Announcements and/or Agenda Modifications Ms. Kautenburg stated that Messrs. Simmons (a), Carter, and Reyes have been excused, and Mr. Mauti (a) will be voting this evening. 5. Approval of Minutes A. Regular Meeting of June 21, 2018 Ms. Kautenburg asked for any additions or corrections to the Minutes as presented. Hearing none, she asked for a motion to accept the Minutes. A motion to accept the Minutes as presented was made by Mr. Hughan, seconded by Mr. Qizilbash, and approved unanimously by voice vote. New Business A. Recommendation to City Council -- Review of Capital Improvements Program and Capital Outlay Items Greater than $50,000 -- 6-Year Schedule FY 2018/2019 through 2023/2024 Ms. Bosworth stated this meeting is for the purpose of recommending to City Council the proposed Capital Improvements Program for fiscal years 2018/2019 through 2023/2024 and Mr. Killgore is here to make a Power Point presentation. She also introduced Mr. Paul Carlisle, City Manager. Mr. Killgore made a Power Point presentation that sets forth highlights of the proposed Capital Improvements Program for the aforementioned fiscal years. He then asked for questions, comments or concerns from the Commission. Ms. Kautenburg thanked the staff as well as the members of the Commission for their work regarding this matter. She then called for questions from the Commission. Mr. Roth: • Queried if the street paving/repaving includes the striping as well. Mr. Killgore stated that generally the additional striping is included in the bid. Mr. Carlisle stated that most of the contracts include that the contractor replace the striping that was present before the paving work and/or modifications were done. Mr. Roth stated he is most concerned with the striping condition on Barber Street near the Publix and Walgreens. Mr. Carlisle explained that that sort of striping is part of the maintenance budget. • Regarding the proposed public facilities compound, he asked if this refers to the new building at the Airport. Mr. Killgore explained that the proposed public facilities compound is presently off SR 512, and the new facility will be situated at the Airport. PLANNING AND ZONING COMMISSION Page 3 MINUTES OF REGULAR MEETING OF JULY 19, 2018 • Regarding the purchase of six police vehicles annually, including body cameras, he asked if those body cameras will be assigned to a certain vehicle. Mr. Killgore stated that the City is instituting a body camera program so that at the time the vehicles are replaced the new vehicles would be fully equipped with body cams. That program will be phased in over several years. • Regarding radar signs and speed trailers, he inquired about the number of radar signs proposed. Mr. Killgore stated he thought that was for two units, but he will verify that. • An early warning system is also mentioned, and he asked for clarification. Mr. Killgore replied that is a software program, and he will try to clarify that item in the final draft so as to state what is being purchased. • Regarding the sea walls, he inquired if that project is going to be partially funded with grants. Mr. Carlisle stated it is anticipated that the City will get St. John's Water Management grants to construct that wall. He also stated that the City in the future will further evaluate what is needed regarding all projects to be sure that tax money is being spent efficiently. Mr. Hughan: • Regarding the street repaving/reconstruction, he asked how many miles are estimated to be repaved/reconstructed. Mr. Carlisle stated that will depend on the program process. The City is planning to hire a company to come in and do an overall paving condition index, which will tell the City whether the road needs to be reconstructed, repaved, needs a surface treatment, etc. so that the monies are spent efficiently, so he cannot give an exact number until he has an exact plan. • Regarding the working waterfront parking lot, he questioned the $500,000 cost. Mr. Killgore stated that figure includes the work along the shore line to protect the parking lot. Ms. Kautenburg: • Regarding the Public Facilities Department, she asked if there have been any ecological accidents on the existing site that will have to be remedied. Mr. Killgore stated that over the past year there has been some additional testing which reveals that there is not a significant level for concern. Mr. Carlisle stated the recent testing has shown reduced levels of hydrocarbon, and so the City is confident that the site will be acceptable. PLANNING AND ZONING COMMISSION Page 4 MINUTES OF REGULAR MEETING OF JULY 19, 2018 Mr. Mauti: • Inquired if the Public Works site will be slated for resale. Mr. Carlisle stated it would be presented to City Council who will make the final determination. He and staff feel it should be put on the market for resale. Mr. Mauti asked if the Public Works facility will be moved to the Airport property. Mr. Carlisle stated it would, and the money for that will be coming from the DST fund set forth in the budget. • Regarding the Police Department, he asked if, when the new equipment is purchased, that will include training for the Department. Mr. Carlisle stated it would. • Regarding the evidence storage facility, he questioned $50,000 for storage shelves. Mr. Killgore said that when the facility was built there was not sufficient planning as to how it would be equipped. He stated that the shelving will be special shelving that will have to be secured. • Inquired regarding the status of the restaurant at the Airport. Mr. Carlisle stated the City will be bidding