1. Mayor Dodd called the Regular City Council Meeting to order at 6:00 p.m.
2. A moment of silence was held.

Mayor Dodd read and presented the proclamation to Virginia Skov, Rex Enriquez, and
Emily Wilcox who played a shortvideo of the Meals on Wheels Program.

Mayor Dodd read and presented the proclamation to Ms. Fraser who participated via
Zoom.

Report and Annual City Audit by Ross Cothemian of Rehmann Robson

Ross Cotherman of Rehmann, Robson reported the City has completed a thorough
comprehensive financial report which indicates the City's commitment to the citizens.
He briefly went over the financial statements noting there will be a Federal audit required
for receiving CARES Act revenue that will be due at the end of September. He thanked
the CFO and his team, as well as the MIS team, for the extra time required to conduct
the audit remotely.

March 19-21- Shrimptest 8 Craft Brew Hullabaloo Festival at Riverview Park (Friday 3-9pm,

Mayor Dodd announced the upcoming events, as well as an upcoming FOOT workshop
that is to be held April 1 9 � in the Council Chambers at 5:30 p.m. to go over the
upcoming CR510 Widening Project.

11. UNFINISHED BUSINESS
21.020 A. Review and Discuss City Attorney Contract Addendum (Transmittal. Contract
Committee Recommendation. Citv Attornev Recommendation. Current
Acreement. R-21-04)
Vice Mayor Hill began the discussion stating the City Attorney is doing an outstanding
job but he was not going to support the contract adjustments. He noted there was a lot of
discussion during the contract committee proceedings but he did not hear that the
attorney's salary was an interim salary or that the offered salary and benefits were
unacceptable. He also said the current contract provides for a vehicle for City use.
The Vice Mayor said Council could talk about the addendum providing for an increase of
$20.000 and the use of a vehicle if the attorney went above and beyond but to
completely redo the contract is beyond what could be asked. He asked what has
changed in the one year and one month since the attorney agreed to the current contract
except that things have calmed down for the City. He said he appreciated the work that
the City Attorney is doing but he believed the right thing to do was to not go forward and
adjust this contract.
Mayor Dodd said as the individual who negotiated with the City Attorney, he was
obligated to bring the best that he could do forward to Council for the decision process
which Included a 6% increase effective October 1, and the use of automobile within 75
miles of the City.
Mayor Dodd said he did remember having conversations to reopen the contract during
the interview process and commented that Mr. Anon does a good job but it was entirely
up to Council. He also said that the City Attorney was an asset to the City from
November 2019 to September 2020.
Council Member Jones asked if based on 75 miles from the City, does that come up to
$52,000 a year. The City Manager confirmed the wear and tear on a vehicle would be
about $5,200 a year in maintenance cost.
Council Nunn said he has talked to a lot of City employees who were not happy with the
raises that were given and obviously Mr. Anon should be given a bonus for everything
that he has gone through, but he had a hard time giving an additional raise; but he did
not have a problem with a take home vehicle. He said with time and better years to
come, his pay would be similar to some of the salaries listed in backup.

Mayor Dodd said he was uncomfortable bringing a salary increase outside the budget
cycle for same reasons as discussed by Vice Mayor Hill and Council Member Nunn.
Council Member McPartlan said he agreed with Vice Mayor Hill. He also said he uses a
take home vehicle with the state which saves him about $5,000 a year; commenting that
the additional benefit of personal use would probably increase the benefit amount.
MOTION by Vice Mayor Hill and SECOND by Council Member McPartlan to leave the
City Attorney's current contract in place as it is and as was signed on February 12, 2020.

