DiscussiQn_t[~: Gam_~ling Boat~ and Water Taxis (Requested b:~ Councilm~ll~ber Sullivan) Mrs. Sullivan said she felt it was important to have an ordinance prohibiting gambling boats from docking in Sebastian. MOTION by Sullivan/ I want to make a motion, I want to be on the record that I want to see gambling boats prohibited or boats equipped with gambling equipment prohibited from docking in Sebastian. The City Attorney said there would have to he a reasonable basis for differentiating between gambling boats and other types of boats before gambling boats could be prohibited, since the gambling activity would not take place within the City's jurisdiction. Mrs. Sullivan went on to express concern for the lack of parking in the Riverfront area. 2 Regular City Council Meeting December 17, 1997 Page Three 10. Mayor Barnes said while he would not want to see gambling, Council could not pass what may be an illegal ordinance and suggested the matter be studied. The City Attorney said she could draft an ordinance regulating the size of boats allowed to dock in the City. Mrs. Sullivan said she would also like to see water taxis banned. Mayor Barnes said he could contact Ft. Pierce and Port Canaveral to determine the size of gamblir~ :?, boats that dock in those areas. Mrs. Cartwright, referring to a letter to the Editor of the Press Journal by Mrs. Sullivan regarding gambling boats, said she had contacted DEP and other government agencies which would have information on applications for dredging, and had been informed by all that no applications are pending. She said individual Council members should not present personal opinions using their positions as members of the Council. Mr. Taracka said the Army Corps of Engineers is conducting a dredging possibility study for Good Guys and Mrs. Sullivan said she had been told by DEP that there are three dredging applications on file. The City Clerk reiterated the motion, and Mrs. Sullivan added "based on safety factors and size", however, the City Attorney said the motion should be based on limiting the size of commereial boats or that Council could eom, ider a policy statement relative to commercial activity on the fiver.' The City Manager explained the purpose of the observation pier. Don Smith, Poinciana Street, Sebastian, said he felt that the City was getting away from principles in the way it does business, relative to performance evaluations and the way it imposes regulations. Mayor Barnes said there is no written policy for the way evaluations are done and intended to ask that the Personnel Director come up with a policy. Mr. Smith recommended no more Council time be spent on gambling boats, but that staffbe asked to study it; suggested the City move forward on the Riverfi'ont; and thanked City Council. Carolyn Corum, 881 Dolores Street, Sebastian, said she had sent letters to Council asking questions about the Land Development Code and never received a response. Mayor Barnes said he would follow up on it. Mrs. Corum said the observation pier is beautiful. I (8:32 p.m.) . She went on to say she was disappointed that Council did not have a quorum for the Comprehensive Land Use Plan hearing on December 10th, stn~ssing its importance to the City. Mayor Barnes said prior to the hearing date, the Department of Community Affairs claimed they had not received the citY's Evaluation and Appraisal Report, therefore they would need time to review it and were considering a six month extension. Tony Finazzo, Georgia Boulevard, Sebastian, said city staff'had dug a trench in his swale to alleviate a drainage problem, and suggested a solution by punching holes in swales. The Public Works Director said staffhad considered this method. Mayor Barnes said Council adopted the Resolution establishing the make-up of the committee. The City Manager .~uggested that since.the committee has to be formally established by ordinance, the Council could reassess the make-up of the committee at that time. Discussion took place as to whether there was intent for the committee to be permanent or temporary. Mrs. Cartwright said action taken at the previous meeting was clear, and she would like this to go to ordinance form and stay as is. Mr. Sullivan and Mr. Taracka recommended eleven regular members. Mr. Paul suggested staying as is. Mayor Barnes called for a motion. OLD BUSINESS old A. Oy=stm:_B. ay Assessmeal; The City Manager distributed backup at the beginning of the meeting for this item (see December 17, 1997 memo attached). He offered three options for Couacil: 1) do nothing; 2) redo the entire assessment, a method he did not believe would be beneficial to anyone because if redone he would recommend the City not pay on certain of its property the next time, and which would redistribute those funds to other parties; and 3) or, in accordance with FS 170.14, conduct a reapportionment hearing to readjust Oyster Bay's assessment with funds from discretionary sales tax, a method that would afford others the opportunity to question their assessments. The City Attorney read from 170.16 FS and said there is no legal basis for reopening the assessment, noting Oyster Bay had their opportunity to question the assessed amount Max Abrams, oyster Bay, addressed City Council requesting relief for the error in calculation. In response to Mr. Paul, Mr. Abrams said he had not questioned the assessment at the hearings because he assumed the assessment had been done fairly and equitably. TAPE