Special Use Permit Application AMOUNT BUDGETED: SUMMARY STATEMENT APPROPRIATION REQUIRED: The applicant, Mr. Gideon, is proposing to operate a pet cremation business located in the C-512 zoning district. Since this use is not specifically mentioned within the C-512 zoning district or similar to any other use within any zoning district, this use would fall under the special use category of Section 20A-2.6 of the Land Development Code. Since this agenda transmittal is just to set the public hearing for the special use permit, staff will not present any documentation regarding this case. RECOMMENDED ACTION Set the public hearing for the special use permit. Staff is not recommending a date since the City Council has indicated they wish to have a special meeting for any special use permits. W APPLICATION FOR SPECIAL USE PERMIT In accordance with Section 20A-2.6, Land Development Code, the City Council may, in its sole discretion, grant a special use permit in any district for a use which is not provided for in the zoning regulations. All such uses shall not be otherwise illegal, and shall not be specifically prohibited pursuant to the comprehensive plan or other applicable law or regulations. The City Council shall no -t --grant any special use permit under this section unless it shall make findings based upon the evidence presented to it in each case that: 1) The granting of the permit will not be detrimental to the public safety, health or welfare or be injurious to other properties or improvements within the immediate vicinity in which the property is located; and 2) The use requested is consistent with the purpose and intent of the respective district, and can be demonstrated to be similar in nature and compatible with the uses allowed in such district. The fee for a special use permit is $150 (established by 41,50-00 Resolution No. R-88-09) . In addition the applicant must provide A0.03 the City Clerk's office with a list of the surrounding property owners within a 200' radius of the subject property along with the appropriate certified return receipt mailing fee (currently `'- ���• 0.3 $2.29 for U.S. wailing). Particulate emissions averaged 0.025 grains per standard cubic feet (gr/SCF) corrected to 7% Oxygen and 0.04 pounds per hour (lbs/Hr) which is within the permitted limit of 0.100 gr/SCF at 7% 02 and 0.20 lbs/Hr. Carbon Monoxide emissions averaged 32 parts per million (ppm) corrected to 7% 02 and 0.025 lbs/Hr. The limiting standards are 100 ppm at 7% 02 and 0.10 lbs/Hr. Visible emissions averaged 0.0 percent opacity for the highest six minute of the one-hour test (see Appendix E for data sheets and observer's certification). Emission Summary with sample calculations, field data and laboratory data, and CO emission summary with strip chart copies are presented in Appendices B, C, and D, respectively. 2 3.0 PROCESS DESCRIPTION AND OPERATION The Crawford Multiple Chambered Incinerator (CMCI) Model C -500P is designed to incinerate bio -hazardous waste in an environmentally clean manner. A multiple chamber concept is used to provide complete combustion of the work. Figures 1, 2, and 3 provide schematics of the system. The primary chamber incorporates solid hearth. The primary incineration chamber has a Natural Gas Burner. After a 30 minute preheat period, the bio -hazardous waste is loaded into the primary chamber and th-e burner is fired at 175,000 BTU/Hr (high fire) until the temperature stabilizers above 1000°F at which time the unit switches automatically to low fire (100,000 BTU/Hr). The secondary chamber is designed with a two step process to optimize combustion. At the exit of the incineration chamber (inlet to the secondary chamber) air is injected into the hot combustion gases to provide additional oxygen for continued combustion. Also, at the bottom of the chamber a gas burner is fired at 450,000 BTU/Hr (high fire) until the temperature stabilizes at 1800 ° F or higher then switches to low fire (300,000 BTU/Hr) . Both primary and secondary chamber temperatures are continuously monitored. Residence time in the secondary chamber was calculated from the stack test data and stochiometric constants and averaged 1.33 seconds for the three test runs. Since this use is not specifically mentioned within the C-512 zoning district or similar to any other use within any zoning district, this use would fit within the special use category of Section 20A-2.6 of the Land Development Code. Section 20A -2.6(B) states, It Required findings of fact. The City Council shall not grant any special use permit under this section unless it shall make findings based upon the evidence presented to it in each specific case that: 1. The granting of the special use permit will not be detrimental to the public safety, health or welfare or be injurious to other properties or improvements within the immediate vicinity in which the property is located; and Page 2 2. I have enclosed a copy of the C-512 zoning district regulations which specify the permitted uses and the conditional uses within this zoning district. Staff would find that the retail portion of this business would be compatible and similar in nature to other general retail sales and services that are permitted within this district. The cremation and service provided for the individual could conceivably be similar in nature to veterinary medical serviceslif you were to look at the conditional use criteria that is required to be met before a veterinary service could be approved within this district. Section 20A-6.1 (C)(27)(b)(1) requires a veterinary medical service to be within a completely enclosed building which shall be