The proposed development for the subject parcel is for construction of a 2,798 SF five -bay self service carwash facility, together with associated parking, water and sewer service, drainage, and landscaping. There are currently two (2) self-service car wash facilities in operation within the City that are similar in design and layout as the proposed. There are no reports or records of harm to the public safety, health or welfare from the operation of either facility. It is reasonable to determine based on these facts that the proposed will not be detrimental to the public safety, health or welfare or injurious to other properties or improvements within the immediate vicinity in which the property is located. 11. Is the use requested consistent with the purpose and intent of the respective zoning district, and can it be demonstrated to be similar in nature and compatible with the uses allowed in the zoning district? Although not in operation, the City Council did authorize a drive-through car wash facility for the Exxon station located just East of Fleming Street on CR -512. At that time it was determined similar in nature and compatible with the uses allowed in the zoning district. However, although it is located on CR -512, the underlying zoning for the Exxon is Commercial General. 12: Is the requested use consistent with the Comprehensive Plan and Code of Ordinances. Yes 13. Additional Considerations: In approving a special use permit, the City Council may require such conditions as will, in its judgment, substantially secure the objectives and intent of the zoning regulations. 13. Recommendation: Staff and the Planning and Zoning Commission recommend the City Council find the requested special use permit for a car wash on CR -512 is not detrimental to the public safety, health or welfare nor injurious to other properties or improvements within the immediate vicinity and the use requested is consistent with the purpose and intent of the C-512 zoning district, and it is similar in nature and compatible with the uses allowed in the C-512 zoning district. Schulke announced that City Council has appointed Mr. Smith to full member status. He noted that VC Mather is excused from tonight's meeting and Ms. Carbano(a) will be voting in his place. NEW BUSINESS: Attorney Stringer explained the Public Hearing and Quasi Judicial Hearing process. A. Recommendation to City Council — Public Hearing — Special Use Permit - Car Wash Facility — C512 Zoning District — K. Chestnut Randy Mosby of Mosby & Associates, Vero Beach, FL, was present representing the applicant. Randy and Tracy Hass were sworn in by the Chairman. PLANNING AND ZONING COMMISSION MINUTES OF REGULAR MEETING OF AUGUST 3, 2000 Mr. Mosby gave a brief presentation and addressed the drainage issue and the condition of the alley. Tracy Hass _gave staff presentation which recommended approval of the special use permit and the site plan with two conditions as outlined in the staff report. Mr. Mosby noted that the applicant is in the process of obtaining permits from Indian River County Utilities for a lift station and the water flow will be completely self- contained. He also noted that the water will be recycled with minimal discharge to public sewer. There was further discussion of the water source and disposal. It was also noted that this facility will have a restroom. Chmn. Schulke opened the public hearing at 7:23. Mr. Arthur Harris, 861 Dale Circle, commented that the two other car washes in town are enough, and spoke in opposition to this application. Ms. Shirley Harris of the same address spoke on this issue also. Ms. Mary Rose McCarthy, 874 Wentworth St., spoke in opposition to this permit. The issue of hours of operation were discussed and Mr. Hass noted that this is an issue that can be addressed. Mr. Mosby noted the buffers for the lights and suggested installing an eight (8) foot fence, and commented that this applicant would comply with the same hours of operation as allowed at the car wash facilities on U.S. #1. It was noted that an eight (8) foot fence would have to be approved by Planning and Zoning. The issue of stop bars, stop signs, and the placement of the sidewalk and bike path were discussed. Mr. Mosby agreed to include an additional stop bar and another stop sign at the property line. Mr. Hass read parts of the code that pertain to "drive-through facilities". Ms. McCarthy spoke again about the hours of operation. Mr. Kenneth Chestnut, 9848 — 880' St., Vero Lakes Estates, one of the owners of the car wash, spoke of his desire to keep a clean car wash and be on good terms with the neighboring residents. In the late 1989s, I had a preliminary planning conference with the Building Director/Planner for the city at that time. I asked about building a carwash on 512 in the city. He replied that my chances of getting a permit for a car wash on 512 in the city were from slim to none for the city envisioned Fellsmere Road as Light commercial and Office buildings. I bought a much more expensive property on USI and built my