Call to Order 2. Initial Hearing of Code Violations: Case No: CE-18-024127 PATRICK G. PAWLING 933 STREAMLET AVENUE Sec. 54-2-7.7 Walls and fences. (a) General regulation of walls and fences. (3) Permit required. Except as provided in subsection (4), it shall be unlawful for any person, association, corporation or other entity to install, erect, alter, or locate a fence or wall within the city without first obtaining a fence permit for such activity. Notwithstanding the foregoing, a fence permit shall not be required for the replacement or repair of an existing fence or wall unless the replacement or repair cost exceeds 50% or more of the value of the fence or wall before its repair or replacement. Case No: CE-18-030695 ALBERT CLINGER 561 BENEDICTINE TERRACE Sec. 98-33 Damaging or parking in swales and shoulder prohibited. It shall be a violation of City Code for a vehicle to be parked or driven in such way that it damages the swale. Further, except as provided in sections 98-34 and 98-35, it shall be a violation for any motor vehicle to park in the swale or shoulder of the right-of-way. However, a vehicle may park on the shoulder if one of the following conditions exists: (1) The motor vehicle has been removed from the paved street due to mechanical failure or is temporarily parked due to emergency situations such as an accident, with a time limit of 24 hours. (2) The motor vehicle is titled to the owner or resident of the residential lot adjacent to the right-of- way, or an invited guest thereof, and all available parking space within the driveway of said lot is occupied by other motor vehicles. 3. Adjournment: ANY PERSON WHO DECIDES TO APPEAL ANY DECISION MADE BY THE SPECIAL MAGISTRATE WITH RESPECT TO ANY MATTER CONSIDERED AT THIS HEARING WILL NEED A RECORD OF THE PROCEEDINGS AND MAY NEED TO ENSURE THAT A VERBATIM RECORD OF THE PROCEEDINGS IS MADE, WHICH RECORD INCLUDES THE TESTIMONY AND EVIDENCE UPON WHICH THE APPEAL IS TO BE HEARD (286.0105 F.S.)