that out for a new restauranteur. • Asked what the percentage of increase is for capital improvements over the prior budget. Mr. Killgore stated it is at a much higher amount due to the Public Works project and the increase in storm water improvements. Mr. Qizilbash: • Inquired as to what stage the building of the new Public Works facility is in presently. Mr. Killgore stated there was a preliminary design worked up, which was set up as a phase -type project, and the $1.6 million is for the infrastructure and the first phase of the plan. Mr. Carlisle further explained the project will be handled as a design -build so that the contractor will do the architecture, designing and building, which will be a more economical method of doing the project. Mr. Carlisle thanked the Commission and staff for their work and input. Ms. Kautenburg called for a motion. A motion that the Capital Improvement Program be submitted to City Council with no changes was made by Mr. Roth, seconded by Mr. Hughes. Staff Matters Ms. Bosworth updated the Commission on projects which have been before the Commission and their status. • At the City Council meeting on July 25th there will be the final adoption of the Spirit of Sebastian Land Use and Rezoning. • The first reading of the vacation rental ordinance will be presented at the City Council meeting on July 25tn • August 8th will be the final adoption of the Land Use and Annexation of the Graves Brothers property, which is the 67 acres along SR 510. • The final reading of the vacation rental ordinance will be scheduled for September 12tn. After that, the residents will have three months to get registered with the required paperwork. Ms. Kautenburg inquired as to how long it takes for a license to be granted once it has been applied for. Ms. Bosworth stated that once the paperwork is in order, the state license is received and the fee paid, then the life safety inspection is done, and that total process should only take 10-14 days. She clarified that there will not be a "license" issued, but the business tax receipt will serve as proof of registration. Ms. Kautenburg suggested that the requirement information be made available to interested parties. Ms. Bosworth stated once the ordinance is passed, staff will put together packets containing the pertinent information and disseminate that to realtors, property managers, etc. through news articles, website articles, etc. Ms. Kautenburg suggested that the City's website is a good place to post the information. Ms. Bosworth stated staff will pursue that. 13. Adjourn -- Ms. Kautenburg called for any further business. Hearing none, she adjourned the meeting at 6:39 p.m. jg LMLT SEB`STIN HOME OF PELICAN ISLAND COMMUNITY DEVELOPMENT DEPARTMENT 1225 MAIN STREET ■ SEBASTIAN, FLORIDA 32958 TELEPHONE (772) 589.5518 ■ FAX (772) 388-8248 www.cityofsebastian.org MEMORANDUM TO: Local Planning Agency (Planning and Zoning Commission) RE: Proposed Land Development Code Amendment to Article VII — General Regulations; specifically Section 54-2-7.7 Walls and fences DATE: September 27, 2018 After consideration of the amount of variances requested for eight -foot fences during the past few years, the Board of Adjustment (City Council) has directed staff and the Planning and Zoning Commission to review and possibly amend the fence section of the Land Development Code. Currently, the code allows a fence to be a maximum height of six feet behind the front of the main structure and behind the secondary front yard setback if on a corner lot. Because of the raised finished floor elevations on newer homes, residents are finding that the six-foot fences placed near their property lines are not delivering the privacy sought. Staff would like to discuss with the Commission the following areas within the wall and fence section in order to get direction on possible revisions: 1. Height measurement determination 2. Keep six feet in height and allow administrative variance for eight feet or just allow up to eight feet 3. Protection of visibility triangle in front yards 4. Variance Language similar to 54-2-7.3 5. Addition of material to top of fences 6. Record affidavit for fences allowed in easements An ordinance will then be prepared, and staff will schedule a public hearing for October 18th, 2018, for the Commission's review and recommendation to City Council. Dom Bosworth, Manager/Plane Community Development Depa ent GENERAL REGULATIONS § 54-2-7.7 b. The roof of the accessory building must have a minimum pitch of 3:12 C. Accessory structures 501 square feet to 750 square feet in size shall be compatible with the overall general architectural design of the primary residence, including facade and materials, colors and trim, roofing materials and pitch. d. Accessory structures 751 square feet to 1,000 square feet in size shall be of the same architectural design of the primary residence, including facade and mate- rials, colors and trim, and roofing materials and pitch. Foundation plantings shall be required on all sides of the accessory structure excluding entranceways and doorways. Said requirements are as follows: One shrub for every three lineal feet, 24 inches in height at planting. (Ord. No. 0-02-19, § 1, 12-11-02) Sec. 54-2-7.6. Aboveground storage of gasoline/other combustible fluids. Any aboveground storage of gasoline and other combustible fluids shall be subject to compliance with all state and local laws pertaining to aboveground storage of gasoline and other combustible fluids. Sec. 54-2-7.7. Walls and fences. (a) General regulation of