first car wash. In 1996 or 1997, 1 again approached the then Planning Director for the city. At our pre -planning conference 1 asked about building my second car wash somewhere on 512 in the city. I again was told quite frankly by the director that in his opinion I would not stand a prayer of getting a permit for this was not a project he could recommend on 512, for the future of 512 was toward Light commercial and Office buildings. Then he stated he would recommend the project in a more proper setting. So I had to buy a much more expensive property to build Sebastian Car Wash II on US1. If the past Planning Directors and City Officials had thought a car wash was appropriate for 512 it would have been built years ago by myself. But once the Planning and Zoning board approved the Chestnutt Car Wash I, immediately searched for and found an available property on 512 that suits my needs for a multi -use facility including a car wash. If the present council and planning department sees the 512 Corridor moving in a different direction then prior administrations, I want to be ready to act on it. There are no reports or records of harm to the public safety, health or welfare from the operation of either facility. It is reasonable to determine based on these facts that the proposed will not be detrimental to the public safety, health or welfare or injurious to other properties or improvements within the immediate vicinity in which the property is located. 11. Is the use requested consistent with the purpose and intent of the respective zoning district, and can it be demonstrated to be similar in nature and compatible with the uses allowed in the zoning district? Although not in operation, the City Council did authorize a drive-through car wash facility for the Exxon station located just East of Fleming Street on CR -512. At that time it was determined similar in nature and compatible with the uses allowed in the zoning district. However, although it is located on CR -512, the underlying zoning for the Exxon is Commercial General. 12: Is the requested use consistent with the Comprehensive Plan and Code of Ordinances. Yes 13. Additional Considerations: In approving a special use permit, the City Council may require such conditions as will, in its judgment, substantially secure the objectives and intent of the zoning regulations. 13. Other Matters: The granting of a special use permit for this project is required due to car washes not being specifically provided for in the zoning regulations. Chestnut Randy Mosby of Mosby & Associates, Vero Beach, FL, was present representing the applicant. Randy and Tracy Hass were sworn in by the Chairman. PLANNING AND ZONING COMMISSION MINUTES OF REGULAR MEETING OF AUGUST 3, 2000 Mr. Mosby gave a brief presentation and addressed the drainage issue and the condition of the alley. Tracy Hass .gave staff presentation which recommended approval of the special use permit and the site plan with two conditions as outlined in the staff report. Mr. Mosby noted that the applicant is in the process of obtaining permits from Indian River County Utilities for a lift station and the water flow will be completely self- contained. He also noted that the water will be recycled with minimal discharge to public sewer. There was further discussion of the water source and disposal. It was also noted that this facility will have a restroom. Chmn. Schulke opened the public hearing at 7:23. Mr. Arthur Harris, 861 Dale Circle, commented that the two other car washes in town are enough, and spoke in opposition to this application. Ms. Shirley Harris of the same address spoke on this issue also: Ms. Mary Rose McCarthy, 874 Wentworth St., spoke in opposition to this permit. The issue of hours of operation were discussed and Mr. Hass noted that this is an issue that can be addressed. Mr. Mosby noted the buffers for the lights and suggested installing an eight (8) foot fence, and commented that this applicant would comply with the same hours of operation as allowed at the car wash facilities on U.S. #1. It was noted that an eight (8) foot fence would have to be approved by Planning and Zoning. The issue of stop bars, stop signs, and the placement of the sidewalk and bike path were discussed. Mr. Mosby agreed to include an additional stop bar and another stop sign at the property line. Mr. Hass read parts of the code that pertain to "drive-through facilities". Ms. McCarthy spoke again about the hours of operation. Mr. Kenneth Chestnut, 9848 — 88 h St., Vero Lakes Estates, one of the owners of the car wash, spoke of his desire to keep a clean car wash and be on good terms with the neighboring residents. He expressed his opinion that 10:00 pm seemed like a reasonable time to close this facility. John Scherer, 841 Wentworth Street, agreed with a 10:00 pm closing time, and commented on the water usage and disposal. Chmn. Schulke closed the public hearing at 7:51 pm. Mr. Barrett suggested the Commission consider the 10:00 pm closing time as a condition of approval. Mr. Smith also noted the