CITY COUNCIL CHAMBERS 1225 MAIN STREET, SEBASTIAN, FLORIDA Mayor Hill called the Regular City Council meeting to order at 6:00 p.m. 2. A moment of silence was held. 3. Council Member Dodd led the Pledge of Allegiance. 4. AGENDA MODIFICATIONS There was no objection to adding a presentation by Indian River County Commissioner Laura Moss under item 6E. 6. PROCLAMATIONS. AWARDS. BRIEF ANNOUNCEMENTS A. Proclamation — Christooher Scott Mach — Indian River Countv's First Sea Scout Quartermaster Quartermaster Christopher Mach was not in attendance. Sebastian Social Resoite Proaram for Residents Presentation by Vicki Drumheller. RN and Courtnev Sanchez. Proaram Director. of the Alzheimer Parkinson Association of IRC Regular City Council & CRA Meeting January 26, 2022 Page 2 Ms. Drumheller distributed information (see attached) and briefly described the background of Alzheimer Parkinson Association of IRC. Ms. Sanchez, Program Director of the Sebastian Respite Program, described the free program that is housed at the Sebastian Yacht Club from 9 am to 3 pm on Thursdays to give caregivers a break. For those interested, they could give the office a call at (772) 563-0505 and she will help them go through the application process. C. Sebastian Rotary Brewfest Update by Marc Ginoras Mr. Gingras introduced Sebastian Brewfest Chairman Scott Theo who stated there were over 700 participants at the December event and presented the Mayor with a $1850 check from the proceeds. D. Community Development Block Grant Proaram Housing Rehabilitation/Replacement Update by Guardian Communitv Resource Manaaement. Inc. Antonio Jenkins, Consulting Project Manager for the CDBG Program, gave a PowerPoint presentation highlighting the program's overview and activity for the; past two funding allocations. (see attached) E. Presentation by Indian River Countv Commissioner Laura Moss Commissioner Moss extended a personal invitation to the community to participate in planning the future of Indian River County at a workshop to be held next Thursday, February 3, from 10 am to noon at the Vero Beach Intergenerational Center. Brief Announcements: Saturday, January 29 - Sebastian River Art Club at Riverview Park — 8 am — 4 pm Thursday, February 3 - Four Chaplains Ceremony at Veterans Memorial in Riverview Park 8 - 8:30 am — Date will change Friday, February 4 - Chamber of Commerce Concert in the Park at Riverview Park — 5:30 pm — 8 pm - Dave Scott Band Sebastian Police Department Citizens' Police Academy — February 17 to May 5 Mayor Hill announced the upcoming events. PUBLIC INPUT Robert Masterson said he drives US Highway 1 everyday where there seems to be an increasing number of swales, bumps and potholes. He realized the Florida Department of Transportation doesn't have any improvements planned until 2025 which is a long time for the road to take abuse. Referencing the recent article in the Sebastian Daily, he also sees speeding, traffic lights being run, and bad U-turns and noted if there were a Regular City Council & CRA Meeting January 26, 2022 Page 3 greater police presence, flashing lights and a campaign for safer driving it might help. He also suggested that the City should annex anything the City has the opportunity to so that the City will have a say on the impact of the growth. 8. CONSENT AGENDA A. Approval of Minutes — January 12, 2022 Regular City Council Meeting B. Resolution No. R-22-05 — Accepting the 41h Quarter Financial Report and Recognizing Necessary Amendments and Adjustments to the FY 202-2021 Annual Budget (Transmittal, R-22-05, Report) A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, RECOGNIZING CERTAIN ADJUSTMENTS TO THE BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2020 AND ENDING SEPTEMBER 30, 2021 AS PROVIDED FOR IN EXHIBIT "A"; PROVIDING FOR CONFLICTS; PROVIDING FOR SCRIVENER'S ERRORS; AND PROVIDING FOR AN EFFECTIVE DATE. Approve the Purchase of One John Deere 35G Mini Excavator in the Amount of $66,836.75 Using the Florida Sheriffs Contract #FSA20-EQU18.0 for the Stormwater Division (Transmittal, Quotes) Approve Wounded Waters, Inc. Request to Waive Park and Stage Rental Fees to Hold an Event called "Operation New Day" in Riverview Park on February 10, 2022 (Transmittal, Application) Mayor Hill asked to pull Item I for discussion. MOTION by Council Member McPartlan and SECOND by Council Member Nunn to approve items A-H. Roll call: Vice Mayor Jones - aye Council Member Dodd - aye Council Member McPartlan - aye Council Member Nunn - aye Mayor Hill - aye Motion carried. 