MINUTES OF REGULAR MEETING OF DECEMBER 18, 1997
Mr. Massarelli noted a change in landscaping materials from live oaks to crepe myrtles and
Savannah hollies. He then proceeded with staff presentation and recommended approval with
conditions in the staff report.
MOTION by Vesia/Driver
Roll call:
I make a motion that we recommend approval for the preliminary development plan for
Harbor Federal Bank to City Council, tract 2 of Sebastian Lakes Shopping Center,
Fellsmere and Laconia and include the four staff recommendations.

H. Site Plan Review - Angler's Inn, Phase I (Stevenson House) - 805 Indian River
Drive - Joseph Graham
Mr. Joseph Graham, 805 Indian River Drive, was present and gave a short presentation. He noted
that Phase I is completed.
PLANNING AND ZONING COMMISSION
MINUTES OF REGULAR MEETING OF DECEMBER 18, 1997
Ms. Vesia mentioned a possible lighting problem if it was planned for the boat to be out after dark.
Chmn. Fischer noted that if the site plan drawing is cleaned up, he would call a special meeting to
review it. The Commission members tried to convey the issues that should be made clear on this
drawing. Issues such as parking spaces, radiuses, and other measurements were recommended
Mr. Massarelli reminded the Commission of the noticing requirements and would have to chec!,r
with the City Attorney on calling a special meeting. He felt that if this issue is put offto
meeting, it will have to be re-noticed which is a 15 day noticing requirement. He also informed the
applicant that the Code requires that a building permit is issued ten days after the site plan is
approved.
Mr. Taylor accused the Commission and staff of holding him to a standard that is ridiculous
Mr. Massarelli, for the record, noted that Mr. Taylor was not being treated any differently than
anyone else. In fact, he noted that there is another parking lot on the agenda tonight and the
applicant is the City. He noted that the City must submit site plans also.
MOTION by Driver/Pliska
I make a motion to postpone this particular issue until we get the drawing that cleans up
the situation as far as the dimensions and location of landscaping, and things like this, curb
cuts, and then call a special meeting, if allowed by the City Attorney, to approve this
matter as soon as possible.
Discussion:
Ms. Kilkelly referred to her previous motion and noted omitting two changes. She wants to make
sure that it is heard now; changing 18 months to 12 months after lifting of the development
moratorium, and the boat dock is limited to boats that shall not exceed the parking available.
Mr. Driver agreed.

Neither the applicant nor a representative were present. The Commission members discussed
several issues of this site plan review. It was noted that an ATM was not noted on this plan.

SUMMARY
William, Gloria, and Joseph Schulke have applied for approval of a preliminary plat known as the
Barber Street Trade Center. The subject property is located north of Barber Street and west of
the Florida East Coast Railroad. The property is zoned industrial.
The plat divides the property imo four parcels. The parcels will have access over a private road
through an access easement. The project will be served by water and sewer.
The Planning and Zoning Commission has recommended approval with conditions.
RECOMMENDED ACTION
Hold a public hearing and act on resolution R-98-3.

WHEREAS, William, Gloria, and Joseph Schulke have applied for approval of a
preliminary plat for a subdivision known as the Barber Street Trade Center; and
WHEREAS, the Planning and Zoning Commission of the City of Sebastian has
reviewed and recommends approval of the proposed preliminary plat,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, that:
Section 1. PRELIMINARY PLAT APPROVAL. The preliminary plat of
the Barber Street Trade Center, as prepared by Joseph W. Schulke dated October 23,
1997, Sheets 1, 2, 3, 4, and 5, is hereby approved. This is with a fifty foot wide access
easement as recommended by the Planning and Zoning Commission

Project Description
Narrative of proposed action: The subject property lies East and
adjacent to the Flodda East Coast Railroad, North and adjacent to
Barber Street and West and adjacent to Park Place Mobile Home Park.
The property was previously the site of a pdvate wastewater treatment
plant which ceased operations in the late 1980% The applicant has
submitted preliminary plat plans to subdivide said parcel of land int° 4
lots. The subdivided parcels are for the development of a commercial
and industrial complex to be called Barber Street Trade Center. Total
size of the project is 4.47 acres of which 20% or .894 acres must remain

Other Matters:
Analysis: The subject property lies East and adjacent to the Flodda East
Coast Railroad, North and adjacent to Barber Street and West and adjacent to
Park Place Mobile Home Park. The property was previously the site of a pdvate
wastewater treatment plant which ceased operations in the late 1980's. The
applicant has submitted preliminary plat plans to subdivide said parcel of land
into 4 lots. The subdivided parcels are for the development of a commercial
and industrial complex to be called Barber Street Trade Center. Total size of
the project is 4.47 acres of which 20% or .894 acres must remain as open
space, and max_[r~um building coverage of 50% or 2.235 acres. Buildings to be
built on the~ide of the property must maintain a 30 foot setback from the
residential areas to the East.
Conclusion: The proposed preliminary plat is consistent with the Land
Development Code, Comprehensive Plan and Code of Ordinances.
Recommendation: The staff recommends the Planning and Zoning
Commission adopt this staff report and recommend to City Council approval of
the Preliminary Plat for the proposed Barber Street Trade Center.

noted that these are not required, but they could be included for safety.

