HomeMy WebLinkAbout08-17-2021 MinutesSEBASTIAN POLICE DEPARTMENT 1201 Main Street, Sebastian, Florida 32958 Code Enforcement Division CITY OF SEBASTIAN, FLORIDA MINUTES SPECIAL MAGISTRATE CODE ENFORCEMENT HEARING AUGUST 17, 2021 The Hearing was called to order at 2:05 p.m. by Special Magistrate Kelley H. Armitage. Present: Special Magistrate Kelley H. Armitage, City Attorney Manny Anon, Code Enforcement Officer Richard lachini, Code Enforcement Officer Curtis Bloomfield, Administrative Assistant Janickie Smith, Joseph Perez, AV Technical Assistant, and Janet Graham, Technical Writer (via Zoom), Ms. Smith swore in staff and all other persons who would be speaking. Call to Order II. Initial Hearinq of Code Violations: Case No. CE 21-018419 DOUGLAS M. SASTRAM 1006 LANDSDOWNE DRIVE Sec. 66-3.11 Illustrative Enumeration Mr. Anon read the docket for Appeal of Code Violation and called on the City's representative to present its case. He also asked that, for this case and all of today's cases, the entire packet from the Code Enforcement officers, including all the returns, notices, and all the photos be entered as part of the files. So ordered by the Magistrate. Code Enforcement Official Richard lachini identified himself and his position with the City of Sebastian. Officer lachini reviewed that on May 1, 2021 a Notice of Violation was issued for the property which gave the owner five days to comply. Officer lachini reinspected the property on May 10, 2021, and the notice had not been complied with. On May 14, the City issued a Notice of Violation via Certified Mail, Return Receipt Requested, and the property was posted. Photos of the property were taken, which were displayed on the monitor. On July 23, the property was again posted with a notice to appear before the Magistrate, and photos were again taken. A copy of that letter was also shown on the monitor. Officer lachini stated that he finally made contact today with SPECIAL MAGISTRATE CODE ENFORCEMENT HEARING PAGE 2 AUGUST 17, 2021 the owner, and they are now able to communicate. He talked with the owner immediately prior to this hearing, and the owner is working on getting the grass and weeds taken care of. Magistrate Armitage asked the owner if he had any questions or comments. Mr. Sastram identified himself for the record. Officer lachini stated the owner is coming into compliance, having gotten half of the lot mowed. Mr. Anon requested a date certain to have this work completed. Mr. Sastram stated he hoped to have the mowing completed by this weekend, weather permitting. Mr. Sastram stated he thinks he can have the mowing done by August 27. Mr. Anon recommended that, even if the work is completed before August 27, Mr. Sastram notify Officer lachini that he has completed the work so he can inspect the property, and then the case can be closed out. Mr. Anon stated the City is willing to waive the $100.00 fee at this point. Magistrate Armitage ordered that the case be left open pending satisfaction of Officer lachini. Case No.: CE 21-016841 and 21-016838 MYRODES Z. KONSTANTIMIDES 461 PONOKA STREET Sec. 66-3 Illustrative Enumeration and Soil Erosion and Sedimentation Control Officer Curtis Bloomfield identified himself and his position with the City of Sebastian. He stated that the City Engineer received a complaint from an adjacent property owner, and the property was cited under 54-3-11.2, which is for soil erosion and sedimentation control. Officer Bloomfield stated that the seawall at the rear of the property is failing, and soil is being washed into the canal. The owner was cited and notified to repair the hole in the wall. The property was posted. Certified Mail was sent for both violations. Photographs were taken, and the photos were displayed on the monitor showing the conditions of the seawall. He stated that the adjacent property owners took it upon themselves to repair this initially, but the photos show that the soil is still sinking. In order for the City to make those repairs, the overgrowth will have to be cut back. That is why the property was cited with two violations. Magistrate Armitage asked if the City is going to repair the seawall. Officer Bloomfield explained that the City will contract it out, as the homeowner has not responded to the notices. He also stated that the same contractor will cut back the overgrowth, repair the SPECIAL MAGISTRATE CODE ENFORCEMENT HEARING PAGE 3 AUGUST 17, 2021 seawall, and bill the homeowner. Mr. Anon clarified that the order should be for the homeowner to perform the repairs. If the homeowner does not do it, then this case will come back before the Special Magistrate to ask the City to enforce the order and do whatever is necessary to correct the violation. He stated August 27 is the date that the work is to be completed. Mr. Anon stated that the City does have the Return Receipt from the homeowner showing that he received the notice and signed for it on July 27t" Magistrate Armitage, seeing no one present in chambers and hearing no one on Zoom to speak on this matter, asked if there was anything else. Hearing nothing further, the Magistrate ordered as requested. Case No. CE 21-016619 and 21-016611 DAVID A. KREBS 326 KING STREET Sec. 66-3 Illustrative Enumeration Officer Curtis Bloomfield identified himself and his position with the City of Sebastian. He stated that this property was cited for high grass and weeds. The City removed that from this hearing as the owner had complied with that case. The case that is remaining is case no. 21-016611. Photos of the property were taken and were displayed on the monitor. Notice was sent via Certified Mail, Return Receipt Requested. Officer Bloomfield stated that he has received several complaints from adjacent owners about the junk sitting on the property for months. He is requesting permission to hire a vendor to go on the property and have the junk removed. He is also asking for administrative costs of $100.00. The date certain for compliance is August 27, 2021. Magistrate Armitage, seeing no one present in chambers and hearing no one on Zoom to speak on this matter, asked if there was anything else. Hearing nothing further, the Magistrate ordered as requested. III. Adiournment There being nothing further, the hearing was adjourned by Magistrate Armitage at 2:22 p.m.
