Your application foraDepartmentofthe Armypermitcontinues to be theassigned
numberSAJ-2017-00354.Areviewoftheinformation,anddrawingsprovidedshows
theproposedworkistheplacement of 330 linear feet of rockrevetment ator above the
currentordinaryhighwater line(OHW) of theIndian River Lagoon.Theprojectis
situatedwater wardofthe buildings with the addresses of 15320-1540 Indian River Dr.,
Sebastian, FL 32958.
Yourproject,as depictedontheencloseddrawings, is authorizedbyNationwide
Permit Number13.Inaddition,project specific conditions havebeenenclosed.This
verificationis validuntil March18,2022.Furthermore, ifyoucommenceorareunder
contract tocommencethisactivitybeforethedatethat therelevant nationwidepermit
is modifiedorrevoked, youwill have12monthsfrom thedateof themodificationor
revocationof theNWPtocompletetheactivityunderthepresentterms andconditions
ofthis nationwidepermit.

Pleasebeawarethis webaddressiscasesensitiveandshouldbe enteredasit
appearsabove.Once thereyouwillneedtoclickon“NationwidePermitsorGeneral
Permits.”Thesefiles containthedescriptionoftheNationwidePermitauthorizations
andGeneralPermits,theNationwideandGeneralPermitgeneralconditions,and the
regionalconditions,whichapplyspecificallytotheverificationforNWP13.Enclosedis
alistofGeneralConditions,whichapplytoallDepartmentoftheArmy authorizations.

Youmustcomplywithallofthespecialandgeneralconditionsand anyprojectspecific
conditionofthisauthorizationoryoumaybesubjecttoenforcementaction.Intheevent
youhavenotcompletedconstruction ofyourprojectwithinthespecifiedtimelimit,a
separateapplicationorre-verification mayberequired.
Thefollowing specialconditionsareincludedwiththisverification:
1.ReportingAddress:Allreports,documentation andcorrespondencerequiredbythe
conditionsofthispermitshallbesubmittedtothefollowing address:U.S.ArmyCorpsof
Engineers,RegulatoryDivision,EnforcementSection,P.O. Box4970,Jacksonville,
FL32232.The Permittee shallreferencethispermitnumberSAJ-2013-00194,(NW-
BAB) onallsubmittals.
2.Commencement Notification:Within10daysfromthedate ofinitiating the
authorizedwork,thePermitteeshallprovidetotheCorpsawrittennotificationofthe
dateofcommencementofworkauthorizedbythispermit.
3.CompletionNotification:Within60daysofcompletion oftheworkauthorized,the
attached "Self-CertificationStatementofCompliance"mustbecompleted andsubmitted
totheU.S.ArmyCorpsofEngineers.
4.Manateecondition:Thepermitteeshallcomplywiththe“StandardManatee
ConditionsforIn-WaterWork2011” designedtoprotectthe endangeredWestIndian
Manateeprovided inattachments.
5. Sea Turtlesand Smalltooth Sawfish: For many activities, potential adverse
impacts to sea turtles can be reduced and/or eliminated through adherence to the
construction conditions found in the joint Corps/National Marine Fisheries
Service's“Sea Turtle and Smalltooth Sawfish Construction Conditions–Revised March
23,2006."
6.Turbiditycontrols:
a.Shallbeusedthroughoutconstructiontocontrolerosion andsiltationand
ensure thatturbiditylevelswithintheprojectareadonotexceedbackground
conditions.
b.Shallbe madeofmaterialinwhichlistedspeciescannotbecomeentangled
(i.e.,reinforcedimpermeable polycarbonate vinylfabric \[PVC\]),and shallbe
monitored toensurelistedspeciesarenotentangledortrappedin theproject
area.
c.Shallberemovedpromptlywhentheworkiscomplete andthewater quality
intheprojectarea hasreturnedtobackgroundconditions.
7.Regulatory Agency Changes:Should thePermitteepropose oranyother
regulatoryagencyrequirechangestotheworkauthorizedorobligatedbythispermit,
thePermitteeisadvisedthatamodificationto thispermitinstrumentisrequiredprior to

