'Sec. 98-36; Parking in residential'districts and on street rights-of, way.
(a) For purposes of, this 'section, a vehiCle' shell be considered.'to be ~arked' if it is st~pped
other' than for.the purpose,of and .while: actually, engaged in :loading.or.~0ading merchandise
or passengers.
(b) 'No vehicle may be parked' on.any, lot in any residential district, .except in. an enclosed.

In accordance .with Section.316.008(4) Florida Statutes,..any violation of Section 316.1955;

"The following words and phrases where used in this article, shall, have the meanings
respectively ascribed to them in this section, except where'.the.context clearly .indicates 'a
different meaning:.
Cited means 'to notify .a person that he has been'charged with a .municipal noncriminal
infraction and must comply with 'the. provisions., of this. article.
Infraction means a.mtmicipal noncriminal.~olation, whicl~ is. not punishable.by-incarcera-

Sec. 98-53.' .MuniCipal noncriminal traffic infractions; .purpose.
(a) Any person who violates a provision of article I-or II.-of this chapter regarding a vehicle
found parked, stopped or standing shall, be deemed to have.committed a' municipal nonm~ving
audnoncr~-~-al infraction.and shall'be cited for.such-an ~-~action.
(b).'-:Whenever sny'~vekicle with a driver therein or thereby is.found'parked; i stopped.- or
standing in violation of auy of the',pr0visions of.article I or. II. of this chapter, the of Scer.fiuding
the vehicle shall deliver to the driver therein or thereb~ a traf~c ,citation or notice in.writing

(c) .Whenever'any vehicle, without' a driver therein'or thereby is .found parked,.stopp~d.or
standing in violation of any.: 0fthe provisions of article I or.]/of this chapter, the 'officer findiug.

(d). Whenever a.citation-has been issued, the oWner or .driver of th~.vehicle must answer, the
citation or notice within 72 hours of the iSsuan'ce of the citation er notice, during the. hours .and
at the place, specified in.the citation or notice, or mail.a check or money, order"as psyment .for
the penalty by U.S. mail. If/such procedure is followed'within.-72 hours, the penalty for
violation of the parking, stoppin~ or .s:andiu§ provisions of article ~ or ~II.'..of this chapter is
(e) If the operator or.owner, of-the vehicle cited for violation of'any of the stopping, standing
or. parkin~ provisions of.this chapter dOes not deliver or mail a check or money order in timely

to. a. hearing, or any appeal..

RESOLUTION NO, R-00-2.0
A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY,
F. LORIDA, ADOPTING CODE ENFORCEMENT CITATIQN FEES; PROVIDING FOR
CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, City Council, 'at its November 18, 1998 Regular Meeting, adopted Ordinance No.
O-98-10, which authorized code enforcement officers, so designated by the city, to.issue citations
for violations of duly enacted codes of the City of Sebastian, pursuant to F.S. 162.21.
WHEREAS., Section 2-194(c)('1) of:the Code of Ordinances requires that City Council shall
adopt, by resolution, a schedule of violations and penalties to be assessed by code enforcement
officers, including standard notification time pedods for specific types of violations, said time period
not exceeding 30 days; and
WHEREAS, the Code Enforcement Board met on March 29, 2000 to review and recommend
a schedule of fees to City Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, that:
Section 1. CODE ENFORCEMENT CITATION FEES. In accordance with Section
2-194(c)(1) of the Code of Ordinances, a schedule of violations and penalties to be assessed by
code enforcement officers and attached hereto as Exhibit '%" is hereby adopted.
Section 2. All Resolutions or parts of Resolutions in conflict herewith are hereby
repealed.
Section 3. This Resolution shall become effective immediately upon,/~doption.
