The September 25, 2019 CRA Meeting Minutes were approved by a MOTION by Mr. Dodd and SECOND by Vice Chair Kinchen with a unanimous voice vole. B. Seotic to Sewer Grant Proaram I. Consider Grant Reauest for 13060 U.S. Highwav 1 — Merchriz Condo Association (Transmittal. Application. Deeds. Tax Receiot. Quotes) The Administrative Services Director stated this was a $5,000 grant request to remove one septic tank system. The Community Development Director advised that postcards have been sent out to all eligible property owners to conned to the recently installed gravity sewer line installed by Indian River County which will prompt an increase of future applications. MOTION by Vice Chair Kinchen and SECOND by Mr. McPartlan to approve the grant request to 13060 U.S. Highway 1. Item E2 - Citv Website Redesion Council Member Dodd asked if the annual $3,500 fee for the Ally Managed Service would be included in the annual maintenance fee to the contractor. (page 179) The Administrative Services Director responded it would be. MOTION by Council Member Dodd and SECOND by Vice Mayor Kinchen to approve the piggyback to GSA Contract GS-35F-0124U with Icon Enterprises, Inc. dba CivicPlus for the website redesign. Continued from October 9. 2019 Regular Meeting - Resolution No. R-19-29 — Partial Abandonment of Rear Easement 561 Benedictine Terrace (Transmittal, R-19-29, Site Mao. Staff Report. Summarv. Utility Aoorovals. ADDlication) A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, VACATING A PORTION OF A CERTAIN EASEMENT ON LOT 6, BLOCK 273, SEBASTIAN HIGHLANDS UNIT 10, PROVIDING FOR CONFLICTS HEREWITH; PROVIDING FOR RECORDING; PROVIDING FOR SCRIVENER'S ERRORS; PROVIDING FOR AN EFFECTIVE DATE. The City Attorney read the title to Resolution R-19-29. The Building Official said this is in regard to a pool that was installed without a permit in 2018 and was discovered during the abandonment of the easement; the non -permitted work was brought before the special magistrate in December 2018 with a continuance in July 2019 and today the permit is ready to be issued but Council must vacate the easement. He advised there were special conditions issued by the magistrate that the applicant must address before the close out of the permit to include the payment of some fees and fines. Carl Richards, 561 Benedictine Terrace, said he would like to have the matter resolved. The City Attorney advised that Council should consider the abandonment of easement as opposed to the accruing fines; once the pool is found to be in compliance, the property owner could request to have the fines reduced. Vice Mayor Kinchen asked if the portion of the decking beyond the easement would be staying out. The Building Official responded that it would be staying out; the pool itself was the problem. The City Attorney advised the fine reduction or forgiveness would have to come back to City Council at a later date; and the abandonment of any easement it is a matter of public necessity based on staff and the utility companies' recommendation. MOTION by Mayor Hill and SECOND by Council Member McPartlan to approve Resolution No. R-19-29. PUBLIC INPUT Cindy Geesey said in April 2016 she received a proclamation encouraging a rest, relaxation and romance program for active duty military couples. Since that time she has hosted 18 couples with the donations of generous Sebastian businesses. She said in 2020 she plans to host six couples and thanked Council for the 2019 proclamation. Regular City Council Meeting & CRA Meeting October 23, 2019 Page Six As a resident, Ms. Geesey thanked Council for their genuine love for the community, concern in maintaining a small town feel, dedication in doing research, and willingness to listen to all opinions. She encouraged fellow residents to do their research and choose experience and integrity next month. Richard Feldhann, Vice Commander American Legion Post 189, said the Post's architect, Todd Smith, submitted expansion plans to the City last June and have not heard anything. He asked why. Mayor Hill advised him that the City would look into it. Bob Stephen, 150 Concha Drive, said at the last meeting the City Manager refused to tell him what alternative product the City was using on the canals. He said that was unacceptable. He advised everyone to get out and vote. Pamela Parris, Gerald Street, Vice President SPOA, local reallor, Sebastian Construction Board Member, community advocate said she reached out to citizens to find out what was paramount on their minds. She asked if there was proof that the Graves Brothers Annexation will not have any septic