A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA, VACATING CERTAIN EASEMENTS OVER LOTS 3
THROUGH 6, BLOCK 187, SEBASTIAN HIGHLANDS UNIT 8; PROVIDING
FOR CONFLICTS HEREWITH; PROVIDING FOR RECORDING; PROVIDING
FOR EFFECTIVE DATE.
WHEREAS, a Development Order Application has been submitted for construction of a
new building for the Italian -American Club across four contiguous lots within the City of
Sebastian; and
WHEREAS, the owner of the land upon which said club shall be built has filed a
request for abandonment of the public utility and drainage easements along the interior
lot lines of the site; and
WHEREAS, the providers of telephone, electric, cable, water, and drainage utilties
have all consented to abandonment thereof;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF SEBASTIAN, as follows:
Section 1. VACATION OF EASEMENT. The City Council of the City of
Sebastian does hereby vacate, abolish, abandon and discontinue all of that portion of land
previously dedicated for a public utility and drainage easement described as follows:
The northeasternmost six (6) feet of Lot 3, the southwesternmost six (6) feet of Lot 4,
the northeasternmost six (6) feet of Lot 4, the southwesternmost six (6) feet of Lot 5,
the northeasternmost six (6) feet of Lot 5, and the southwesternmost six (6) feet of Lot
6, all being in Block 187, Sebastian Highlands Unit 8, as recorded in Plat Book 6, Pages 9
through 14, of the Public Records of Indian River County, Florida,
all located within the City of Sebastian, Indian River County, Florida
Section 2. CONFLICT. All resolutions or parts of resolutions in conflict
herewith are hereby repealed.
