RE: Riverfront District
In May of 1991, the "Vision For the Riverf.ront:" was presented
to the City Council by the Riverfront Study Committee which
contained a program to preserve and enhance the City of
Sebastian Riverfront area. At its January G, 1993.meeting,
City Council approved the "1993 Plan of Action", which
/"N itemized a five point approach to the implementation of the
plan.
One point of action involves enacting more f..loxible zoning
and land development codes for the Riverfront area. Included
in the proposed revisions would be to allow more marine use
in the commercial zoning designations and to allow more
general commercial zoning throughout the distri.c.t. Following
several discussions, the planning and 'Zoning Commission
drafted the attached Riverfront: Commercial Divl:r.ir.t and
recommended the creation of a master plan prior to any land
use changes being implemented.
The City Council, at its workshop meeting of December 1,
1993, has directed staff to invite property owners from Main
Street to Davis Street, east of U.S. 1 to a meCt.iny to
discuss the zoning and land development .node cllangc-_s they
would like to see adopted. This meeting has bcen scheduled
for Tuesday, March 1, 1994, at 2:00 p.m. in the. City Council
Chambers. If you are not able to attend this meeting, feel
free to submit your written comments to:

RC, Riverfront Commercial District.
A. Purpose and intent. The RC district is established to
implement comprehensive plan policies for managing land designated
for riverfront commercial development.
B. Permitted uses. In this district, as a permitted use, a
building or premises may be used for only the below stated uses.
All applicable provisions of this code shall be satisfied,
including site plan review and performance criteria.
Permitted uses: single-family dwellings, administrative
services (public and not-for-profit), churches, synagogues and
other places of worship, clubs and lodges (public and not-for-
profit), cultural or civic activities, business and professional
offices, general retail sales and services, limited commercial
activities, medical services, parking lots, restaurants (except
drive-ins), trades and skilled services, marine power sales and
service (within enclosed buildings), bait and tackle shops, fish
markets, marine retail and electronic shops.
C. Conditional uses. In this district as a conditional use a
building or premises may be used for only the following conditional
uses upon compliance with applicable conditions stated in article
VI and all other applicable provisions of this Code, including site
plan review and performance criteria. The Planning and Zoning
Commission shall ascertain if such conditions and provisions are
satisfied. Appeal of such decisions shall be heard by the City
Council.
Conditional uses: Nursing homes (including rest homes and
convalescent homes), protective services, public parks and
recreation, public and private utilities, bars and lounges,
enclosed commercial amusements, drive-through facilities (business
and professional offices only), farmers markets, gasoline sales,
hotels and motels, veterinary medical services, wholesale trades
and services, transient quarters and child care facilities.
D. Size and dimension criteria:
1. Minimum lot size: None; except ten thousand (10,000) square
feet for new subdivisions approved subsequent to the adoption
of this ordinance.
2. Minimum lot width: None; except seventy-five (75) feet for new
subdivisions approved subsequent to the adoption of this
ordinance.
3. Minimum lot depth: 125 feet.
4. Maximum building height: 35 feet.
5. Minimum living area: N/A. -
6. Minimum building setbacks from property lines:
a. Front yard with sidewalks, curb and gutters: None
required.
b. Front yard without sidewalks, curb and gutters: 6 feet.
C. Side yard: 5 feet; except ten 910) feet when abutting a
residential district.
d. Rear yard: Ten feet; except thirty (30) feet when
abutting a residential district.
7. Maximum building coverage: 30 percent.
8. Minimum open space (pervious surface): 20 percent.

SUMMARY
Discuss the various alternatives for the City regarding developing the Indian River Drive
river front area.
There are currently three (3) methods available by local legislation: These are
(1) Creation of a Community Redevelopment Agency as provided
within FS 163.356, or
(2) Creation of a Special District, either dependent or independent of the
City Council as provided under the provisions of FS 189.404 (4), or
(3) Creation of a Community Development District as provided within the
provisions of FS 190.005 (2).
There are specific advantages and disadvantages for each, and the major points for each will
be discussed in detail.
RECOMMENDATION
I recommend the last approach and create a Community Development District with specific
functions and sunset provisions. The District could be titled - The "Sebastian River Front
Development District", and would be bounded on the north and south by the current City
limits, bounded on the east by the eastern City limits and the west by the western boundary
of the railroad right-of-way.
We would have to loan the initial funding (administrative costs), and allow the District to
utilize space in the "Teen Center". After the Utilities relocates back to City Hall, we could
move the Chamber of Commerce into the "Teen Center" with the District office.