adequately soundproofed and constructed and utilized so that emission of odor or noise shall not detrimentally impact property in the immediate vicinity. The only concern staff has regarding this use would be the emission of odor or smoke that would be detrimental to the immediate vicinity. The applicant will present at the hearing evidence that this equipment meets all EPA requirements and does not emit smoke or any odors to the outside air. Provided that the applicant can submit sufficient documentation to substantiate that there will be no detrimental impact to the immediate area based on the above concerns, staff has no objections to the granting of this special use permit for Mr. John Gideon. This district is in- tended to include all lots abutting the south side of County Road 512 which are included in the following blocks lo- cated within respective plats of the Sebastian Highlands Subdivision: Blocks 485, 490, 492, 508 and 509 located within Plat Unit 12; Tract A located within Plat Unit 14; Blocks 188 and 189 located within Plat Unit 6; and Blocks 185, 186 and 187 located within Plat Unit 8. The linear distance of the C.R. 512 arterial is approximately ten thou= sand (10,000) linear feet or 1.89 miles. The district includes approximately two hundred fifteen (215) platted lots of Supp. No. 15 134 LEGAL BASIS AND GENERAL PROVISIONS § 20A -3.8(A). record, eleven (11) dedicated roadways intersecting with C.R. 512, and two (2) dedicated alleys intersecting with C.R. 512. Along the ten thousand (10,000) linear feet of C.R. 512, the existing platted lands yield a potential for two hundred twenty-eight (228) total curb cuts into C.R. 512, an average of one curb cut for every forty-four (44) feet of road frontage. 2. Traffic impacts along C.R. 512 corridor. The purpose and intent of the C-512 district is to provide a well planned and equitable growth management policy for directing future development within the impact corridor of the C-512 dis- trict boundaries above defined. The existing pattern of de- velopment without such regulation violates accepted prin- ciples and practices of traffic engineering, county road policies and standards, and adversely impacts the safety, welfare and convenience of the motoring public. This state- ment acknowledges the fact that C.R. 512 is identified as an arterial highway on the major thoroughfare plans of both the City of Sebastian and Indian River County. Both acknowledge the fact that C.R. 512 is a major regional transportation facility linking U.S. 1 and I-95 and also linking the cities of Sebastian and Fellsmere with Indian River County and the City of Vero Beach urban areas to the south. 3. Plan for off-street parking and controlled curb cuts. The purpose and intent of the C-512 district is also to restrict the location of curb cuts within the district, require com- pliance with a master plan for parking and curb cut con- trol, and regulate the timing and intensity of land devel- opment in order to alleviate potential traffic congestion along the C.R. 512 corridor. Although land within this dis- trict is at present relativity undeveloped, if the regulations prescribed herein were not duly adopted, future develop- ment within this district would generate unsafe and dan- gerous conflicts in traffic flow along C.R. 512. B. Permitted uses. In this district, as a permitted use, a building or premises may be used only for the below stated uses. All ap- plicable provisions of this code shall be satisfied, including, but Supp. No. 15 135 § 20A -3.8(A). Conditional uses: Public protective and emergency services, gasoline sales, public and private utilities, public parks and recreation areas, child care facilities, nursing homes, hotels and motels with kitchen facilities in units,. transient quarters with kitchen facilities; veterinary medical services, and acces- sory uses. D. Size and dimension criteria: 1. Minimum lot size: None; except twenty thousand (20,000) square feet for new subdivisions approved subsequent to the adoption of this ordinance. 2. Minimum lot width: None; except one hundred twenty-five (125) feet for the new subdivisions approved subsequent to the adoption of this ordinance. 3. Minimum lot depth: None; except one hundred sixty (160) feet for new subdivisions approved subsequent to the adop- tion of this ordinance. 4. Maximum height: 35 feet. 5. All development proposals having C-512 designation must demonstrate that all land within the project is held under common ownership whether the proposal is submitted by an individual, a trust, a joint venture, an associa- tion, a limited liability company, a partnership or a corporation. F. Mandatory compliance with master parking' and curb cut control plan (MPCCCP). The MPCCCP is hereby adopted by ref- erence and shall apply to all developments within the C-512 dis- trict (see Appendix B). G. Expansion of uses to adjacent lot(s). An existing permitted land use within the C-512 district may be expanded to an adjacent lot or lots of less than one hundred twenty (120) feet width pro- viding that the following conditions are met and the site plan for the expansion is approved by the planning and zoning commis- sion: 1. The subject lot or lots shall be under unified control with the adjoining subject developed properties pursuant to sub- section 20A-3.8A(E); 2. All such extensions must be constructed as a contiguous extension to an existing structure on the adjoining lot. 3. The proposed development shall comply with all codes and ordinances of the City of Sebastian and reasonable condi- tions affixed to the site plan by the planning and zoning commission and/or the city council.
