A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA, DECLARING SPECIAL ASSESSMENTS,
PROVIDING FOR WATER MAIN AND EXTENSION LINES FOR THE
AREA EAST OF U.S. 1 TO INDIAN RIVER DRIVE RUNNING
FROM THE CITY'S SOUTHERN BOUNDARY TO ITS NORTHERN
BOUNDARY; PROVIDING PUBLIC PURPOSE, THE NATURE OF THE
IMPROVEMENTS, PORTIONS OF THE EXPENSE PAID BY
ASSESSMENT, THE TOTAL ESTIMATED COST, METHOD OF
PAYMENT OF ASSESSMENTS, NUMBER OF ANNUAL
INSTALLMENTS, AND DESIGNATION OF LANDS; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL OF RESOLUTIONS OR

A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA, SETTING A TIME AND PLACE AT WHICH
THE OWNERS OF PROPERTIES LOCATED GENERALLY IN THE
AREA EAST OF U.S. 1 TO INDIAN RIVER DRIVE RUNNING
FROM THE CITY'S SOUTHERN BOUNDARY TO ITS NORTHERN
BOUNDARY AND OTHER INTERESTED PERSONS, MAY APPEAR
BEFORE THE CITY COUNCIL AND BE HEARD AS TO THE
PROPRIETY AND ADVISABILITY OF CONSTRUCTING A WATER

Mr. Freeland requested that saleable city properties
be identified.
E. Mr. Frank Oberbeck

15. CITY ATTORNEY MATTERS
The City Attorney reported on the decision in the
Shuping vs. City of Sebastian case and sought
direction on whether to appeal the decision. It was
the consensus of City Council to direct the City
Attorney to appeal.
The City Attorney reported that a decision on the
Fey/Gilliams case will be received any day and the
Fischer case should come down within a couple of
months.
16. CITY MANAGER MATTERS
The City Manager reported that Chief Petty had won
another Police Olympics gold medal.
The City Manager reported on his discussions with
Indian River County regarding contracting for
water connections and installation of meters to allow
the city to provide service to the Riverfront area.
He said the funding can be achieved by special
assessment in the amount of $ .08 per square foot for
an amount of $250,000.00 for properties abutting
Indian River Drive.
The City Attorney said, in his opinion, that
mandatory water connection can be required for anyone
who is a sewer customer.
It was the consensus of City Council to direct the
City Manager to pursue negotiations with the County.

8. CITY ATTORNEX MATTERS
The City Attorney was excused from the July 9, 1994
special meeting at which the Assistant City Attorney
will be interviewed.
94.190/ The Assistant City Attorney reported that the
93.262 decision on the Fey lawsuit has been decided and that
the City must issue the special use permit for a
mulching facility subject to the applicant meeting
certain conditions.
He recommended against appeal and it was the
consensus of City Council that there be no appeal.
9. CITY MANAGER MATTERS
94.180 The City Manager said he and the Finance Director met
with Indian River County today regarding acquiring
water for the Indian River Drive area, reported that
the County will allow the City to piggyback their
existing engineering and construction contracts, and
that he will need a resolution requesting that the
County provide water to the City through the meter
process at the City southern boundary.
He further asked whether the City would ever be
interested in selling the total system to the County.
It was the consensus of City Council to sell the
system to the County if approached.
Discussion took place on costs for installation of
water in the area of Indian River Drive. It was the
consensus of City Council to direct the City Manager
to have the resolution drafted.

the workshop at 10:00 p.m.

D. Mrs. Norma Damn
Mrs. Damp reported on an Indian River County Chamber
of Commerce luncheon at which Vice Mayor Corum spoke
and did a wonderful job; expressed concern for the
dangers related to all -terrain vehicles; and inquired
whether road impact fees for Barber had been
received.
E. Mr. Robert Freeland
Mr. Freeland said he had been informed that
Cumberland Farms could provide fuel to City vehicles
at a savings; noted that Council members should not
get involved in the hiring of personnel for the City;
and made reference to a letter to Richard Fey
outlining required improvements to Old Dixie
Highway for establishment of his mulching facility.
15. CITY ATTORNEY MATTERS
None.
16. CITY MANAGER MATTERS
The City Manager requested authority to establish
policy to reduce the required insurance amount in the
standard form of agreement based on individual
contract amounts, referring specifically to the City
Hall window shutters contract. City Council
concurred.
The City Manager said all parcels, ERU's and acreage
have been identified in the proposed U.S. 1 water
service area (South City limit to North City limit
and U.S. 1 to the river) and again requested City
Council consensus to allow the City Attorney to
prepare a recommendation on the most equitable manner
of assessment and contractual documents between the
City of Sebastian and Indian River County, however,
he offered an alternative to allow the County to
provide the water.
He also suggested the current ordinance be amended to
define mandatory hook-up in three different
instances, 1) if the resident requests hook-up and
capacity is available, 2) if the current septic
system fails, or 3) if St. John's River Water

Management District imposes rules for elimination
of septic tanks in the Riverfront District. He also
suggested that if a property owner has potable water
and decides to retain his well, he provides the City
with an annual water analysis.

Discussion continued.
The City Attorney discussed City liability in the
case of a person becoming ill due to contaminated
water.
It was the consensus of City Council to authorize
the City Manager to proceed.

the Regular Meeting at 9:40 p.m.

Mr. Freeland recommended a separate checking account
for the Golf Course; and suggested abandoning the
Golf Course "bridge".
E. Mr. Frank Oberbeck
Mr. Oberbeck noted that junior golfers have used the
bridge in the past and discussed possible fixes.
City Council concurred that it be removed.
15. CITY ATTORNEY MATTERS
The City Attorney said that the Police Pension Board
of Trustees have requested Vince Torpy to continue to
represent him on a matter before the board. City
Council concurred.
16. CITY MANAGER MATTERS
The City Manager said the outside restrooms will be
renovated soon; the Utilities Dept. move has been
delayed for tenting; the Golf Course bridge poles
will be stored at the City Garage, the ditch closed
in and another short walkway constructed; said the
Garage clean-up bid will be advertised soon; said
Fleming Street bridge construction and Schumann
drainage basin will be bid soon; and requested
direction from City Council authorizing the City
Attorney and him to proceed to negotiate with the
County relative to water service connection
assessment procedures and costs, to which City
council concurred.
17. Being no further business, Mayor Firtion adjourned
