CITY COUNCIL CHAMBERS 1225 MAIN STREET, SEBASTIAN, FLORIDA 1. Mayor Hill called the Regular Meeting to order at 6:00 p.m. 2. Pastor Grant Foster, Riverside Church of Sebastian, gave the invocation. 3. Council Member Dodd led the Pledge of Allegiance. 4. MOTION by Council Member Dodd and SECOND by Vice Mayor Kinchen to approve consent agenda items A, C through G. ROLL CALL: Vice Mayor Kinchen — aye Council Member Dodd — aye Council Member lovino — aye Council Member McPartlan — aye Mayor Hill — aye Motion carried 5-0. Item 8 — 0 Quarter Financial Report Council Member Dodd thanked tha Finance Director for the report's new format. Vice Mayor Kinchen slated many divisions went over budget. The City Manager responded that the divisions have been alerted to stay within their budgets. Damien Gilliams, 1623 US Highway 1, commended the Vice Mayor's comment and stated the residents near the Airport should be alerted to the planned increase in development. He also stated that general fund adjustments should be displayed on the monitor to let the community know what is going on. He suggested the divisions should be on target with their budgets unless it is an emergency. Regular City Council Meeting January 9, 2019 Page Three Andrea Ring, 407 Quarry Lane, member of the Citizens Budget Review Advisory Board, invited the public to come to their meetings where the adjustments are displayed in a PowerPoint given by the Finance Director. MOTION by Vice Mayor Kinchen and SECOND by Council Member McPartlan to approve Item B. ROLL CALL: Council Member Dodd — aye Council Member lovino — aye Council Member McPartlan — aye Mayor Hill — aye Vice Mayor Kinchen — aye Motion carried 5-0. 8. COMMITTEE REPORTS & APPOINTMENTS - None 9. PUBLIC HEARINGS - None 10. UNFINISHED BUSINESS - None 11. PUBLIC INPUT 6:15 pm Dennis Powers, resident since 1992, stated he has observed homes with hurricane shutters outside of hurricane season and expressed concern that children would not be able to get out if there was a fire. He asked that there be a law requiring homeowners to remove their shutters after the hurricane. Mr. Powers also asked that new homes be required to install a solar panel. Mayor Hill asked him to contact the City Manager or City Attorney. Bob Stephen, 150 Concha Drive, cited chemicals he believed to be sprayed in the canal behind his house. Council Member Dodd informed Mr. Stephen that he has asked for information from him twice and has yet to receive it; if Mr. Stephen provided the information there could be a more thorough investigation. He noted an agency did a study on his yard and found no glysomine in his yard and to look at it from a systemic prospective with all the appropriate information. Mr. Stephen said he would provide Council Member Dodd his information. Stella Garofalo, Sebastian Lakes Community, expressed concern with the unsightly view of the Brook's 512 Development and asked if there was a better way to handle the site during the development process. She asked Council to protect the residents from any development that will have a negative effect on their quality of life. (See attached) The City Manager said the contractor has been slowly working on the development and has until April 2019 to bring in the final plat; if the contractor does not make that deadline then staff can take action. Damien Gilliams, 1623 US Highway 1, asked that the public be brought up to date on the Working Waterfront property; that FPL clear the trees from the powerlines while it isn't hurricane season; and that a quarterly report be given on the stormwater improvements. He said the Chamber parking in the boat trailer lot should say 'public parking' so citizens won't think they are going to get a ticket if they park there. Regular City Council Meeting January9, 2019 Page Four He asked that there be a public workshop on the canal spraying. He thanked Bob Stephen for talking about the environment and requested a workshop to disclose what is being sprayed. He thanked the new City Manager and City Attorney for coming aboard and said it was going to be a great year. Robert Harkins, 662 Layport Drive asked why the parks are being sprayed, especially when there is wildlife, children, and elderly citizens there. Mayor Hill asked him to get in touch with the City Manager. 