SUMMARY STATEMENT
We are pleased to present a following plan of action for implementing
provisions of the "vision of the Riverfront,11 as directed by City
Council. The 1993 Plan of Action calls for a five (5) point plan
utilizing current fiscal year budget allocations. Essentially, the
plan would address improvements to Indian River Drive, park
improvements, the U. S. #1 median improvement project, relocating the
Chamber of Commerce to the 1959 City Hall Building, and revisions to
the Land Development Code, including rezoning certain areas of the
riverfront area.
A more detailed report is attached for your perusal and discussion at
the upcoming Workshop Meeting. I ask City Council to review each of
the five (5) items and direct staff accordingly.
RECOMMENDED ACTION
Move to accept the 1993 Plan of Action Dated, December 18, 1992 and:
1. authorize and direct staff to initiate improvements for Indian
10%, River Drive, 2. authorize and direct staff to initiate park
improvements. 3. authorize and direct staff to implement U. S. #1
median improvements, 4. authorize the City Manager to negotiate with
the Chamber of Commerce and S. authorize and direct the City Attorney
to prepare ordinances for rezoning and amendments to the Land
Development Code.

Introduction
The "Vision Of The Riverfront" report was prepared by a blue
ribbon citizens committee and contained a bold program to
preserve and enhance the City of Sebastian Riverfront area. The
city can begin implementing this plan in 1993 by the following
five point approach and by utilizing existing budget allocations.
The City, through cooperation with Indian River County and the
private utility companies serving our municipality, could greatly
improve Indian River Drive by constructing pedestrian and bicycle
ways and undergrounding utilities, could implement park
improvements, work with FDOT on the US #1 Median Improvement
Project, negotiate with the Chamber of Commerce to vacate the
existing property and relocate the Chamber into a new "Welcome
Center" utilizing the 1959 City Hall Building and by enacting
more flexible zoning and land development codes.