I1 - SIDE II (9:32 p.m.) Mrs. Cartwright recommended Oyster Bay be relieved and the proper reapportionment hearing be conducted. In response to Mr. Paul, Mayor Barnes and Mrs. Sullivan said they'd been informed by Commission on Ethics that they could vote on the matter. The City Attorney said these letters were public record and could be obtained by anyone. Both said they would provide copies of their letters to the City Manager. Discussion followed on use of discretionary sales tax funds. Carolyn Corum, 881 Dolores Street, Sebastian, said oyster Bay had their chance to be heard during the advertised hearings. RE: Legislative Alert HB 3291- "Telecommunications Right of Way Act" Dear Mr. Frame: The purpose of this letter is to alert you to a bill recently filed in the Florida Legislature that has potentially sweeping ramifications with local government's authority over its public dghts of way and the telecommunications providers who may wish to utilize it. The proposed bill, which is an amendment of Chapter 337, F.S. provides, in pertinent part, as follows: 1. Telecommunications providers operating under the authority of the FCC or the FPSC require no additional authority from a local government to operate within its boundaries; 2. Telecommunications providers who have either obtained permission to operate or are currently operating within a local government's dght of way pdor to the effective date of the bill are grandfathered in and require no authorization from such local governments to operate in their dghts of way in the future; 3. Compensation to a local government for the use of its dghts of way is limited to the cost of managing the dght of way as narrowly defined within the proposed bill; and 4. All other taxes, fees and charges for the privilege of using the public right of way, other than an occupational license or dght of way permit, are specifically precluded. This Bill, as currently drafted, effectively eliminates a local govemment's ability to control who utilizes their local rights of way and to set terms and conditions of such use such as the length of time a telecommunications provider may occupy such space. It also, significantly limits the type and amount of compensation a local government can charge for the use of this limited resource. In light of the potential impact of this proposed legislation on both existing agreements as well as any future agreements local governments may wish to enter into with telecommunication providers, it is strongly recommended that your jurisdiction express its opposition to the bill the legislators who will be considering its passage. Resolution No. R-98-06, stating the City Council's opposition is presented for adoption. RECOMMENDED ACTION Adopt Resolution No. R-95-06. RESOLUTION NO. R-98-6 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, TO THE LEGISLATURE OF THE STATE OF FLORIDA iN OPPOSITION TO HOUSE BILL 3291 RELATING TO PUBLIC RIGHTS OF WAY AND THE TELECOMMUNICATIONS INDUSTRY; PROVIDING FOR AN EFFECTIVE DATE WItE~S, there is presently Amendment #1 to House Bill 3291 before the Utilities and Communications Subcommittee of the Florida House of Representatives and other legislative committees; and WHEREAS, House Bill 3291 would prohibit local governments fi-om requiring any compensation other than for management costs for use of their rights of way by telecommunication providers; and WItEREAS, the acquisition, development, and maintenance of public rights of way is an extremely expensive function of local governments which contributes to the feasibility of the telecommunications industry; and WHEREAS, this industry, as a profit-making enterprise, should contribute to the cost of public right of way as a cost of business. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, CITY OF SEBASTIAN, INDiAN RIVER COUNTY, FLORIDA, that: This Bill, as currently drafted, effectively eliminates a local government's ability to control who utili~es their local fights of way and to set terms and conditions of such use such as the length of time a telecommunications provider may occupy such space. It also significantly limits the type and amount of compensation a local government can charge for the use of this limited resource. In light of the potential impact of this proposed legislation on both existing agreements as well as any future agreements local governments may wish to enter into with telecommunication providers, the City Council strongly opposes the passage of House Bill 3291, as amended. The City Clerk of the City of Sebastian is directed to provide a copy of this resolution to the Local Legislative Delegation and to the committees to which this House Bill has been assigned. The units are totally portable, computer controlled devices and are designed to diagnose whether or not a victim needs an electrical shock to bring their heart out of ventricular fibrilla ration, a quivering motion that stops the heart's pumping action and stops the flow of blood, often resulting in severe brain damage and death. Many police and fire departments, including Vero Beach P.D. locally, are now equipping their units with these devices. Numerous heart attack victims have been saved as a direct result of the use of AED's. Police officers are otien the first on the scene ora heart attack incident and EMS, due to their few and far between deployment, can oilen take long minutes to arrive. Having AED's would allow officers to begin immediate and