HomeMy WebLinkAbout07-20-2021 MinutesSEBASTIAN POLICE DEPARTMENT 1201 Main Street, Sebastian, Florida 32958 Code Enforcement Division CITY OF SEBASTIAN, FLORIDA MINUTES SPECIAL MAGISTRATE CODE ENFORCEMENT HEARING J U LY 20, 2021 The Hearing was called to order at 2:14 p.m. by Special Magistrate Kelley H. Armitage. Present: Special Magistrate Kelley H. Armitage, City Attorney Manny Anon, Code Enforcement Officer Richard lachini, Code Enforcement Officer Curtis Bloomfield, Administrative Assistant Janickie Smith, Joseph Perez, AV Technical Assistant, and Janet Graham, Technical Writer (via Zoom), Ms. Smith swore in staff and all other persons who would be speaking. Call to Order II. Initial Hearinq of Code Violations: Magistrate Armitage, seeing no one present in chambers and hearing no one on Zoom to speak on this matter, asked if there was anything else. Hearing nothing further, so ordered as requested. Case No.: CE21-004419 Edward G. and Caecilia Parker 1220 George Street Sec. 66-3 Illustrative Enumeration Mr. Anon read the docket for Appeal of Code Violation into the record and called on the City's representative to present its case. He also asked that, for this case the entire packet from the Code Enforcement officer, including all the returns, notices, and all the photos be entered as part of the record. He also asked for a fine of whatever is allowed per day be levied up to $250.00. The homeowner has until July 30, 2021 to respond or to have the cutback done. After that date, a fine of $250.00 was ordered by the Magistrate. Code Enforcement Official for the City of Sebastian, Richard lachini, identified himself and his position with the City of Sebastian. Officer lachini reviewed that on February 2, PAGE 2 2021, he received a complaint from the adjacent homeowner about the property being in violation of City Ordinance Section 66-3.11(b), stating that the owner of the adjacent unimproved property must maintain the vegetation on the property a minimum of five feet in. At that time, Officer lachini issued a Notice of Violation. On February 4, 2021 the property was posted with the letter of violation, and he has photos of it. A notice was sent via Certified Mail, Return Receipt Requested, to the owner of record. On April 30th, he posted it with a letter to appear before the Special Magistrate. At that particular time, it was pulled from the docket at the request of a potential buyer. It was reposted on July 1, 2021 with a letter to appear before the Special Magistrate. Photos were taken at that time, and the photos were posted on the monitor in chambers and identified by Officer lachini. Notice via Certified Mail, Return Receipt Requested was also sent out at that time. Ms. Smith stated that the Notice of Violation was returned, and her office has not received confirmation of the notice of the hearing. Officer lachini stated that he was told by a realtor that the owner has passed away, but there are heirs involved, and they are trying to locate all the heirs to see if it possibly can be bought before it came before the Special Magistrate. That was back in May, and that matter has not been resolved. Officer lachini is asking for permission to go on the property and to abate it and make the cutback and allow administration fees of $100.00 plus the cost of the abatement. There being no one else wishing to testify, either in Chambers or on Zoom, the fine was ordered by the Magistrate as requested. The hearing ended at 2:20 p.m. ff
