MOTION by Council Member Dodd and SECOND by Mayor Hill to approve Item B — Resolution No. R-19.09 regarding human trafficking. No public input or action except for City committee membernominations and appointments under this heading. 19.018 A. Natural Resources Board (Transmittal. Applications. Ad. List) L Interview, Unless aived, Submit Nominations for One Regular Member Position Natural Resources Board —Term to Expire 7/1/2022 Mayor Hill nominated Donna Ware to the regular member position. There were no other nominations. Ms. Ware will fill the regular member position to expire July 2022. 9. PUBLIC HEARINGS - None 10. UNFINISHED BUSINESS - None 11. PUBLIC INPUT Rick Lewis described the Wreaths Across America Program and said he would like to bring this ceremony to the Sebastian Cemetery on December 14, 2019. Mayor Hill invited him to work with the City Manager. 12. NEW BUSINESS 19.050 A. Desian-Build Public Facilities Compound Presentations by Too Three Candidates (Transmittal) The City Manager said seven qualified firms responded to the request for qualifications, which were narrowed down to three by the selection team. The top three firms were present to make a brief presentation to Council, followed by a question and answer period. 6:18 pm L Ahrens Companies Richard Ahrens presented a PowerPoint presentation outlining their brief history, accolades and testimony of similar projects. (See attached) Mayor Hill said he wanted to be careful about the aesthetics of the building and asked what it would take to make their design more appealing. Fernando Savala, licensed architect, responded there were many options to keep it within price to make it more palatable and compatible with the area. Council Member Dodd asked if the building would be lead certified. Mr. Ahrens said it wasn't requested in the RFQ documents but they could prove the required points necessary for certification, but it would cost $10-15K more to become certified. Council Member lovino asked if a scaled down, rolled bay door would be possible as depicted in their Palm Beach Garden Fire Station photo. Mr. Ahrens said their six doors were $250K. Regular City Council Meeting April 10, 2019 Page Five Vice Mayor Kinchen noted the front of building faces Airport Drive West and the rear will face Roseland Road with a huge buffer so residents won't see too much of the building. 6.40 pm ii. Wrjoht Construction Scott Loiacano presented a PowerPoint presentation describing their work methodology. (See attached) 6.57 pm Mayor Hill said he appreciated their zero change order philosophy and their aesthetic design. Mr. Loiacano said they would be hiring local subcontractors with Wright Construction supervision. Council Member lovino said he appreciated the one-way entrance, function of the building layout, one year start -to -finish, the zero change order, and the cyclic punch -out list. There will be showers which are not depicted in the slide. While they did not anticipate building a lead certified building, Mr. Loiacano said the desired level should be discussed at the construction design phase. The City Manager noted it was not requested in the RFQ that the project will be completed in a year, but it is to be a phased project. 7.00 pm iii. W & J Construction Eric Kauffman, President, introduced his associates and presented a PowerPoint presentation. (See attached) He noted that W & J Construction is the closest to the City and 70% of their business involves municipalities. Mayor Hill asked how they could make the building more aesthetically appealing. Mr. Kaufman said they could come up with some siding, overhangs or a more prominent entry feature would add to the appearance of the building. Mr. Kauffman said there is no learning curve with his team and their main focus was to bring to the City a pleasing building at a competitive local market cost. 7.09 pm 19.050 AA. Selection of Desirn-Build Contractor for New Public Facilities Comoound and Authorization of City Manaaer to Neaotiate a Work Service Aoreement The City Manager asked Council to rank the three firms, then direct staff to negotiate the final design, contract and maximum price. Mayor Hill recommended that Council choose 1) Wright Construction, 2) Ahrens, then 3) W & J. Council Member Dodd agreed with Mayor Hill's ranking. Vice Mayor Kinchen said all three presentations were great, she could go either way with Wright Construction and Ahrens. MOTION by Mayor Hill and SECOND by Council Member Dodd to begin to negotiate with 1) Wright Construction, 2) Ahrens Companies, then 3) W & J Construction. Award As -Needed Concrete Construction Service I leements to Santa Cruz Construction. Inc. and Tim Rose Contractinq. Inc. and Xuthorize the Citv Manager to Execute the Aoorooriate Documents (Transmittal. RFB. Resoonses) The City Manager said proposals went out on three different occasions and this time Santa Cruz and Tim Rose Construction responded. He asked for dual award because there were different pricing structures based on what will be needed. MOTION by Council Member Dodd and SECOND by Council Member lovino to award as - needed concrete construction service agreements to Santa Cruz Construction and Tim Rose Contracting, Inc. AD rove Pipoy-Backina of Collier County A reement with Eric Ryan Corporation for Utility Audits for a Twelve (12) Month Period and Consecutive Automatic Twelve (12) Month Renewals and Authorize the Citv Manager to Execute prODriate