Lots 22 & 23, Block 361, SEBAS IAN HIGHLANDS Unit 11, according to the map or plat thereof, as recorded in Plat Book 7, Pages(s) 56, of the Public Records of Indian River County, Florida ADDRESS: 1566 Pleasantview Lane, Sebastian, Florida PARCEL I.D. 31-38-25-00001-3610-00023.0 1 Land Use: LDR; Zoning: RS-10 REQUEST(S): Variance request from Mr. & Mrs. Nicholas Wanklyn for their property located at 1566 Pleasantview Lane from Sebastian Land Development Code Sections 54-2-7.5(c)(4) and 542-7.5(c)(6) to allow construction of an accessory structure which would exceed the 1,000 square foot maximum allowable area by a total of 176 feet and exceed the height of the principal structure by 1.6 feet in the RS-10 Zoning District. ORDER WHEREAS, upon presentation at a public hearing on the 28th day of April, 2021, before the Board of Adjustment, of the application for Variance by the Property Owner and upon review and consideration of all testimony, evidence and argument presented at said duly noticed public hearing, which constitutes substantial competent evidence, the Board determined by a vote of 55 to that the variance requested does meet the prerequisites, in part, as set forth in Section 541-2.5(c)(2) of the land Development Code of the City of Sebastian. IT IS, THEREFORE, ORDERED AND ADJUDGED THAT THE PROPERTY OWNER'S REQUEST FOR VARIANCE IS GRANTED, in part, to exceed the height of the principal structure by 1.6 feet in the RS-10 Zoning District and DENIED, in part, to allow construction of an accessory structure which would exceed the 1,000 square foot maximum allowable area in the RS-10 Zoning District. This Order shall take effect immediately, and shall be deemed rendered three (3) days after it has been signed by the Chairman of the Board of Adjustment, and deposited in the United States Mail for first class delivery. Any appeal of this decision shall be made in the Circuit Court of Indian River County within thirty (30) days of this Order's rendering, as required by 54-1-2.5(e), of the City's Code.
