WEDNESDAY, MAY 11, 2022 — 6.00 P.M.

1. Vice Mayor Jones called the Regular meeting to order at 6:00 p.m.
2. Vice Mayor Jones asked the moment of silence be dedicated to Swami Anjani Cirillo of
Kashi Ashram who recently passed away. Swami Cirillo helped begin the annual
Sebastian Clambake Festival in 2002 and served as the foundation's president for over a
decade.
3. Council Member McPartlan led the Pledge of Allegiance.

Vice Mayor Jones read and presented the proclamation to Officers Devin Keskinen and
Frank Scianimanico.

Vice Mayor Jones read and presented the proclamation to Mr. Cannon and members of
the United States Coast Guard Auxiliary.
22.088 D. Michele Buldo. Substance Abuse Free Indian River Coalition Director. Substance
Awareness Center of IRC
Ms. Buldo was unable to attend and her presentation will be rescheduled in July.
BriefAnnouncements:
Saturday, May 14 — Sebastian River Craft Club Show in Riverview Park —10 am to 3 pm
Council Member Nunn announced the upcoming craft show.
7. PUBLIC INPUT
John Norris, 566 Cross Creek Circle, suggested that Council should buy the Sembler
property contiguous to Crab E Bills before someone else builds a two story condo or
restaurant.
Indian River Council Commissioner Laura Moss thanked Council for their help in
disseminating information on the Courtly's visioning process. She invited everyone to
come out and participate in the upcoming workshops.
A. Approval of Minutes — April 27, 2022 Regular City Council Meeting
22.089 B. Approve Alcoholic Beverages at the Community Center for the Hurtado Family
Event on June 11, 2022 from 5:00 to 11:00 pm - DOB Verified (Transmittal,
Application, Receipt)
MOTION by Council Member Nunn and SECOND by Council Member McPartlan to
approve Consent Agenda Items A and B passed with a unanimous voice vote.

9. COMMITTEE REPORTS & APPOINTMENTS
Council Member Nunn said he just came from the Indian River County Tourist
Development Committee meeting where they reviewed presentations from many great
organizations that provide support for tourism. He said the Council is projected to double
last year's income which is awesome for Indian River County.

Vice Mayor Jones opened the hearing at 6:18 p.m. A MOTION was made by Council
Member Dodd and SECONDED by Council Member Nunn to continue the hearing for
Ordinance No. 0-22-04 until May 25a'. The motion passed with a unanimous voice vote
of 5-0.

12. NEW BUSINESS
22.090 A. Establishment of the Centennial Task Force to Plan the Citv's Centennial
Celebration (Transmittal. R-22-02)
A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY,
FLORIDA, ESTABLISHING A CITY OF SEBASTIAN CENTENNIAL TASK
FORCE; PROVIDING FOR RESPONSIBILITIES; PROVIDING FOR DISSOLUTION;
PROVIDING FOR CONFLICTS; PROVIDING FOR SCRIVENER'S ERRORS; AND
PROVIDING FOR AN EFFECTIVE DATE.
The City Manager said it was determined that the formation of a committee was needed
to plan the City's centennial celebration and he requested approval of R-22-02.
There was no public input.
MOTION by Council Member Nunn and SECOND by Council Member Dodd to
approved Resolution No. R-22-02.
Council Member Dodd asked that the public participate in the year -long event.
The resolution was adopted with a unanimous voice vote of 5-0.
Added B. Approve Amendment I to the SJRWMD Sebastian Roseland Road Septic to
Sewer Proiect (CSP20-211 and Authorize the Citv Manaeer to Execute the
Aoorooriate Documents (Transmittal. Amendment. Scone)
MOTION by Council Member Dodd and SECOND by Council Member McPartlan to
approve the amendment to the SJRWMD Sebastian Roseland Road Septic to Sewer
project and authorize the City Manager to execute the appropriate documentation.
The City Manager said originally this funding was to help with the sewer on the west side
of Roseland Road but some of those funds were not needed so the City transferred the
grant to the airport sewer project. When the City applied for the SJRWMD
reimbursement, it was realized that only 20% could be matched instead of 33% which
reduces the amount the City would be saving but it is still a great opportunity to reduce
the City's cost by $160,000.
There was no public input.