1993 PLAN OF ACTION
Indian River Drive Improvements
Boardwalk
A boardwalk at grade would would be constructed on the
eastern edge of the Indian Drive right-of-way. The Indian River
Drive right-of-way is approximately sixty six (66) feet wide and
in some cases greater. The boardwalk would be built at
essentially the same elevation as the street and would be bridged
or handrails installed only where needed for safety. The
boardwalk should begin at the Stevenson property and be
constructed Northward with available funds.
b. Bikepath
A bicycle path would be constructed within the west
right-of-way using existing funds and begin at Riverview Park and
extend north.. The bike path would be a six foot wide pavement
extension and properly maked as a bike path.
C. Utilities Underground
Fortunately, there are very few overhead utilities
along Indian River Drive. The primary electrical system (high
voltage) would most likely need to stay overhead. However, the
secondary electrical system (low voltage) and service drops to
buildings could be placed underground through cooperation with
FPL. The'City should contact FPL to see what programs may be
available and what cooperation is possible. Southern Bell
Telephone Company does have overhead lines along portions of
Indian River Drive. Fortunately, these are local lines which
serve the area and consist of only one cable assembly. The City
should contact Southern Bell to see what programs are available
and what cooperation could be accomplished. We would likewise
contact Falcon Cable TV.
d. "Theme" Lighting
The existing overhead street lighting system should be
replaced with "Theme" lighting with underground wiring. While it
may not be practical to install a "gas lantern" type fixture, we
may want to consider a standard "post top" fixture which is 18'
to 19' above grade with an enclosed 9,500 lumens street light on
a fiberglass pole.
e. Close Ditches
^ The City should ask Indian River County to close the
existing open drainage ditches for safety and to facilitate
bicycle path and other improvements within the right-of-way.
,ON f. Australian Pines Stumps
Indian River County would be requested to remove the
remaining Australian Pine stumps within the right-of-way.
g. Impact of IIS #1 Drainage Project
We should ask the County to coordinate their
improvements to Indian River Drive with FDOT and the proposed US
#1 Median Improvement Project. The FDOT project calls for
replacement of some culverts under Indian River Drive.
h. Renovate Pavement
Generally, Indian River Drive is in good condition and
there are no obvious major failure areas. However, the driving
surface needs to be renovated.
II Park Improvements
a. Stevenson Park
The FY -93 Budget allocates $35,000 for improvements to
the Stevenson tract, which is situated due east of Riverview Park
and Riverview Park North. The plans call for a boardwalk along
the water's edge, a parking lot, and landscaping improvements.
.IN The City should specify and bid these improvements.
b. Riverview Park North
The 2.2 acre tract known as Riverview Park North needs
to be carefully planned. The City should engage an engineer to do
the necessary site planning with consideration of closing a
portion of Fellsmere Road which would allow the new and existing
parks to be connected together as one.
C. Yacht Club Improvement
The FY -93 Budget allocates $65,000 for improvements to
the Sebastian Yacht Club. These improvements consist primarily
of extending the existing finger pier, constructing a breakwater,
and redecking the existing 350 foot fishing pier. The Boating
Improvement Fund ("BIF"), administered through Indian River
County, is providing $40,000 in funding.
III IIS #1 Median Project
a. Landscape Architect
The City has agreed to engage a landscape architect to
design the landscaping improvements within the Us 41 medians. At
our request, the FDOT has agreed to modify the type of curbs to a
type "F" (six inch straight back curb) which will allow trees
within the medians.
b. FDOT has asked the City to develop a landscaping plan.
FDOT has agreed to fund landscaping improvements within the medians
including pavement blocks, irrigation, trees, shrubbery, grass, etc.
^ C. The City will be responsible for the maintenance of the
landscaping improvements.
IV Chamber of Commerce Location
a. Relocate Chamber of Commerce
I propose to enter into an agreement with the Chamber of
Commerce requesting that the Chamber occupy the 1959 City Hall
Building located at US #1 and Main Street. This building should be
a "welcome center" with sufficient space set aside for displays by
the Historical Society, local art clubs, and Chamber of Commerce
activities.
b. Raze Existing Building
The existing Chamber of Commerce Building has little
long term benefit and, in my judgment, it would be most desirable
to raze the building to provide a panoramic view of the river at
this focal point in the center of the Riverfront area.
V Land Development Code
a. Update Code
The Community Development Director and Planning & zoning
00..� Commission are currently working on updates to the Land Development
Code which would provide much more flexibility in the Riverfront
district. Included in the proposed revisions would be to allow more
marine use in the commercial zoning designations and to allow more
general commercial zoning throughout the district.

The Director of Community Development addressed
concerns relative to proposed zoning amendments.
The City Manager stated he was asking for direction
to proceed as outlined (see attached) and then come
back to City Council with bidding items as they are
scheduled and for Council to refine the plan as
presented. He said he would return to city council
with further information on costs for underground
utilities and street lighting, proposal for the
Chamber of Commerce to take over the old library
building, razing of the old building, and concept for
Fellsmere Road and Riverview Park north.

A proposal from Rod Reed, Registered Public Land Surveyor
in the State of Florida to survey the corridor commonly
known as Indian River Drive was received and reviewed.
The survey will be a topographic survey from the south
city limits to the north city limits and will show
right of way locations, all improvements, and elevations.
I have reviewed the scope of services and the required
compensation and have determined that it is fair and
equitable with the proposed services.
RECOMMENDED ACTION
Move to approve the proposal for surveying from Rod Reed
Public Land Surveyor in the amount of $8,230.