potentially life saving treatment on the victim. AED's cost about $3,500. each. It would be great if our department could acquire 3 or 4 of them so that each car on duty could have one on board. We frequently get questions from our local service clubs, businesses and individuals about the needs of the department. It would make a good project for service clubs, businesses and others to provide the City with AED's. According to our insurance carrier, the Florida League of Cities, use of these units causes no increased liability exposure and does not increase our insurance costs. (8) The conditional use permit shall limit the hours of operation of the stationary mulching machine to the hours of 7:00 a.m. to 5:00 p.m. on weekdays. Operations on Saturday and/or operations other than between the hours of 7:00 a.m. and 5:00 p.m. may be permitted by the Planning and Zoning Commission upon a finding that the mulching operation does not constitute a,nuisance or hazard to the adjacent neighborhoods, (9) A mulch stockpile plan shall be submitted with the site plan. The mulch stockpile plan shall be approved by the Indian River County Fire Department prior to the issuance of the conditional use permit. Mulch shall not be stockpiled within 100 feet of the properud line. Definitions of Terms. Stationary mulching_machine. A machine which can be transported to a site and erected for the purpose of chopping, vegetative material into mulch. Typically. such a machine is fed vegetation into the chipper via a hopl~er on the top of the machine by a front end loader. The vegetation is chopped by disc cutters and the mulch is expelled via a discharge chute. This definition does not include a chipping machine, with drum or disc cutters, which i~s typically pulled behind a track, or moved by hand and the vegetation is fed by hand. Section 4. CODIFICATION. It is the intention of the City Council of the City of Sebastian, Florida, that the provisions of this Ordinance shall become and be made part of the Land Development Code of the City of Sebastian, Florida, and that the sections of this Ordinance may be renumbered, relettered, and the word "ordinance" may be changed to "Section", "Article", or other such word or phrase in order to accomplish such intention. Section 5. SEVERABILITY. The result of the review conducted over the last several months indicated that changes in some of the warning signs were required, but, there was no justification for further measures for traffic calming required, such as speed humps, due to the low speeds observed (35 mph). The attached report describes the study items and the actions taken to correct the deficiencies that were encountered. No further action is indicated by the traffic studies, therefore any changes in traffic patterns and regulations imposed by the Council would be done so as a matter of policy. RECOMMENDED ACTION The staff recommend that no action be taken. December 1997 Depart~nent of Public Works GEORGE STREET TRAFFIC SAFETY AND SPEED STUDY EXECUTIVE SUMMARY Speed studies collected on George Street have revealed that the 85~h percentile (the speed upon which the speed limit is generally based) between Wave and Dyke (900 block) is 35 miles per hour. The posted speed limit is 30 miles per hour. Absent of any supporting accident data, speeds that warrant intervention are those that approach 20 miles per hour over the posted limit. Attention to safety improvements have resulted in better placement of warning signs and curve delineation. Other actions affecting human factors have taken place including enforcement and posting a radar speed indication sign board. Based upon the findings, no other action (other than continued monitoring and' enforcement) is warranted at this time. Traffic calming or traffic impedence devices are not recommended due to lack of data to support such action. However, there is no engineering reason to deny measures to change the traffic patterns if made as a matter of policy. Two possible options of traffic calming measures are included in the report. I '1 i I I I I I I I I I I i i I I I I I I' I I I i I i I i I I I I I I i I I GEORGE STREET TRAFFIC SAFETY AND SPEED STUDY BACKGROUND The City Council requested the Department of Public Works to perform a traffic safety study for George St. in the area between George St. and Dyke St. There was concern regarding the volume and speed of traffic. In particular, there was some concern from residents entering/exiting the road from their driveways located on the inside of the curve between these two roads. DATA COLLECTED On October 21, 1997 a study was conducted on George St. in the 900 block. The traffic volume was 1,635 vehicles (772 northbound and 863 southbound). The 85'h percentile speed; that is, the speed upon which the speed limit is generally based, was 35.0 miles per hour (34.5 mph northbound and 35.5 mph southbound). The average speed was 30 miles per hour. There were no reported accidents on George Street that are related to speed, backing, or right angle. Speed enforcement has been continuing on an on-going basis. A review of the tickets issued indicate that there is traffic traveling on George Street which is originating from outside the immediate neighborhood. Travelers are from Schumann Drive area and some are from west of Barber Street. The number of tickets issued is not great, which supports the results of the speed study. ACTIONS TAKEN From a traffic engineering standpoint, the data