Richard Taracka, 1320 Coverbrook Lane, Sebastian,
suggested a boat trailer parking fee.
The City Manager reiterated his recommendation to
create a Community Development District with a board
elected by the affected property owners in the
riverfront area as provided for in FS 190.005(2),
and use the north, south, and east city limits and
the western edge of railroad right-of-way as the
district boundaries.
City Council discussion followed.
TAPE I - SIDE II (7:57 p.m.)
Discussion continued. Mayor Firtion and Mrs. Damp
concurred with the recommendation. Mrs. Corum
suggested including all of Indian River Drive. Mr.
Oberbeck objected to the district. Mr. Freeland
,v►, expressed concern that all property owners in the
district have input.

The City Manager said if City Council is inclined to
look at the district, the next step is to have the
City Attorney develop a brief on legalities and
procedures, include a copy of FS 190.005, determine
whether Council wants to move forward, and if so,
adopt an ordinance. He said this would probably not
be accomplished before October.
Following further discussion, it was the consensus of
City Council that the City Attorney prepare the brief
with recommended boundaries.
Mr. Freeland inquired about the status of zoning
amendments as sent back to Planning and Zoning. The
Director of Community Development responded.
Mayor Firtion called recess at 8:03 p.m. and
reconvened the workshop at 8:11 p.m. All members
were present.

Vice Mayor Corum reiterated her recommendation for
the City to adopt a wellhead protection ordinance in
compliance with the Comprehensive Land Use Plan and
to direct the City Manager to order a schematic of
well field zone of influence.
TAPE II - SIDE I (5:45 p.m.)
The Utilities Director said if the water system is
sold to Indian River County, it is a moot point,
however, if the City retains ownership it is
important to look into. He said there are schematics
in Exhibit D in the Hartman and Associates report
relative to the consumptive use permit for the water
treatment plant that could serve her purposes.
The City Manager said it would be at least 30 days
until the County's decision is known.
It was the consensus of City Council to delay this
item until such time as it is known if the County
will purchase the system.

Vice Mayor Corum said she had invited Peter Jones to
address City Council on architectural and design
standards for the Riverfront.
Peter Jones handed out publications relative to
planning and design guidelines. He gave a brief
presentation on the establishment of design
guidelines and volunteered to assist the City.
City Council discussion followed relative to
"envelope" zoning for the Riverfront District.
Vice Mayor Corum suggested setting up an
architectural review advisory committee now to begin
to set up guidelines and make recommendations to City
Council.
Mr. Oberbeck suggested waiting until a planner is on
board.
Mrs. Damp concurred with Vice Mayor Corum.

Mayor Firtion suggested coming back in January to
consider a committee at a workshop, however, he told
Vice Mayor Corum she could certainly begin to seek
committee members.
Mr. Freeland suggested staff input be obtained and
discussed at a January meeting.
It was the consensus of City Council to conduct a
special meeting for this matter in January.
94.271 3. Amend LDC Re: Commercial Land Clearing Vice
Mavor Corum Transmittal dated 10/27/94. Refer

Mr. Oberbeck was excused from 9:37 p.m. to 9:39 p.m.
Vice Mayor Corum suggested establishment of a
regulation in the commercial district relative to
land clearing.
City Council discussion took place and a consensus
was reached to direct staff to look into Indian River
^ County's policy.
(Vice Mayor Corum asked for a resolution designating
the Hardee Oak an historic tree)
B. Mrs. Norma Damp
Mrs. Damp requested that the building at the Easy
Lake park be removed and the City Manager said he
signed a purchase order for its removal; inquired
whether when a garage permit is being sought are
there specific questions that can be asked prior to
permitting, to which the Director of Community
Development responded that there are only specific
guidelines for "detached" accessory structures and
that new guidelines are being considered to prevent a
similar situation from happening again; and
requested, relative to denying the American Cancer
Society move along-a-thon, alternatives be looked at.
C. Mr. Robert Freeland
Mr. Freeland discussed the denial of the American
Cancer Society and alternatives; and reiterated his
request for City Attorney billing.

