On the 10th day of January, 1996, the City Council of the City of Sebastian, Florida adopted Resolution No. 96-05 which has been simultaneously recorded with the Clerk of the Circuit Court in the Public Records of Indian River County in O.R. Book 1087, Page 2054 up to and including Page 2133. Resolution No. 96-05 levied a special assessment lien on certain properties for a public water project known as the "Riverfront Project." 5. The City of Sebastian, Indian River County, Florida claims a special assessment lien under the provisions of Resolution No. 96-05 on the real property described in Exhibit `B" which is set out in O.R. Book 1087, Page 2054 up to and including Page 2133, which was recorded in the official records of the Clerk of the Circuit Court of Indian River County on the 15th of January, 1996. The post office address and the name of the owner and the post office address of the person in whose name the property is assessed on the last complete tax assessment roll of Indian River County at the time of filing of this Certificate, and the amount of the lien claimed on the date of Resolution No. 96-05 are set out in O.R. Book 1087, Page 2054 up to and including Page 2133 which was recorded in the official records of the Clerk of the Circuit Court of Indian River County on the 15th of January, 1996. 6. Resolution No. 96-05 supersedes and amends Resolution No. 94-53 of the City of Sebastian. This Special Assessment Certificate and Claim of Special Assessment Lien cancels and supersedes the Special Agreement Certificate and claim of Special Assessment Lien filed in Official Records Book 1043, Page 0887 up to and including Page 0934 Public Records of Indian River County. FIRTION as Mayor of the City of Sebastian, Indian River County, Florida, and KATHRYN M. FINAL AUTHORIZATION OF THE CITY PROJECT: The Riverfront Water Project described in Resolution R-95-68, as more specifically described by the plans and specification on file at the office of the City Clerk at 1225 Main Street, Sebastian, Florida, are hereby authorized and approved and the proper officers, employees and agents of the City are hereby authorized and directed to take such further action as may be necessary or desirable to cause the same to be constructed and accepted by the City. SECTION 4. ESTIMATED COST OF IMPROVEMENTS: The total estimated cost of the Riverfront Water Project and the cost to be 5 0 O co -o c� IND CD U1 c'o paid by special assessment on all specially benefitted properties are set forth in Exhibit "A" which is attached hereto and made a part hereof by this reference. SECTION 5. EQUALIZATION, APPROVAL, CONFIRMATION AND LEVY OF SPECIAL ASSESSMENTS: The special assessments for the Riverfront Water Project on the parcels specially benefitted by the project, all as specified in the final assessment roll marked as Exhibit "B" which is attached to this Resolution, are hereby equalized, approved, confirmed and levied. Promptly following the adoption of this Resolution, those special assessments shall be recorded by the City Clerk in a special book, to be know as the "Improvement Lien Book." The special assessment against each respective parcel shown on such final assessment roll and interest thereon, as hereafter provided, shall be and shall remain a legal, valid and binding first lien on such parcel until paid; such lien shall be coequal with the lien of all state, county, district, municipal or other governmental taxes and superior in dignity to all other liens, titles and claims. The special assessment imposed by this Resolution prevails over any special assessment which is imposed by Resolution R-94-53 dated September 28, 1994, and the special assessments imposed by this Resolution supersede and substitute for the special assessment imposed by such prior Resolution. FINALIZATION OF SPECIAL ASSESSMENTS: When the project has been constructed or otherwise provided to the satisfaction of the City, the City shall adopt a resolution accepting the same and determining the actual cost thereof, as required by Sections 170.08 and 170.09, Florida Statutes. The City shall credit to each special assessment for the project the difference between the special assessment as hereby made, approved and confirmed and the proportionate part of the actual cost of the project to be paid by special assessment, as finally determined upon completion thereof, but in no event shall the final amount of any such special assessment exceed the amount of benefits originally assessed hereunder. Such credits shall be entered in the Improvement Lien Book. once the final amount of the special assessments for all of the improvements have been determined, the term "special assessment" shall, with respect to each parcel, mean the sum of the cost of the project. Any landowner who has heretofore paid such special assessment shall be credited for such payment. SECTION 7. PAYMENT OF SPECIAL ASSESSMENT AND METHOD OF COLLECTION: A. All special assessments shall be payable in no more than ten (10) equal yearly installments of principal plus interest charged at a rate of 6.75% per year on the sum of the unpaid principal. The due date (credit date) shall be forty- five orty-five ( 4 5 ) days from the effective date of the Resolution which accepts the improvements after completion of the improvements. 