collected did not substantiate concerns over the traffic volume or speed, the area was reviewed for the appropriateness GEORGE STREET TRAFFIC SAFETY AND SPEED STUDY - cont'd of traffic control signs and markings. The following areas were reviewed and minor changes and/or corrections were made as required: · The existing curve warning signs were too far away from the curve. They were relocated in September to a more appropriate location. · The safe travel speed through the curve was reviewed. It is a broad-sweeping curve with a long turning radius, therefore, installing advisory speed warning signs are not indicated. It did not seem to be a problem for vehicles to negotiate the curve. There were no "run-offthe road" accidents. Though it was not indicated, delineators were installed on the outside of the curve to provide added assistance to drivers traveling through the curve. ° The traffic data collected provided the peak times during the day in which speed violations were occurring. This information was supplied to the Police Department so that enforcement during those time periods could be performed. Enforcement has been continuing on an on-going basis. · For informational purposes to travelers on George Street, a Speed Informational Indication Board was posted intermittently for approximately two weeks. This allowed drivers the opportunity to see their routine travel speeds as compared to the posted speed. · Additional traffic speed data was collected which supports the original data. I '1 I I I I I I I i I I I I I I I I I I I' I i I I i I I GEORGE STREET TRAFFIC SAFETY AND SPEED STUDY - cont'd TRAFFIC CONTROL OPTIONS Some altematives to the traditional traffic control signage and markings are available to the City may be imposed as a matter of policy. Some of those alternatives include: Rumble strips Speed humps Traffic circles Road narrowing Uneven pavement (cobblestone) Creating U-street (blocking the street) George Street does not meet the criteria for establishing a number of these traffic calming measures. Rumble strips are not advisable as they do not slow down travelers and cause a great deal of noise which is inappropriate for a neighborhood. Speed humps would not be recommended because they cannot be placed in a curve or near intersections and only can be used where speeds are greater than 20 mph over the posted speed limit. Speed humps have been used in a number of neighborhoods in Florida such as Tampa, Boca Raton, Palm Beach County and Seminole County. Due to complaints about the speed humps, officials are finding that they are having to remove the speed humps they installed. Seminole County has placed their program on hold due to the complaints they have received about the use o£ speed humps. 3 GEORGE STREET TRAFFIC SAFETY AND SPEED STUDY - cont'd If the City policy makers are intent upon instituting measures to stop or drastically change traffic on George Street, regardless of the engineering data, two options (of many possible) are attached to this report. The options are titled: "George St. Traffic Calming Option 1" and "Option 2". Option 1 redirects a portion of the traffic to a neighboring street (Carnation). Option 2 eliminates a portion of the traffic and redirects it to another route. There are no right answers to this situation. There are actions that can be very wrong. Both options presented can meet traffic control standards with proper marking and signage. Whatever route taken, it is important that it must follow cOdes and standards for traffic control. It is unfortunate that neither option will satisfy all of the concerns that have an interest in this issue. The traffic engineering review concludes there is no problem with traffic safety, speed, or volumes on George St. Therefore, additional action is not warranted. Many of these trees have been donated as memorials, some have been donated out of friendship, and many have been purchased by the club. Ail donations have markers specifying by whom, to whom and the kind of tree. I have put the letter N by the native plants on my list. We appreciate the cooperation of the Parks Department and especially Chris McCarthy working with us so diligently. The paths look great with the city's mulch. Mr. Mike Rhodes of The Landscape Stop donated the cypress mulch for the trees and beds and has been most supportive of our project. Very soon we will be self sufficient as far as watering is concerned, for we have installed a pump that will syphon water from the pond, thus doing away with the need to leave the city water truck in the park on weekends. Massarelli, Community Development Director Land Development Permit Fees With the completion of the procedural changes to the Land Development Code and the Department's Development Order Procedures Manual, i have completed a review of the Land Development Permit Fees Schedule. The Department's fees were last adjusted in 1987. Based on my evaluation, the Fee Schedule should be revised. Attached is a detailed description of the fee schedule evaluation. As noted in the evaluation, the proposed fee schedule is based on the costs of the Community Development Department. The costs of the City Engineer, Police Chief, and City Clerk are not included. This information is required to recover the true cost of processing permits. However, if these costs were included at this time, there may be a sedous case of sticker shock. To include those other departmental costs, a cost allocation study