SEBASTIAN WATERFRONT DISTRICT
Draft Work Program
1.0 PROSECT DEFINITION & SITE ANALYSIS
1.1 Formalize project (study) objectives, development
goals, work program and services to be performed.
1.2 Establish study area, prepare scaled project base
maps, aerials, etc.
1.3 Establish communication and task responsibilities
of City, Consultants, Public. Agencies, businesses,
land owners, merchants and all other interested
organizations and individuals that will be involved
in both the development and approval process of
this project.
Clearly, the future development of the City's
waterfront is a collective process, one that
requires the interest, input, review and approval
of the City as a whole.
^' 1.4 Develop and formalize a Project Schedule.
1.5 Gather, organize and review existing applicable
data for the study area from sources including
but not limited to: City, County, FDOT, DNR,
Army C of E, Marine Resources Council.
1.6 Analyze context of the property regarding
development and design implications. The analysis
would include but not be limited to: area growth
affecting development, available services,
accessibility (auto, pedestrian, transit,
watercraft), environmental setting, adjacent area
land use and development, related development
projects.
1.7 Develop study analysis derived from both man-made
and natural constraints and opportunities. Data
sources for this analysis would include, but not be
limited to: related City (and County) land
development and zoning regulations, property
ownership/vacant land assessment, property
easements (utility, etc.), existing vehicular
accessibility and traffic_ volumes, topography,
flood/drainage areas, vegetation, wetlands,
estuarine setting, unique physical features,
historical features.

1.8 Prepare synthesis map(s) of the site analysis.
1.9 Review.
2.0 DEVELOPMENT PROGRAM
2.1 Determine market feasibility of various types of
development in terms of land use types, densities
and building type quantities based upon anticipated
market demands.
2.2 Test and evaluate the development program against
the physical capacities of the site.
2.3 Test and evaluate traffic volume and circulatory
implications to the site and adjoining roadway
network.
2.4 Determine general infrastructure requirements of
the selected development program.
2.5 Refine and prepare development program.
2.6 Review.
3.0 WORKING REPORT
Prepare a Working Report illustrating and describing the
results of work accomplished in Sections 1.0 and 2.0.
This Report would document the Site Analysis and the
Development Program summarizing the conclusions and
recommendations from the efforts up to this time. The
presentation quality of this Report would not be
oriented toward use as a promotional tool but more of a
working summary; (a formalization of the Site Analysis
and the Development Program so that all participants are
in agreement that it is the "Basis for Design.")
4.0 DESIGN
4.1 Prepare Land Use Plans.
4.1.1 Using the Working Paper as the "basis for
design" and any adjustments authorized by
the City to the program, prepare no fewer
/1 than three alternative Land Use plans.
These plans will identify specific land
uses, vehicular and pedestrian circulation,
open space systems, preliminary landscape
concepts, development phasing and
approximate size of land use areas.
4.1.2 Review
4.1.3 Select and refine a final Land Use plan.
All of the elements of the Land Use plan
will be refined, including (but not limited
to) parcelization, vehicular access and
circulation, roadway widths, pedestrian
circulation, easement requirements,
environmental preservation zones, and a
suggested phasing strategy.
4.2 Review.
4.3 Prepare an Illustrative Master Plan for approval.
The Plan will include, but not be limited to the
^ delineation of the following: building
configuration and massing, parking (surface and/or
structured), pedestrian/non-vehicular circulation
systems, recreation and open space systems, general
landscape concept, infrastructure systems,
environmental/estuarine zones, and all related
statistics for the Plan.
4.4 Review.
4.5 Refine and finalize the Master Plan. This Plan
will provide the basis for a Sebastian Waterfront
District zoning, development framework and design
guidelines.
5.0 DEVELOPMENT FRAMEWORK AND DESIGN GUIDELINES
5.1 Using the Master Plan as its basis, establish a
Development Framework for the Waterfront District.
The Framework will define the City's intentions for
development of the District and creates the policy
basis for Design Guidelines and subsequent design
controls.
The Framework creates the basis for a cohesive,
functional and economically productive environment
by defining basic Framework Elements including land
.,
use and zoning, circulation and transportation,
landscape and hardscape, and development subareas.
This clear definition of the physical structure and
overall land use concept of the District will have
will have a number of benefits including:
* Exciting developers and public at large
as to the possibilities of the District.
* Assuring that all development will meet
the same high standard.
* Defining the essential public improvements
needed to stimulate and complement private
development.
* Assure the maintenance of the very uniqueness
of the City's Waterfront.
5.2 Review.
5.3 Using the Master Plan and Development Framework as
a basis, develop design guidelines for the
Waterfront District. The purpose of these
^ Guidelines will be to encourage, through private
and public investment, the development of the
District as a cohesive, functional and aesthetic
whole. The Guidelines will contain standards
addressing the major components of the physical
development of the District.
The Guidelines do provide a coherent statement of
the City's intentions and an overall approach to
achieving quality environments. The Guidelines
contain specific requirements which provide a
baseline for excellent design.
The Guidelines are not and cannot be all-inclusive.
Mere adherence to them will not in itself guarantee
or be sufficient to produce an excellent building
and a quality environment. No set of guidelines
can cover all circumstances. Rather, it is the use
and interpretation of these standards by the city
and qualified creative design professionals, fully
supported by committed developers and owners, which
produces the intended results.
5.4 Review.