sidewalk issue. The members also mentioned the eight (8) ft. high opaque fence. The location of Performance Overlay zones is established by the City of Sebastian based on the need for special protective measures in that area. The underlying uses in the area, as determined in Chapter II of this Code, remain undisturbed by the creation of the Performance Overlay zone. The Performance Overlay zone merely imposes additional or different development standards than those that would otherwise apply. SECTION 54-4-21.2: PURPOSE The overall purpose of these regulations is to: a. Promote an attractive and inviting corridor, b. Provide for a sufficient amount of attractive and well-maintained landscaping to complement buildings and structures within the corridor. c. Encourage development of attractive buildings within the condor, d. Ensure unobtrusive and orderly signage that averts a garish and visually cluttered appearance along the corridor. e. Encourage creative designs and buildings of quality; f. Foster creative approaches that result in buildings of enduring character through use of quality design and building materials; and g. Make the Overlay Districts consistent with their vision statements. SECTION 54-4-21.3 SPECIAL REGULATIONS AND EXEINIPTIONS A. Exemptions. Within the Performance Overlay Districts, the following exemptions shall apply: Single-family development and redevelopment shall be exempt from all Performance Overlay District special development regulations. 2. Industrial and storage buildings located within an industrial district shall be exempted from foundation planting landscaping requirements and architectural building requirements only if no building facades abut a residentially zoned area or front on public or platted roads. All industrial buildings shall satisfy the color requirements. Electrical substations and similar public or quasi -public facilities that prohibit access by the public onto the site may be exempted from architectural/building requirements, if the exempted building(s) and equipment will be visually screened from adjacent properties and roadways. B. Uses. With the following exceptions, uses within the Performance Overlay Districts shall be as specified in Article V of this Code. 1. Outdoor displays. No outdoor displays shall be permitted unless approved by the Planning and Zoning Commission pursuant to Section 54-3.10.2.D. 2. Uses with Vehicle and Service Bays. Uses involving vehicle and service bays that are oriented perpendicular to CR 512 are allowed only if a Type "B" buffer with a four (4) foot high opaque feature is provided along the site's CR 512 frontage. CR512 OVERLAY DISTRICT REGULATIONS SECTION 54-4-21.13.1 INTENT "As a significant business and residential center and a major entranceway into the City of Sebastian, the corridor will have an attractive, well maintained, orderly and uncluttered appearance. The Corridor will be characterized by impressive vegetation and landscaping; complementary buildings and signs with enhanced designs and aesthetic appearances; and a safe transportation system that accommodates mass transit, pedestrians, bicycles, and other transportation alternatives, as well as automobiles." SECTION 54-4.21.B.2 BOUNDARIES OF THE CR 512 CORRIDOR The boundaries of the CR 512 Overlay District shall include all the properties which abut CR 512 and that are located within the City limits of the City of Sebastian. If any additional segments of CR 512 are subsequently duly annexed into the City, land development along the said newly annexed segment shall be consistent with the City's Land Development Code, including this Article. In the CR 512 Overlay District, the following special regulations and exemptions shall apply to new development and redevelopment. SECTION 54-4-21.133: ARCHITECTURALBUILDING STANDARDS A. Prohibited Architectural Styles. The follow are prohibited: Corporate signature or commercial prototype architecture, unless such is consistent with these special corridor requirements. Examples of such prohibited architecture include flat roofed convenience stores, gas stations, and canopies for gas stations, car washes, and drive through facilities. 2. Any kitsch architecture (such as a building that does not resemble a typical structure), including structures or elements that resemble an exaggerated plant, fish, edible food, or other such items such as giant oranges, ice cream cones, dinosaurs. 3. Any architecture having a thematic reference that is so different from current design philosophy that such reference is inconsistent and/or incompatible with surrounding structures. Examples of such include: igloos, domes or geodesic domes, quonset style structures, teepees, log cabins, western "false fronts", medieval castles, caves, and the like. B. Special Provisions 1. Industrial and Storage Uses in Commercial and Industrial Districts. Compliance shall be required only for those facades fronting on residentially designated areas or public or platted roads. However, industrial buildings shall satisfy the color requirements. 