12. NEW BUSINESS 19.007 A. A9�rove Municipal Election Aoreemenl between the Indian River Countv Supervisor of Elections and Citv of Sebastian for Calendar Year 2019 (Transmittal. Aoreement) The City Clerk stated this election would not be in conjunction with a state or federal race therefore the ballot cost would be $2.00 a voter and asked if Council would like to hold early voting at an additional cost of $10,000 to $11,000. MOTION by Council Member McPartlan and SECOND by Vice Mayor Kinchen to approve the 2019 Municipal Election Agreement between the Indian River County Supervisor of Elections and the City. Resolution No. R-19-02 Authorizino the Citv Manager to Accent and Execute Documents Relating to FDOT Public Trans go Cation Grant Agreement to Replace Security Gate at Sebastian Municipal Airport (Transmittal. R-19-02. Aoreement) A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, AUTHORIZING ACCEPTANCE OF A FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) PUBLIC TRANSPORTATION GRANT AGREEMENT (PTGA), PROVIDING $10,000 FUNDING FOR THE REPLACEMENT OF A SECURITY GATE AT SEBASTIAN MUNICIPAL AIRPORT; AND AUTHORIZING THE CITY MANAGER TO EXECUTE AND SUBMIT APPROPRIATE DOCUMENTS; PROVIDING FOR CONFLICT; PROVIDING FOR SCRIVENER'S ERRORS; PROVIDING FOR EFFECTIVE DATE. The City Attorney read the title to Resolution No. R-19-02 and the City Manager stated this was for Gate 3 at the Airport which is in bad shape. He asked for approval. MOTION by Vice Mayor Kinchen and SECOND by Council Member McPartlan to approve Resolution No. R-19-02. Damien Gilliams thanked staff for obtaining FDOT funds which saves taxpayers a lot of money. Aoorove CSA #6 to Conlinuin@ Services Agreement with Schulke Bitlle & Stoddard. LLC to Provide Final Construction Plans for the Fisherman(s Landinq Pervious Parkin Lot in the Amount of 21.100.00 and Authorize the City Manager to Execute the ADDrooriate Documents Transmittal. CSA#6. Exhibits) The City Manager said this was for the impervious parking lot at the Working Waterfront and asked for approval up to $21,100. MOTION by Council Member Dodd and SECOND by Council Member lovino to approve CSA#6 with Schulke, Bittle & Stoddard to construct plans for the Fisherman's Landing parking lot. Damien Gilliams said there are non -profits at the Working Waterfront with 50 year leases who should be participating to these expenses. Mayor Hill said the great improvements made to this property are amazing. Council Member Dodd noted this is the last commitment required under the Florida Communities Trust agreement and now the City would be entering into the maintenance mode with the next budget cycle. Aooqrove CO#1 to Conlinuin Consulting Services Agreement with Applied Technoloa& Management to Provide Construction Manepement of the Workinq WaterfronNarkina Lot Improvements In the Amount of $3.000.00 and Authorize the City, Manaqer to Execute the ADorooriate Documents (Transmittal. C0#1, Scope) The City Manager explained this was a cost saving measure to have one engineer manage this and the shoreline improvements at the site. MOTION by Council Member McPartlan and SECOND by Mayor Hill to approve CO#1 with Applied Technology & Management to provide construction management of the Working Waterfront parking lot improvements. Damien Gilliams said taxpayers do not want to see additional change orders. Maya, Hill EST: rre e_1M'Nlahfs.MMC—City Clerk E Stella and Frank Garofalo 1442 Tradewinds Way Sebastian, FL 32958 Chairperson Planning and Zoning Commission City of Sebastian, Florida January 9, 2019 Dear Chairperson, I am a resident of the Sebastian Lakes Community and have lived here for 15 years. I have seen signs for the sale of the parcel now known as the Brook's 512 Commercial Development many times over the years. Once, it was almost sold to the county for the expansion of the library but unfortunately that did not happen. In September 2015, many residents attended a meeting just like this one to express their concern for the development of the parcel sited above. They pointed out the various ways our neighborhood would be negatively affected by the proposed plans submitted by Dr. Brooks. We thank you for your response to our concerns and for the added requirements for the project to proceed. Here we are again hoping you will assist us with the present situation. The development of the parcel is dragging on for months, it looks unsitely to say the least, weeds are growing high, children have been seen riding bikes on the parcel that has uneven land and pools of water. The residents can see 512 from their homes and are affected by the sound of noise from the traffic. It feels open and unsafe. I realize that the developer has until April to complete this phase but shouldn't there be a better way to handle this site during the process? The for sale sign was recently removed. Does that mean that the property was sold? It is bad enough to experience the negative effects of this construction which is more inactive than it is active without knowing what the use of the property is going to be. Unfortunately, we have seen many variances approved in Sebastian. The residents of Sebastian Lakes are depending on you to protect us from any development that will have a negative effect on our quality of life and home and condo values. What about the homes presently for sale in our community? Why would someone buy a house not knowing what is going to be at the entrance of the community?