tanks. Mayor Hill advised her to contact the City Clerk for the law. She asked if three council members disapprove the Graves Brothers annexation, would the 'order' be suspended. Council Member Dodd responded that a Council action cannot be brought back unless one who voted in the majority brought it back up. He noted if she was elected to Council (in November), she could not bring it back up --only he or Mayor Hill could bring it back up. Ms. Parris said the City Manager had an alternative for the canal spraying and asked for an update. Mayor Hill responded that the City Manager was finalizing a plan and he would bring it forward when he is finished. Russell Herrmann, 586 Redwood Court, said he was concerned that the annexation vote was taken before a thorough airing of the issue by the citizens; the vote shows a lack of sensitivity to the public and lack of judgement. He asked for a public forum to explain the pros and cons of why it should be done and discover the mechanics to get proper sewage service to the property. 14. NEW BUSINESS 19A41 A. Resolution No. R-19-32 Parkir 0-in-Lieu Aareement for 1550 Indian River Drive — Crab StoD Restaurant (Transmittal. R-19-32. Aareement) A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, APPROVING PARTICIPATION IN THE PARKING IN LIEU OF PROGRAM, LIEN AGREEMENT AND COVENANT RUNNING WITH THE LAND, FOR ELLEN L. GRAFF FOR PROPERTY LOCATED AT 1550 INDIAN RIVER DRIVE, SEBASTIAN, FLORIDA; PROVIDING FOR TERMINATION, CONFLICTS, AND SCRIVENER'S ERRORS; AND PROVIDING FOR AN EFFECTIVE DATE. Regular City Council Meeting & CRA Meeting October 23, 2019 Page Seven The City Attorney read the title to Resolution No. R-19-32. The Community Development Director said the Crab Stop has been finding success in Sebastian and are now asking to expand their seating and parking leading to their request to purchase four spaces. She said this would bring the Parking in Lieu of Account to $55,000 to give the City about 20 spaces in the future to help the other businesses in the downtown area. The Community Development Director stated the restaurant was working diligently to resolve the site plan issue. Council Member Dodd said he has concern for the people who are doing work without permits then come in to ask for help. He noted the importance of obtaining permits and asked what steps have been taken to correct that. The Community Development Director stated she would like to give kudos to the Code Enforcement Division and Building Department for catching these violations before they go too far; the restaurant has until November 1" to correct their issue. CITY ATTORNEY MATTERS The City Attorney reported that he has received three individual applications and numerous inquiries from firms in response to the city attorney advertisement. He stated a comfortable salary range would be between $95,000 and $120,000 to post on the advertisement. The Administrative Services Director stated the average between $95,000 to $125,000 would be $110,000. The City Attorney said he expects to receive enough of a pool within the next few weeks to bring some applications to them. 16. ADMINISTRATIVE SERVICES DIRECTOR - None 17. CITY CLERK MATTERS - None 18. CITY COUNCIL MATTERS A. Vice Mayor Kinchen - None B. Council Member Dodd cited a TCPaIm Editorial, "Incumbents continue to poo poo residents' concerns about the spraying of alleged carcinogen glyphosate to kill weeds along the banks of the Elkham Canal," noting the meaning of poo poo was to disrespect and ignore. He said he wanted the Editorial Board to know they were absolutely incorrect. This spring as a result of many conversations with the residents about the use of chemicals, Council unanimously approved that the City Manager produce a report that specifies what needs to be done to address all of the vegetation. He said the report is in its final stage and under review by the new Slormwater Engineer. He advised that some will be surprised by the City Manager's findings. Regular City Council Meeting & CRA Meeting October 23, 2019 Page Eight He reminded everybody that Council, especially him, does not poo poo the residents and didn't appreciate reading on social media how little integrity they have and little care for the citizens. He urged the Editorial Board to check their resources and call him. He asked anyone that would like to receive information to call him noting his phone number is on the City's website. C. Mayor Hill invited the public to the Treasure Coast Food Bank's Fifth Annual "Pack the House' event to build 10,000 holiday meal boxes on Friday October 25 in Fort Pierce.
