AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, ABANDONING
THE EIGHTY FOOT RIGHT-OF-WAY OF HARRISON STREET FROM THE
EASTRLY-I�DGE OF INDIAN RIVER BOULEVARD TO THE INDIAN RIVER;
AND ABANDONING THE EIGHTY FOOT RIGHT-OF-WAY OF JEFFERSON
STREET FROM THE EASTERLY RIGHT-OF-WAY OF INDIAN RIVER
BOULEVARD TO THE INDIAN RIVER AND FROM THE WESTERLY EDGE
OF INDIAN RIVER BOULEVARD WESTERLY EIGHTY-NINE AND EIGHT -
TENTHS FEET TO THE SOUTHERLY PROJECTION OF THE WEST PROPERTY
LINE OF LOT 15, ED�GEWATER PARR SUBDIVISION; PROVIDING AN

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN,
FLORIDA, AS FOLLOWS:
SECTION .1
The City of Sebastian, Florida hereby abandons the following
public streets as specified:
(1) The eighty foot wide street called Harrison
Street from the easterly edge of the right-
of-way of Indian River Boulevard (formerly
called Old Dixie Highway) to the Indian
River, the same being a distance of 91.15 feet,
more or less.
(2) The eighty foot wide street called Jefferson
Street from the easterly edge of the right-
of-way of Indian River Boulevard (formerly
called Old Dixie Highway) to the Indian
River, the same being a distance of 148.05
feet, more or less.
(3) The eighty foot wide street called Jefferson
Street from the westerly edge of the right-
of- _Y f Ixf iver Boulevard (formerly
ld Dixie Highway) � southerly pro ctio
of the west property line of lot 15,)brk
Edgewater Park Subdivision, as per plat book
1, page 23, Public Records of Indian River
County, Florida, a distance of 89.9 feet,
more or less.
SECTION II
This Ordinance shall be effective upon passage by the City
Council and upon recording of a copy of this Ordinance in the Public
Records of Indian River County, Florida.

Dear Sirs:
I represent the Florida Partnership known as "Good Guys" who purchased the
trailer park described in the attached survey. Despite the fact that the
survey refers to an abandoned right-of-way on both Harrison Street and
Jefferson Street we are unable to locate in the public records the aban-
donment. The surveyor's predecessor (Peter Musick) had indicated they
were abandoned in prior survey notes. To clarify the 'title to the
property and the public records I would request a formal abandonment of
Harrison Street and the northern 1/2 of Jefferson Street described as
follows:
Northern 1/2 of Jefferson Street bounded on the west
Southerly projection on the West line of Lot 15, Bleck
11, and bounded on the South by the centerline of 80'
right of way extended from its intersection with the
projection -of the west line of Lot 15 to the west right-
of-way to Old Dixie Highway AND ALSO the North 1/2 of
Jefferson Street extending eastward from the East right-
of-way of Old Dixie Highway to the edge of the Indian
River.
I would as soon as reasonably possible request an opportunity to meet
with you at a workshop or other meeting to discuss this natter with
you. The parcel north of Harrison Street was purchased by the City
of Sebastian and upon abandonment of Harrison Street reverts to the
abutting land owner, the City of Sebastian. Enclosed is a copy of
your deed.

Please find enclosed a copy of the recorded Warranty Deed dated
August 1, 1968 from R.S. Swing, a single man and J.W. Ball &
Ruth Ball, his wife to Orvis E. Coursey and Alice M. Coursey,
his wife. This is the property that is immediately South of the
southern road that we are requesting the city to vacate. You
had requested this in a telephone conversation we had. Please
advise me if you need any further documentation or information.

Council.

The Council of the City of sebastian, Florida, will hold

more or less.
(2) The eighty foot wide street called Jefferson
Street from the easterly edge of the right-
of-way of Indian River Boulevard (formerly OUB
called 0ld Dixie Highway) to the Indian
River, the same being a distance of 148.05
feet, more or less.
(3) The eighty foot wide street called Jefferson
Street from the westerly edge of the right-
of-way of Indian River Boulevard (formerly
Old Dixie Highway) to a southerly projection
of the west property line of lot 15,
Edgewater Park Subdivision, as per plat book
1, page 23, Public Records of Indian River
County, Florida, a distance of 89.9 feet,
more or less.
SECTION 11
This Ordinance shall be effective upon passage by the City
Council and upon recording of a copy of this Ordinance in the Public
Records of Indian River County, Florida.

SECTION I
The City of Sebastian, Florida hereby abandons the following
public streets as specified:
(1) The eighty foot wide street called Harrison
Street from the easterly edge of the right-
of-way of Indian River Boulevard (formerly
called Old Dixie Highway) to the Indian
River, the same being a distance of 91.15 feet,
more or less.
(2) The eighty foot wide street called Jefferson
Street from the easterly edge of the right-
of-way of Indian River Boulevard (formerly OV�
called Old Dixie Highway) to the Indian
River, the same being a distance of 148.05
feet, more or less.
(3) The eighty foot wide street called Jefferson
Street from the westerly edge of the right-
of-way of Indian River Boulevard (formerly
Old Dixie Highway) to a southerly projection
of the went property line of lot 15,
Edgewater Park Subdivision, as per plat book
1, page 23, Public Records of Indian River
County, Florida, a distance of 89.9 feet,
more or less.
SECTION 11
This Ordinance shall be effective upon passage by the City
Council and upon recording of a copy of this Ordinance in the Public
Records of Indian River County, Florida.

Dear Ms. O'Halloran:
Florida Power & Light has reviewed the request set
forth in the letter dated August 28, 1987, for an
abandonment of the referenced easement. We have
established that there are existing facilities in
the area for which the request for abandonment was
made.
Florida Power & Light has been in touch with the
property owner and has requested an easement for
that portion where the facilities exist. Once
the easements have been processed, we will be
willing to abandon the easement for the remaining
area of Harrison Street and Jefferson Street.
If there are any questions in this regard, please
don't hesitate to contact our office.

Indian River County Public Utilities - Decision on
Abandonment of Harrison and Jefferson Streets
This office received a phone call today at 3:00 P.M. from John
Lang, Indian River County Public Utilities, with a decision on
the abandonment of Harrison and Jefferson Streets.
He stated to me the following:
The County Utilities Division does not need the extension of
Florida Power and Light right of way. They will install a 10
inch force main on the east side of the right of way of Indian
River Drive. when water comes in water and gravity sewer will
probably be parallel lines to the force main. They may ask for
additional right of way adjacent to the road right of way if
these lines goes in on the east side.
Mr. Lang said he will follow up the call with a letter.

Enclosed is the original executed new easement deed from Good Guys,
Inc., a Florida Corporation to Florida Power and Light Company for
an access easement to its power poles.
Originally, I was advised the property was owned by Good Guys, a
Florida General Partnership, but I have since received evidence
that the owner is Good Guys, Inc., a Florida Corporation. A copy
of -the recorded deed is enclosed to complete your file.
A check for $10.50 is enclosed to record the deed.
It is my understanding the easement deed will be recorded simul-
taneously with the ordinance vacating or abandoning the streets.
Please return the original recorded deed to me and I will forward
it to Florida Power and Light Company. In addition, please forward
to me a copy of the executed and recorded ordinance abandoning the
streets.
A copy of this letter and documents is also being sent to Jim

Street from the westerly edge of the right-

block 91 Edgewater Park Subdivision, as per plat
book 1, page 23, Public Records of Indian River
County, Florida, a distance of 89.9 feet,
more or less.
This Ordinance shall be effective upon passage by the City
Council and upon recording of a copy of this Ordinance in the Public
