ADoroval of Minutes: Regular Meeting of March 17, 2022 Ms. Kautenburg asked if all the Commissioners have had a chance to review the Minutes of the March 17, 2022 meeting. All indicated they had. There being no comments or corrections, Ms. Kautenburg called for a motion. A motion approving the Minutes of PLANNING AND ZONING COMMISSION/LOCAL PLANNING AGENCY PAGE 2 MINUTES OF APRIL 21, 2022 March 17, 2022 as presented was made by Ms. Kinchen, seconded by Mr. Christino, and approved unanimously via voice vote. Ms. Kautenburg closed the Planning and Zoning Commission meeting and opened the Local Planning Agency Hearing AT THIS POINT, MS. BATTLES RECUSED HERSELF. VI. Local Planning Agency (LPA) Public Hearing A. REMOVE FROM TABLE 1. Public Hearing -- Recommendation to City Council -- Ordinance 0-22-06 -- Land Development Code Amendment -- ARTICLE V BY ADDING TRANSFER OF DENSITY AND DENSITY INCENTIVE PROGRAM REGULATIONS; AMENDING ARTICLE XI BY ADDING THE COASTAL HIGH HAZARD AREA; AND TO PROVIDE FOR SEVERABILITY, CONFLICTS, CODIFICATION, SCRIVENER'S ERRORS, AND AN EFFECTIVE DATE Mr. Anon read the item into the record, and Ms. Kautenburg called for staff presentation. Ms. Bosworth reviewed that this had been discussed at the March 17th meeting. At that meeting, there were still some issues that the Commission wanted staff to look into regarding possible revisions. A motion at that meeting was to table this item. At this time, a motion is needed to take the item off the table and put it on the agenda for this hearing. Ms. Kautenburg called for a motion on this item. A motion removing the above item from the table and putting it back on the agenda for this meeting was made by Mr. Christino, seconded by Ms. Kinchen, and approved unanimously via voice vote. Ms. Frazier reviewed the history of this item, and that this ordinance was reviewed thoroughly at the last meeting, and the option was provided for the Commission to table it and to bring it up again at a time certain, which was at this meeting, in order to finalize any discussion. Staff incorporated the changes that the Commission had recommended at the previous meeting. Staff and the consultant reviewed both Section 54-2-5.16 as well as Section 54-2-5.17 and Section 54-3-11.12 regarding the discussion that was had at the last meeting. She stated that regarding Section 54-2-5.16, the Transfer of Development Rights, there were very few changes that were made, or for the Coastal High Hazard area. The majority of changes occurred in Section 54-2-5.17, Development Incentives. There was discussion about whether we wanted to just delineate the PLANNING AND ZONING COMMISSION/LOCAL PLANNING AGENCY PAGE 3 MINUTES OF APRIL 21, 2022 potential benefits as far as what the incentives were —the public benefit infrastructure — or attempt to put numbers to it. She cited some examples. She stated staff also found that there were not many good examples from other municipalities or local governments utilizing that. Staff felt that they should refer back to what is done today in the City's PUDs in the assessments of the City's planned unit developments, giving them that flexibility when they provide public infrastructure benefits. Staff felt that that would be the best way to go about this. Staff has delineated the Public Benefit Infrastructure standards with some positive ideas. It is not an exhaustive list, but it is a list that meets the items that were put in the City's Comprehensive Plan and which staff has always measured as public benefits during the PUD process. Staff did not allocate numbers to it, as that became very cumbersome, and staff felt that that was not the correct way to proceed. That was the biggest change that was made to that section and overall. Ms. Frazier then asked for questions/comments from the Commission members. She added that Ms. Bosworth is here also. She has been heavily involved with Kimley-Horn during this process, and she is here to answer any questions the commissioners may have regarding this subject. Ms. Bosworth followed up by explaining how the incentives would be managed. She explained that when a project is presented to the City, staff is going to rely heavily on the section that states that the developer has to submit to the City a development incentive program. She stated that staff is going to look for very specific items that would be in a development proposal that would then come to this Commission with the developer's application such as a site plan or a subdivision, etc. so that this Commission can determine, along with City Council, if this development program is warranting the amount of increased density that they want. Mr. Christino inquired if this is consistent with what was discussed recently. Ms. Frazier said that it is. Mr. Christino asked if these parameters are for anyone who wants to develop in the City, not just in the Coastal High Hazard area. Ms. Frazier said yes. She also said the Coastal High Hazard area is only along Indian River Drive, which is miniscule. She added that there are some areas along the River to the west in the City. Ms. Frazier emphasized that these incentives are