SUMMARY STATEMENT
APPROPRIATION
REQUIRED:
Mary Flood is requesting permission to construct a single-family dwelling at
1716 Indian River Drive. Section 20A -3.12(D) of the Land Development Code
requires residential uses to obtain site plan approval from the Planning and
Zoning Commission and a special use permit from the City Council. On December
7, 1989, the Planning and Zoning Commission approved the site plan and the
Commission has recommended approval of the special use permit.
RECOMMENDED ACTION
Move to direct the City Attorney to draft a resolution for the special use
permit and set the public hearing for February 14, 1990.

APPLICATION FOR SPECIAL USE PERMIT
In accordance with Section 20A-2.6, Land Development Code, the
City Council may, in its sole discretion, grant a special use
permit in any district for a use which is not provided for in the
zoning regulations. All such uses shall not be otherwise
illegal, and shall not be specifically prohibited pursuant to the
comprehensive plan or other applicable law or regulations.
The City Council shall not grant any special use permit under
this section unless it shall make findings based upon the
evidence presented to it in each case that:
1) The granting of the permit will not be detrimental to the
public safety, health or welfare or be injurious to
other properties or improvements within the immediate
vicinity in which the property is located; and
2) The use requested is consistent with the purpose and
intent of the respective district, and can be
demonstrated to be similar in nature and compatible with
the uses allowed in such district.
The fee for a special use permit is $150 (established by
Resolution No. R-88-09). In addition the applicant must provide
the City Clerk's office with a list of -the surrounding property
owners within a 200' radius of the subject property along with
the appropriate certified return receipt mailing fee (currently
$1.67 for U.S. mailing).

by the ROBERT L. FLOOD and MARY B. FLOOD, Post Office Box 277,
Sebastian, Florida 32958, their successors and assigns,
grantee,. conveys to grantee the following -described real

From the intersection of the easterly right of way of Old U.S.
Highway No. 1, and the South line of lands described in deed

CHAIRMAN KRULIKOWSKI SPEAKS ON THE PERMITS RECEIVED AND THE
SEWER HOOKUP REQUIREMENTS.
MR. THOMPSON CLARIFIES THE ACTUAL LOCATION AND WHETHER THE
HEALTH DEPARTMENT WILL APPROVE THE DRIVEWAY WITH A NORTH AND
SOUTH DRAINFIELD DIVIDER.
MRS. KILKELLY HAS SOME CONCERNS REGARDING WATER RUNOFF INTO
THE RIVER AND ASKS IF IT IS POSSIBLE TO TURN AROUND RATHER
THAN BACK OUT ON INDIAN RIVER DRIVE.
BRUCE STATES ORDINANCES ALLOW RESIDENCES TO BACK OUT ON
STREETS AND STATES THERE IS NOT ENOUGH ROOM FOR A TURN
AROUND.
MRS. KILKELLY ASKS IF THEY WOULD CONSIDER OYSTER MARL FOR
THEIR DRIVE RATHER THAN PAVING THE APPLICANT STATES YES THEY
WOULD.
MR. WADSWORTH ASKS WHY MARL IS ON SITE NOW FOR FILL AND THE
APPLICANT STATES THEY INTEND TO USE IT TO FILL THE WASHOUT
AREA WHICH WAS LOST IN THE STORM A COUPLE OF YEARS AGO OUT TO
THE MEAN HIGH WATER LINE.
MR. THOMPSON MAKES A MOTION THAT PLANNING AND ZONING
RECOMMENDS TO THE CITY COUNCIL THE APPROVAL OF THE SPECIAL
USE PERMIT FOR ROBERT AND MARY FLOOD AT 1716 INDIAN RIVER
DRIVE SUBJECT TO THE FOLLOWING CONDITIONS LISTED AS 1 AND 2
OF THE DECEMBER 1, 1989 TRC LETTER AND NUMBER THREE -- THAT
THE HIGHEST POINT OF THE ROOF SHOULD NOT BE MORE THAN 25 FEET
BUT THE CHIMNEY IS ACCEPTABLE ABOVE 25 FEET. AND FOUR THAT
DRYWELLS OR SOME OTHER ACCEPTABLE METHOD APPROVED BY THE
BUILDING DEPARTMENT BE PROVIDED AT DOWNSPOUTS FOR RUNOFF.
