B. Septic to Sewer Grant Proaram
i. Consider Grant Request for 1697 N. Central Avenue — Single Family
Residence (Transmittal, Application, Deed, Tax Receipt, Invoices)
The City Manager stated if approved, this property would tie into the gravity sewer
system and it was owned by Beth Sembler.
MOTION by Mr. Hill and SECOND by Mr. Gilliams to approve the grant request for
1697 N. Central Avenue.

C. Authorize Citv Manager to Enter Into Contract with Clark Sales Disolav for Annual

$21.610 for Years 2019-2021 (Transmittal. Pr000sal. Comparison)
The City Manager said this was a renewal of the existing contract the City has with
Clark Sales. He noted that FPL is gradually discontinuing the use of power on their
poles; they may be able to use battery operated garland on the poles in the future.
MOTION by Mr. Hill and SECOND by Mr. Gilliams to approve the contract with
Clark Sales Display.

AGENDA ITEM TITLE: Septic -to -Sewer Program Grant Application
RECOMMENDATION: Approve grant application up to the maximum allowed
BACKGROUND: In accordance with the Septic -to -Sewer (SSP) Grant Program, the
property owners at 805 Indian River Drive have submitted a grant application for the parcel
located within the CRA district. The applicant will be removing a septic system and connecting
to the Indian River County's wastewater sanitary system. The property owners have unified the
property with 803 Indian River Drive where an existing lift station was installed and services the
site. They now would like to remove the septic tank located at 805 Indian River Drive and tie
into the existing lift station. A complete grant application has been provided, including a copy of
the deeds, proof of taxes paid, and applicable invoices:
• 805 Indian River Drive —Joseph and Martha Graham — Commercial
If approved, award amounts are based on connection types at a 25/75% cost share. Properties with
septic systems with connection to available pressurized main sanitary sewer will receive award amounts
not to exceed $10,000. Based on the applicant's invoice from Meeks Plumbing, Inc. whose job
costs are $2,250 and the invoice from the Indian River County Utilities Department for $4,196
(cost for I ERU), the maximum grant that can be awarded is $4,834.50.

BACKGROUND: In accordance with the Septic -to -Sewer (SSP) Grant Program, a

Good afternoon Lisa and Paul,
We are appealing to your offices today to reconsider the city's position on denying our application to receive
reimbursement for septic to sewer conversion on our property located at 1620 N. Central Ave, Sebastian.
Lisa, you were included on copy from some of Michelle Faulkner's communication with us from October / early November;
here is the history of the job for your review:
After some two years of being aware that property owners would need to participate in the septic to sewer conversion
process, we diligently watched for communication and explanation of the timeline for execution. Even before we received
our assessment fee, Tom was on the phone with several city representatives (Jesse Roland was one), and we understood
from these conversations that "after completion of the city work, we would need a plumber to connect to city sewer. Grant
money can be used for connecting to the city sewer." At no time during these conversations were we advised that we
needed to apply to city council to move forward with the job.
In May 2019 when our assessment fee was issued, we promptly paid it so as not to accrue interest fees. This
assessment was in excess of $4,000, not a small sum! In July our hookup was completed by a plumbing contractor. At
this point, we thought we had done our due diligence to comply with the City of Sebastian's requirements.
The next part of the process went as follows: on September 19, Michelle Faulkner communicated with Tom via email and
attached the application for the SSP Grant - no mention was made of city council approval being needed. On September
26th, she and Tom discussed us providing proof of ownership for the property, property tax estimate, and contractor fees
which were supplied supplied in anticipation of the CRA meeting on Nov 20 when Paul Carlisle would be in
attendance. (Since then property taxes became due and typically get paid from escrow mid -November) Also, in another
effort to have city council understand our position, we had our property manager, Nancy Beeh, impart the above
information on our behalf at the September city council meeting, as we reside in California, and at that meeting we were
granted approval after the fact.
On October 16th, Michelle communicated that "the CRA board has already stated that they support your application being
submitted as an after the fact application, so I wouldn't worry." and that "no other steps were needed." We were surprised
to receive correspondence from Michelle on November 6 that the city will not be taking after the fact applications, despite
the fact that city council unanimously approved this request at the past meeting when our property manager was heard.
We respectfully request that the CRA board and City Manager's office reexamine our circumstances and allow us to
proceed with the septic to sewer grant application process as ultimately it was the city's intent to ease the financial burden

Recommendation: Provide direction moving forward with the site
Background: The City in 2018 purchased the property at 1215 Indian River
Drive formally known as the Harbor Lights Motel. The property at the direction of the Board
was separated to remove the east section from the west section of the property to preserve the
vista of the Indian River Lagoon. Staff has just recently received calls from people interested
in the property. One would like to restore the hotel site, the other is considering removing the
current building and constructing an office.
The City Manager asked staff to work on a cost to take down the structure, for him to bring
that back to the Board for consideration. With the new interest in the property, the City is
moving forward with an appraisal to determine the value of the property, with and without
the building.
The current land use is Riverfront Mixed Use designation, intended to provide a mixture of
residential, commercial, recreational, and institutional uses in the Riverfront District. The
current zoning is Commercial Waterfront Residential District (CWR). The Zoning Code has
been included with this transmittal.

(a) Intent. The purpose and intent of the CWR District is to provide a management

premises in a sales office and in up to a maximum of two model units;
(2) The on -site sales activity shall be limited to original developer sales;
(3) The sales activity shall be conducted inside the sales office and model units
so as not to be noticeable from the outside, except for permitted graphics;
(4) On -site sales activities shall be terminated upon completion of original sales;
and
(5) A minimum of one parking space for each two proposed units shall be
provided on site for the sales staff and potential purchasers' use during the
(marketing) sales promotional and construction phases.
(f) Conversions to time-share units. No development involving the conversion of an
existing dwelling unit to a time-share unit may take place unless the applicant
attaches to his application for zoning or site plan approval either:
(1) A copy of any information required by the state, including as may be
appropriate, a condominium declaration, sales prospectus, and/or other
documents required by the state in regulating the use. Such material shall
include a statement in prominent type declaring that time-share units will or
may be created with respect to units proposed; and/or
(2) An amendment to a prior existing condominium declaration that permits
time-share estates to be created, which amendment has been executed by
each record owner of each unit of the condominium and each record owner
of each lien on each unit of the condominium.
(g) Other required information. Applicants for a time-share use shall file with the city
all public documents required by the state in regulating such use. The purpose of
this requirement is to provide assurance that the applicant has been found in
compliance with all requisite state regulations governing the use, including method
of sales, operations, and other issues of public health, safety and welfare.