over and above what would be required for a regular development plan such as sidewalks, etc. Ms. Bosworth reviewed some examples. She emphasized that the land use is always going to establish what density is allowed through the Comprehensive Plan. Ms. Kautenburg asked if staff will be able to provide to the entity asking for incentives a list of incentives as examples. Ms. Frazier said yes, that is what is in front of the commissioners this evening. Ms. Kautenburg asked if the staff will be open to other PLANNING AND ZONING COMMISSION/LOCAL PLANNING AGENCY PAGE 4 MINUTES OF APRIL 21, 2022 suggestions, and Ms. Frazier answered yes. Ms. Kautenburg stated this is a good beginning, but she does not think it will go very far in providing affordable housing in the City. Ms. Bosworth stated that in the City's zoning districts there are specifics for new lot sizes, what the setbacks must be, etc. Also, within the RM-8 district there are established townhouse regulations She explained that in the new zoning district for RM-10 and mixed use, there will be included attainable housing standards. Staff felt that that was a better fit in the zoning districts versus the incentives. At that point, staff can set up affordable housing for 5,000 square -foot lots, etc. Ms. Kautenburg agreed. There being no further questions/comments from the commissioners, Ms. Kautenburg called for public input on this issue. There being no public input, Ms. Kautenburg called for a motion. A motion recommending to City Council approval of Ordinance 0-22-06 -- Land Development Code Amendment -- Article V by adding transfer of density and density incentive program regulations; amending article XI by adding the Coastal High Hazard Area; and to provide for severability, conflicts, codification, scrivener's errors, and an effective date, in compliance with the Comprehensive Plan of the City, was made by Mr. Christino and seconded by Mr. Carter. Requested Action: Modification to an existing church site that includes a 7,160 SF sanctuary addition, a 314 SF building addition, and additional parking spaces, along with improvements to landscaping, utilities, lighting, and stormwater. 3. Narrative of proposed action: Calvary Chapel has submitted a request for a site plan modification and conditional use permit for a 7,420 SF sanctuary expansion along with parking, landscaping, lighting, and stormwater improvements. The existing site was the location of the former United Church of Sebastian congregation. In 1992, a phased site plan was approved, and a stormwater system designed and installed to accommodate future phases. The initial Multi -purpose building was constructed, with Phase 1A added in 1996. No other phases were completed in the ensuing years. b. C. 9 This current request is for the remaining phases and build -out. The design layout is generally the same as the earlier site plan, however, since the 1992 site plan approval, parking regulations and PS zoning requirements have been revised, and it was favorable for both the property owner and city to re -review the plans using current codes. Per the Florida Building Code (FBC), capacity is calculated differently depending if the seats are fixed or mobile. Surface water management: Provided - When the existing site was approved and constructed in 1992, the stormwater system was designed for a future build -out of the property. Maximum capacity needed was determined by using the maximum impervious area that was allowed per the zoning district. The previous approved site plan was a phased plan with expected expansion as the church community grew. Therefore, no increase to the size of the existing pond is necessary to accommodate the increased impervious area being added to the site as this was already calculated and designed for on the previous site plan. However, as noted on Sheet C3 in the demolition notes, all exotic aquatic species will be removed from the pond, and existing stormwater structures will be cleaned out so that the system will function optimally as it was designed. 16. Churches are Conditional Uses in the Public Service (PS) zoning district. The existing church facility received a Conditional Use permit when the original site plan was previously approved, but the proposed modifications must also meet the required conditional use criteria, found in LDC Article VI, which are: 1) A minimum lot area of 20,000 square feet shall be required. 2 2) A minimum lot width of 100 feet shall be required. 3) The maximum lot coverage by all impervious surfaces shall not exceed 60% of the lot area. 4) No building or structure shall be located closer than 30 feet to any property line abutting a residential use or district. 5) Access shall be from a major thoroughfare or as otherwise approved by the city engineer. 6) Any accessory residential use or school upon the premises shall provide such additional lot area as required for such use by this section and shall further be subject to all conditions set forth for such uses by this section. Accessory residential uses may include convents, monasteries, rectories or parsonages. 