5-0 Item I -Wounded Waters. Inc. Chris Nolan introduced Wounded Waters Founders Kevin and Chuck. He said Wounded Waters helps veterans with PTSD counseling. He said their goal is to have 10 realtors by February 10th donate part of their commissions to go directly to the veterans at their roll out event. They are requesting Council to waive the park and stage fees for their event, "Operation New Day." Council Member Dodd said it was a great opportunity to assist the fledging organization and he made a MOTION to waive fees for the first event to get them off the ground which was SECONDED by Council Member Nunn and passed with a unanimous voice vote of 5-0. 9. COMMITTEE REPORTS & APPOINTMENTS A. Citizens Budoet Review Advisory Board (Transmittal, Application, Advertisement, List) i. Council Members Confirm Their A000intees The Council confirmed their appointed members. ii. Nominate One Additional Member —Term to Expire November 2022 Mayor Hill made a MOTION and SECOND by Vice Mayor Jones to appoint Amber Cerda in the vacant Additional Member position. 10. Mayor Hill recessed the City Council meeting and convened the Community Redevelopment Agency meeting at 6:38 p.m. Regular City Council & CRA Meeting January 26, 2022 Page 5 A. MOTION by Mr. McPartlan and SECOND by Mr. Nunn to approve the October 27, 2021 CRA meeting passed with a unanimous voice vote. 5-0 B. Consider Sebastian River Area Chamber of Commerce's Public Mural Program (Transmittal. Prooram. Code Sections) Cheryl Thibault, President/CEO of the Sebastian River Area Chamber of Commerce, Nichole Johanson, Director of Operations of Mel Fisher's Treasure Museum, and Amanda Smalley, Manager at Skydive Sebastian, who are also members of the Public Mural Program Committee introduced themselves and displayed a PowerPoint presentation outlining the program's objectives, examples, and participants of the Florida Mural Trail. (see attached) Chairman Hill said he wanted to make sure that they won't be disrupting something they have built for the last 20 years in the CRA and with regard to the First Amendment, he asked what is to say the First Amendment won't get in the way of putting something up that can't be stopped. Ms. Johanson responded that she respected his concerns, the committee would want to preserve the community as well and she would hope the Council would trust that they have best interest at heart for the community. They would only allow things approved within the categories that they have established. Mr. Dodd said the program has specifications on the topics and ambience of the murals and as long as it stays within those and the Growth Management Department makes sure it's not advertising, he said the program gives them the opportunity to say "no" to something inappropriate. He said he was in favor of this. Mr. Nunn said he believed there are enough checks and balances to avoid most issues. He said they were in great hands with this team they have and he looked forward to some new art within the community. Vice Chairman Jones said the murals are a powerful way to tell story of a community and he looked forward to seeing that; it is a great opportunity to go forward with this. Mr. McPartlan said he looks forward to this; it all has to go through the CRA Manager who he trusts. Derek Gerry said as a citizen he would really like to see this and as a business owner, he looks forward to applying for mural. Kirk Funnell, Indian River County Chamber of Commerce Director of Tourism and Marketing, said he would love to see this and it will really bring out the historic community. MOTION by Mr. Dodd and SECOND by Vice Chairman Jones to approve the mural program as presented by the Sebastian Area Chamber of Commerce and direct City staff to draft the appropriate changes to the Land Development Code. Chairman Hill adjourned the Community Redevelopment Agency meeting and reconvened the City Council meeting at 6:54 p.m. 12. PUBLIC HEARINGS - None 13. UNFINISHED BUSINESS - None 14. NEW BUSINESS A. Aooroval to Select Ahrens Companies. Inc. as the Desion-Build Firm for Two (2) Airoort Hanaars at 70 Airoort Drive West on Sebastian Municioal Airoort Prooertv and Authorize Neaotiations for a Guaranteed Maximum Price Contract (Transmittal. Bid Tab. R-21-24) The City Manager said Mr. Ahrens who has built Hangars A, B, C, and D has now put in a proposal for these hangars and he recommended awarding this project and allow staff to negotiation a guaranteed maximum price. MOTION by Council Member McPartlan and SECOND by Council Member Nunn to approve item #14A. Roll call: Council Member McPartlan - aye Council Member Nunn - aye Mayor Hill - aye Vice Mayor Jones - aye Council Member Dodd - aye Motion carried. 