13. CITY ATTORNEY MATTERS
The City Attorney advised Council that he will be reporting to Ft. Bragg for military duty
next week but would be available by phone.
14. CITY MANAGER MATTERS
The City Manager said he has received a lot of positive responses from the survey
recently sent out and encouraged everyone that received one to be sure to send it back in.
The City Manager said at a previous Council meeting, staff was asked to look into
roosters and found that they were not prohibited in the code related to the keeping of fowl
but the noise could be addressed by the enforcement of:
Sec. 67-1. - Noises; unnecessary and excessive prohibited.
C. The following acts, among others, are declared to be unreasonably
loud, excessive, unnecessary or unusual noises in violation of this chapter
but this enumeration shall not be deemed to be exclusive, namely:
(1) Power tools and landscape equipment. The operation of
noise -producing lawn mowers, lawn edgers, weed
trimmers, blowers, chippers, chain saws, power tools and
other noise producing tools which are used at a residence
out-of-doors between 9:00 p.m. and. 7:00 a.m.
(2) Animals, birds, etc. The owning, harboring,
possessing or keeping of any dog, animal or bird which
causes frequent, habitual or continued noise and which
disturbs the peace, quiet and comfort of neighboring
residents.

He asked Council if they would like to prohibit the keeping of chickens in the City
Vice Mayor Jones said he has had some conversations where people would like to have
some roosters to fertilize eggs.
Mayor Hill said the City is behind in not regulating roosters and it would be his
preference to adjust the ordinance to get in line with other municipalities.
Discussion followed on what the County allowed and if they should include fowl of all
kinds.
Mayor Hill said the fowl are farm animals; there are other municipalities that have laws
in place and if the City regulates the roosters most people will follow the law and it will
also provide recourse for those that live next to the roosters.

Council Member MCParthm asked about the offending roosters that me presently here.
The City Attorney said they would be probably be grandfathered in.
The City Manager said he has seen ordinances where existing roosters can't be replaced
or that they must be removed after six months. He said staff would research the options.
Resurfacine of U.S. Hiehwav 1
He advised that the U.S. 1 corridor from Harrison Street to Davis Street is scheduled to
be resurfaced that will mill off the decorative parking and crosswalks. The cost to
replace the decorative paving would be $350,000.00 that could come out of the DST
funds. He asked Council if they would want to put the decorative paving back.
Mayor Hill said Council added the decorative parking to reduce the speed limit and let
people know that they were entering a special district. He said it was important to
continue that commitment and not lose the feel of the riverfront district.
Vice Mayor Jones agreed, stating it is something residents and visitors have come to love.
The City Manager said the work would start in July 2023; FDOT will replace the
markings; and the City will have to enter into a maintenance agreement.

Council Member MCPertlen asked that the parallel crosswalks that are outside of the road
be included.
The City Manager explained that FDOT is looking for what the City is interested in so
they can include it in their bid price. He offered to ask what the price would be without
the decorative paving but his challenge to that would be that he would need to close the
road twice and it would take twice as long.
The City Manager requested consensus to put back crossing and parking spaces as they
are in the FDOT plan and add the crosswalk at Harrison Street.
Council Member Dodd suggested leaving Harrison Street until they decide the structural
plan for Harrison Street.
It was the consensus of Council to keep the decorative paving in the 23/24 budget cycle.
15. CITY CLERK MATTERS - None
16. CITY COUNCIL MATTERS
A. Council Member McPartlan said Sheriff Flowers would be holding a multi -
agency law enforcement memorial in front of the court house on Monday, May
16m at 10:00 a.m.

B. Council Member Nunn said his friend's daughter, Abigail, received her driver's
license earlier in the day and decided to make her first drive to the Council
meeting. He said it was exciting to have youth excited about City government.
C. Council Member Dodd announced the upcoming Indian River County Visioning
Workshops to encourage people to get involved. (See attached) He said that so
far the desires of the people of Sebastian are not represented very well in the
visioning document. If people are interested in what the development might look
like across the border they might want to come.
D. Mayor Hill said it was nice to have Commissioner Moss come to the meeting to
care about what the citizens of Sebastian have to say.
He thanked Vice Mayor Jones for running the meeting in his absence. He also
thanked the City Attorney for his military service.
Mayor Hill asked if a rooster ordinance was coming back to Council. The City
Manager said his understanding that he was to look at what the County has and
the ability to not have roosters but have fowl. Mayor Hill said that was correct,
the same as Vero Beach's ordinance.

17. Being no further business, Vice Mayor Jones adjourned the Regular City Council
meeting at 6:59 p.m.
