A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA, REQUESTING ST. JOHNS RIVER WATER
MANAGEMENT DISTRICT AND FLORIDA DEPARTMENT OF
ENVIRONMENTAL PROTECTION TO REDUCE OR WAIVE PERMIT
PROCESSING FEES IN ACCORDANCE WITH FLORIDA STATUTES
SECTION 218.075; PROVIDING FOR CONFLICTS; PROVIDING FOR
SCRIVENER'S ERRORS; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Florida Statutes Section 218.075 provides for the reduction or waiver of
permit processing fees by the Department of Environmental Protection and Water Management
Districts for municipalities with a population of 25,000 persons or less that certify that the cost is
a fiscal hardship due to certain factors; and
WHEREAS, the City of Sebastian hereby certifies that it is a municipality with a
population of 25,000 persons or less; and
WHEREAS, the City of Sebastian further certifies that it qualifies for the permit
processing fee reduction for the Fiscal Year October I, 2019 through September 30, 2020, since
the City of Sebastian per capita taxable value is less than the statewide average for the current
fiscal year and the percentage of assessed property that is exempt from ad valorem taxation is
higher than the statewide average.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SEBASTIAN, FLORIDA, as follows:
SECTION 1. The foregoing statements are hereby incorporated within this Resolution.
SECTION 2. The City of Sebastian, a Florida municipality, does hereby request that
the Florida Department of Environmental Protection and the St. Johns River Water Management
District reduce or waive the permit processing fees for public purpose projects for which the City
of Sebastian is the permit applicant in accordance with Florida Statutes Section 218.075.
SECTION 3. All resolutions or parts of resolutions in conflict herewith are hereby
repealed.
SECTION 4. Sections of this resolution may be renumbered or re -lettered and
corrections of typographical errors which do not affect the intent may be authorized by the City
Manager, or the City Manager's designee, without need of fiuther action of City Council by
filing a corrected copy of same with the City Clerk.
SECTION 5. This Resolution shall take effect upon adoption.
The foregoing Resolution was moved for adoption by Council Member Dodd
Motion was seconded by Council Member Kinchen and, upon being put to a vote,
the vote was as follows:

Councilmember Ed Dodd aye

The Mayor thereupon declared this Resolution duly passed and adopted this 10" day of April,
2019.
