Call to Order -- Chairman Fortier called the meeting to order at 6:00 p.m.

Mr. Fortier called for additions, deletions or corrections to the Minutes.
A motion to approve the August 12, 2019 Minutes as presented was made by Mr. Wilcher,
seconded by Mr. Manero. Mr. Fortier called for discussion. Ms. Carbano called attention
to Item 4 where it states Mr. Parris. That should be Ms. Parris. With that correction, Mr.
Fortier called for a roll call vote.

CERTIFICATE OF COMPETENCY:
IN THE MATTER OF MR. JOHNNY J. JOHNSON,
DBA J. Johnson Construction, Inc.
Mr. Johnson is seeking Board approval to obtain a certificate of competency as a
concrete specialty contractor.
APPLICABLE CODE SECTION FROM THE CITY CODE OF ORDINANCES:
Sec. 26-162. - Puroose
It is hereby declared to be the intent of the city council that, in order to
safeguard the life, health, property and public welfare of its citizens, the
business of construction and home improvements is a matter affecting the
public interest, and any person engaging in such business shall be required
to establish his competency and qualifications as provided in this article.
Sec. 26-161. - Definitions
Specialty contractors are those who specialize in one or more crafts of the
building construction and related contracting trades whose scope is less
than those contractors defined above and as limited under the certificate of
competency issued by the board to such specialty contractor. The board
may further classify and define specialty contractors in such rules and
regulations it promulgates in accordance with this article. All specialty
contractors whose trade is tested by Prometric Services or other
comparable testing agency must take such examination and receive a
passing grade of at least 70 percent on the examination for their trade which
is administered by the testing agency.
Sec. 26-165. - Certification Procedures
(a) To obtain a certificate an applicant shall submit an application in writing
to the construction board containing the statement that the applicant desires
the issuance of a certificate and the class of certificate desired on a form
containing the information prescribed by the construction board and shall
be accompanied by the fee fixed by this article.
(b) As a prerequisite to issuance of a certificate, the board shall require the
license holder to submit satisfactory evidence that he has obtained public
liability insurance in the following amounts:
(1) General contractor, building contractor and residential building
contractor: Not less than $100,000.00 property insurance and not less than
$300,000.00 personal liability insurance.

(2) All others: Not less than $50,000.00 property insurance and not less
than $100,000.00 personal liability insurance, together with evidence of
workers' compensation insurance or certificate that he has complied with
the state workers' compensation law. All evidence of insurance must be
filed with the building official. Thereupon, the certificate shall be issued
forthwith, but this subsection does not apply to the issuance of renewal of
inactive certificates.
Sec. 26-166. - Certificates issued by reciprocal agreement.
(a) The board may by reciprocity grant a certificate of competency to any
applicant who has obtained a certificate of competency in any other county
or city in the state having codes and conducting examinations which are, in
the opinion of the board, substantially equal to those of the city, upon the
applicant furnishing proof of insurance coverage required hereunder and
payment of the application fee herein provided and furnishing to the board
in writing all information as required by section 26-165. Certificates issued
through reciprocity shall be subject to all of the other provisions of this
article.
Mr. Eseltine slated the applicant, Mr. Johnny J. Johnson, doing business as J. Johnson,
Incorporated, is seeking Board approval to obtain a Certificate of Competency as a
concrete specialty contractor. Mr. Johnson has not tested before. He was actually
grandfathered in In St. Lucie County. He has been a contractor for many years. He has
obtained certifications as a contractor in Indian River County, St. Lucie County, the City
of Port St. Lucie, Orchid, and Fort Pierce.
Outlined in the Agenda are the applicable code sections that would apply to this situation.
Also included in the agenda are the other documents relating to this application.
Mr. Eseltine described that the Board's task is to assess whether what Mr. Johnson has
done in other jurisdictions meets the criteria for competency in the City of Sebastian so
that he can obtain reciprocity from Sebastian.
Mr. Wilcher asked for more clarification regarding the applicant being grandfathered in.
Mr. Eseltine described in depth how being grandfathered in applies to Mr. Johnson.
Mr. Eseltine stated Mr. Johnson is present to answer any other questions by the Board
Mr. Fortier called for testimony from the applicant.

Mr. Johnson clarified that he wants certification for concrete, carpentry, and a masonry
license. He described the areas where he has done work in the past.
Mr. Eseltine stated that, if all three specialties are going to be approved, the City would
need to get letters of reciprocity from St. Lucie County for the masonry and the carpentry
trades.
After discussion by the Board members, Mr. Fortier called for a motion. A motion to go
ahead and, with receipt of the proper letters of reciprocity from St. Lucie County being
received by the City of Sebastian, approve the three specialty licenses, which would be
carpentry, masonry, and concrete, was made by Mr. Crockett and seconded by Mr.
Manero. Mr. Fortier called for a roll call vote.

8. Buildina Official Matters
Presentation to Construction Board of Proposed Ordinance 0-20-01.
• Amending City Code of Ordinance; Chapter 42 Fire Prevention and
Protection; Article II Fire Prevention Office; Section 42-28 Fire Safety
Inspections, Plan Review
• Seeking Board Approval for Recommendation to City Council
Mr. Eseltine stated the Fire Prevention Office was created in Sebastian in 2018, which
was formerly done by Indian River County. This is for the plan review and inspections
aspect. There are also other duties such as annual inspections and special events that
are now under the Fire Prevention Office in Sebastian. Mr. Eseltine was appointed as
the Fire Marshal for the City. The City also has a contract with a private provider which
aids when needed for larger projects.
Mr. Eseltine presented a PowerPoint presentation (SEE ATTACHED) where he reviewed
and described a proposal for an ordinance modification to the City Code of Ordinance,
Chapter 42, Fire Prevention and Protection. He described in detail the purpose and duties
and benefits to the City of having the Fire Prevention Office. He also stated that Indian
River County uses the same system. Benefits and the procedure for utilizing the system

were also discussed. This system is free for the City. Costs to upload the documents
are covered by the third -party vendors.
Mr. Manero inquired whether business owners would have access to this system in order
to look up the history of a certain building/business. Mr. Eseltine stated he was not certain
of that, but those business/building owners would have access to the reports from their
vendors, being alarm companies, sprinkler systems, etc.
Mr. Eseltine asked for a recommendation from this Board to take to City Council to
approve this amendment.
Mr. Wilcher asked who would be doing the inspections on a new building. Mr. Eseltine
stated his office does them in conjunction with the private provider that the City has a
contract with.
Mr. Fortier called for a motion recommending amendment of City Code of Ordinance, 0-
20-01 as presented. The motion was made by Mr. Crockett and seconded by Mr. Manero.
Mr. Fortier then called for discussion by the Board members. Hearing none, a roll call
vote was called for.
