I represent Edgar L. Schlitt, Trustee, who owns Lot
21 lying West of the Westerly right of way line of U. S.
Highway No. 1, and Lots 53 and 54 lying East of the
Easterly right of way line of the Florida East Coast
Railroad, in Wauregan Subdivision according to the Plat
filed in the office -of the Clerk of the Circuit Court
of Brevard County, Florida, in Plat Book 1, page 75,
and refiled in the office of the Clerk of the Circuit
Court of St. Lucie County, Florida, in Plat Book 1,
pages 178 and 179, said land lying and being in Indian
River County, Florida and the City of Sebastian.
My client desires to abandon the right of way between
Lots 53 and 54 and, additionally, to abandon the right of
way between Lots 21 and 53, all as shown on the Plot Plan
enclosed.
Additionally, I would like to discuss with the City
Council, the Council's intent for Wauregan Avenue.
I am sending a copy of this letter to the City Attorney.
Please advise when the City Council will review this request.

I represent Edgar L. Schlitt, Trustee, who owns Lot

53 and 54 and additionally to abandon right of way between lots 21 and
53, it will be necessary for you to research the records and contact each
individual property owner advising them of the wish of your client and
consequently to ask for their concurrence.

If and when all parties are in agreement, it will be necessary for us
to meet with you to determine what action, if any, the council will be
asked to take with reference to the future use of Wauregan Avenue.

In response to your letter of March 2, 1982, please find
enclosed a xerox copy of the plat for Wauregan Subdivision.
Edgar L. Schlitt, as Trustee, has entered into a contract
to sell Lot 21 east of U.S. Highway No. 1 and Lots 53 and 54
to the Diocese of Orlando for the purpose of the construction
of a church. The purchaser has requested that the seller obtain
an abandonment of both roadways shown in red and blue on the map
enclosed. A highest priority is the roadway between Lots 53 and
54.
I understand that the City would like to formulate a policy
as to Wauregan Avenue, and my clients would be happy to discuss
the City's plan on that item.
Tie do request that you authorize us to proceed with adver-
tising as to the abandonment of the roadway between Lots 53 and
54 as soon as possible. As you can see, the requested abandon-
ment would not adversely affect any other property owners.
Looking forward to receiving your appropriate authorization
and I again remain available if an appearance before the City
Council is in order.

Dear Mrs. Reid:
Reference is made to your letter dated March 24 to Arthur Mayer concerning
the referenced property and the request to abandon a right-of-way between
Lots 53 and 54.
I am also aware of a letter to Mr. Gass dated March 5, 1982, from Mr. Collins
with an attached map submitted on behalf of the Diocese of Orlando.
Please be advised that Mr. Mayer and I have reviewed various plans concerning
this request and made a field visit to the site during the afternoon of March
29. It is our recommendation that the Mayor and City Council grant the re-
quest for abandonment of the right-of-way between Lots 53 and 54. It should
be noted that the March 5 letter from Mr. Collins makes reference to the future
possibility of a request for abandonment of the right-of-way between Lots 21
and 53 which was marked in blue on the plan attached to his letter. It is
our recommendation that the Mayor and Council not grant any future request
to vacate a portion of Wauregan Avenue between Lots 21 and 53 due to the fact
that it is essential that Wauregan Avenue remain as a future street right-of-
way to serve the properties northwest and southeast of the properties in question.

hesitate to contact me if you have any questions.

SECTION I.
That the right of way located on, over and between
the following described property located in the City of
Sebastian, Indian River County, Florida:
Lots S3 and 54, WAUREGAN SUBDIVISION, according
to the plat filed in the Office of the Clerk of
the Circuit Court of Brevard County, Florida,
in Plat Book 1, page 75, and refiled in the
Office of the Clerk of the Circuit Court of St.
Lucie County, Florida, in Plat Book 1, pages
178 and 179, said land now lying and being in
Indian River County, Florida.

Father LeSage of St. Williams Parish has discussed with me as Trustee for the
property lying immediately south of the St. Williams Parish property, the possi-
bility of the abandonment of Wauregan, as it relates to their property.
As you may recall, when they purchased the property, we assisted in having Brevard
Avenue vacated to help accommodate their development, but now it appears that it
would be much to their preference to have Wauregan vacated instead. Our ownership
group does not object to the abandonment of Wauregan, so long as we do have access
to Wauregan as it runs to our property, and this can be accomplished by jogging
around their property if it is possible to again reopen Brevard, previously vacated
at our request.
If we knew for certain at this point how we would be developing the balance of our
holdings south of the parish property, we could more easily determine whether or
not all or part of Wauregan lying south of the church property might best be vacated.
In the meantime, we stand ready to be of assistance and still have the options open
as to the way our property to the south will be developed.
Our main interest is in trying to cooperate with Father LeSage in his efforts to
develop the new St. Williams Parish, and if we can be helpful in accomplishing
this, please let us know.