RE: Riverfront Development - Survey Proposal - Rod Reed
At the direction of City Council to begin improvements along
the Riverfront Development District and Indian River Drive
for bicycle paths and pedestrian walkways, a survey will be
required to determine the location of existing topographic
features. A meeting was held with Rod Reed Registered Public
Land Surveyor who prepared survey information for Indian
River County for the installation of the sanitary sewer force
main. We discussed several approaches to determine the
existing location of the right of ways and improvements,
which included aerial photography. However, due to the long
and narrow area he explained a ground crew would be more cost
effective.
It has been my experience that whenever -a project of this
nature is considered for the construction of improvements
that adjacent property owners may not concur with the right
of way limits. When this occurs, the survey brings this
possible conflict to the forefront for discussion and
resolution. Without a proper survey the contractor could
.forcibly be stopped during his construction causing delays
and project costs overrun. It is understood that the survey
will not intercept all possible conflicts or resolve all
situations to both the city and owners satisfaction. There
will be certain cases in which title survey work will need to
be completed. However, it is vitally important that any
possible conflicts be determined prior to the installation of
the improvements.

The proposed fee does not exceed the statutory limits of the
Chapter 267 FS, "Consultants' Competitive Negotiations Act",
which is $10,000. Mr. Reed is uniquely qualified for this
project due to his extensive research of the Indian River
Drive right of way and his survey for the Indian River County
utilities which are constructed within the existing Indian
River Drive right of way.

RE: Riverfront District Surveying Proposal
Dear Mr. McClary:
We thank you for the opportunity to offer the expertise and
experience of Masteller, Molar & Reed Inc. relative to the
proposed referenced project. Upon field investigation of the
site, Masteller, Moler & Reed, Inc. proposes to furnish the
following:
1.) A route survey delineating the right-of-way lines
of Indian River Drive from the south city limits to
the north city limits. This also includes the
horizontal location of all visible structures,
utilities, pavement, signs, sidewalks and culverts
located within said right-of-way. We also propose
to locate the first (+/-) 50 feet of any road that
intersects into Indian River Drive.
2.) We propose to locate the shoreline of the Indian
River from the south city limits to the north city
limits along Indian River Drive.
3.) We propose to perform cross-section between the
right-of-way lines of Indian River Drive from the
south city limits to the north city limits on 150
foot stationing increments.
4.) We propose to show all adjacent land owners along
Indian River Drive from the south city limits to
the north city limits per the latest tax records
of Indian River County, Florida.
5.) We propose to monument the centerline or baseline
of Indian River Drive for construction or layout
use. This will include benchmarks set along the
route and the horizontal data will be based on the
State Plane Coordinate System of Florida.

6.) All information will be drawn on a 24" X 36" sheets
of vellum and will be at a scale acceptable to the
City of Sebastian. We will provide five (5) sets
of signed and sealed drawings together with a
floppy disc of the finished product.
All surveying services performed on this project will be in
complete accord with the surveying minimum technical standards as
set forth under Section 472 of the Florida Statutes.
We propose to perform the above described scope of services
for the lump sum fee of $ 8,230.00. The fee for our services does
not include any recording or filing fees.
For any and all subcontract services invoiced through our
office, there will be a 10% surcharge of the face amount of said
subcontractor's invoice, in order to cover the costs associated
with administration and coordination of the subcontractor's
services.
If at any time information must be forwarded to you by
express mail, these charges will be invoiced to you monthly.
Items not specifically outlined in this proposal are not to
be considered a part of this contract.

Any and all work performed, other than that specifically
contracted for within this general contract, shall be billed at

Nevertheless, no representations or warranties are made as to
the success, approval or the issuance of permits on any
application submitted by Owner/client based in whole or in part
upon the surveys prepared by Masteller, Moler & Reed, Inc.
Backcharges will not be accepted by Masteller, Molar & Reed,
Inc. unless we provide written agreement covering all corrective
action and the total amount of the backcharge necessary to
accomplish the corrective action.
d) Print Costs
Print costs include five (5) copies of each phase of each
survey as part of the surveying fee. All other prints and Xerox
copies requested by the client shall be billed to the client based
on a charge of $0.666/SF for blue line prints, $1.501SF for
sepias, $8.80/SF for mylars, $0.50 for each 8 1/2 x 11 copy, $0.70
for each 8 1/2 x 14" copy, and $1.00 for each oversized copy.
e) Price Guarantee
Prices quoted are firm for sixty (60) days from the date of
this proposal.

f) Contract Assicnment
While binding upon the parties, their successors or assigns,
this Contract may not be transferred or assigned without the
consent of both parties. The Owner/client reserves the right to
terminate this Contract within ten (10) days written notice.
Masteller, Molar & Reed, Inc. shall be compensated for services
performed to termination date.
If this proposal meets with your approval, please sign and
return one (1) copy of this letter as our formal Authorization to
Proceed.

