAND PLACE - S. BARTON - TOPIARY/CONTAINER GARDENS Shirley Barton was pres~ and ideatified herseff. There were 14 notices of hearing sent out. We received no objection or non-objection lotters. Mr. Massarelli gave a staff presentation and recommended approval conditional upon her receipt of the Department of Agriculture License. The pubhc heating was opened at 7:20 PM. Ms. Ann Moore of 158 Pelican Island Place asked who pohces the pedestmn traffic where there are Home Occupational Licenses? Mr. Mnssamlli responded that if increased activity is noted, yon can contact the Codo Enforcement Department and it will he checked into. The public hearing was closed at 7:21 PM. MOTION by Vesia/Mun.~art I make a motion that we approve the Home Occupational License for Ms. Barton do/ng topiary container gardem at 150 Pelican Island Place. Roll call was taken.. 7 - 0 motion carried. ACCESSORY STRUCTURE REVIEW - SECTION 20A-5.? - 502 LAYPORT I)RIVE - NICHOLAS NUDO Nicholas Nudo was present and idardfied h/mself and stated that he has hved in Sebastian for six (6) years. Mr. Massamlli gave the staff preson~on and gave two reasons why this case is being brought before Planning 'and Zoning: 1. It is in excess of the 200 sq. fi. (It is 720 sq. ft.) 2. The door open/ngs are greater than 7 ft. in height. (They am 8 ft.) There was much discussion about the height of the roof on the presort home m comparison to the height of the proposed structure. MOTION by Munsart/Johns I move that we approve the application for an auxiliary building for Mr. Nicholas Nudo of 502 Layport Drive conditioned upon receiv/ng the measureme~ts for getting tho actual peak of the roof of his house measured so that the auxiliary building does not exceed it. Roll call was taken. 7 - 0 motion earned. RECOMMENDATION TO CITY COUNCiL - SPECIAL USE PERMIT - JOE GRAHAM - 1021 U.S. HIGHWAY #1 - BOAT SALES IN CG The applicant was not present and the case was dehyed till the cad of the ~. SITE PLAN REVIEW - SEBASTIAN VILLAGE - INDIAN RiVER DRIVE - RESORT/HOTEL Mr. Randy Mosby of Mosby and Associates, and Mr. Greg Burke, Arch/tect, were present, and along with Mr. Massarelli, all were sworn in by Chum. Fischer according to quasi-judicial procedure. In response to the question of ex-pane communication, Mr. Munsart, Mr. Pliska, Mrs. Vesia, Mr. Mathers and Chinn. Fischer all visited the premises. Mr. Massarelli gave the staff presmtation. Staff recommends that the exterior lighting shown on the south side oftbe building be relocated to the north side. The proposal of a fourteen (14) unit resort hotel on Indian River Drive will require a conditional use permit. Staff r~ approval of the site plan with the following conditions: 1. They obtain a conditional use perm/t for the resort/hotel 2. Handicap access must be provided, by ramps if necessary 3. Exterior lighting be relocated to the north and direct the light onto the parkln~ lot and not onto the adjacent property. Mr. Burke of Donadio and Associates, Inc. presented details of this project including materials to be used, color scheme, and handicap features. The public heating was opened at 7:50 PM. There was no public input and the hearing was closed at 7:50 PM. MOTION by Matber/Munsart I make a motion to approve Sebastian Village in comp~ce with the staff's report and site plan of Mosby and Associates dated Oct. 29, Sebastian Village existing conditions, Donadio & Associates, Architect, dated 10/31, irrigation plan, landscape plan, sheets 1 through 5, seven (7) architectural sheets with no numbers, dated August 26, 1996. Going back to sheets 1 through $ plan of Mosby & Associates, existing conditions, sheet two (2) site plan, sheet three (3) paving and drainage site details, sh~ four (4), force main details and specifications, sheet five (5), private pump station details. Roll call was taken. 7 - 0 motion carded. SITE PLAN REVIEW - SKYDIVE SEBASTIAN - 400 W. AIRPORT DRIVE - MAJOR MODIFICATION - OFFICE MODULAR Mr. Randy Mosby of Mosby & Associates was previously sworn in according to quasi-judicial procedures. There were no ex-pane commu cations. Mr. Massarelh gave the staff presentation. Staff ~ approval with the modification of the site plan as depicted on sheet 1 of 2, identified as master plan site improvemems and dated 10/25/96, sheet 2 of 2 identified as paving and drainage details, and notes dated 10/15/96, based on the;following condition, that the applicant should provide the City with a letter from Indian River County Health Department approving the addition of a bathroom connecting to the existing septic tank prior to construction of the new building. If the applicant does not proceed with the additional bathroom, then there would be no need for the letter from the Health Department. Th~ public bern'lng was ogened at 8:05 PM. Airpor~ Drive, subject to the recommendation oftbe staff report on page eight (8). Roll call was taken. 