Documents (Transmittal. Agreement. Lists. Recommendations. areement) The City Manager said Eric Ryan Corporation has given us a proposal to review and monitor our utility billing whereby the City would get to keep any savings they find after 20%. MOTION by Council Member Dodd and SECOND by Council Member lovino to approve an agreement with Eric Ryan Corporation to audit the City's utilities. Consider Lien Reduction and Diposition of Fine in Exchange for Developer's Aareement for 1671 U.S. Hiahwav 1 (Transmittal. Reauest. Calculations, Agreement) The City Manager stated the current owner of the building at 1671 U.S. Highway isrequired to clear up some fines before the new owner, AT&T, can move in. He asked City Council to consider reducing the fines so the building can be demolished and the land put back on the tax roll. Regular City Council Meeting April 10, 2019 Page Seven The Community Development Manager said to use the existing building for something in the future, the main cost would be to bring the building itself up to current code. She noted there is currently contract on the property and they plan to demolish it. Mayor Hill said he would defer to Council, but he didn't think the City should ask the owner to pay $400K to sell the property. John Walker, representative for the current owner, said his goal was to take direction from City Council, come to an agreement as to the dollar amount of the fines and facilitate whatever paperwork is necessary. Aaron Bowles said the site has been submitted for site plan approval, the building is going away. MOTION by Council Member Dodd and SECOND by Mayor Hill to reduce the lien amount to $10,000 and release all liens the City has against this property. The City Manager said the owner did pay approximately $2,447.64 in liens. Council Member Dodd said the amount in his motion would be minus what has been paid. Council Member Dodd asked the City Attorney if the lien amounts should be paid by the current owner, then the liens are released, and the property transfer would take place. The City Attorney advised that is correct, in addition to the bond requirement. Council Member Dodd said the $10,000 includes some unttacked hidden costs incurred by the City. The City Attorney advised in the code enforcement procedure, daily fines are meant to be a deterrent and encourage compliance; property owners shouldn't be allowed to sit idle for ten years and then receive a "get out jail" card because you have a buyer for the property. Resolution No. R-19-05 — Revised City of Sebastian Records Manacement Policies and Procedures (Transmittal. R-19-05. 2014 Policv) A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, ADOPTING A REVISED CITY OF SEBASTIAN RECORDS MANAGEMENT POLICIES AND PROCEDURES MANUAL 2019, AS THE CITY'S OFFICIAL RECORDS MANAGEMENT POLICY; PROVIDING FOR FUTURE AMENDMENTS BY THE CITY CLERK IN ACCORDANCE WITH UPDATED FLORIDA RECORDS LAW AND NON - SUBSTANTIVE ADMINISTRATIVE PRACTICES; PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH; PROVIDING FOR SCRIVENER'S ERRORS; AND PROVIDING FOR AN EFFECTIVE DATE. Regular City Council Meeting April 10, 2019 Page Eight The City Clerk advised some of the features of this revision included a shorter gratis time frame for services, the storage of newer technologies and requested approval. There was no public input. MOTION by Council Member lovino and SECOND by Vice Mayor Kinchen to approve Resolution No. R-19-05. Canal Vecetation Removal 7.32 pm Council Member Dodd said there has been a great amount of interest expressed on how we remove vegetation from the canal system; he has done a lot of research and finds there is a lot of evidence on both sides of how this should be done. He said there is currently a move underfoot by governmental agencies to shift the direction that they have being doing this and because of that, it warrants a discussion. He noted the City has cut down on the amount of spraying and the City Manager is working on alternative methods to remove the vegetation. He would like to bring this discussion out to the public and provide some formal direction to the City Manager to have him provide an outline of options for removal of vegetation from the canal system and cost estimate for each, with the pros and cons of the appropriate methods. He said he believed the less that is sprayed, the better; he can find evidence that the chemicals don't cause harm and that they do; the problem includes the weeds and the failing seawall. For the public input they were about to receive, Council Member lovino asked the public to speak fact, truthful information. Mayor Hill said they all have families in the City and it would be ludicrous to think that anyone would want to hurt the people that live here. He asked that the public input be limited to five minutes and that everyone be respectful of the viewpoints. Public Input Russell Herrmann, 586 Redwood Court, Vice President Friends of St. Sebastian River, said the Friends are very ecstatic that Council recognizes that there should be some research to make sure no one is injured; they look forward to the outcome. 