HISTORY: At its regular meeting of January 6, 1993, the City Council
approved the 1993 Plan of Action for the riverfront project and authorized
staff to secure the necessary information for Council. Part 5 of the Plan of
Action was to amend the Land Development Code to provide more flexibility in
the riverfront district. Included in the proposed revisions would be to
allow more marine use in the Commercial zoning designations and to allow more
General Commercial zoning throughout the district.
LOCATION: Enclosed is a map detailing the area that the City would be
pursuing to have its land use and zoning amended to the new Riverfront
Commercial zoning district. This proposed amendment would not affect any of
the properties on the east side of Indian River Drive.
INTENT OF RC ZONING: In the past, the City has recognized that the proposed
amendment areas are too restrictive with its present zoning for present and
future development. The RC zoning will allow the majority of uses allowed
within the Commercial General zoning (excluding plant nurseries, secondhand
merchandising, vehicular services and maintenance and vehicular sales and
,lservice) and in addition, will allow marine commercial activities and

waterfront general activities. Currently, marine commercial and waterfront
general activities are only allowed within the GMC and MCR zoning districts
which are exclusively on the east side of Indian River Drive. Since there
are limited amounts of lands along the east side of Indian River Drive, this
would restrict these type of uses being developed.
ADDITIONAL USES WITHIN THE RC DISTRICT: The City Council may wish to include
residential uses, at least a single-family residence within the new zoning
district. This would allow some flexibility with the development to allow
both commercial and a residence within the zoning district.
If the City Council is inclined to go along with the proposed amendment, the
Council should direct the City Attorney to draft the necessary ordinances to
amend the Comprehensive Plan Land Use Map and create the new zoning district.
The amendment to the Comprehensive Plan would have to be submitted to the
Department of Community Affairs for their review and determination of
compliance.
RECOMMENDED ACTION
Move to direct the City Attorney to prepare the necessary ordinances to
implement the new Riverfront Commercial zoning district and land use
amendment.
i� RC, Riverfront Commercial District.
A. Purpose and intent. The RC district is established to
implement comprehensive plan policies for managing land designated
for riverfront commercial development.
B. Permitted uses. In this district, as a permitted use, a
building or premises may be used for only the below stated uses.
All applicable provisions of this code shall be satisfied,
including site plan review and performance criteria.
Permitted uses: single-family dwellings, administrative
services (public and not-for-profit), churches, synagogues and
other places of worship, clubs and lodges (public and not-for-
profit), cultural or civic activities, business and professional
offices, general retail sales and services, limited commercial
activities, medical services, parking lots, restaurants (except
drive-ins), trades and skilled services, marine power sales and
service (within enclosed buildings), bait and tackle shops, fish
markets, marine retail and electronic shops.
C. Conditional uses. In this district as a conditional use a
building or premises may be used for only the following conditional
uses upon compliance with applicable conditions stated in article
VI and all other applicable provisions of this Code, including site
^ plan review and performance criteria. The Planning and zoning
Commission shall ascertain if such conditions and provisions are
satisfied. Appeal of such decisions shall be heard by the City
Council.
Conditional uses: Nursing homes (including rest homes and
convalescent homes), protective services, public parks and
recreation, public and private utilities, bars and lounges,
enclosed commercial amusements, drive-through facilities (business
and professional offices only), farmers markets, gasoline sales,
hotels and motels, veterinary medical services, wholesale trades
and services, transient quarters and child care facilities.
D. Size and dimension criteria:
1. Minimum lot size: None; except ten thousand (10,000) square
feet for new subdivisions approved subsequent to the adoption
of this ordinance.
2. Minimum lot width: None; except seventy-five (75) feet for new
subdivisions approved subsequent to the adoption of this
ordinance.
3. Minimum lot depth: 125 feet.
4. Maximum building height: 35 feet.

