FLORIDA 32958 305-589-4353 The legal description of the alley described in the ordinance X1148, 1957 is as follows: "A ten foot strip of land running between North Central Avenue and the West right-of-way line of the new right-of-way for U.S. No. 1; said ten feet being the center ten feet of said Lot 7, and the Northerly boundary of said alley lying 22 1/2 feet from the North boundary of said Lot 7 and the Southerly boundary of said alley lying 22 1/2 feet from the South boundary of said Lot 7, said measurements being along the East right-of-way of North Central Avenue and said alley running parallel to the North and South boundary lines of said Lot 7." A copy of the ordinance is enclosed. In addition, the ordinance purports to abandon an alley on the Southerly 10 feet of Lot 7. However, it appears that the alley- way at that time may have been either the Northerly 10 feet of Lot 7 or the Southerly 10 feet of Lot 8. (See enclosed sketch.) The property appraisers may also seems to show the abandoned alleyway as located between Lots 7 and 8. I thought this might be a good time to clear up the problem by abandoning any confusing interests by also abandoning any interests the public may have on any alleyway located on either the South ten feet of Lot 7, (as described in 1957 ordinance) or the Northerly 10 feet of Lot 7 or the Southerly 10 feet of Lot 8. We have found that here is a 10' alleyway through Lot 7 from North Central to U. S. 1. There is no curb cuts for this alley and it has obviously been forgotten since U. S. 1 was put through. We would appreciate the city abandoning this alley so we could clear the title on this whole piece of property. Mr. and Mrs. Paluch have purchased Lot 8 and Lot 7, less and except the N.22 1/2 feet, Hardee's Subdivision #B. This property is immediately North of Hoose's Restaurant between N. Central Avenue and U.S. #1. The title search showed that there is apparently a 10 feet alleyway located in the middle of Lot 7. Mr. and Mrs. Paluch are hereby requesting the City of Sebastian to abandon this alleyway to the Paluch's who also own the property to the South of the alley. The reason I enclosed item #3 was to illustrate that originally the alley appears to have been located between Lots 7 and 8 and not the Southerly 10 feet of Lot 7 as indicated in the 1957 Ordinance (Chapter #148). Either it was the Southerly 10 feet of Lot 8, or the Northerly 10 feet of Lot 7. While the City is abandoning the current alley, I thought it might be adviseable to clarify this point at the same time.