walls and fences. (1) Permit required. Except as provided in subsection (4), it shall be unlawful for any person, association, corporation or other entity to install, erect, alter, or locate a fence or wall within the city without first obtaining a fence permit for such activity. Notwithstanding the foregoing, a fence permit shall not be required for the replace- ment or repair of an existing fence or wall unless the replacement or repair cost exceeds 50% or more of the value of the fence or wall before its repair or replacement. (2) Application procedures. Application for a fence permit under this section shall be made to the building official and shall include the following: a. A survey prepared by a licensed surveyor of the State of Florida; b. The location, length and height of the proposed fence or wall; C. A description of the materials contained in the proposed fence or wall; and d. Location of any fire hydrant adjacent to the property. (3) Issuance of permits. The building official shall issue a fence permit to an applicant under this section upon his finding that the proposed fence or wall is in compliance with the provisions of this article and all other pertinent state and local regulations, and upon payment of the appropriate fee. Fence permits issued under this section shall be subject to all other rules and regulations pertaining to fence permits in general. Supp. No. 4 LDC.7:5 § 54-2-7.7 SEBASTIAN LAND DEVELOPMENT CODE (4) Construction to withstand forces of nature. All fences and walls shall be constructed to withstand the force of wind and to allow, and not inhibit, divert or alter, the free flow of surface water from the natural course it followed prior to installation of the fence or wall. (5) Posts and supporting members. If the posts or supporting members of a fence or wall are placed in or upon the ground, the posts or supporting members shall be treated or composed of materials resistant to decay, corrosion and termites.; (6) Maintenance. All fences and walls shall be maintained in good repair, in a non- hazardous condition, and shall not be allowed to become dilapidated. (7) Height. The height of a fence or a wall shall be determined from the highest point of the ground in an eight -foot run lying directly beneath the fence or wall. Berms shall not be considered as part of the ground. (8) Temporary construction fences. The building official may require and approve tempo- rary construction fences for a period not to exceed 120 days. Temporary construction fences in excess of 180 days shall receive approval by the planning and zoning commission. F• (b) Types of fences and walls permitted. Fences and walls shall be constructed and/or composed of at least one of the following groups of materials: (1) Termite -resistant species wood or wood which has been treated to resist rot and termites; (2) Steel posts and wire fabric of a minimum lllh-gauge galvanized or other non - corrodible metal; (3) Ornamental iron; (4) Concrete or masonry; (5) Plastic. (c) Fences and walls in residential areas: (1) Height of walls and fences. Fences and walls, not exceeding six feet in height, may be placed along the boundary of a lot on that portion of the lot lying behind the front setback line and behind the front of the main structure. Fences and walls placed in front of the main structure shall not exceed four feet in height. (2) Exception to height regulations for walls and fences. Notwithstanding the provisions of 54-2-7.7(c)(1) of the Sebastian Land Development Code, fences and walls, not exceeding eight feet in height, may be placed along the boundary of a lot on that portion of the lot lying behind the front setback line and behind the front of the main structure on any of the following residential lots adjacent to Fellsmere Road, also known as County Road 512, in the City of Sebastian: Lots 1 - 8, Block 41, Sebastian Highlands Unit 1 Lots 2 - 19, Lot 28, Block 59, Sebastian Highlands Unit 2 Supp. No. 4 LDC7:6 GENERAL REGULATIONS § 54-2-7.7 Lot 16, Block 68, Sebastian Highlands, Unit 2 Lot 2, Block 72, Sebastian Highlands Unit 2 Lots 9 - 18, Block 72, Sebastian Highlands Unit 2 Supp. No. 4 LDC7:6.1 GENERAL REGULATIONS § 54-2.7.7 Lots 1-2, Block 42, Sebastian Highlands Unit 2 Lots 4 - 40, Block 42, Sebastian Highlands Unit 2 Lots 7 - 8, Block 57, Sebastian Highlands Unit 2 Lots 1 - 21, Block 149, Sebastian Highlands Unit 3 Lot 1, Block 169, Sebastian Highlands Unit 5 Lots 18 - 49, Block 169, Sebastian Highlands Unit 5 Lots 122 - 124, San Sebastian Springs Lots 147 - 154, San Sebastian Springs Lots 1 - 6, Roseland Acres In addition, tennis court enclosures, not exceeding ten feet in height, may be placed along the perimimmeter of said tennis court(s). The fence enclosure(s) shall not be located closer than ten feet from the side and rear property lines and shall not be located in any easement(s). (3) Walls and fences on corner lots. Notwithstanding the provisions of 54-2-7.7(c)(1) or 54-2-7.7(c)(2), fences and walls four to six feet in height may be located to the front of the front setback line along the boundary of the secondary front yard of an improved corner lot. Only those fences and walls placed along the boundary of the primary front yard of an improved corner lot must be located behind the front setback line. a. Primary front yard. For purposes of this paragraph, the term "primary front yard" shall mean the yard of an improved corner lot located between the street and the wall of the main structure facing the street where the primary entrance to the main structure is