initiation ofthose changes.Itisthe Permittee’sresponsibilitytorequestamodification
ofthispermitfromthe CocoaPermitsSection.
8. UnreasonableObstruction:ThePermittee understandsand agreesthat,iffuture
operationsbytheUnitedStatesrequiretheremoval,relocation,orotheralteration,of
thestructuresorworkherein authorized,orif,intheopinion ofthe Secretaryofthe
Armyorhisauthorized representative,said structureorworkshallcause unreasonable
obstructiontothe free navigationofthe navigablewaters,thePermitteewillberequired,
uponduenotice from theU.S.ArmyCorpsofEngineers,toremove,relocate,oralter
thestructuralworkorobstructionscaused thereby,withoutexpense totheUnited
States.NoclaimshallbemadeagainsttheUnited Statesonaccountofanysuch
removaloralteration.
9. CulturalResources/HistoricProperties:
a.Nostructure orworkshalladverselyaffect impactordisturb propertieslistedin
theNationalRegisterofHistoricPlaces(NRHP) orthoseeligible forinclusionin the
NRHP.
b.Ifduring thegrounddisturbing activitiesandconstructionworkwithinthepermit
area,there are archaeological/culturalmaterialsencountered whichwerenot the
subjectofapreviousculturalresourcesassessmentsurvey(andwhichshallinclude,
butnotbelimited to:pottery,modified shell,flora,fauna,humanremains,ceramics,
stonetoolsormetal implements,dugoutcanoes,evidence ofstructuresoranyother
physicalremainsthatcould beassociatedwithNativeAmericanculturesorearly
colonialorAmericansettlement),thePermitteeshallimmediatelystopallworkand
ground-disturbing activitieswithina100-meterdiameter ofthediscoveryandnotifythe
Corpswithinthesame businessday(8hours).TheCorpsshallthen notifytheFlorida
StateHistoricPreservationOfficer (SHPO) andtheappropriate TribalHistoric
PreservationOfficer(s) (THPO(s)) toassess thesignificance ofthediscoveryand
deviseappropriate actions.
c.Additionalculturalresourcesassessmentsmayberequiredofthepermitareain
thecase ofunanticipateddiscoveriesas referencedinaccordancewiththeabove
SpecialCondition;andifdeemednecessarybytheSHPO,THPO(s),orCorps,in
accordancewith36CFR800or33CFR325,AppendixC(5).Based,onthe
circumstancesofthediscovery,equitytoallparties,andconsiderationsofthepublic
interest,theCorpsmaymodify,suspend orrevokethepermitin accordancewith33
CFRPart325.7.Such activityshallnot resume onnon-federallandswithoutwritten
authorization fromthe SHPOforfindsunderhisorherjurisdiction,andfrom the
Corps.
d.Inthe unlikelyeventthatunmarked humanremainsareidentifiedonnon-federal
lands,theywillbetreatedin accordance withSection 872.05Florida Statutes.All work
andground disturbing activitieswithina100-meter diameter oftheunmarkedhuman
remainsshallimmediatelyceaseandthePermittee shallimmediatelynotifythe
medicalexaminer,Corps,andStateArcheologistwithinthesamebusinessday(8-
hours).TheCorpsshallthennotifytheappropriateSHPOand THPO(s).Based,on
thecircumstancesofthediscovery,equitytoallparties,andconsiderationsofthe

publicinterest,theCorpsmaymodify,suspendorrevokethe permitinaccordance
with33CFRPart325.7.Such activityshallnot resume withoutwrittenauthorization
fromthe StateArcheologistandfrom theCorps.
This letterofauthorizationdoesnotobviatethenecessitytoobtainanyother
Federal,State,orlocalpermits,whichmayberequired.Prior totheinitiation ofany
construction,projectsqualifying forthisNationwideandGeneralpermitsmust qualifyfor
anexemptionunder section403.813(1),F.S.or373.406,F.S.,orotherwisebe
authorizedbytheapplicable permitrequiredunder PartIVofChapter 373, F.S.,bythe
DepartmentofEnvironmentalProtection,awatermanagementdistrictunder section
373.069,F.S.,oralocal governmentwithdelegated authorityundersection 373.441,
F.S.,andreceiveWaterQualityCertification(WQC)andapplicableCoastalZone
ConsistencyConcurrence(CZCC) orwaiver thereto,as wellas anyauthorizations
required fortheuseofstate-ownedsubmergedlandsunder Chapter253,F.S.,and,as
applicable,Chapter 258,F.S.YoushouldcheckState-permittingrequirementswiththe
FloridaDepartmentofEnvironmentalProtectionortheappropriate watermanagement
district.
Thisletterof authorizationdoesnotincludeconditions thatwould preventthe‘take’
of astate-listedfish orwildlifespecies.Thesespecies are protectedundersec.
379.411,FloridaStatutes,andlistedunderRule68A-27,FloridaAdministrativeCode.
Withregard tofishand wildlifespeciesdesignatedasspeciesof special concern or
threatenedbytheStateof Florida,youareresponsibleforcoordinating directlywiththe
FloridaFishandWildlifeConservationCommission(FWC).Youcan visittheFWC

information,including alistofthose fishand wildlifespeciesdesignated as speciesof

reached.
2.Youmustmaintaintheactivityauthorizedbythispermitingoodconditionandin
conformancewiththetermsandconditionsofthispermit.Youarenotrelievedofthis

theNationalRegister ofHistoricPlaces.
4.Ifyousellthepropertyassociatedwiththispermityoumustobtainthesignatureofthe
newownerinthespaceprovidedandforwardacopyofthepermittothisofficetovalidate
thetransferofthisauthorization.
5.Ifaconditionedwaterqualitycertificationhasbeenissuedforyourproject,youmust
complywiththeconditionsspecifiedinthecertificationasspecialconditionstothispermit.
