8. Project Description
a. Narrative of proposed action: The applicant is requesting approval of a two -lot
commercial subdivision on 2.04 acres located along Sebastian Boulevard between
the North County Library and the entrance to Sebastian Lakes. This is a replat of a
portion of Tract C (a.k.a Tract 1X) of Sebastian Lakes PUD. Previously, in 2015, a
one -lot preliminary plat for the same parcel was approved by City Council via
Resolution R-15-33, along with subsequent Construction Plans, approved by the city
engineer in 2017. Landclearing began shortly after.

At that time, the property contained two existing ponds. The western pond, part of
the master stormwater system for Sebastian Lakes PUD, was reconfigured in
accordance with the approved 2015 preliminary plat. The eastern pond that
extended across the property line onto the Indian River County Library site served no
stormwater purpose for either property and was filled. While continuing construction
on the one -lot plat, the applicant was approached by two separate buyers, each
wanting to purchase only a portion of the property. An ensuing new, preliminary plat
application for two -lots was submitted to staff and the previous application was
voided.
The western reconfigured stormwater pond will continue to provide drainage for the
overall PUD, as well as future development of the two lots at a maximum 1.40 acres
of new impervious area. Further development of the commercial lots will require fully
designed site plans showing building location, access drives and easements,
parking, and landscaping, which plans will need to be approved by the PZ
Commission and City Council.

12. Other Matters: The previous preliminary plat approval had four conditions, as noted in R-
15-33:
• Provide a stormwater easement for the reconfigured drainage pond and a
sign easement for the existing subdivision entrance sign.
• Provide a written agreement between the owner and the Sebastian Lakes
Master Association, Inc. regarding maintenance responsibility of the
stormwater pond and the entrance sign.
• Preserve the landscape buffer along the rear (southern) property line, to the
extent possible.
• Provide letter of approval from U.S. Fish and Wildlife Service.
All four conditions were met, with the easements and their recordation information noted on
the current plat. A copy of the written stormwater maintenance agreement is attached for
review.
Access to Sebastian Boulevard/CR 512 will be via a ROW permit issued by Indian River
County. County staff has verified that access will be given from CR 512, but location and
design will be determined when the future site plan applications are reviewed. Other specific
details, such as turn lanes and length, will be dependent on the proposed uses of the two
lots, and required traffic analyses.
13. Conclusion: The proposed two -lot subdivision is consistent with the Comprehensive Plan,
the Code of Ordinances and the Land Development Code.
14. Recommendation: Staff recommends that the Planning and Zoning Commission find the
Brook's 512 Commercial Development Preliminary Plat to be consistent with the
Comprehensive Plan, the Code of Ordinances and the Land Development Code, and that
they forward their recommendation of approval to City Council.

THIS EASEMENT is made, this .[Lay of June, 1999, by Lennar Northeast Partners
Limited Partnership, a Delaware Limited Partnership, and its successors and assigns (hereafter the:
"Grantor"), whose address is c/o Lennar Partners, Inc., 101 Marietta Street, Suite 3600, Atlanta, GA
30303, in favor of the Sebastian Lakes Master Association, Inc., a Florida Not -for -Profit '

considerations, the receipt and sufficiency all of which is hereby acknowledged, Grantor does hereby
grant and convey unto the Grantee, its successors and assigns, a non-exclusive Easement for the
construction, use and maintenance of a sidewalk and decorative monument sign, over, under, across
and through the following described real property situated in the State of Florida, County of Indian
River, to -wit:
A parcel of land, being a portion of Tract "C" Sebastian Lakes Unit 1, as shown on
the Plat thereof, recorded in Plat Book 12, Page 11, of the Public Records of Indian
River County, Florida, more particularly described as follows:

Hereinafter referred to as "Easement Area". This Easement Area lies within the dotted cross-
hatched area as shown on Exhibit "A", which is attached hereto for informational purposes only.
The rights herein granted to Grantee by Grantor are specifically for the Grantee, the residents
of The Sebastian Lakes P. U. D., their tenants, and guests and invitees, and the rights include, but are
not limited to the right to use the sidewalk within said Easement Area. The Grantee shall maintain
and repair the sidewalk and monument sign ("improvements") and cut, trim and maintain the
landscaping within the Easement Area in a neat and professional manner. All work undertaken by
or performed by Grantee shall be at Grantee's sole expense and when necessary, prior written
approval and all permits shall be obtained from all appropriate governmental agencies, including but
not limited to the City of Sebastian, Florida. The monument sign shall not be constructed until the
construction plans and specifications, including materials and color, have been approved in writing
by the Grantor. Once constructed, any changes in the monument sign, including appearance, color
or size shall not be undertaken until such changes have been approved in writing by the Grantor.
By acceptance of delivery of this Easement, the Grantee and its successors, will and do
hereby agree to indemnify and hold harmless the Grantor from and against any loss, claim, damage,
liability, attorneys' fees, and court costs incurred by the Grantor as a result of any lawsuit,
administrative action, or other objection made or brought by any individual person or group of
persons against the Grantor, arising directly or indirectly from any loss, claim, damage, injury or
death, including but not limited to attorneys' fees, to said person or group of persons as a result of
negligent or intentional conduct relating to the construction, reconstruction, removal, repair, or
maintenance of the improvements, failure to supervise or adequately train workers or users of this
Easement, or the use of this Easement by owners within Tile Sebastian Lakes P.U.D., or their
invitees and guests and tenants or trespassers.
By acceptance of delivery of this Easement, the Grantee and its successors, continuously
during the effectiveness and term of this Easement as to any part of the Easement Area, hereby agree
to maintain at its sole expense and shall furnish to the Grantor, a copy of its general liability
insurance policy and a certificate of coverage showing general liability coverage for bodily injury
or death with coverage in an amount of not less than $1,000,000.00 naming the Grantor as an
additional insured under said policy. The insurance shall be with an insurance company licensed to
write insurance by the State of Florida; such company to be rated A+ or better as determined by A.M.
Best's Rating Guide, or if such guide is discontinued, the Grantor shall in its reasonable discretion
determine a successor rating standard. Said policy shall include a clause that no cancellation or non -
renewal shall occur of said policy and coverage therein without at least thirty (30) days prior notice
to the insured Grantor.
Grantor covenants with the Grantee that Grantor is lawfully seized of the real property
described herein and that the Grantor has the good and lawful authority to grant and convey this
Easement. All covenants, terms, provisions, and conditions herein contained shall inure and extend
to and be obligatory upon the successors, lessees, and assigns of the respective parties hereto.
The Grantee under this Easement, shall not be entitled to make any assignment of its
Easement rights, except that owners within The Sebastian Lakes P.U.D., their invitees, guests and
tenants may use the sidewalk.

The failure of Grantor or Grantee to comply with terms of this Easement will obligate the
defaulting party to pay all costs and *eases of litigation, including a reasonable attorneys' fee, at
all levels of judicial review, incurred by the other party because of such default.
If any provisions of this Easement or the application thereof to any person or circumstance
is found to be invalid, the remainder of this Easement and the application of such provisions to
persons or circumstances other than those as to which the provision or application is found to be
valid, shall not be effected.
This Easement may be enforced by Grantee's successors and by Grantor's successors and
assigns.
TO HAVE AND TO HOLD the said Easement unto the Grantee and the Grantor, their
respective successors and, in the case of Grantor, assigns forever.