,ON 6.0 ZONING OVERLAY DISTRICT
6.1 Using the Master Plan Guidelines and accompanying
Framework Plan develop the documentation required
for an overlay to the City Land Development Code
for the Waterfront District. The Overlay Zoning
would "dovetail" with existing related codes.
Elements should include, but not be limited to: use
and development intensity of land, parking and
loading requirements, pedestrian access,
performance standards for air, noise and water
quality, landscaping, screening and permitted and
special uses, lot size, coverage and yard
requirements.
6.2 Establish the process by which the development
review and approval takes place within the existing
Land Development Code framework. Inclusive in this
process would be the coordination with any
architectural review process.
6.3 Review.

A MOTION TO FORWARD THE RIVERFRONT STUDY COMMITTEE REPORT TO
THE CITY COUNCIL WITH THE FOLLOWING COMMENTS:
A:) WE CONGRATULATE THE RIVERFRONT COMMITTEE FOR THEIR
EFFORTS AND COMPLETENESS OF AN EXCELLENT REPORT AND WE
CONCUR WITH THEIR BASIC CONCEPT.
B:) IST PRIORITY OF ACTION IS TO AGRESSIVELY PURSUE THE
ACQUISITION OF THE ROAD RIGHT OF WAY FOR INDIAN RIVER
DRIVE WITHIN THE SEBASTIAN CITY LIMITS.
C:) 2ND PRIORITY OF ACTION IS TO OBTAIN ALL LAND POSSIBLE
EASTERLY OF INDIAN RIVER DRIVE BY DONATION OR PURCHASE.
PARTICULARLY THOSE PARCELS THAT ARE NOW NON -BUILDABLE.
D:) 3RD PRIORITY OF ACTION IS TO DESIGN AND BUILD A LINEAR
PARK EASTERLY OF INDIAN RIVER DRIVE.
E:) WE CONCUR IN THE RECOMMENDATION TO IMPLEMENT POLICIES TO

ALSO STATED WAS IN FAVOR OF THE PROPOSED IMPROVEMENTS TO THE
PARK ON THE EAST SIDE OF INDIAN RIVER DRIVE.
JOE MORSOWSKI CARNIVAL TERRACE STATED HE WOULD BE VERY
UNPOPULAR AFTER HE SPOKE. STATED HE WAS AGAINST OUT OF TOWN
BOATERS AND AGAINST THE CITY COUNCIL REGULATING THE ARTS, AND
CRAFTS AND OTHERS BEING BARRED FROM USING THE PARK AS WAS

STATED THE CAVCOR PROPERTY SHOULD BE SOLD TO A MOTEL FOR
REVENUE TO THE CITY SINCE THE COUNCIL DIDN'T WANT THE PARK
USED ANYWAY.
MARY PEROW TUNISON LANE STATED SHE WOULD LIKE TO SEE ALL THE
RIVERFRONT DEVELOPED AND NOT JUST ONE PIECE AND ASKED WHAT
WAS BEING DONE TO ACQUIRE THE REST OF THE PROPERTY.
JOHN STIRK 709 DOCTOR AVE - HIGH SCHOOL ENGLISH TEACHER
STATED THERE WAS NOTHING FOR THE KIDS" AND HAD THE CITY EVER
CONSIDERED A SKATEBOARD RAMP OR POSSIBLY FOUR OR FIVE PUTT
PUTT HOLES. HE IS DEFINATELY IN FAVOR OF BIKE PATHS AND
BENCHES. HE ALSO STATED THE CITY NEEDS TO STOP HAVING ALL THE
REPEAT STUDIES OVER AND OVER AGAIN AND SPEND THE MONEY ON
DEVELOPMENT OF THE FACILITIES INSTEAD. HE STATED HE DIDN'T
WANT TO SEE THIS FALL FArz LIKE EVERYTHING ELSE IN THE CITY

YOU CAN'T SEE THE WATER ANYMORE BECAUSE OF DEVELOPMENT AND WE
CAN'T WAIT TO ACQUIRE THE NEEDED PROPERTIES TO PUT IN THE
LINEAR PARK SYSTEM OR THEY WILL NOT BE AVAILABLE.
STATED THE PROPERTY NEXT TO THE YACHT CLUB WAS NOT PURCHASED
YEARS AGO WHEN IT WAS AVAILABLE TO THE CITY AND NOW A
RESTAURANT IS GOING IN THERE.

COMMISSION HOW MANY OF THEM USE RIVERVIEW PARK AND WHETHER IT
WAS USED ENOUGH TO WARRANT MORE IMPROVEMENTS.

