These improvements will effectively convert the existing conveyance into a Best Management Practice (BMP) wet detention treatment system in order to increase sedimentation control, reduce turbidity, and improve water quality of the stormwater runoff discharged to the St Sebastian River. The project will be constructed on approximately 7 acres of City owned property and right of way to treat stormwater runoff from neatly 615 acres of primarily residential development watershed. The project also Includes construction of a new control structure at the west end to control the discharge of run-off to the St. Sebastian River. This project has been Identified as a major component of the City's adopted Master Stormwater Management Plan, The SJRWMD permit for the project was obtained in 2006. The low bidder for the construction contract is Master Excavators, Inc., (MEI), with a bid of $897,133.50 and Council approved going forward with award of the construction contract to MEI on 10 January 2007. The amount of funding currently remaining in the project budget is $1,009,652,25 ($112,518.75 more than the low construction contract bid). It Is proposed to mMmk no more than $35,560 of that underun amount to the subject contract amendment to CDM for providing ongoing engineering services during contracting and construction for the project Any budgeted amounts not spent on this project will go toward funding of other projects within the Stormwater Capital Improvement Program. It should be noted the City has been advised by DEP that its grant application for $500,000 for this project, prepared in large part by CDM, is currently in process and, funding resources permitting, Is likely to be - awarded to the City perhaps as early as August 2007. Discussions with DEP, however, Indicate the CitUD could not take advantage of such grant on this project If the project Is substantially complete by me Urn the grant is ready for award (which may well be the case). City therefore has requested DEP consideration for applying the $500,000 grant to another stormwater capital improvement project that could take advantage of th "ant at a later date (i.e., the Collier Creek Dn., ng project). DEP has agreed to favorably consider such request and City, with CDM assistance, is therefore currently revising the grant application package to effect such transfer of the $500,000 grant opportunity to the Collier Creek Dredging project. RECOMMENDED ACTION Move to accept CDM proposal to provide professional engineering services during contracting and construction of the Twin Ditches Slormwater Retrofit Project for an upper limit amount of $35,550 with tasks to be performed and billed as Identified in the accompanying documentation. 636 WORK ASSIGNMENT UNDER PROFESSIONAL SERVICES ENGINEERING AND ENVIRONMENTAL SERVICES AGREEMENT CITY OF SEBASTIAN, FLORIDA TWIN DITCHES STORMWATER RETROFlT PROJECT. PHASE II - CONSTRUCTION SERVICES SCOPE OF SERVICES CDM shall.perform the following described engineering services related to bidding and construction services for the City of Sebastian (CITY) Twin Ditches and Middle Stonecrop . . Stormwater Retrofit Projects. TASK1.0 GENERAL ENGINEERING SERVICES These services shall include the following subtasks: Subtask 1.1 CDM will obtain the Front -End Documents from the City, review and prepare the contract documents, incorporate the technical specifications, and submit the complete package to the City for review. Subtask 1.2 CDM will consult with and advise the CITY and act as its representative as provided in the General Conditions of the construction contract. Consult with and advise the CITY as to the acceptability of substitute materials and equipment proposed by the Contractor when substitution is permitted by the Contract Documents. Subtask 1.3 CDM will make visits to the site at intervals appropriate to the various stages of construction to observe the progress and quality of the executed work of the Contractor and to determine in general if such work is proceeding in accordance with the Contract Documents. During such visits and on the basis of on-site observations; CDM shall keep the CITY informed of the progress of the work, shall endeavor to guard the CITY against defects and deficiencies in such work and may disapprove or reject work as failing to conform to the Contract Documents. Subtask 1.4 CDM will review and approve Shop Drawings and samples, the results of tests and inspections and other data which the Contractor is required to submit. Subtask 1.5 CDM will issue CTTY instructions to the Contractor and issue necessary interpretations and clarifications of the Contract Documents. Have authority as the =a representative, to require special inspection or testing of the work. Act as initial interpreter of the requirements of the Contract Documents regarding the execution and progress of the work. A-1 , M. Subfusk 1,6 .. Subfask 1.7 CDM will conduct a final check to determine if the work has been completed in accordance with the Contract Documents. TASKZ0 SPECIAL ENGINEERING SERVICES Activities performed under this task consist of supplementary and special engineering services required during the construction and implementation of the project Subfask 2.1 Prepare for the CITY a set of reproducible record drawings and two (2) blueline prints showing those significant changes made during the construction process based on digital files (AutoCAD) information furnished to CDM by the Contractor. Subtask 2.2 Provide services in connection with preparing final certifications of completion of construction. Aoorove CDM Twin Ditches Stormwater Retrofit Proiect Contract (City Enaineer 135-140 Transmittal. CDM Letter. Pr000sed Aareement) The City Manager gave a brief update and said the project will be funded by the 2003 stormwater bond. Mr. Neglia asked if this would prevent discharge to the SL Sebastian River and the City Manager explained this project identified by the 2000 Master Plan, will affect a different watershed area. On MOTION by Mr. Neglia and SECOND by Ms. Coy, item E was approved on a roll call vote of 4-0. 07.028 F. Aoorove CDM Middle Stonecroo Stornwater Retrofit Pro, act Contract (City 141.147 Enaineer Transmittal. CDM Letter. Proposed Aareement� The City Manager gave a brief report on the cost reduction and said the project will be funded by the 2003 bond. On MOTION by Ms. Coy and SECOND by Mr. Neglia, Item F was approved on a roll call vote of 4-0. 07.029 G. Ap�ove CDM Collier Canal Se wall Assessment and Desian Prolect Contract 149-159 ICIN Engineer Transmittal. CDM Letter, Pr000sed Aoreement) The City Manager gave a brief update on the project and advised the permitting process is almost done. Mr. Neglia noted the City is receiving a $500,000 Dept. of Environmental Protection grant for this project. Bob Audette, 755 Wimbrow Drive, Sebastian, clarified he works in the construction industry though not in the City and not in this realm, and said it is very important that people know the initial plan was submitted well before the Council decided not to go with curb and gutter, expressed Concerns about wildlife and widening, and swale work. He said it is important to Consider what might have happened if Council had not decided to go with curb and gutter. He said CDM had a lot of work to do of their own making and asked why should the City pay to fax this sorry plan. He said the new plan is to work within walls, which has a wading bird habitat which will take away a good part of the walking trail of Hardee Park. He noted that Hardee Park is lit up and did not understand how authorities determined it to be suitable habitat. Ms. Coy asked if there was room for negotiation in the contract.