2. Residentially Designated Properties. The following materials are approved for use in residentially designated areas: fiberglass or asphalt shingle -style roofing for sloped roofs and visible roof structures, and textured plywood as a finish product. Rooftop screening devices shall not be required for attic ventilators or plumbing roof vents on residentially designated properties. However, roof ventilators, roof vents, and the like shall be located where they will be least visible from roadways. Shopping Centers And Out -parcels. The materials, exterior finishes, signage and colors of shopping centers and structures developed on shopping center outparcels shall be compatible and harmonious with each other as determined by which structures are developed first. This requirement may be waived by the Planning and Growth Management Department if: a. The initial shopping center or outparcel was built prior to the enactment of the CR 512, special regulations and b. It is determined by the Planning and Growth Management Department that enforcement of this requirement would conflict with the intent of these CR 512 special requirements. 4. Electrical Substations and Similar Uses. Electrical substations and Similar uses that prohibit access by the public into the site may be exempted from all architectuml/building requirements by the Planning and Growth Management Director if the exempted building(s) and equipment will be visually screened from adjacent properties and roadways. C. General Design Criteria 1. Buildings with facades fronting on more than one street shall have similar design considerations (e.g. roof treatment, building articulation, entrance features, and window placement) and consistent detailing on all street frontages. 2. General prohibitions and restrictions: a. Flat, blank, unarticulated, or massive facades fronting on a roadway, exclusive access drive or residentially designated areas are prohibited. Facades fronting such roads, drives, or areas shall be designed to incorporate architectural elements providing breaks in the planes of exterior walls and/or roofs to articulate the building and to lessen the appearance of excessive mass. Facades should incorporate elements relating to human scale, and can be divided by use at proportional expression of structure, openings, arcades, canopies, fenestration, changes in materials, comice details, molding details, changes in the heights of different sections of the building, and the like (stepping or sloping of a parapet wall in conjunction with a low sloped roof is prohibited). Flat, blank, unarticulated, or massive fonder will be permitted on the sides of a building when building is constructed to the allowable zero (0) foot side setback. b. The following materials or systems are prohibited as a finish and/or exposed product: corrugated or ribbed metal panels, smooth finish concrete block (standard concrete masonry units), precast concrete tee systems, plywood or textured plywood. Plywood shall be allowed for soffit material. c. The location and distribution of specific types of commercial activities shall be determined based on the following considerations: Trip generation characteristics, including impact on transportation facilities and off-street parking systems; • Location and site requirements based on specific needs of respective commercial activities, their market area, anticipated employment generation and floor area requirements; • Compatibility with and impact on nearby residential and other surrounding commercial activities; • Relationship to surrounding land uses and natural systems; and • impact on existing and planned community services and utilities. All commercial development shall comply with the Comprehensive Plan, performance criteria in Chapter III, as well as all other applicable land development regulations. Following is a description of the purpose of each zoning district herein established, including reference to the Comprehensive Plan Future Land Use Map designation which shall be implemented through the land development regulations. SUBSECTION 54-2-5.3.1 COMMERCIAL -512 DISTRICT (C-512) A. INTENT. The C-512 district is established to implement Comprehensive Plan policies for managing land designated for commercial development along segments of C.R. 512. I. Traffic Impacts Along C.R. 512 Corridor. The purpose and intent of the C-512 district is to provide a well-planned and equitable growth management policy for directing future development within the C-512 district boundaries. The existing pattern of development without such regulation violates accepted principles and practices of traffic engineering, county road policies and standards, and adversely impacts the safety, welfare, and convenience of the motoring public. This statement acknowledges the fact that C.R. 512 is identified as an arterial highway on the major thoroughfare plans of both the City of Sebastian and Indian River County. Both acknowledge that C.R. 512 is a major regional transportation facility linking U.S. 1 and I-95, and also linking the cities of Sebastian and Felismere with Indian River County, and the City of Vero Beach urban areas to the south. 