similar to the one completed by this Department should be completed. Two fees included in the evaluation are not included in the proposed resolution. The first is for occupational licenses. (The cost of processing the fee is $60.00.) The current permit fee averages $60.00. Without an adjustment, the true Post of processing the permits will not be captured. An evaluation of the cost of processing for the City Clerk's Office would be required before the fee is adjusted. In addition, that fee is set by ordinance (sec. 30-15, Code of Ordinances(COO)). The second is the fee for a special event temporary use permit. That fee is set by ordinance (sec. 20A-Ilo.4.13., LDC), and that provision should be reworded to have the fee set by resolution. That will be completed dudng the current LDC revisions. There are additional fees which require further review. The first is alarm fees. This is set by ordinance (sec. 39-36 (b) COO). it is recommended that the alarm ordinance be reviewed and setting the fees by resolution be included in any revisions. The second is garage sales. This fee is set by ordinance (sec. 82-53, CO0). The City Clerk's cost needs to be evaluated to determine if the current fee ($2.00) is valid. The third fee relates to street openings. The costs of the Public Works Department needs to be evaluated to determine the proper fee on such a permit. The final permit fee which is not included in this proposal are the building permit fees. These fees are set by ordinance (sec. 26-35, CO0) and should be completely reviewed. I am currently working with Mr. Bonacci on this. When the code is revised, a provision that the fees will be set by resolution should be included. Attached is a copy of proposed Resolution R-98-02 which implements the proposed fee revisions. If the attached information is acceptable, i suggest that a workshop be held with the City Council on the proposed revisions. I '1 I I I i i I I I I I I I I I I I i I I' I I i I I I I I I LAND DEVELOPMENT CODE FEES REVIEW The Community Development Department has recently completed an in-depth review of the Department's fees for permit applications. The Department's fees were last revisited in 1987 and 1988. Based on this review, the staff is recommending that most of the fees be adjusted. The following is a outline of the steps used to evaluate the fee structure. The first item which needed to be addressed was the Land Development Code The procedures in the Code had no relationship to how permits were actually being processed in the City. The staff and City Council has spent the last year correcting the Code. The last major revisions were completed this summer. The next step was to develop Departmental procedures to implement the Land Development Code. A Development Order Procedures Manual has now been completed. This manual outlines each step in the permit approval process. Concurrent with the above activities, the staff of the Community ~D~velopment Department, completed a cost allocation study. Each staff member identified the percent of time spent in each of twelve program areas. These were: go ho General Administration Building Permits Inspections Code Enforcement and Code Enforcement Board Contractor Licensing and Contractor Licensing Board Comprehensive Planning and Local Planning Agency Land Development Code (including rezoning, site plans, plats, special use permits) and the Planning and Zoning Commission Riverfront Committee CDBG and Citizen Advisory Task Force Tree Advisory Committee Variances, appeals and Board of Adjustment Intergovernmental Coordination The cost allocation study determined the overhead associated with each program area. study are included in Attachment A. Department's direct costs and The results of the cost allocation Next, staff requirements and estimated man-hours were assigned to each step of the approval process identified in the Development Order Procedures Manual (step 2). This is provided in Attachment B. The houdy rate for labor cost for each position was determined from the cost allocation study and a labor cost was estimated for each application process. Estimated legal ad expenses, signs, and mailing costs were also estimated. (Attachment B) For each of the permits identified in the Development Order Procedures Manual, an estimation was made as to how many permits are issued in a single year. The total number of permits was then divided into the overhead costs determined in the Cost Allocation Study (Step 3). The estimated overhead cost per permit was $9.61. An overhead cost of $10.00 per permit was used in the fee review. This information is shown on Attachment C. The total cost for each permit (labor, direct, and indirect) was then determined. (Attachment B). Based on the total cost of each permit, a recommended fee was developed. (Attachment D) Using the estimated number of permit issued each year, the current rates generate approximately $25,175. The projected revenues from the proposed fee schedule is $76,565. (Attachment C) To assess the validity of this process, the estimated cost for the Land Development Code Program, as determined in the cost allocation study, was compared with the projected revenues from the recommended fees. The cost allocation study identified the estimated cost of the Land Development Code Program to be $75,176 (Land Development Code, Planning and Zoning and Board of Adjustment). The projected revenues from the proposed fee schedule cover the estimated program