7 0 O co N O 01 CD The first installment of principal and interest shall be due on the credit date. The City -�v C:) 5 CA U0 shall credit to each special assessment for the project the difference between the special assessment as hereby made, approved and confirmed and the proportionate part of the actual cost of the project to be paid by special assessment, as finally determined upon completion thereof, but in no event shall the final amount of any such special assessment exceed the amount of benefits originally assessed hereunder. Such credits shall be entered in the Improvement Lien Book. Once the final amount of the special assessments for all of the improvements have been determined, the I term "special assessment" shall, with respect to each parcel, mean the sum of the cost of the project. SECTION 7. PAYMENT OF SPECIAL ASSESSMENT AND METHOD OF COLLECTION: A. All special assessments shall be payable in no more than ten (10) equal yearly installments of principal plus interest charged at a rate of eight percent (8%) per annum charged on the sum of the unpaid principal. The first installment payment of principal and interest shall be made within twelve (12) months from the due date. The due date shall be forty-five (45) days from the date of the adoption of a resolution affirming the special assessments after the City's acceptance of the project. B. The City will record the special assessments and this Resolution, which describes the properties assessed and the amount of the special assessments on the public records, R which shall constitute prima facie evidence of the validity of the special assessments. SECTION 8. SEVERABILITY: If any section or part of a section of this Resolution is declared invalid or unconstitutional, the validity, force and effect of any other section or part of a section of this Resolution shall not thereby be affected or impaired unless it clearly appears that such other section or part of a section of this Resolution is wholly or necessarily dependent upon the section or part of a section so held to be invalid or I unconstitutional. SECTION 9. CONFLICTS: All Resolutions or parts thereof in conflict herewith are, to the extent of such conflict, superseded and repealed. SECTION 10. In order to provide for a safe supply of potable water, the City Council (Council) of the City of Sebastian (City) is implementing a program for the installation of water distribution lines and the installation of fire hydrants for the Riverfront Water Project in the area of the City in which your property is located. On September 28, 1994, the Council adopted Resolution R-94-53 to levy a special assessment for funding the Riverfront Water Project against benefited properties, of which your property is one. Your were sent a notice setting out the amount of the assessment to be levied against your property. On December 20, 1995, the City Council adopted Resolution R-95-68, which revised and amended the prior Resolution of the City pertaining to the improvements which the City seeks to make and the assessments for the improvements. Your assessment will not exceed the amount set out in September, 1994 letter which was sent to you, or the former owner of your property. The areas to be improved under the Riverfront Water Project are 310 parcels of property in the area east of U.S. Highway #1 from the north to the south City limit and including Jackson Street, Madison Street, Coolidge Street, Cleveland Street, Martin Avenue, Indian River Drive, Davis Street, North Central Avenue, Jefferson Street, Washington Street and an unnamed alley from Martin Avenue running south 650 ± feet within the Riverfront Water Project. The Riverfront Water Project should be completed in January,1996. Legal Description of Parcel: See Attached 2. Estimated Project Cost: $750,000.00 or $0.142786 per square foot for each square foot on property assessed 3. Assessment Amount on Your Parcel: $2.861.09 Assessments may be prepaid or may be financed over a period of 10 years at a rate of 8% per year or 1 % above the rate of interest at which improvement bonds issued for the project are sold, whichever is less. The first installment, if financed over a period of ten years, shall be due 45 days after the City Council accepts the project as completed. The estimated prepayment amount for your parcel is shown in line 3, above. This amount may be paid without interest within 45 days from the date when the City Council accepts the project as completed. If the assessment is approved, there will be a lien against your property until the assessment is paid. THIS IS AN ASSESSMENT NOTICE ONLY, DO NOT PAY AT THIS TIME. ANY PROPERTY OWNER WHO HAS PREPAID WILL BE CREDITED WITH SUCH PAYMENT. Please take notice that there will be a public hearing beginning at 7:00 P.M. on Wednesday, January 10, 1996, at City Council Chambers located at 1225 Main Street, Sebastian, Florida. At the public hearing the City Council will hear the testimony of affected persons as to the propriety and advisability of making the improvements for the Riverfront Water Project, as to the cost thereof, as to the manner of payment therefor, as to the amount therefore to be assessed against each property so improved.