21.042 A. Resolution No. R-21-03 — Acceotino the 1" Quarter Financial Report and
Recoanizinp Necessary Amendments and Adjustments to the FY2020-2021
Annual Budaet (Transmittal. R-21-03. Report)

A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA.
APPROVING AN AMENDMENT AND RECOGNIZING CERTAIN ADJUSTMENTS TO
THE BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2020 AND ENDING
SEPTEMBER 30, 2021 AS PROVIDED FOR IN EXHIBIT "A'; PROVIDING FOR
CONFLICTS; PROVIDING FOR SCRIVENER'S ERRORS; AND PROVIDING FOR AN
EFFECTIVE DATE.
The CFO summarized the first quarter financial information, stating the projections were
as to be expected; the departments do have some items that are pending that will
reduce the projected balances at the end of the year. He stated the enterprise funds
appear to project out favorable; the department's activities were provided in the report
and he asked for approval of the resolution recognizing the amendments made during
the first quarter.
Vice Mayor Hill congratulated the CFO on a great job and successful audit.
There was no public input.
MOTION by Council Member McPartlan and SECOND by Council Member Jones to
approve Resolution No. R-21.03 recognizing the necessary amendments and
adjustments to the FY20/21 budget passed with a unanimous voice vote. 5-0
21.039 B. Continue Receivino Financial Auditing Services from Rehmann Robson to the
Year Endina Senttember 30. 2021 in the Amount of $46.200 (Transmittal.

The City Manager stated that Rehman Robson has done a fantastic job in providing the
audits and asked Council to extend their services for another year.

MOTION by Vice Mayor Hill and SECOND by Council Member Jones to continue
receiving auditing services from Rehman Robson until Sept. 30, 2021 in the amount of
$46,200.

21.043 C. Award and Authorize Neaolialions to Desiqn Build a Yacht Club Seawall
Replacement to Ferreira Construction Co.. Inc. (RFQ #21-04) (Transmittal.
Scores. Comments. Current Proiects)
The City Manager reported the seawall is failing at Yacht Club, and staff would have
liked to have waited until the new budget year but it is a safety hazard. He asked
Council to authorize staff to negotiate a maximum price for the design/build repair to
Ferreira Construction.
Council Members Jones and Nunn staled it was important to get the repair completed.
MOTION by Council Member Nunn and SECOND by Council Member Jones to approve
RFQ#21-04 with Ferreira and if that doesn't work out, the City Manager has the authority
to work with the second firm.

21,044 D. Discuss and Direct Staff Repardinq Launch Cottons for the 0 of July Fireworks

The City Manager reported that Pelican Island National Wildlife Refuge Manager Jeremy
Edwardson would be prohibiting any future launching of fireworks off spoil island IR6
leading to the need for either a barge at an additional cost of $27,000 or launching the
fireworks off the Twin Piers.
The Leisure Services Director displayed the buffer zone noting there would be more than
adequate space if the pier is used. He also said if there happens to be high winds; the
vendor will disarm the 6 inch shell which will increase the fallout area.

The City Manager added that if they need to, they can move the debris field closer to the
sidewalk.
The Leisure Services Director said Indian River County Fire Rescue would be on site
during the show and the plans have been reviewed by the Fire Marshal.
It was the consensus of Council to launch the fireworks off the Twin Piers and have the
City Manager continue to work with the refuge manager to see if the spoil island might
be used again.
13. CITY ATTORNEY MATTERS
The City Attorney thanked Council for their consideration of item #11a.
He briefly outlined the upcoming Charter Review Committee schedule with any approved
referendum questions to come before Council May 26 and June 9.
14. CITY MANAGER MATTERS
The City Manager reported that the City did not receive the Florida Dept. of Economic
Opportunities grant to update the stormwater master plan but staff plans to apply for the
Community Development Block Grant - Mitigation (CDBG-MIT) which will come out in
the fall. He said while the master plan update is not moving forward, the projects outlined
in the previous plans are moving forward today.
In regard to the septic to sewer conversions, staff has met with Schulke, Bittle &
Stoddard LLC to iron out what needs to be researched and studied; now the City is
waiting for a price to get it moving.
He announced there would be a North County S2S Phase 2 Water Assessment Public
Information Meeting sponsored by Indian River County Utilities in Council Chambers on
April 5th, 2021 at 6:00 p.m.
Vice Mayor Hill remarked there is no more important spot than this project site because
of its location to the St. Sebastian River.

C. Mayor Dodd remarked that he had the pleasure of addressing the 5' Grade
Safety Patrol Class at Pelican Island Elementary. He said the children were very
knowledgeable, they asked a lot of good questions and he really enjoyed the
visit.