a. Front yard with sidewalks, curb and gutters: None
required.
b. Front yard without sidewalks, curb and gutters: 6 feet.

expressed concern for a new zoning category

inquired why Planning and zoning recommendations were
not included in this backup and asked that they be

Manager said he was asking for concurrence with the

After three years of meetings and debates, it is time we move
forward with the planning and development of Sebastian's prime
asset, the Riverfront. Proper planning, zoning, architectural
review controls, sign ordinances and development of public
facilities such as parks, bike paths and pedestrian walkways are
absolutely essential if the area is to evolve in a cohesive and
uniform fashion.
With $100,000 budgeted for planning andimprovements, and the
most recent endorsement by the Planning and Zoning Board, it is
time for the council to formally establish the boundaries of the
Riverfront District and retain an independent professional firm
to develop a master plan for the area. Remember, the previous
Planning and Zoning and City Council both unanimously endorsed
the Riverfront Study which included the strong suggestion that a
master plan be developed.
in conjunction with defining the district and the hiring of the
planning firm, I would like to suggest that the city put
together an advisory board to coordinate the development of the
master plan. The board should include property owners in the
district, the city planning director, a representative from the
Tax Payer's Association and a representative from either the
City Council or Planning and Zoning Board. The Board would
ultimately report to Planning and Zoning or City Council and
would aid in the process to implement and establish the master
plan.
we are simply running out of time on this issue. Positive
decisions by the City Council setting clear-cut direction will
convey a confidence to investors and business people who, in
/1 turn, could help turn around the difficult economic times that

Get Rolling On Riverfront
Seleastlan's riverfront is an asset most small
towns in the United States would love to have. City
Council should stop dragging its feet and ensure the
preservation and enhancement of the riverfront.
Manning and zoning commissioners recently
ed to ask council whether it is interested in hir-
...g someone to design a master plan for the river -
front. Commissioners made the request after
discussing whether they should relax some of the
zoning restrictions along Indian River Drive, the fo-
cal thoroughfare in a proposed riverfront district.
The rezoning would have capped a series of
moves over the past 24 years to spruce up the
riverfront and create a core district.
In 1991, the Sebastian Riverfront Study Commit-
tee said council should designate a riverfront dis-
trict with an old fishing village ambiance, limiting
existing development and prohibiting new devel-
opment on the east side of Indian River Drive.
Since then, the city has taken a piecemeal ap-
proach to creating a district. In 1991, the city pur-
chased the CAV Corp. property on the west side of
Indian River Drive, between Coolidge and Harrison
streets, for;742,500. The property sits Idle.
Sebastian also built a 670 -foot boardwalk along
Riverview Park's eastern edge. The city has com-
pleted a survey of property along Indian River
Drive and drafted a conceptual plan for bicycle
paths and a walkway.
What's needed now is a master plan for the entire
riverfront. It's a plea that has fallen on the deaf ears
of council for more then two years.

Council should hold public hearings to determine
exactly what city residents and businessmen want
along the riverfront. Expanding Riverview Park
and preserving the river view, without abridging
private property rights, Is a logical first step.
Several city residents and businessmen have
made their pitches for other Items, from installing
gaslight -looking street lamps to placing a band
shell on the CAV Corp. property. Maybe the asphalt
on Indian River Drive should be replaced with red
brick
What's most important is that council decide what
the riverfront look like. It should be different than
the rest of the city, offer recreation, residences and
restaurants, and appeal to residents and tourists al-
ike.
Planning and zoning commissioners should not be
required to fly blind the next time a rezoning appli-
cation comes before them. Commissioners should
know exactly what city residents Bud fathers want.
The city has budgeted ;100,000 for the riverfront
this year. Council should hire a riverfront planner,
who could be retained as a city planner, find out
what residents want, then devise a plan.
Continued delays on a master plan indicate coun-
cil is not serious about enhancing the riverfront.
Rather, it appears council is willing to place the
riverfront in the hands of zoning commissioners
and whatever developer comes down the river next
hoping to build his dream business. A master plan
cannot watt.