costs. Attachments A and C. 10. Next, the staff conducted a comparison of the city's current fees and the proposed fee schedule to other local governments in the area, This information is provided in attachment D. The proposed fee schedule is fair because the total cost of the Community Development Department is included - labor, direct expenses, and indirect expenses. The proposed fee schedule covers the estimated cost of p.rocessing Land Development Permits based on the cost allocation study. The proposed fee schedule would provide that the application cover the true cost of a permit, not a cost subsidized by the general budget and the public. The proposed fee structure does not include the cost (labor, direct expenses, and indirect expenses) of the other departments (City Engineer, Police Chief or City Clerk) involved in the development review process. In order to accurately include those costs, a detailed cost allocation study would be required in each of those Departments. The fee schedule also does not include general city overhead cost - City Administration (City Manager, Finance, Human Resources, Purchasing) and the physical buildings (maintenance, electricity, water, etc.). Since that time, the Citizens Advisory Task Force (CATF) has reviewed the grant's budget and has developed a recommendation for the expenditure of the grant. The cost of the parking at the Cav-Corp property is sigmificantly lower than the original budget. In order to keep the gram, the grant money must be spent on projects that will maintain the same ranking. In May 1991, the City had a proposed site plan for parking improvements for the east side of Indian River Drive, east of the Cav-Corp property. This included a paved driveway and 10 parking spaces. The drainage facilities associated with the proposal were constructed. The concept of that plan was discussed with DCA to determine eligibility for funding by the gram. DCA has indicated that it would be eligible. Based on that positive response, the CATF developed a revised site plan that included shifting Indian River Drive to the west. This would act as a traffic calming technique to help slow traffic in the area. It would also give additional room on the east side to allow for perpendicular parking. The proposal would eliminate the backing om of traffic omo Indian River Drive, improving the safety in the area. The parking would be paved to eliminate the standing water problems. Handicapped parking would be provided to allow handicapped access to the observation pier and the FDOT sidewalk. The swale west of Indian River Drive would be piped, and the 'collapsing culvert at Coolidge St. would be fixed. The CATF has recommended approval of the revised site plan to include the improvements to Indian River Drive and the parking to the east. The revised site plan has been submitted to and approved by the Planning and Zoning Commission. Attached is the revised site plan. As we mentioned in a previous City Commission meeting, we intend to request that the City apply for a CDBG Economic Development grant, which will be loaned to CRA Care Centers for elig~ole project expenses. We do not have certain components of the plan ready to provide details to the City, so we are not requesting project approval at this time. However, we request that a grant writer be appointed in January 1998 for this project only, in order to allow the City's CDBG application to receive 10 points for having a representative at the February 3-4 application workshop in Tallahassee. The CDBG application process awards 10 points to applicants who attend the annual CDBG application workshop for the fiscal year of the application. That workshop is tentatively scheduled for February 3-4, 1998. The local government representative may be either a) a citizen appointed by the local government to be the representative, b) a local government employee or elected official, or e) the consultant who prepares the application if the consultant selection was done by the local government before the workshop (even though the actual contract for services may not have been executed prior to the workshop). This consultant option can include a consultant who works fi-ce of charge, with no advertised procurement required. CRA Care Centers, Inc. is putting this ALF project together using the services of Roumelis Planning and Development Services, Inc. (RPDS). The estimate of cost by Public Works set the mount at $5,075. That amount exceeds any amount that could be considered on an administrative level. Additionally, such improvement was not anticipated to be picked up by the City at the time the lease was negotiated. Council may recall that when the City constructed Airport Drive West, every tenant got one drive way paved. While I understand Skydive's desire to have the driveway improvement picked up by the airport, I am o/('the opinion that t]ll~should have been a term of the lease agreement. RECOMMENDED ACTION Since this was not an improvement the airport negotiated to provide to Skydive, move to deny the request. The intent is for the dance to be jointly sponsored by both the County and the City of Sebastian. If approved, Fellsmere Road between Riverview Park and the Cay Corp property would be closed to vehicular traffic. The teens would be permitted to participate upon presentation of their student I.D. card and the payment of a $3.00 cover charge. Entertainment would consist of bands, disc jockeys and games.
