PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES NOVEMBER 19, 1992 ViCE-CHAIRMAN THOMPSON OPENED THE MEETING AT 7:00 P.M, PRESENT; MR. THOMPSON, MRS. KILKELLY, MR. SHROYER, MR. FIRTION, MR. FISCHER, MRS. DAMP, ABSENT; MR. KRULIKOWSKI, MR. GOLDSTEIN, MR. FULLERTON ALL EXCUSED ALSO' PRESENT; LINDA KINCHEN, SECRETARY, BRUCE COOPER, COMMUNITY DEVELOPMENT DIRECTOR ANNOUNCEMENTS; MOTION TO CHANGE THE ORDER OF BUSINESS ON. AGENDA TO PUT HOME OCCUPATIONAL LICENSES FIRST AND ,THEN THE OTHER BUSINESS BY MRS. KILKELLY SECOND MR. FISCHER PASSED UNANIMOUSLY. CHAIRMAN REQUESTED THAT THE MEMBERSHIP RENEWAL OF MR. GOLDSTEIN BE ADDED TO THE AGENDA. MOTION BY MRS. DAMP SECOND MR. SHROYER PASSED UNANIMOUSLY. APPROVAL. OF MINUTES: 10-5-92 - PAGE'TWO ADD "OF THE LAND D~Vi~nOPMENT CODE" AFTER PAGE 125 UNDER MPRBERS MATTERS. A MOTION TO APPROVE THE MINUTES AS AMENDED BY MRS. DAMP SECOND MRS. KILKELLY PASSED UNANIMOUSLY. HOME OCCUPATIONAL LICENSE - VINTAGE POTTERY - JOSEPH WYNES 610 BELFAST TERRACE - WILL BE GETTING ESTIMATES FOR A CARPORT APPLICANT STATES ACTUAL GARAGE AREA IS 270 SQ FT. THERE IS MUCH DISCUSSION ABOUT THE KiLN AND KEEPING THE DOOR TO THE GARAGE OPEN DURING USAGE. ALSO THERE IS MUCH DISCUSSION ABOUT WHERE .A CARPORT COULD GO ON THE PROPERTY WITH THE LAYOUT OF THE HOUSE. 'PUBLIC HEARING OPENED AT 7:35 P.M. CLOSED 7:35 P.M. NO PUBLIC 'COMMENT - BRUCE SUGGESTS DO NOT APPROVE POSTPONE ACTION' UNTIL THE APPLICANT DECIDES WHAT HE WANTS TO DO A MOTION TO DENY AT THE PRESENT TIME BECAUSE TO APPROVE WOULD BE SETTING A PRECEDENCE BY MR. SHROYER SECOND MR. FISCHER FOR DISCUSSION UNDER DISCUSSION MRS. KILKELLY STATES RELUCTANT TO DENY HiS HOBBY WOULD BE BETTER TO DEFER UNTIL HE CAN SHOW HE MEETS' THE REQUIREMENTS OF CODE. MOTION PASSES 4-2 WITH MRS. DAMP AND MRS. KILKELLY VOTING NO. FOR AN ADDRESS OF CONVENIENCE PUBLIC HEARING OPENED 7:55 P.M. CLOSED 7:58 P.M. FOR THE RECORD 4 LETTERS OF OBJECTION ARE IN THE FILE. A MOTION TO APPROVE THE HOME OCCUPATIONAL LICENSE FOR SUNTECH SECURITY SYSTEMS AT 689 BELFAST TERRACE WAS MADE BY MRS. KILKELLY SECOND MR. FIRTiON PASSED UNANIMOUSLY. WATERCRAFT CHANGES - BRUCE STATES RECEIVED FROM.THE .ATTORNEY DELIBERATIONS FROM CLEARWATER WHICH NEED REVIEW - GIVES SOME CONCERNS ABOUT PAGE ONE THE ACCESSORY BUILDING LANGUAGE ALSO PAGE TWO WANTS ALL DOCKS IN CENTER 1/3 OF THE PROPERTY AND' ALSO NEED TO ADD A MAXIMUM LENGTH OF 30 FEET. ALSO HE FEELS THE INTERCOASTAL WAY SHOULD NOT BE INCLUDED IN THE CENTER'~..~/S - NEEDS TO LOOK AT PROHIBITION OF LIVEABOARDS .ON PAGE THREE STATES HE WILL BRING BACK THE FINAL DRAFT IF COMMISSION DESIRES., A MOTION TO DIRECT BRUCE TO PROCEED WITH THE CHANGES DISCUSSED FOR SECTION 20A510 A & B AND FORWARD TO THE CITY COUNCIL BY MRS. THOMPSON SECOND MRS. DAMP PASSED UNANIMOUSLY. PROCEDURE RECOMMENDATIONS - MR. THOMPSON SPEAKS SINCE IT IS HIS RECOMMENDATION. A MOTION TO APPROVE THE PROCEDURES RECOMMEND DATED 10-1-92 AS AMENDED AND INCLUDE IN THE PLANNING AND ZONING HANDBOOK AND ALSO ADD TO THE AGENDA FOR EAOH MEETING WAS MADE BY MRS. KILKELLY SECOND MR. FISCHER PASSED UNANIMOUSLY. CHAIRMANS MATTERS - NONE MEMBERS MATTERS: SHIRLEY SAYS. BASED ON THE, ATTORNEY COMMENTS SHE RECOMMENDS CODE CHAN(]E TO SAY "NO HOME OCCUPATIONAL LICENSE CAN BE APPROVED IF ANY. OTHER VIOLATIONS EXIST - MADE A MOTION WITH SECOND BY MR. FISCHER PASSED UNANIMOUSLY. MR. SHROYER WANTS TO CHANGE 20ALl.8 LIMIT TO i YEAR FOR CHAIRMAN AND 1 YEAR FOR VICE CHAIRMAN - FROM THE TWO YEAR REQUIREMENT. A MOTION TO CHANGE THE 2 YEAR REQUIREMENT TO 1 YEAR AND ALSO TO LIMIT THE TERM OF CHAIRMAN TO ONE YEAR WAS MADE BY MRS. KILKELLY SECOND MR. SHROYER PASSED UNANIMOUSLY. BLDG OFFICIAL MATTERS: ANNOUNCES THAT THE TREE TRIMMING HOME OCCUPATIONAL LICENSE WILL NOT BE ISSUED SINCE THE MAN MOVED OUT OF THE CITY. STATES SIGN ORDINANCE IS COMING NEXT TO THE COMMISSION FOR REVIEW MEETING ADJOURNED AT 9:40 P.M.
