A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN
RIVER COUNTY, FLORIDA, REPEALING RESOLUTION R-
22-07 IN ITS ENTIRETY AUTHORIZING THE CITY
MANAGER TO EXECUTE NON-EXCLUSIVE EASEMENTS
WITH FLORIDA POWER AND LIGHT (FPL) PROVIDING
ELECTRICAL SERVICE FOR TWO EASEMENTS TO
PROVIDE ELECTRICAL SERVICE TO THE SEWER LIFT
STATION, AND TO THE NEW PUBLIC WORKS COMPOUND
ON SEBASTIAN MUNICIPAL AIRPORT PROPERTY;
PROVIDING FOR CONFLICT; PROVIDING FOR
SCRIVENER'S ERRORS; AND PROVIDING FOR AN
EFFECTIVE DATE.
Whereas, Florida Power and Light (FPL) requires easements to provide power to
the sewer lift station on Sebastian Municipal Airport Exhibit 1A and to the Public Works
Compound Exhibit 2A and
Whereas, the City of Sebastian agrees to the non-exclusive conditions an
easement,
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
SEBASTIAN, as follows:
Section 1. AUTHORIZATION. The City Manager is hereby authorized to
execute said non-exclusive easement with Florida Power and Light Company on behalf
of the City.
Section 2. CONFLICTS. All resolutions or parts of resolutions in conflict
are hereby repealed, specifically R-22-07 as recorded in the Indian River County Clerk
of Court Book 3509, pages 404-407.
Section 3. SCRIVENER'S ERRORS. Sections of this resolution may be
renumbered or re -lettered and corrections of typographical errors which do not affect
the intent may be authorized by the City Manager, or the City Managers designee,
without need of further action of City Council by filing a corrected copy of same with the
City Clerk.
Section 4. EFFECTIVE DATE. This resolution shall take effect
immediately upon its adoption.
The foregoing Resolution was moved for adoption by Council Member
Dodd