5-0 B. Review and Consider 2022 Council Meetino Dates (Transmittal. Calendar) Mayor Hill suggested cancelling the December 28 and moving the November 23 meeting to the 2"d or the 215`. The consensus of Council was to have a November 21' and December 14`" meeting and if needed, a special meeting could be called. 15. CITY ATTORNEY MATTERS - None 16. CITY MANAGER MATTERS - None 17. CITY CLERK MATTERS The City Clerk thanked Cathy Testa for covering for her during her absence as she did a great job. Regular City Council & CRA Meeting January 26, 2022 Page 7 18. CITY COUNCIL MATTERS A. Mayor Hill Discussion of Golf Carts (F.S.316.212 & F.S.320.01) Mayor Hill said driving regular golf carts throughout the City are illegal and he asked if there were concerns or questions from the community about permitting regular golf carts on the City's streets. Council Member Nunn said if there was interest in permitting them then they should meet the state guidelines. Vice Mayor Jones said he was not looking forward to having golf carts on the City's streets. In his previous career he dealt will a lot of the accidents and loss of life. He said he would like to stick with what they have which is the state law that allows the golf carts that have been certified and registered with the state can be driven. Council Member McPartlan said he was okay with leaving things the way they are noting the scooters in Miami are a nightmare. The City Attorney advised the County does not have any ordinances that permits regular golf carts or restricts the low speed vehicles. B. Vice Mayor Jones - None C. Council Member McPartlan - None D. Council Member Nunn Council Member Nunn stated that everyone has seen the new transitional housing going in just outside the City's limits and noted that the City found out at the same time as they did. He asked the public to be more caring for their neighbors who are trying to get off the street which is the hope of the transitional housing. He asked that we all be less judgmental because we could all be homeless in a moment. Mayor Hill said for everyone that says the City shouldn't be annexing any property, if we annexed it at least we would have a say in what happens to the property; much like all of the properties surrounding Sebastian, we will have say and generate tax revenues from those properties. Council Member Dodd said if the Source would like to build the facility that they have in their rendering, which is an extremely attractive multi -use affordable housing subdivision, he would love them to come to Sebastian to talk to us because that is what we need. Council Member Dodd Council Member Dodd thanked the people who showed up for the two workshops and wanted everyone to understand that they truly do appreciate our employees. He also said the Vice Mayor of Port St. Lucie, Ms. Jolien Caraballo, will be vice president of the Florida League of Cities next year and people who are interested in becoming active can review proposed legislation on the League of Cities website right now. For example, a proposal that has already passed one committee provides that an ad valorem tax increase in a municipality will have to be approved by referendum in a general election, which is nice for those that want to control taxes but it prevents municipalities from balancing a budget until the next election which will force municipal governments to have a higher tax rate in anticipation that they won't get approval in the next general election which is the opposite effect of controlling taxes. Council Member Dodd said the link on the Florida League of Cities website is called "advocacy" and he asked that people contact their legislators to let them know how these proposals are not something they would like to see happen or they could contact Vice Mayor Jones who is going to lobby the legislators in Tallahassee next week. 19.