2. Plan for Off -Street Parking and Controlled Curb Cuts. The purpose and intent of the C-512 district is also to restrict the location of curb cuts within the district, require compliance with a master plan for parking and curb cut control, and regulate the timing and intensity of land development in order to alleviate potential traffic congestion along the C.R. 512 corridor. Although presently land within this district is relatively undeveloped, if the regulations prescribed herein were not duly adopted, future development within this district would generate unsafe and dangerous conflicts in traffic flow along C.R. 512. The :proposed development shall comply with all codes and ordinances of the city of Sebastian and reasonable conditions affixed to the site plan by the -Planning and Zoning Commission and/or the City Council. H. Compatibility of Building Lines. No structure within the C-512 district shall be set back more than eighty-four (84) feet from the front property line in order to ensure a uniform pattern of development along the CR 512 corridor. SUBSECTION 34-2-5.3.2 COMMERCIAL LEMTED DISTRICT (CL) A. INTENT. The CL district is established to implement comprehensive plan policies for managing land designated for limited commercial development. Areas designated for limited commercial development shall not accommodate large-scale retail sales and trade activities generally serving regional markets. Such stores usually differ from limited commercial shops since the former generally require a larger floor area, carry a relatively larger inventory, and require a substantially greater off-street parking area. Uses which are not accommodated within the limited commercial area include the following: large scale discount stores or supermarkets; department stores; wholesale and warehousing activities; sales, service or repair of motor vehicles, machine equipment or accessory parts, including tire and battery shops; automotive services centers; and fast food establishments with drive-in or drive-through facilities. It was his recommendation that Council approve the special use permit if it finds the use meets this criteria. The City Attorney said Council also has to find that the project is consistent with the Comprehensive Plan and Code of Ordinances. He then cited a discrepancy in language in Exhibit 3, Section 54-4-21.B.3.A.1 and C.2.c relative to canopies. He also noted that the Exxon car wash was to be located in a different zoning district (PUD -C). The Growth Management Director said the intent of this code was not to prohibit car washes but to prohibit the canopies and flat roofs. City Council discussion followed on the location of the vacuum cleaners at the back of the building based on St. Johns River Water Management District on-site stormwater requirements; and the rear wall material changed to wood due to an existing easement and prohibition on erecting a masonry wall in an easement. Mr. Mosby submitted specifications relative to proposed low noise vacuums; and a revised site plan dated 1013100 for the record. Mr. Mosby said he would also submit a full set of plans following the meeting if the project is approved. Jean Carbano, Betty Avenue, Sebastian, spoke in favor of the request. Mr. Dill submitted the artist's rendering as an exhibit (will be on file in City Clerk's vault) and confirmed that the three page vacuum specifications that Mr. Mosby submitted should be entered into the record as an exhibit. Being no further input, Mayor Barnes called for a motion. Mayor Barnes opened the public hearing at 7:33 p.m., and the City Attorney read Resolution No. R-00-56 by title. Mr. Hill said he spoke to Mr. Chestnut briefly. The City Clerk swore in all those who intended to offer testimony. Attorney Warren Dill, representing the applicants, addressed City Council on a request for a special use permit for Chestnut Carwash and introduced Ken Chestnut, Brian Jenkins, Randy Mosby, and Chuck Emory. Mr. Dill submitted, for the record, and described Exhibits 1, 2, and 3; five photos labeled 1-5 depicting existing uses on CR512 and described them (see copies attached). A rendering depicting proposed landscaping along the CR512 corridor was exhibited. Mr. Dill continued his presentation and presented, for the record, photos labeled 6-9 depicting the rear of other car washes; and a paper entitled "Conditions of Approval" (see copies attached). Randy Mosby, Mosby and Associates, described his background and experience in projects within the City and County; said the project is not detrimental to the health, safety or welfare of the community and is consistent with the ordinances of the City; and noted that all required permits have been received. He described the enhanced landscape and architectural design. Chuck Emory, representing all parties in the real estate transaction on the property, said he believed the project will enhance property values in the area.