located. b. Secondary front yard. For purposes of this paragraph, the term "secondary front yard" shall mean the yard of an improved corner lot located between the street and the wall of the main structure facing the street where the primary entrance to the main structure is not located. (4) Trellis structures. Trellis structures that do not form a barrier may be erected at any location on a lot except within visibility triangles or dedicated easements. Such trellis structures need not satisfy the height limitation and restrictions for residential fences and walls provided in this subsection. (d) Fences and walls in nonresidential districts. (1) All commercial and industrial zoned properties that are being utilized for residential purposes shall comply with the requirements set forth in section 54-2-7.7(c). (2) Fences and walls not exceeding eight feet in height may be permitted upon approval of the planning and growth management director. The planning and zoning commis- sion must approve all fences and walls exceeding eight feet in height. The action of the planning and growth management director may be appealed to the planning and zoning commission. Such appeal shall be filed with the planning and growth manage- LDC7:7 § 54-2-7.7 SEBASTIAN LAND DEVELOPMENT CODE ment department within ten working days after action of the planning and growth management director. The request for the appeal shall include information concerning the disputed issues in the planning and growth management director's actions. (e) Fences within easements. (1) Fence permit required. It shall be unlawful for any person, association, corporation or other entity to erect a fence or wall within any easement unless a fence permit for the fence or wall is obtained prior to the erection of the fence or wall, and the fence or wall is constructed of the materials listed in section 54-2.7.7(b)(1), (2) and (5). Prior to city approval of the permit, the applicant shall provide the city an affidavit from the holder(s) of the easement stating that the holder(s) has (have) no objection to the permit approval. (2) Property owner responsible for removal cost. Any fence or wall proposed to be installed within a utility or drainage easement that accesses, abuts or provides the city or utility company with a maintenance area to lot line ditches, canals, drainage tracks, or rights -of -way, may be of a permanent or temporary nature. However, if the city or utility company should later determine that removal of the fence or wall is necessary for the installation, repair or replacement of the drainage or utility facility, the property owner shall be required to remove the fence or wall within five days of the owner's receipt of written demand for removal from the city or utility company. All cost incurred in the removal and replacement of the fence or wall shall be the responsibility of the property owner. (3) Maintenance. With the exception of drainage ditches maintained by others, the property owner shall be responsible for the maintenance of all property within a utility or drainage easement regardless of the placement of the fence or wall. The city may remove any fence or wall within the easement, as needed, in cases of emergency. (f) Prohibited fences and walls. (1) Prohibited types of walls and fences. It shall be unlawful to erect, construct, install or maintain the following structures: a. A fence or wall within six feet of a fire hydrant; b. A fence or wall within any street right-of-way; C. An electricity charged fence or wall; d. A fence or wall in a dilapidated condition which appears to be neglected, unkempt, or in substantial disrepair, in whole or in part, and as a consequence thereof is either unsound, hazardous or ineffectual; e. Any fence or wall containing hazardous substances such as broken glass, barbed wire, (except as provided in paragraph (2) below), spikes, nails, wire, or similar materials designed to inflict pain or injury to any person or animal. Any fence constructed of such material shall be deemed to be a public nuisance. LDC7:8 GENERAL REGULATIONS § 54-2-7.8 (2) Barbed wire fences. Barbed wire fences may be permitted by the planning and zoning commission in commercial and industrial districts if the proposed fence is a minimum of six feet and a maximum of eight feet in height and topped with no more than three strands of barbed wire. Transects spaced 15 feet apart were walked across this undeveloped lot. One Gopher Tortoise burrow was found near the northeast corner of the parcel (see Figure 1). This burrow was located near the north propertyline, close to the mowed lawn of the adjacent propertyowner. Trails ran from the burrow into this adjacent property, and fresh GopherTortoise scat in these trails indicated that the animal foraged in this area. The location of the Gopher Tortoise burrow is approximately 85 feet from the area of proposed construction, and all construction activities will avoid the area occupied by the tortoise. To comply with the Gopher Tortoise Management Plan (Florida Fish & Wildlife Conservation Commission, 2012), silt fencing will be placed along the north boundary of the construction area to prevent access by the tortoise. Silt fencing will also be installed in a semi -circle 25 feet from the mouth of the burrow (Figure 1). This arrangement of fencing will exclude the tortoise from the area of work, while still allowing it freedom of access to foraging areas. According to the GopherTortoise Management Plan, no mitigation, relocation, permitting, or reporting is required by FWC in this case.