Mr. Schutke noted that this project will have curb and gutter, and swales would not be needed.
Staff suggested an easement in accordance with a minor collector street which would be sixty (60)
feet, fifty (50) foot access and five (5) feet on each side for utilities and drainage.
Ms. Kilkelly mentioned ingress and egress and there was discussion on this and referred to page
1100 of the Code.
Chrrm. Fischer opened and closed the public hearing at 7:50 P.M. and there was no pu,,blic input. ,

Zoning report, I recommend to City Council.

improve it, but this issue will be followed up on and a report brought back to this Commission.
DIRECTOR MATTERS:
Mr. Massarelli referred to the model home permit approved tonight. He noted that model homes
require five (5) parking spaces, two (2) of which could be in the driveway, and t/nee (3) add/lion,al
would be nec~ssa~. He presented a question which included a sales center, with a model home
adjacent next door - would the model home still need five (5) parking spaces, or is it more like an
accessory use to the sales office.
The consensus of the members was that at least five (5) spaces should be provided.

Conclusion: The proposed Harbor Federal Bank site plan is consistent
with the Land Development Code, Comprehensive Plan and the Code of

Recommendation: Staff recommends the Planning .and Zoning
Commission adopt this staff report and recommend approval to the City
Council for the Harbor Federal Bank on Outparcel Tract 2 of Sebastian
Lakes Shopping Center with the following conditions:
Extension of existing 6' high fence and 3' high wax myrtle's up to
the 30' x 30' sight triangle at the intersection of Laconia and C.R.
512, as noted on sheet 4 of 4 of the Harbor Federal Site Plan by

Clarification conceming the dedication and maintenance of the 20'
landscape easement, as noted on sheet 2 of 4 of the Harbor

SUMMARY
Lennar NE Partners Limited Partnership has applied for a modification to the conceptual
developmem plan for the Sebastian Lakes PUD. This modification reduces the number of
residential units from 264 condominium units to 64 condominiums and 98 detached single family
houses.
The single family lots will be approximately 60' by 125'. The parcels will have access over a
private road through an access easement. The applicant has agreed to construct a sidewalk
internal to the projects as well as along Roseland Road, Laconia Street, and Granduer Avenue.
The applicant will provide extensive landscaping and buffeting. The project will be served by
water and sewer.
The Planning and Zoning Commission has recommended approval with conditions.

COUNTY, FLORIDA, APPROVING AN AMENDMENT TO THE
CONCEPTUAL DEVELOPMENT PLAN FOR THE SEBASTIAN
LAKES PUD; PROVIDING FOR REPEAL OF RESOLUTIONS OR
PARTS OF RESOLUTIONS IN CONFLICT HEREWITH; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Lennar NE Partners Limited Partnership has applied for approval of
an amendment to the conceptual development plan for the Sebastian Lakes PUD, and
WHEREAS, the City Council of the City of Sebastian approved the conceptual
development plan for Sebastian Lakes on June 11, 1984 and December 7, 1988, and
WHEREAS, The City Council has entered into a developers agreement relating to
Sebastian Lakes dated February 9, 1994, and
WHEREAS, the Planning and Zoning Commission has recommended approval of
the amendment to the conceptual development plan for the Sebastian Lakes PUD
NOW, THEREFORE, BE iT RESOLVED BY THE CITY COUNCIL OF THE

All temporary utility easements shall be vacated prior to approval of the
final development plan.
Tracts A1 and B 1 shall be landscaped to provide a type A vegetative buffer
between the residential and commercial land uses. A type A buffer shall be
completely opaque from the ground up to a height of at least six (6) feet,
with large trees utilized as intermittent visual obstructions from the opaque
portion to a mature height of at least twenty (20) feet.