7) Screening: All side and rear yards abutting residential districts or uses shall be screened in accordance with the standards established in Section 54-3-14.16 of this ordinance. See Exhibit A, which is a letter from the project's Engineer addressing each criterion and verifying that the proposed project is in compliance. The Planning and Zoning Commission must also find that the expansion of the church use: 1) Is so designed, located, and proposed to be operated so that the public health, safety and welfare will be protected. 2) Does not present an unduly adverse effect upon other properties in the impacted area in which it is located. 3) Based on the scale, intensity and operation of the use shall not generate unreasonable noise, traffic, congestion or other potential nuisances or hazards to contiguous residential properties. 4) Conforms to all applicable provisions of the district in which the use is to be located. 5) Satisfies specific criteria stipulated for the respective conditional use described above. 6) Is consistent with the Code of Ordinances and comprehensive plan. Upon such finding, the Planning and Zoning Commission shall approve the conditional use permit. Staff concurs that the project meets the required conditional use criteria. However, regarding #7, the east, south, and southwest yards abut residential districts and/or uses, and must provide opaque screening at least 6 feet in height. These yards currently have natural opaque buffers in place that consist of trees, palmettos, and natural ground cover that meet this regulation. During landclearing activities, though, all invasive plant materials are required to be removed. If an existing buffer, within the required yards, becomes less opaque than mandated because of the removal of the invasives, additional plantings and/or fencing should be required to meet the conditional use buffering requirement. 7 B. The site plan and traffic information was forwarded to Indian River County Traffic Engineering for review since the project is located on County Road 512. Correspondence was received from IRC (Exhibit B) stating that no road improvements would be required for CR512 until "such time that an expansion of the facility allows for seating above the proposed 350 seats." Although parking needs are in compliance with Sebastian code, and have been calculated and provided for a maximum capacity of 559 persons, any future increase of seating above 350 should be presented to the city as a modification application so that IRC can re -review traffic impacts, and the city can review parking standards, i.e. grass vs. paved. C. There is an existing well noted on the site plan showing that is within the stormwater pond adjacent to CR512. City staff has observed the piping to be cracked below the water surface and opines that the well should be plugged and abandoned through the proper permitting authorities. At this time the applicant is not sure if they want to formerly abandon it, or temporarily cap the well until it can be assessed by a professional. Clarification was received from the Department of Health (DOH) providing guidance and information regarding permitting. (See Exhibit C) 22. Staff Conclusion: The site plan is consistent with the Comprehensive Plan, the Land Development Code, and the CR512 Overlay District. 23. Recommendation: Staff recommends approval of the proposed site plan modifications along with the conditional use permit request for Calvary Chapel located at 1251 Sebastian Boulevard subject to the following conditions: 1. Opaque buffering must be provided along the eastern, southern, and southwestern boundary lines. If the existing natural buffer ceases to be opaque after removal of invasive plant materials (i.e. pepper trees), or plants and trees become weakened by age, storm, fire, or disease, additional buffering — landscaping or fencing — must be re-established along these boundary areas. Buffering will be verified at final inspection and must be in compliance before issuance of the Certificate of Completion. 2. If additional seating is added over the proposed 350 seats, Calvary Chapel shall submit a site plan application so that parking compliance can be reviewed by the city and traffic improvements by the county. 3. The existing well located in the stormwater pond shall be examined and determined if functional, and either abandoned or capped before issuance of the Certificate of Completion. 4. That's a complicating factor that I was unaware of. The ill -sited well presents a potential for groundwater contamination, a consideration used to determine if a well should be plugged. I'm unable to locate construction records for this well so I assume it may have been constructed in 1992, the year the building was constructed. Perhaps this well is nearing its life expectancy and should be plugged before it becomes a hazard, a direct conduit for surface water to enter the aquifer. In the interim, if the well is in good repair and functioning as intended, and the new stormwater calculations are not increasing the surface area of the adjacent detention pond, the well head may be temporarily sealed, no permitting required from this department.