7 - 0 motiou carried. RECOMMENDATION TO CITY COUNCIL -MINOR SUBDIVISION -BARBER STREET REPLAT - PARK PLACE Afl~ reviewing the proposed plat for the above referenced project, it was recommmded that the followin~ be added: 1. All curre~ property owners be shown on the plat. 2. Any easements dedicated to Florida Power & Light, Southern Bell, and Indian River County be noted on the plat. All pemument ref~ren~ r~rence marke~ (Pl~avl's) and ~mument control ~ (PCM's) be shown on the plat. Mr. Mas~lli requested that further action and approval on this project be delayed until the above recomm~dafions are added. RECOMMENDATION TO CITY COUNCIL - REGULAR MEMBER I~OSITION, TERM TO EXPIRE 11/99 There were two applicants, Mr. Kelley Mather and Mr. Lewis Nicolini, Sr. Mr. Mather is presently on the Plamfing and Zoning Board, and Mr. Nicolini was on the Code Enfo~ Board. Mr. Johns nominated Mr. Mather. The~ were no other recommendations. MOTION by Johns/Vesia I move to recommend Mr. Kelley Mather to City Council for the regular member position on the Planning and Zonins Board. A voice vote was tak~. 7-0 motion camed. DISCUSSION - PLANNING AND ZONING PROCEDURES Mr. Massarelli gave a presentation, discussing why changes are needed to the ordinances and procedures. He is in the process of correcting and re-writing and strcmulin~ these ordinances and they will then be brought before this Board for formal action and recommend~on to City Council. In answer to a question from Ms. Kilkelly, Mr. Massarelli explained that the Police Department plays a role in the Comprehensive Plan by being interested in not creating an environment for crime. Under new proposals, rezopin~o would be a recommendation to City Council, who would then hold the quasi-judicial hearing. Another proposal is to place a time limit on minor site plan approvals and provide for limited extensions to be permitted. In response to a question from Mr. Munsart, Bob responded that the City can develop a drainage threshold for minor and major site plans and subdivisions. After much discussion, there were several very good sug~tions for improving the procedures. DISCUSSION-PARKING REQUIREMENTS Mr. Massarelli pointed out that the code requires many more parking spaces for doctor offices:than are needed for other professional offices. This has affected the ability to place other medical and office businesses in existing sites. He suggested utilizing the code with a little more flexibility, until such time that the code can or may be chansed, and also referrin~ to the APA lp~ielines. He pointed out that all office businesses do not require the same number of parking spaces. Ms. Roxanne Malone, DDS, 13242 U.S. 1, was present to speak about obtaining consideration for thc number of parkin~ spaces required for her to practice her profession in Sebastian as a solo Dentist on a limited basis. Mr. Fischer mentioned that a varmnce can be'obtained for the number of parkin8 spaces needed. Ms. Norma Damp spokc about how some Doctor's parking space needs are much lower than the average because of their limited practice. Mr. Massarelli suggested that in the interim, until a better system can be impl~ thc City needs to be aware of the need to be flexible in utilizin~ thc code in reference to required parking for various office businesses. CHAiRMA~ Mb. TTERS: Clmm. Fischer mentioned flint fl~ is a lot of debris and.junk behind where the new Sebastian Village Hotel is to be built. He noted that ifthis is in,he City lim~s, i~needs tobe~ on. He also mentioned that the paths a~ Hardee Park on Barber sU~e~ need to be clem~l up. 6 Mr. Pliska mentioned the subject of the pipes in the swales, .under dri~ways. It seems tbe galvanized pipes presently USed are disintegratin~ over a period of 5 or 6 or 7 years. He sugSested changing the code to require plastic, cement or aluminum pipe to keep the homeown~ from' having to replace these pipes in a short amount of time. ~. Vesi~ mentioned an A-flame sign in a pick-up .truck on U,S. 1, at Carpenter's Antiques. Mr. MaSsarelli will check into this. She also mentioned cbildr~n crossing the street by the Learning Nest. Mr. Massar¢lli ~ look in ~othc site plan permit and see what conditions were'involved and if caution signs arc needed. Mr. Munsart announced that he will be ~bs~ for the nex$ meeting o~ 11/17/96. He.also questkmed parking in the City fight-of-way, specifically at Captain'Hiram's on indian River Drive. Mr. Massamlli noted that the same problem exists at Hurricane Harbor, and'he will g~ with Code Enforcaueut about it. drainage on that property.