Narrative of proposed action: Approval of Conceptual
Development Plan for the Sebastian Lakes PUD-R Subdivision.
The proposed conceptual development plan is a modification of the
Sebastian Lakes PUD-R conceptual development plan which was
originally approved on 12-4-85. The submitted plan is also a
revision of the June 16, 1997 plan which was denied by the
Planning and Zoning Commission.
Sixty-four (64) condominiums were constructed during the initial
development phase. The proposed conceptual development plan
comprises a mixed use development consisting of 6.456 acres of
commercial land on two parcels and 44.57 acres of residential
subdivided into 98 lots comprising a reduction from the previous
proposal for 141 lots. The proposed and existing constitutes a
density of 2.87 Units/Acre. The site also contains a county library
which was approved for development on 4-26-89.

previously approved with the odginal PUD plan, and-is
existing. The library tract access is also existing. The
developer proposes an additional access off of CR 512 for
the 2.0 acre commercial tract, and an additional CR 512
access, Two (2) accesses along Roseland Road, are being
constructed for the 4.4 acre commercial parcel.
The developer has contacted Indian River County and
obtained approval of the driveway connection accesses for
the Waigreens and First National Bank locations..Final
approval for the remaining access off CR-512 will be based
on proposed use and location, projected traffic counts,
internal traffic flow, etc.

The developer also proposes to provide an emergency
access location off of Laconia Street. This access will
consist of a stabilized marl drive with breakaway or otherwise
accessible gate - for emergency access purposes. Staff
needs confirmation on the future use of this emergency
access. Applicant shall also provide a temporary emergency
access to Grandure Avenue during construction of Phase I.

planning objectives for this project include providing varied
and unique housing type~ not currently available in the
Sebastian area marketplace, together with a surrounding
coordinated community development which maximizes the
on-site water features, common areas, and recreation areas
within the project. The associated commercial development
is intended to complement the residential units, and
minimize traffic generation from the project.

Development schedule: provided - anticipated 12-18
month time period for development and csnstruction of each
phase. The three commercial tracts along Roseland Road
have already obtained approval and are currently under
construction.

Environmental impact statement: provided - An
environmental evaluation of the site was c~nducted with the
initial PUD project, and no environmental issues were raised
at that time. The site has been cteared and filled to suitable
elevations, and there are no known wetlands or endangered
species issues associated with the site. It is noted that a St.
Johns River Water Management District (S. J. R.W.M.D.)
MSSW permit has been issued for this site, thereby verifying
that there are no adverse wetlands impacts associated with
the project.

Public facilities impact statement: provided - There
will be no negative impacts to existing public facilities,

project, as now proposed, contains significantly less units
than the originally approved P.U.D. project.

Quantity of wastewater generated; The quantity of
additional wastewater generated is estimated to be
24,500 gallons per day (GPD); based on an average
flow of 250 GPD per unit. This is supposing an
average of 2.5 persons per household.
(b)
Description of proposed recreational facilities;
provided -The proposed recreational facilities within
the project include the existing clubhouse and pool
area, an existing, tennis court, and a large lake
system. The pool' and deck area are oversized and
the clubhouse contains two (2) stories and
approximately 6,000 SF. All required recreational
facilities are in-place.

The quantity of potable water required is estimated
(similar to sewer) to be 24,500 GPD.

Conclusion: The proposed PUD-R subdivision and corresponding
commercial property is consistent with the Comprehensive Plan, Code of
Ordinances and the Land Development Code.
Recommendation: The staff recommends that the Planning and
Zoning Commission adopt this staff report and recommend to the City
Council approval of the Conceptual Development Plan for the Sebastian
Lakes PUD-R Subdivision with the follqwing conditions:
All temporary utility easements shall be vacated prior to
approval of the final development plan.
Tracts A1 and B1 shall be landscaped to provide a type A
vegetative buffer between the residential and commercial
land uses. A type A buffer shall be completely opaque from
the ground up to a height of at least six (6) feet, with large
trees utilized as intermittent visual obstructions from the
opaque portion to a mature height of at least twenty (20)
feet.

Final Development Plan Approval for phase i shall be
obtained in 18 months, phase II in 36 months, and phase 111
in 54 months. The commercial tracts shall be completed
within 24 months.
Applicant shall provide open space calculations for the
existing and proposed commercial properties prior to
Preliminary Development Plan approval.
The applicant shall provide a lot by lot building envelope
detail and open space calculations prior to Preliminary
Development Plan approval.
Clarification of future use of emergency access to LaConia
Street pdor to Preliminary Development Plan approval for
Phase I!.
The mechanical equipment for the pool on lot # 53 needs to
be addressed prior to Preliminary Development Plan
approval.
Lake dimensions and boundaries shall be provided prior to

Applicant shall provide a buffer between the clubhouse and

A sidewalk easement shall be provided and dedicated.to
Sebastian Lakes Master Homeowner's Association.
St. Johns River Water Management District permit and the

submitted pdor to Preliminary Development Plan approval.
