The Hearing was called to order at 2:00 p.m. by Special Magistrate Kelley H. Armitage. 2. Present: Special Magistrate Kelley H. Armitage, Paul Carlisle, City Manager, Code Enforcement Officer Curtis Bloomfield, Code Enforcement Officer Richard lachini, Administrative Assistant Janickie Smith, Janet Graham, Technical Writer. 3. Ms. Smith swore in staff and all persons who would be speaking. 4. Hearing of Code Violations: a. Case No. CE-19-001173 Jean Machajski and Jean Peters 1097 Phelps Street Magistrate Armitage noted that there was no one present on behalf of the owners of record for the property to offer testimony, and he called on Code Enforcement Officer Curtis Bloomfield to present the City's case. Code Enforcement Officer Curtis Bloomfield identified himself and his position with the City. He stated that the property is in violation of City Ordinance Section 66-3.11, Grass and Weeds. The owner was notified on January 14, 2019 via Certified Mail to the address listed on the Property Appraiser's website, and there has been no response. The property was also posted. The owner has not corrected the violation. The City is requesting that the property be abated and have the administrative costs of $97.32 attached. So ordered by Magistrate Armitage. b. Case Nos. CE-18-048921 and CE-18-048923 Vincent Olson 455 Biscayne Lane PAGE 2 Magistrate Armitage noted that there was no one present on behalf of the owner of record for the property to offer testimony, and he called on Officer Richard lachini to present the City's case. Code Enforcement Officer Richard lachini identified himself and his position with the City. He stated there are two violations attached to this property: one is for grass and weeds, and the other is for trash and debris. The property is abandoned, and the owner is deceased. This property has been abated previously, and Officer lachini is requesting that the Court abate it again and assess administrative costs. So ordered by Magistrate Armitage. Magistrate Armitage inquired as to whether there has been an estate opened, and Officer lachini did not know. He stated that the owner had passed away almost three years ago, and sometime ago two women came to the office stating they were close relatives of the deceased. Officer lachini accompanied the women to the house where they went through it and took some incidental items. He stated they have not been seen since. The taxes have not been paid. Ms. Janickie stated the administrative costs would be between $80.00 and $100.00 in total. C. Case No. CE-19-000230 Avchen Construction 932 Barber Street Magistrate Armitage noted that there was no one present on behalf of the owners of record for the property to offer testimony, and he called on Officer Richard lachini to present the City's case. Code Enforcement Officer Richard lachini identified himself and his position with the City. He stated that this property is in violation of City Ordinance Section 66-3.11, Grass and Weeds. This property is abandoned. The owner of record is Avchen Construction Company, PO Box 100386, Palm Bay, Florida. Notices have been sent via Certified Mail, and they are marked "Return to Sender, Not Deliverable as addressed. Unable to forward." The taxes have been being paid on the property. Officer lachini stated this is the only address the City has for the owner of this property, which is the address on the Property Appraiser's website. The property has also been posted, and photos of the property have been taken. The City is asking that the property be abated and administrative fees of $100.00 be assessed. So ordered by Magistrate Armitage. PAGE 3 d. Case No. CE-18-045658 Warren J. and Elizabeth Feltz, Jr. 137 Midvale Terrace Magistrate Armitage noted that there was no one present on behalf of the owners of record for the property to offer testimony, and he called on Officer Richard lachini to present the City's case. Code Enforcement Officer Richard lachini identified himself and his position with the City. He stated that this property is in violation of City Ordinance Section 66-3.11, Grass and Weeds. This property is abandoned. He stated that recently the property was put in the hands of a bank. He is requesting that the property be abated at this time and a copy of the Order be sent to the bank informing them of the City's actions. So ordered by Magistrate Armitage. e. Case No. CE-18-041574 Heather Stenson 797 Helicon Terrace Magistrate Armitage noted that there was no one present on behalf of the owners of record for the property to offer testimony, and he called on Code Enforcement Officer Richard lachini to present the City's case. Code Enforcement Officer Richard lachini identified himself and his position with the City. He stated that this property is in violation of the City Ordinance regarding a cutback situation. Notice was sent via Certified Mail. The owner did sign for the letters being sent but has not taken any other action regarding the property. The City is requesting that the property be abated and administrative fees of $100.00 be assessed. So ordered by Magistrate Armitage. 5. Liens a. Case Nos. CE-18-033795 and 18-033796 Roderick and Joyce Gebensleben 573 Wimbrow Drive Magistrate Armitage noted that there was no one present on behalf of the owners of record for the property to offer testimony, and he called on Officer Curtis Bloomfield to PAGE 4 present the City's case. Code Enforcement Officer Curtis Bloomfield identified himself and his position with the City. He stated this hearing is to request the Court to lien the property which was abated previously by the City. The owners were notified via Certified Mail, which notice was signed for, and the property was posted. So ordered by Magistrate Armitage. b. Case No. CE-18-038148 Erica and Chris Golden 118 Easy Street Magistrate Armitage noted that there was no one present on behalf of the owners of record for the property to offer testimony, and he called on Officer Curtis Bloomfield to present the City's case. Code Enforcement Officer Curtis Bloomfield identified himself and his position with the City. He stated this property was previously ordered abated, and the City is now requesting that the property be liened. The owner was notified of this hearing via Certified Mail, and the letter was returned as undeliverable, the notice having been sent to the address of record on the Property Appraiser's website. So ordered by Magistrate Armitage. C. Case No. CE-18-038133 Jean M. Mackey and Jean E. Peters 1097 Phelps Street Magistrate Armitage noted that there was no one present on behalf of the owners of record for the property to offer testimony, and he called on Officer Curtis Bloomfield to present the City's case. He stated this property was previously ordered abated, and the City is now requesting that the property be liened. The property was posted and photos taken. So ordered by Magistrate Armitage. Magistrate Armitage requested that the City look into Avchen Construction to verify that it is an active entity. If it is discovered that the company is active, the City needs to find out what their correct address is so that they may be contacted regarding these matters. f. Case No. CE-18-039535 Barbara C. Hawkins 313 Bayfront Terrace PAGE 6 Magistrate Armitage noted that there was no one present on behalf of the owners of record for the property to offer testimony, and he called on Code Enforcement Officer Richard lachini to present the City's case. Code Enforcement Officer Richard lachini identified himself and his position with the City. He stated the owner of the property is deceased, and the City is now requesting that the property be liened. The property was posted and photos taken. The property taxes have been paid and are up to date. So ordered by Magistrate Armitage. g. Case No. CE-18-039545 US BANK 922 Laredo Lane Magistrate Armitage noted that there was no one present on behalf of the owners of record for the property to offer testimony, and he called on Code Enforcement Officer Richard lachini to present the City's case. Code Enforcement Officer Richard lachini identified himself and his position with the City. He stated the owner of this property is deceased, and just recently US Bank took over the property. The property was previously abated, and the City is now requesting that the property be liened. So ordered by Magistrate Armitage. Magistrate Armitage requested that in the mailing to US Bank noticing them of the lien, the order for the abatement be included as well. h. Case No. CE-18-035892 Edie M. Cannon 594 Bayharbor Terrace Magistrate Armitage noted that there was no one present on behalf of the owners of record for the property to offer testimony, and he called on Code Enforcement Officer Richard lachini to present the City's case. Code Enforcement Officer Richard lachini identified himself and his position with the City. He stated the owner of this property is deceased. This is a property where the structure is very dilapidated, and the City has to decide what is going to be done with the structure. PAGE 7 The City Attorney is familiar with the case.
