A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA, APPROVING THE PRELIMINARY PLAT FOR A
2-LOT SUBDIVISION KNOWN AS BROOK'S 512 COMMERCIAL
DEVELOPMENT; PROVIDING FOR CONFLICTS AND SCRIVENERS
ERROR; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the owner of the subject land has filed an application for approval of a
preliminary plat for a subdivision known as Brook's 512 Commercial Development, a replat of a
portion of Tract C, Sebastian Ickes Unit 1; and
WHEREAS, the preliminary plat complies with applicable State and City codes and
regulations; and
WHEREAS, the Planning and Zoning Commission of the City of Sebastian held a public
hearing on October 14, 2021, and recommended approval of the Preliminary Plat for Brook's
512 Commercial Development, with conditions, by a vote of 6 — 0;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
SEBASTIAN, as follows:
Section 1. PRELIMINARY PLAT APPROVAL. The City Council of the City of
Sebastian, Florida does hereby approve the preliminary plat for Brook's 512 Commercial
Development prepared by Joseph W. Schulke, P.E., bearing the latest revision date of August 13,
2021, as maintained on file with the Community Development Department, subject to the
following conditions:
a. A 10-Foot buffer easement shall be established along the southern property
line, with a 6-foot high opaque buffer installed and shown on the Construction
Plans.
b. All dead and sickly trees shall be removed from the site during subdivision
construction.
Section 2. CONFLICT. All resolutions or parts of resolutions in conflict herewith
are hereby repealed.
Section 3. SCRIVENER'S ERRORS. Sections of this ordinance may be
renumbered or re -lettered and corrections of typographical errors which do not affect the intent
may be authorized by the City Manager, or the City Manager's designee, without need of public
hearing, by filing a corrected or re -codified copy of same with the City Clerk.
Section 4. EFFECTIVE DATE. This Resolution shall take effect immediately upon
its adoption.
The foregoing Resolution was moved for adoption by Councilmember
Nunn The motion was seconded by Councilmember

The Mayor thereupon declared this Resolution duly passed and adopted this 10tb day of
