SEBASTIAN CITY COUNCIL REGULAR MEETING
MINUTES
WEDNESDAY, SEPTEMBER 22, 2021 — 6:00 P.M.

1. Mayor Dodd called the Regular City Council meeting to order at 6:00 p.m.
2. Pastor Grant Foster, Riverside Church of Sebastian gave the invocation.
3. Council Member McPartlan led the Pledge of Allegiance.

In addition to the listed events, Mayor Dodd announced the 2"' Budget Hearing for
FY2021/2022 would be held September 290 at 5:01 p.m.

Mayor Dodd invited the public to speak at the Council meetings rather than social media
if they have a complaint against the City.

21.130 A. Resolution No. R-21-23 - FOOT Public Transportation Grant Aareement (PTGA),
Protect Number #449252-1 for the Purchase of New Security Cameras to Monitor
the Infield Areas at the Sebastian Municipal Airport (Transmittal. PTGA. R-21-231
A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA,
AUTHORIZING THE CITY MANAGER TO EXECUTE A PUBLIC TRANSPORTATION
GRANT AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION
(FDOT) FOR THE PURCHASE AND INSTALLATION OF INFIELD SECURITY
CAMERAS FOR SEBASTIAN MUNICIPAL AIRPORT AS IT RELATES TO FM449252-1
'X26 INFIELD SECURITY CAMERAS'; PROVIDING FOR CONFLICT; PROVIDING FOR
SCRIVENER'S ERRORS; AND PROVIDING FOR AN EFFECTIVE DATE.
The City Manager said this grant was to install security cameras within the boundaries of
the airport and asked for approval.
Bill Flynn, Main Street, asked what the overwhelming reason was to put video cameras
on the infield where skydivers land. He said he thought the City could find another place
for that tax money.
The City Manager said airport security is of the upmosl importance and staff has heard
of inappropriate things that the City would like to document to prevent crime from
happening.
MOTION by Vice Mayor Hill and SECOND by Council Member McPartlan to approve
Resolution No. R-21-23.
Vice Mayor Hill said he appreciated the City Manager and staff for procuring the money;
it is an outstanding use of DST monies and security is incredibly important.
Council Member Nunn said being in the IT industry and dealing with security in the times
that we are in, puts us in a situation where cameras gives us the only way to watch 2417
to cover the City's interest. He said it is great that the City is receiving an 80% grant to
cover the cost.

The City Manager said this is another grant that the Airport Director has obtained that
will be an economic stimulus for the airport. He said by the time they are built someone
will be interested in occupying them.
MOTION by Vice Mayor Hill and SECOND by Council Member McPartlan to approve
Resolution R-21-24.
Mayor Dodd noted the $144,000 will be a loan from the DST fund that will be paid back
through the rents received on the hangars.

MOTION by Vice Mayor Hill and SECOND by Council Member Jones to fund any travel
or registration of the Council Members interested in attending the conference.

13. CITY ATTORNEY MATTERS
Mayor Dodd congratulated the City Attorney and his family upon the birth of his
daughter, Sophia Isabella, on September 18.
Council Member Nunn congratulated the City Attorney on his military promotion to Lt.
Colonel in the U.S. Army.

A. Mayor Dodd said he has received phone calls about a sign hanging on a house
in Sebastian spelling out the "F" word with military weapons regarding a current elected
official. He said understands the First Amendment issue but through his research, not
everything is subject to being a First Amendment freedom. He said there are exceptions
for signs that can incite violence or push for insurrection. In a city of 30,000 people, it
troubled him that the sign is even hanging; he didn't think they really wanted to see this
in Sebastian and he asked Council if they should take a stand on something like this.
Council Member McPartlan said the sign would probably warrant a call to the Secret
Service because when it involves the current President or former President, the
language might be considered a threat.
Council Member Nunn asked if there was a City ordinance banning profanity on signs or
flags. Mayor Dodd said the City does not have one but the City of Punta Gorda just
passed one.
Council Member Nunn said he was aware of a gentleman on Vocelle that had a flag up
last year and Code Enforcement made him take it down. He said while they may not
agree with the wording of such flags, the First Amendment still covers that ability to say
that you don't like somebody. He said he wouldn't want to do anything against
someone's First Amendment rights.
The City Attorney advised that signs on private property squarely fall within the First
Amendment and there is a Supreme Court decision on that. He said he would advise
against passing anything that has to do with someone's First Amendment rights at this
time; if there was an ordinance in place it would be unconstitutional.
Mayor Dodd addressed the man that has the sign up directly and asked him to take it
down. He asked him to get past being threatening to his neighbors just because they
don't agree with him, stating it is the only the way we will get back to being Americans.
B. Vice Mayor Hill said he understood the un-comfortableness with the word
because he has young children. He suggested that individuals be respectful as possible
while trying to get their point across because while he believed in everyone's First
Amendment rights but he does have young children.
C. Council Member Jones - None
D. Council Member McPartlan recognized Ted Pankiewicz and his non-profit
organization, For the Love of Paws, who is fostering some kittens for a young boy until
he can be placed in a home that will take him along with the kittens. He said For the
Love of Paws does a great community service and always looking for volunteers.
He said there are a number of college classes being held right next door in the old City
Hall. He asked if Dr. Casey Lunceford, President -Mueller Campus at Indian River State
College, has made any recent presentations on the classes being offered and the Small
Business Administration associate that can help businesses start up, receive grants, or
expand to the next level. The City Manager offered to reach out to Dr. Lunceford to ask
him to make a presentation at an upcoming Council meeting.

E. Council Member Nunn said our Constitution is very important to our country and
it is important not to do things that would violate it. He said decorum and respect still
come into play so conversations should be held with children. Just because someone
doesn't like a statement, whether we agree or disagree with the statement, it's important
to be able to say that statement as a free citizen of the United States.
He thanked Council Member McPartlan for bringing up the Love of Paws because they
help a lot of senior citizens with pet food.
17. Being no further business, Mayor Dodd adjourned the Regular City Council meeting at
6:31 p.m.