7.39 pm Diana Bolton, George Street, said this is more than the seawall--glyphosate encourages algae blooms, kills sea grass and contributes to 15 different illnesses. She cited the outcome of recent lawsuits, which should be reason to worry. She offered to meet with the Council Members at their convenience to share her knowledge. She asked that pesticides be added to the City's fertilizer's ordinance and ban the use of glyphosate. Pamela Parris, Realtor, Vice President of Sebastian Property Owners Association, said she was diagnosed with non-Hodgins lymphoma on February 14. Regular City Council Meeting April 10, 2019 Page Nine Tawn Holstra-Austin said given her business experience, it is only a matter of time before the City will be held accountable for knowingly using these chemicals. Dr. Graham Cox, 1213 George Street, cited his credentials and offered to lend his expertise to their deliberations. He said the Florida Fish and Wildlife Commission is using the integrated plant management system. Mel Auston, 238 Dickens Avenue, said the $80M Monsanto (lawsuit) award would not have happened on a probability and if the application continues it will be a form of genocide. Bob Harkins, 662 Layport Drive, said he was concerned about the chemicals affecting his grandchildren. He said studies can go on and on and asked Council to make a decision. Mariana Trails, Roseland Road, said she would help find any alternatives. Cynthia Cole said she was grateful that Council was looking into this matter as she is chemically sensitive. Bob Stephen said Council would be heroes if the water going into the Lagoon was cleaned up. 7.57 pm Mayor Hill said he has degrees in environmental horticulture with a focus on soil fertility and pesticides; and has been a restrictive use applicator throughout the years. He has a very good grasp on what they are dealing with. The City Manager stated the City's SJRWMD permit requires us to keep the waterways functioning and flowing; the system is a weir structure to help with irrigation and prevent flooding during major storms; and mechanical cleaning is also used when the equipment can reach the canal. In 2013, the City cut back on spraying and where there is a dirt embankment in front of the canal walls, the applicators were instructed to spray only the cabbage palms trees and Brazilian pepper which are now encroaching into the canal. He is currently gathering cost estimates from contractors to remove the vegetation; and noted there were 26 gallons of concentrate used systemically on all of the City's lakes and canals last year. Mayor Hill said the City has a responsibility to provide for the quality of life and safety of the citizens in the most economical way we can. He does not buy the toxicity of Roundup which is a small piece of the best management practices the City is using. The City Manager said water lettuce and water hyacinths double their volume in every 7 days; the applicators spot spray to try to eliminate that growth once a month. Mayor Hill said he was proud of the City's strong environmental record Council Member Dodd requested a definition of the options (which can include Roundup) predicated on the problem, a public discussion be held, then a decision to be made based on the evidence that is presented, so that they can tell the residents the decision was the determined in the open and based on the evidence provided. Regular City Council Meeting April 10, 2019 Page Ten 8:15 pm The City Manager said he has been meeting with contractors and appreciated the opportunity to look at all of the options. Council Member Dodd said he is asking to communicate to the people by providing a document to City Council, allocate some time to talk and pick an option. MOTION by Council Member Dodd to have the City Manager provide City Council a document that outlines the options for removing the vegetation from the canal system as part of our maintenance responsibility and provide that to City Council with pros and cons and cost estimates. Council Member lovino asked to comment before proceeding and Council Member Dodd withdrew his motion. Vice Mayor Kinchen said she would like to see the other products that can be used included in the City Manager's report. Council Member Dodd said options other than herbicide should be included. Council Member lovino said this Council brings a wealth of knowledge to make good, informed decisions and the knowledge on both sides should be looked at. He said he supported Council Member Dodd's request. MOTION by Council Member Dodd and SECOND by Mayor Hill to provide City Council a document that outlines the options for removing the vegetation from the canal system as part of our maintenance responsibility and provide that document to City Council with pros and cons and cost estimates. CITY MANAGER MATTERS The City Manager reported that his lobbying effort in Tallahassee secured support for the Septic to Sewer Program however it was a long way before the budget reconciliation will be completed. 15. CITY CLERK MATTERS - None 16. CITY COUNCIL MATTERS A. Council Member lovino said beginning with the Septic to Sewer Program, Council is doing the right thing for the people and he was proud to be a part of it. B. Council Member McPartlan -Absent C. Council Member Dodd said the other night he watched a news show where the cities in the northeast were discussing how their police departments could become community oriented to change the way they are viewed by the public. He said that he thought they should come down to Sebastian or Indian River Shores where they will find how much the officers extend themselves out. He congratulated Chief Morris and her department for being innovative and suggested that maybe they can train the northern cities. 17.