IN MORE YOUNG PEOPLE ARE MOVING IN WITH CHILDREN AND THEY
NEED SOMETHING TO DO.
FRANCES VANDERVENTER OF SEBASTIAN LAKES STATED SHE AGREES
WITH THE POOL BECAUSE SHE HAD TO CALL THE POLICE ON SOME KIDS
SWIMMING IN ONE OF THEIR LAKES BECAUSE OF ALLIGATORS. STATED
SHE WANTED TO SEE THE RIVERFRONT PLAN IMPLEMENTED BEFORE IT
GETS AWAY FROM US.

MR. PRIORIE STATED START A PROGRAM WHERE THE PEOPLE OF
SEBASTIAN CAN BUY A FOOT OF BOARDWALK FOR $5.00 IT WOULD HELP
PAY FOR IT
MRS. KILKELLY STATED THAT OWNERS OF PROPERTY WEST OF US.
HIGHWAY 51 SHOULD BE LOCATED TO START LOOKING FOR CENTRALIZED
PARKING LOCATIONS. MR. WADSWORTH VOLUNTEERED TO HAVE THAT
INFORMATION WITHIN 10 DAYS AND BRING IT BACK TO THE
COMMISSION.
A MOTION TO STRONGLY RECOMMEND TO CITY COUNCIL THAT THEY
CONCUR IN FRDAP GRANT FOR AREA EAST OF INDIAN RIVER DRIVE AS
PROPOSED WAS MADE BY MR. THOMPSON SECOND MRS. KILKELLY
PASSED 6-1 WITH MRS. O'CONNOR VOTING NO. MR. SHROYER VOTED
FOR MR. FULLERTON WHO WAS ABSENT TONIGHT.
CHAIRMAN THANKED THE PUBLIC FOR ATTENDING AND STATED HE WAS
GLAD TO SEE ALL OF THEM THERE.

REFERENCE: Riverfront Development
Attached is a position paper from Planning and Zoning Commission
member Howard Goldstein.
At its regular meeting of November 17, 1994, the Planning and
Zoning Commission unanimously approved a motion to send this to the
City Council.
The motion adopts this as an official position of the Planning and
Zoning Commission regarding the Riverfront development and their
willingness to be there to proceed in any manner that may be
helpful in this endeavor.

I. Preliminary matters
A. It's past time to move. Every day that passes without a plan risks more bad
development upon our key asset, the riverfront area. The Planning &
Zoning commission is the correct body to address this matter. It would be
an abdication of our legal and moral responsibility to accept the specious
claim that only those who live in the area need be concerned with its
development.
B. The current plan
1. The problem
i. The present plan has clearly unacceptable elements. If this were not so,
the plan wouldn't have evoked the negative responses it received, nor
would council have rejected it out of hand as it did.
ii. There appears to be a massive confusion as to the uses of this area.
Despite comments by some proclaiming they do not want a tourist -type
area, the fact is that the riverfront is already a tourist area as exemplified
by the numerous bed -and -breakfasts, time share facilities, and lodging
facilities existing and proposed.
C. A better approach
1. Unacceptable elements crept in because the affected property owners were
00-41 not part of the process. This bodes poorly for the committee council
proposes to create in a few months should only the same players be
involved. Planning cannot occur in a vacuum.
a. We must reach out and active[ seek out those individuals who are on
record as opposing the old plan, involving them in formulating a new
plan.
b. Compromise must be the first goal. Discussion of architectural
standards and elaborate improvements is premature absent
agreeable compromises on the obviously contentious matters.
2. New ideas, enhancements on good old ideas, approaches
I. Staging the improvements
a. Some of the improvements to be first placed must benefit all the
residents so as to avoid the perception that the only business benefits.
A fishing or lookout pier for example would benefit all; it and similar
public -place improvements must be timed to precede or coincide with
the construction of clearly commercial improvements.

PON a. Parking is clearly problematic in this congested area. An on-site
solution for each and every business is not only impractical, it's a
non-starter as it is neither viable nor desirable
1) A municipal solution need not burden city residents. We should
examine the feasibility of parking meters, parking assessments
levied upon only merchants, and other solutions geared towards
protecting homeowners
2) Safeguards to protect developed sites should be formulated
iii. Financing, generally
a. External support
1) Outside funding in the form of grants from the Main St. USA
program and like organizations should be sought
b. Organic support
1) Tax -increment financing with a twist. Prof. Shoup of UCLA grad.

ON a. Specific beneficial waterfront uses should be identified and supported

sought to preserve their existence. Forcing out businesses and
residents that have always been on our waterfront is a valid concern
and to do so would adversely change the flavor of the area.