Dear Mr. Kilbride:
I am herewith enclosing a recent topographic survey by Carter
Associates,Inc.,Vero Beach,Florida with the areas of Brevard
and Wauregan Avenues to be abandoned (delineated by cross
hatching) and the proposed fifty -foot (50') right-of-way
north -south which the church intends to dedicate to the City
of Sebastian.Included with this proposed right-of-way is a
triangular piece of land adjacent to the westerly property
line which will also become the City's property after enacting
the ordinance which you will prepare for final abandonment.
The legal descriptions enclosed are written to reflect the
aforementioned areas of abandonment and dedication.
This proposed Site Plan was presented for preliminary review
to the Planning and Zoning Commission December 16,1982.There
were favorable comments from the board members and the City
Engineer,Earl Masteller was in agreement with both size and
placement of our proposed dedicated right-of-way.
We would like to move as swiftly as possible to final Site Plan
approval so we may proceed with construction of our new Parish
Center.If there is any way I might enhance the process of

MR. NELSON HYATT, REPRESENTATIVE, ST. WILLIAMS CATHOLIC CHURCH, INDICATED THAT BREVARD
STREET HAD ALREADY BEEN ABANDONED AND THAT IT IS THEIR PRESENT REOUEST TO RE-
OPEN BREVARD STREET AND ABANDON WAUREGAN AVENUE. HE EXPLAINED THAT PRESENTLY THERE
ARE THREE (3) PARCELS OF PROPERTY WITH TWO ROADS BREAKING THEM APART AND SINCE IT IS
THE INTENTION TO CONSTRUCT A BUILDING ON EACH PARCEL, IT IS FELT THAT THERE WILL BE
CONTINUOUS CROSSING WHICH MAY BECOME A SAFETY HAZARD.

OF SEBASTIAN A MINIMUM OF 50 FEET NORTH, SOUTH, RIGHT OF WAY, WEST OF WAUREGAN
AVENUE. HE ALSO MENTIONED THAT AN ORDINANCE WOULD HAVE TO BE PREPARED TO FINALIZE
THE ABANDONMENT.

EARL MASTELLER, CITY ENGINEER, REPORTED THAT A 16" PIPE HAD BEEN REMOVED FROM
MR. & MRS. WHITE'S SIDE YARD SWALE ON WIMBROW DRIVE, DUE TO SEVERAL UP STREAM
DRAINAGE PROBLEMS AND COMPLAINTS. HE EXPLAINED THAT IT IS NOW THEIR REQUEST TO
INSTALL A 24 " PIPE AT THE SAME LOCATION AND PAY THE DIFFERENCE BETWEEN THE TWO
DIFFERENT SIZE PIPES.
EARL MASTELLER, RECOPM9ENDED THAT THE SIDE YARD NOT BE PIPED, SINCE IT WOULD BE
SETTING A PRECEDENCE AND THAT IT WOULD NOT PROVIDE ANY GROUND WATER RECHARGE.

THE RIGHT OF WAY LOCATED BETWEEN BLOCKS•53 and 54,
WAUREGAN SUBDIVISION, LYING BETWEEN WAUREGAN
AVENUE AND THE FLORIDA EAST COAST RIGHT OF WAY;
• PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SEBASTIAN,
FLORIDA AS FOLLOWS:
SECTION I.
That the right of way located on, over and between
the following described property located in the City of
Sebastian, Indian River County, Florida:
Blocks 53 and 54, WAUREGAN SUBDIVISION, according
to the plat filed in the Office of the Clerk of
the Circuit Court of Brevard County, Florida,
in Plat Book 1, page 75, and refiled in the
Office of the Clerk of the Circuit Court of
St. Lucie County, Florida, in Plat Book 1, pages
178 and 179, said land now lying and being in
Indian River County, Florida.
and more specifically described as follows;
Beginning at the SW corner of Block 53, run 80
feet to the SE corner of Block 54; thence run
North on the East line of Block 54 a distance
of 299.77 feet to the NE corner of Block 54;
thence run 80 feet to the NW corner of Block 53;
thence run South a distance of 299.7, feet along
the West line of Block 53 to the point of
beginning.
be and the same is hereby vacated, abolished and abandoned.
SECTION I.I.
All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION III,
This Ordinance shall take effect immediately
upon becoming law.
