PEA UNION WAGE ARTICLE NEGOTIATION
MINUTES OF REGULAR MEETING
JUNE 28, 2019

Mr. Boettjer brought the meeting to order stating this is the first contract negotiation
meeting between the City of Sebastian and the Coastal Florida Public Employee
Association.
Mr. Boettjer stated the new contract will be a three-year contract beginning on October 1,
2019 and running through September 30, 2022, and he expressed appreciation to the
City for presenting the document in a legisl ative format.
Mr. Boettjer suggested reviewing each Article and, if both parties agree to that Article, it
will be tentatively agreed to, and those items will not have any impact on the negotiations.
Mr. Carlisle stated that, upon speaking with the Police Chief, the PBA and PEA both have
standard procedures that the Police Department has, and anything that the parties now
present agree upon will not impact the Department's Standing Operating Procedures/laws
which they have to follow.
Mr. Boettjer stated he is in agreement with that.
Section: Agreement and Preamble -- Tentatively Agreed.
Article 1 -- Union Recognition -- Tentatively Agreed.
Position Classifications -- Mr. Boettjer stated there are some changes that he suggested
be reviewed. Mr. Carlisle stated these changes are actually more in line with what the
employees are doing. The part-time golf course attendants previously were not part of
the union contract. They were classified as temporary/seasonal. The City has decided it
would be more beneficial to the attendants if they became part -time employees where
they would receive some benefits. They would now be included as union employees.

Mr. Boettjer stated he has had some discussions with Ms. Watson, and he doesn't see
any problem with the restructuring as set forth in this tentative agreement.
Equal Employment Opportunity/Affirmative Action -- Mr. Boettjer questioned if this is a
new paragraph. Mr. Carlisle stated it is. He further stated the original language was
somewhat vague. He had asked Ms. Watson to incorporate the EEOC Fair Labor
Standard Act so that the language is consistent with the PBA and PEA contracts. Mr.
Boettjer stated he had no problem with it. Tentatively agreed.
Article 2 -- Tentatively agreed.
Article 3 -- Bargaining Unit Representation/Bulletin Boards
Mr. Boettjer asked why the Bulletin Boards language was struck. Mr. Carlisle stated the
Bulletin Boards language was added, not struck. What was struck was Section 3.1, which
was redundant because the same language is in Section 4.1. So Article 3 will include
Sections 3.1, 3.2, and 3.3 as presently set forth with no changes. Tentatively agreed.
Article 4 -- Tentatively agreed with changes.
Article 5 -- Mr. Boettjer understands the add-on sentence in Section 5.2 is so the
employees understand that in the documentation the City is presenting to them, they are
signing it not as an admission of guilt, etc., but as proof that they have received notice.
Mr. Carlisle confirmed that. Tentatively agreed.
In Section 5.3, Mr. Carlisle would like to add language to the effect that this added
language is per Florida Statute 119 or as amended. Mr. Carlisle clarified that police
officers, firefighters, HR personnel are exempt from their addresses being revealed, but
their personnel records are not exempt from being revealed. Tentatively agreed.
The following sections will thus become 5.4, and 5.5.
Article 6 -- Tentatively agreed.
Article 7 -- Section 7.1, Subsection (d) tentatively agreed with changes.
In Section 7.2, the word "Such" will be struck and unit will become "Unit." The changes
in Subsections (a) and (b) are tentatively agreed to. Mr. Boettjer stated he will talk to the
union employees regarding the changes in Subsections (c) and (d), and this matter will
be tabled until the next meeting. Subsections (e) and (f) will also be tabled until the next
meeting.
Section 7.3, Subsections (a) and (b) -- Tentatively agreed. Discussion was had

regarding Subsection (c), and that subsection will be tabled until the next meeting.
There were no changes in Subsections (d) and (e), and they were tentatively agreed
upon. The language in subsection (e) will be addressed, and this will be tabled until the
next meeting. Subsections (f) and (g) have no changes and are tentatively agreed to.
Section 7.4. -- Subsection (a) will have the language adjusted and will be addressed at
the next meeting. Subsection (b) have no changes and are tentatively agreed upon.
Article 8 -- Mr. Carlisle stated the language referring to "steps" has been removed, as
the City does not have a step program. Mr. Boettjer tentatively agreed. The remaining
sections in Article 8 are tentatively agreed upon.
Article 9 -- Mr. Carlisle explained the changes in Section 9.1, Subsection (a) defined
who are family members. Subsection (c) sets out a schedule for bereavement time for
in-state versus out-of-state circumstances, part-time employees, and the limit on the time
after death that the bereavement time must be taken. Mr. Boettjer will send Mr. Carlisle
some samples of language regarding 12-hour shifts that has been used in other contracts.
Subsection (d) will be tabled until the next meeting. Subsections (e) and (f) were
tentatively agreed upon.
Section 9.2 -- Tentatively agreed with changes.
Section 9.3 -- All subsections, will be tabled until the next meeting.
Section 9.4 -- Tentatively agreed with changes.
Section 9.5 -- Tentatively agreed with changes.

Section 10.3 -- Subsections (a), (b), (c), and (d), contain no changes. Tentatively agreed.
Subsections (e), (f), and (g) are tentatively agreed to with changes. Subsection (h) --

Article 11 -- Sections 11.1 and 11.2 -- Tentatively agreed.
Section 11.3 shall have language inserted addressing the 6 0-day rule for requesting
vacation as well as language that requests for leave must be made at least seven (7)
days prior to the requested leave date. Subsection (a) shall add language that the
Communications Department employees and the Police Department employees shall
submit requests in writing. Subsections (b), (c), (d), and (f) contain no changes.
Tentatively agreed.
Section 11.4 -- Subsections (a) and (b) -- Tentatively agreed. Subsection (c) will be
tabled until the next meeting.