At its special meeting of October 28, 1993, the Planning and Zoning
Commission made the following motion:
"The Planning and Zoning Commission is reluctant to modify any land use
regulations regarding the riverfront area without a master plan and strongly
urge the City Council to consider funding of creation of the master plan with
costs to be determined at a later date".
RECOMMENDED ACTION
Review the recommendation from Planning and Zoning Commission.

City Attorney to delete the second full paragraph in
10 of section 1.02 of the charter.

I make a motion for the attorney to meet with
Warren Dill, John Evans, and maybe Norma Damp to
rewrite the wording on the referendum for the ballot.
The City Attorney stated that Mr. Evans had suggested
rewording the second paragraph of section 7. Mrs.
Corum added that to her motion.

cease action on zoning at this time.

Herbert Sturm, 549 Saunders Street, Sebastian,
requested that Attorney Torpy's remarks be given
under oath.
The Assistant City Attorney read the two final orders
from the 19th Judicial Circuit Court Appellate
division to Herbert Sturm, advised that the 27
questions posed by Mr. Sturm are the same as those
presented in court, and City Council concurred,
following a brief discussion, that it hoped the issue
was done.

Subsequent to a discussion at the December 1, 1993 City Council
i-- workshop relative to Riverfront District proposed zoning and
Planning and Zoning Commission's recommendation to develop a
master plan for the district, the City Council directed staff to
contact all property owners in the area between Main Street and
Davis Street, and east of U.S. 1 to the river, to schedule a
meeting to determine what those property owners want to see done
to the area.
I am requesting that you compile a list of those property owners
and, in the meantime, I will request further direction to
ascertain whether the City Council wishes to meet with property
owners or have staff do so.

,p.� I thought it appropriate that I respond to Mrs. Ruth Sullivan's
recent letter to the Editor regarding Sebastian's Riverfront.
It is unfortunate that she continues to fight a worthwhile
project with misrepresentations and blatant untruths.
I take personal offense to her comments that I used my position
as one member in ten of the Riverfront Committee to expand my
personal agenda. All of us on the Committee labored hundreds of
hours in trying to develop a workable plan for the area. The
concepts put forth included a pedestrian walkway along the
River, a bike path, uniform lighting, landscaping, public boat
ramps, parks, a sign ordinance and an architectural review
committee. Certai,Lly all of these improvements benefit the City
as a whole and not just the businesses and property owners in
the area.
Mrs. Sullivan misunderstood the concept of forming a taxing
district. A separate taxing district should be set up so
property owners in the area, which would include our Captain
Hiram's property, pay for that portion of the improvements that
would benefit their property or business. An incremental tax
financing bond was suggested by the Riverfront Committee.
Captain Hiram's receives no special treatment from the City and
in fact, just last week contributed over $12,000 in impact fees
related to construction we are now completing on site. In

addition, our company employs over 100 people, has invested
nearly $3,000,000 in the community, pays in excess of $300,000
per year in property sales and liquor taxes and operates a clean
and environmentally sensitive business. The City should do
whatever it can to help and encourage similar businesses along
the waterfront to not only help its tax base but also to provide
jobs and opportunities for people who are moving to our area.
I can only hope our City leaders have the foresight to take the
steps necessary to ensure that our Riverfront develops in a
cohesive and systematic way.
Incidentally, Mrs. Sullivan, what's wrong with making a profit!?
